The idiom, "the road to hell is paved with good intentions", comes to mind when considering both the transformation of California's Republican Party and the Golden State's gubernatorial Recall process since first established by voters on Oct. 10, 1911. Both transformations point to the need for California to either significantly reform or eliminate gubernatorial Recalls altogether.

Our state's Recall process was the brainchild of Hiram Johnson, an immensely popular Republican governor who switched to the Progressive Party after taking office. His progressive bona fides were already on display during his Jan. 13, 1911 Inaugural Address when he declared: "The first duty that is mine to perform, is to eliminate every private interest from the government, and to make the public service of the State responsive solely to the people."

Later that year, in a letter to former President Theodore Roosevelt, Johnson expressed his dismay over then Republican President William Howard Taft's lack of humanity and Taft's belief that government exists only to benefit big business. Johnson expressed admiration for the Progressive Party candidate, Wisconsin Senator Robert M. La Follette, but sought to persuade TR to run against Taft because Johnson believed La Follette would lose. (In 1912, the Progressive Party nominated TR as its Presidential candidate and Johnson as its VP candidate).

As envisioned by Johnson, California's Recall procedures would serve as a form of bottom-up direct democracy that would act as a check against the corrupt influence of corporate wealth and power then being exerted in the Golden State by the Southern Pacific Railroad.

California's gubernatorial Recall, however, has failed to live up to Governor Johnson's lofty expectations. "Since 1911," according to Ballotpedia, "there have been 55 attempts to recall a sitting California governor. The only successful campaign was in 2003 when voters recalled then-Gov. Gray Davis". The Davis Recall was a purely partisan affair made possible only because the wealthy right-wing Republican Congressman, Darrell Issa, invested $1.7 million of his own money to fund a GOP engineered, professional signature gathering campaign. That was coupled, politically, with a disinformation campaign regarding power outages in the Golden State that had been engineered by the infamous, corrupt and now defunct Texas-based energy company, Enron.

This year's gubernatorial Recall against California's Democratic Governor Gavin Newsom is being wielded as an anti-democracy cudgel by an increasingly authoritarian Republican Party --- a Party which morphed into an instrument of the very corporate wealth and power Gov. Johnson hoped the Recall would serve to defeat. The Newsom Recall was initiated because the unpopular CA GOP realizes its only prospect for winning a statewide election at this time lies in what it hopes is a low-turnout election; albeit, a special election that will cost California taxpayers an estimated $400 million.

Last week, California's Lt. Gov. Eleni Kounalakis, a Democrat, set the date for the Newsom Recall Election for Sept. 14, 2021. Per a recently released UC Berkeley poll and a May 25 Public Policy Institute poll, it appears likely that a significant majority will cast a "No" vote. Nonetheless, given the abuse of the process by state Republicans, CA Democrats, who hold a super-majority in the State legislature, would do well to place a proposition on the November 2022 general election ballot to reform or even eliminate the gubernatorial Recall process altogether...

On today's BradCast, Brad and Desi are off breathing deeply. I’m sitting in – Angie Coiro, host of the syndicated In Deep with Angie Coiro.

First up, I spend time with ZIVA BRANSTETTER, Senior Editor with Reveal. She and the Reveal investigative team broke a number of key stories involving the child detainees this week: the drugging of the kids, violence, sexual misconduct, and petty theft at the camps and facilities; who’s making money off the detentions; and what agencies are charged with cleaning up the mess. And yes, she confirms: this has been going on for a good many years. The blatant wholesale grabbing of toddlers from parents is an ugly Trump twist, but Barack Obama has a lot to answer for, too.

Then onto the latest SCOTUS decision. The 5-4 verdict supports privacy protections from government trying to follow personal movements through cell site data. CYRUS FARIVAR of Ars Technica and author of the new book Habeas Data breaks the decision down – including its historic footing, and its peculiarly arbitrary “six day” rule.

