Well, this is an interesting turn of events. It includes a bizarre twist that even we would not have foreseen, involving a Republican operative who is now threatening legal action against us for reporting (accurately) on his companies' relationship to voter registration fraud and deceptive voter registration practices during the 2012 election and in previous cycles.

Remember that massive, multi-state GOP voter registration fraud scandal just before the 2012 election? The one that started in Palm Beach, Florida, spread to several different counties, then several different states? The scandal resulted in the Republican National Committee firing the Arizona firm they had secretly hired for millions of dollars to carry out voter registration drives and get-out-the-vote efforts in a bunch of key swing-states, including Florida, North Carolina, Virginia, Nevada and Colorado in advance of the Presidential Election.

The firm at the center of the RNC scandal was named Strategic Allied Consulting. It was created and run by Nathan Sproul, a notorious Arizona-based Republican operative with a checkered past, who ran Republican voter registration drives and other on-the-ground GOP activist campaigns. Sproul's name was not used in the legal filings which created Strategic Allied Consulting in advance of the 2012 election, due to his various companies facing voter registration fraud allegations and criminal investigations in a number of states going back as far as the 2004 Presidential election. Because of that unfairly tarnished background, Sproul claimed when the 2012 scandal first surfaced, the RNC didn't want his fingerprints on the operation. The RNC was dodgy about the issue, but fired Sproul and his firm in several states once the scandal came to light, despite having paid millions of dollars for the effort.

The BRAD BLOG broke a number of stories related to the RNC scandal at the time, including details on the very first reports of "hundreds" of fraudulent registration forms turned in to the Palm Beach County, FL Supervisor of Elections after they were collected by Sproul's workers and turned in by the local Republican Party.

In the same series of articles, we also exposed the deceptive (and perhaps illegal) registration scheme employed by Sproul's firms in states where they operated. The scheme involved registration workers trained to pretend to be pollsters asking voters who they planned to support in the Presidential election. If they answered the question correctly (Romney) Sproul's workers would help them register to vote. If the unsuspecting citizen answered the "survey" question incorrectly (Obama), the workers would wish them a nice day, and then move on to the next target.

As we documented with video, email and other records at the time, including admissions by Sproul himself, his firm used this same deceptive tactic in state after state and in a number of recent election cycles.

Now, a two-year Florida Department of Law Enforcement (FDLE) investigation has finally wrapped up into the 2012 allegations in that state. It has led to yet another arrest of one of Sproul's workers, found no evidence of conspiracy by the company in that state, confirmed The BRAD BLOG's reporting on their deceptive registration technique, and sent Sproul scurrying to threaten us via email (posted below) with a lawsuit...for something...

D.C. reels after reported upset victory by Dave Brat over the GOP House Majority Leader in Virginia's 7th Congressional District

The political world exploded tonight with the stunning reported defeat of Republican House Majority Leader Eric Cantor to little-known "Tea Party" candidate Dave Brat.

Cantor's loss was so unexpected that Democrats didn't even bother to nominate anyone to run in Virginia's 7th Congressional District until last night, reportedly during a conference call, when they decided to put up a professor named Jack Trammell (from the same Randolph-Macon College where Brat works) as their nominee, just before today's deadline.

"A conservative challenger is expected to fall far short of defeating House Majority Leader Eric Cantor (R-Va.) in Tuesday's congressional primary," wrote Rachel Weiner in Virginia's local paper known as the Washington Post just this morning. "The question in this race is how large Cantor's margin of victory will be."

So, there's more than enough speculative analysis complete guess work out there for you elsewhere about what all of this portends, from the same political pundits and geniuses and well-sourced insiders who had no clue that Cantor was about to become famous as the first sitting House Majority Leader to lose in a primary race since either 1899 or...forever, depending on who you listen to.

But, pretty much just as soon as it appeared that Cantor was about to be announced the "loser" in a blowout of an election late today, questions started coming in to us, via Twitter and elsewhere, with concerns about the integrity of the reported results and if there could have been any chicanery behind them...

Heavy metals said discharged directly into rivers, streams by Alpha Natural Resources Inc.
$27.5m fine, $200m to be paid to 'reduce illegal toxic discharges'...

Big news on the Big 'Clean Coal' front today, just breaking from AP's Dina Cappiello [emphasis added]...

One of the nation's largest coal producers will pay a $27.5 million fine and is set to spend $200 million to reduce illegal toxic discharges into waterways across five Appalachian states.

The proposed settlement is the largest ever of its kind.

The Associated Press obtained details before the settlement involving Alpha Natural Resources Inc. was filed in court in West Virginia.

The government says the company and its subsidiaries violated water pollution limits in state-issued permits more than 6,000 times between 2006 and 2013.

The government says they discharged heavy metals harmful to fish and other wildlife directly into rivers and streams.

The companies agreed to take measures to reduce discharges from 79 active coal mines and 25 processing plants in Kentucky, West Virginia, Tennessee, Pennsylvania and Virginia.

In January of 2011, Alpha Natural Resources, then the third largest coal producer in the U.S., purchased Massey Energy Co. for $7.1 billion to become what Bloomberg News described as "the world’s third-largest metallurgical coal producer" and "the second-largest U.S. coal company by sales, with almost 14,000 employees."

The acquisition happened just months after the horrific April 5th, 2010 explosion at Massey's Upper Big Branch mine near Montcoal, West Virginia. 29 people were killed in the explosion, described as "the worst U.S. coal mining disaster in 40 years."

