Under the proposed bailout legislation (according to Henry Paulson, Secretary of the Treasury), the US Treasury or agents thereof could acquire Microsoft for one US dollar, with no legal recourse for Microsoft or even its shareholders.

I have been a long time critic of the federal 2002 Voting System Standards (2002 VSS) and of the 2005 Voluntary Voting System Guidelines (2005 VVSG). In fact, both sets of standards are virtually worthless. There are two reasons for this. First, the requirements enumerated in the standards are, in and of themselves, much too weak for something as vital as administering an election. Second, both sets of standards have an explicit loophole that allows almost all the requirements "” weak as they are "” to be ignored. This second objection was first brought to my attention two years ago by Howard Stanislevic.

We now have proof that this loophole is used by the labs in order to "pass" systems that don't meet the standards. The proof is laid out clearly in the most recent certification test report submitted to the Election Assistance Commission (EAC) by SysTest labs (one of the labs accredited by the EAC and the National Institute of Standards and Technology - NIST). SysTest recommended certification for the new voting system by Premier Election Solutions (formerly Diebold) even though the lab's findings listed 79 specific failures to meet the standards.

As you read this article, keep in mind that the standards actually allow 77 of these 79 failures to be ignored!...

Currently, the public portions of the top to bottom review published by California last week have rightly been the subject of banner headlines. A report from the University of Connecticut, however, which was entitled "Integrity Vulnerabilities in the Diebold TSx Voting Terminal" and released a few days prior with not quite as much fanfare, provides an excellent counter to the oft-repeated vendor talking point that the California testing is similar to "giving keys to a thief."

The University of Connecticut report is immune to this specious argument. The University of Connecticut team had no access to source code or any information which was not publicly available. These limitations are precisely what all three vendors defined as "realistic" in their testimony in California at the public hearing on Monday July, 30, 2007. Yet, under these vendor-approved conditions, the University of Connecticut found yet another set of new, serious, and election altering defects and was able to exploit them in a disturbingly effective manner.

After a two year interruption, I am beginning to go through the copies of November 2, 2004 election records which were provided to me in the settlement of my lawsuit with the City of Milwaukee Election Commission.

People have asked me: "Why do you still pursue this after two years? Get a life. The election is over and John Kerry carried the state with 11,384 ballots."

The high minded reasons are:

1. Because it is the duty of sovereign citizens to watch public officials vigilantly and eternally. This is a design principle of the American government; Citizens watch those in power.
2. Process auditing is the act of verifying written procedures were actually followed as documented. As a software tester process auditing is in my professional "sweet spot." I thought I could do some process audits of the canvassing done by several cities and share the results with others. I considered this my contribution to the body politic if any of my fellow citizens would want to do the same.
3. Election results are important. John Kerry carried Wisconsin by 11,384 ballots out of 3 million cast (2,997,007 to be exact). This is 0.38% of the vote. It is important to know which candidate won such a razor thin election; especially since the State of Wisconsin and the City of Milwaukee in particular were rife with problems.

But, to be brutally honest the answer is it has been primarily spite and anger which has kept me on this like a Jack Russell terrier clamped to the sleeve of a shaking arm. And the results of my initial examination of these records reveal immediately disturbing findings...