Advertising brings up its own privacy issues. Long-time media critic KEN AULETTA has a new book, Frenemies. He probes here into exactly how tense the battle has become between advertisers, their agencies, and individual consumers trying to keep bits of their lives to themselves.

Finally: exactly how crazy the battle for Silicon Valley primacy and the consumer dollar can get: JOHN CARREYROU talks about the Theranos scandal. If you think you’re already cynical enough about what companies will risk to get your dollar – well, maybe you’re wrong. Guest: Ari Berman of Mother Jones; Also: Trump's legal woes worsen...

Lots of breaking news on today's BradCast, and a look at the real reasons the Trump Administration has now added a new question on citizenship to the 2020 U.S. Census. But, don't worry. It all ends with a song! [Audio link to today's show follows below.]

First up: the never-ending Executive Branch shakeup continues as Trump fires embattled Veterans Affairs Secretary David Shulkin and announces his intention to replace him with White House physician Ronny Jackson.

Then, Trump's never-ending legal woes continue to quickly mount and worsen on several fronts beyond the Special Counsel probe (where he is still having trouble finding attorneys willing to represent him, after his latest lead attorney quit last week.) Porn star Stormy Daniel's has now added a defamation charge against Trump business partner and lawyer Michael Cohen, to her civil suit against the President, and is now seeking to depose both Cohen and the President under oath.

That, on the same day a federal judge in D.C. allowed a case filed by Maryland and the District of Columbia against Trump to move forward based on claims that the President's continued ownership of the Trump International Hotel in D.C. violates the Emoluments Clause of the U.S. Constitution, barring gifts from states and foreign nations.

Up in Wisconsin, in the meantime, the GOP received its second rebuke from a state court in less than a week, for attempting to avoid calling Special Elections for two vacant seats in the state Senate. Gov. Scott Walker was ordered a second time by the court on Tuesday to call those elections immediately. Republicans in the state legislature, however, were hoping to convene a special session in order to change the law which Walker was found to have violated, as they try to avoid calling the elections in two GOP districts they fear they may lose to Democrats. (An appeals court, later on Wednesday, has now also rejected a motion to overturn the initial ruling.)

Then, we're joined by Mother Jones' Senior Reporter ARI BERMAN to discuss the GOP's war on judges who find against them, and the Commerce Dept. Secretary Wilbur Ross' approval this week of a new, last-minute, untested question on citizenship, to be added, by request of the Dept. of Justice, to the 2020 U.S. Census.

Critics, including the last five directors of the U.S. Census Bureau among others, charge the question will unlawfully depress responses to the Constitutionally-mandated decennial survey of all U.S. residents (whether they are citizens or not), as Berman reports in his new feature article for MoJo.

The DoJ, Commerce and White House all falsely claim that the new question is "necessary for the Department of Justice to protect voters [and] comply with the Voting Rights Act". Berman, author of the recently published Give us the Ballot, the landmark book on the history of the VRA and the long struggle for voting rights in the U.S., scoffs at those claims and details what he sees as the real reasons for the change, and the decade-long effect on the nation that it will have if it is not blocked by the courts. California has already sued to block the question from being included, and more than a dozen other states and advocacy groups are expected to file complaints as well.

On the GOP's war on courts following adverse rulings against them in Wisconsin, Pennsylvania and North Carolina, Berman says: "There's a very disturbing trend going on. When Republicans don't like court rulings that constrain their power, they try to nullify those rulings...What I think is so noteworthy about this is that everyone always says how much of an outlier Donald Trump is within the Republican Party. But if you just look at what Republicans are doing, in Wisconsin or North Carolina or Pennsylvania, they're following the Trump playbook, which is if you don't like a law, just ignore it."

On the Census controversy, he tells me: "We are seeing the rigging and corruption of one of the most important, mandated tasks in our Constitution...If you decide to rig the Census, then you've essentially rigged everything that follows" for the next decade. He adds: "The bigger picture here is that a failed Census is going to hurt everybody."

We've reported for years about the ease with which foreign entities could hack a computerized US election with little possibility of being discovered. Well, guess what classic book was reportedly found on 'Bin Laden's Bookshelf'? We discuss on today's BradCast!

Then, my guest is the imprisoned Gov. Don Siegelman (D-AL)'s son Joseph Siegelman (pictured above with his father and sister Dana just before his father was sent back to federal prison in 2012 to serve out his 6.5 year sentence on "bribery" charges), on the latest disturbing ruling by the 11th Circuit Court of Appeals concerning his father's appeal for a new trial and/or reduced sentence in his outrageously politicized prosecution by the Bush Administration.

Joseph, now an attorney, explains what the court's decision this week means; where the case goes from here; whether he thinks the Obama Administration will ever right the wrong; and how you can help to restore justice in this matter.

"This is something that shouldn't happen in America," he told me. "If a sitting governor can be unseated and prosecuted and imprisoned for something that he did not do --- and for something that had not even been considered a crime in this country until he was convicted of it --- what chance do anyone one of us have?"

You'll pardon us if we do so just a bit more here, but only because it affords us an opportunity to bash Texas at the same time.

An editorial by the San Antonio News-Express late last week criticized how lawsuit-happy the state of Texas has become over the past decade. Specifically, under their former Republican AG, now Gov.-elect Greg Abbott, the state filed 31 lawsuits against the federal government from 2004 to 2013, claiming the state had little choice, as they'd become a victim, as some sort of "target" of the feds due to their "success." Or something. (Didn't those guys used to be pretend to be against frivolous abuse of the judicial system?)

Anyway, the paper's editorial board noted how the state has filed lawsuits against the federal government of late on everything from Obamacare to immigration to voting laws, etc. And then they noted this [emphasis added]...

I'm prepping to guest host the Ed Schultz Radio Show tomorrow morning (9a-Noon PT, Noon-3p ET), so, for now, I'm gonna leave you with just the request that you go read some of the transcripts and/or videos available at USA Today.

Over the weekend, they published a conversation with three NSA whistleblowers (and one from DoJ) from during the Bush era. They all laud the latest NSA contractor-turned-whistleblower Edward Snowden for coming forward with his leaks, and say that "he succeeded where we failed" in getting the attention of the public as to what, they say, is going on, and the concerns about secret data gathering operations that the public need to be aware of.

"They say the documents leaked by Edward Snowden ... proves their claims of sweeping government surveillance of millions of Americans not suspected of any wrongdoing," as USA Today describes the conversation. "They say those revelations only hint at the programs' reach."

Please go to the page and read some of the transcripts and/or watch the video conversation, which I don't have time to highlight at the moment: "3 NSA veterans speak out on whistle-blower: We told you so".

Here is just the very beginning of the conversation...

Q: Did Edward Snowden do the right thing in going public?

William Binney: We tried to stay for the better part of seven years inside the government trying to get the government to recognize the unconstitutional, illegal activity that they were doing and openly admit that and devise certain ways that would be constitutionally and legally acceptable to achieve the ends they were really after. And that just failed totally because no one in Congress or — we couldn't get anybody in the courts, and certainly the Department of Justice and inspector general's office didn't pay any attention to it. And all of the efforts we made just produced no change whatsoever. All it did was continue to get worse and expand.

Q: So Snowden did the right thing?

Binney: Yes, I think he did.

Q: You three wouldn't criticize him for going public from the start?

J. Kirk Wiebe: Correct.

Binney: In fact, I think he saw and read about what our experience was, and that was part of his decision-making.

Wiebe: We failed, yes.

Jesselyn Radack: Not only did they go through multiple and all the proper internal channels and they failed, but more than that, it was turned against them. ... The inspector general was the one who gave their names to the Justice Department for criminal prosecution under the Espionage Act. And they were all targets of a federal criminal investigation, and Tom ended up being prosecuted — and it was for blowing the whistle.

Also related and of note, from Thomas Drake, one of the whistleblowers included in the USA Today conversation above --- his column from last week: "Snowden saw what I saw: surveillance criminally subverting the constitution."