The tragedy at the Upper Big Branch mine would be upstaged just 15 days later, on April 20th, when BP's Deepwater Horizon rig exploded in the Gulf of Mexico, killing 11 workers and dumping some 5 million barrels of crude oil into the water over the next 87 days.

As coal and oil families mourned in WV and elsewhere, and as the country watched the unprecedented and unstoppable toxic discharge in the Gulf, it seems that Alpha was quietly poisoning rivers and streams in at least five states and fighting, along with fellow supporters of Big Fossil Fuel, to block the nation's transition to clean, renewable energy.

From US District Judge Arenda L. Wright Allen's ruling [PDF] yesterday, finding that Virginia's ban on same-sex marriage is unconstitutional under federal law (just as both Utah's and Oklahoma's bans were recently found)...

Almost one hundred and fifty four years ago, as Abraham Lincoln approached the cataclysmic rending of our nation over a struggle for other freedoms, a rending that would take his life and the lives of hundreds of thousands of others, he wrote these words: "It can not have failed to strike you that these men ask for just. . . the same thing---fairness, and fairness only. This, so far as in my power, they, and all others, shall have. "

The men and women, and the children too, whose voices join in noble harmony with Plaintiffs today, also ask for fairness, and fairness only. This, so far as it is in this Court's power, they and all others shall have.

While undoubtedly Virginia's law would have been found unconstitutional and overturned eventually anyway --- just like similar laws in all fifty states will be very shortly --- it arguably will have happened much faster there and (take note, conservatives) with much less cost to the taxpayers, thanks to the results of last November's elections. Yes, as we've been detailing for more than ten years now, elections really do matter.

Oh, and happy Valentines Day, Virginia...and everyone else!

NJ Gov. Chris Christie's premiere on the national stage is not going so well.

I was joined on this week's BradCast on KPFK/Pacifica Radio by Bryan Murphy, the former employee of David Wildstein, Christie's Port Authority appointee and old high school chum who gave the order to shut down the George Washington Bridge access lanes from Fort Lee, NJ in the still-expanding "BridgeGate" scandal.

Murphy worked as the Managing Editor of Wildstein's PoliticsNJ.com website some years ago and is now an Asst. Professor at Baruch College. Along with another former Wildstein employee, MSNBC's Steve Kornacki, Murphy posited over the weekend that a "billion dollar development" adjacent to the GWB access lanes in Fort Lee --- a development that has been fought over for at least four decades, but is being finalized now --- could very well be at the heart of this scandal.

We discussed that, the scandal's effects on Christie's 2016 hopes, and what lies ahead as the investigations and subpoenas continue to peel back the rotten onion.

Then I was joined live from West Virginia by my friend Bob Kincaid of Head-On Radio for the latest on the ground in Freedom Industries' toxic chemical spill which has poisoned the drinking water for hundreds of thousands there --- and is now heading down river towards Ohio. UPDATED with 'recount' details and more...

Meanwhile, back in Virginia...here we go again...

Yes. As reported by the State Board of Elections website tonight, that's a 9-vote margin in the state Senate special election held on Tuesday to replace Democratic state Sen. Ralph Northam who is vacating his seat after being elected last November as VA's next Lt. Governor.

To put that another way, control of the entire VA state Senate now rests on 9 unverifiable touch-screen votes out of more than 20,000 cast.

The VA state Senate is currently evenly split between Democrats and Republicans, twenty seats each. The tie-breaking vote in the state Senate goes to the Lt. Governor. Until Northam is sworn in to his new job on Saturday, when he takes over from the current Republican Lt. Governor, the GOP controls both chambers of the state legislature. A Democratic Lt. Governor will, theoretically, for the first time since 1998, mean that control of the upper chamber goes back to Democrats. But that is only if both Northam's Senate seat and the one being vacated by Attorney General-elect Mark Herring both go to Democrats in the special elections...

Dems sweep all three statewide offices for first time since 1969...

At a press conference in Richmond moments ago, late on the third day of a three-day "recount" process in Virginia, state Sen. Mark Obenshain (R) conceded this razor-thin race against state Sen. Mark Herring (D) for state Attorney General.

Herring will replace VA's outgoing, far right Republican AG Ken Cuccinelli who lost his own battle for the Governor's office last month.

Obenshain's concession this afternoon comes after what had previously appeared to be the closest statewide race in history. Just 165 votes out of more than 2.2 million cast had separated the two when the November 5th race was certified by the State Board of Elections late last month. But, by yesterday, Herring's lead had widened to more than 800 votes after two days of what passes for a "recount" in VA (there is no "recount" on touch-screen electronic voting systems used by most voters in the state and most of the paper ballot localities simply re-run the bulk of paper ballots through optical-scan systems again, as per state election code.)

Obenshain's decision means that Democrats will take control of all three statewide offices --- Governor, Lt. Governor and Attorney General --- for the first time in the Old Dominion since 1969 and the first time in twenty years that a Democrat will control the AG's office there.

It also means that a potentially divisive election contest --- described by some as the "nuclear option" --- will not be invoked by the Republican candidate. Once the "recount" is fully complete on Friday, and all of the very few "challenged ballots" are adjudicated by a three-judge special recount panel in Richmond, Obenshain would have had until Monday to file a contest. Unlike similar post-recount contests elsewhere, in Virginia the matter is not decided by a court of a law, but rather by a majority vote of a joint session of the state legislature, which is currently dominated by Republicans.

With both candidates currently serving as state Senators, a special election to replace either winner of the AG race was going to happen no matter the outcome of the "recount". The only question was which state Senator would need to be replaced. Obenshain's district is believed to be solidly Republican and likely would have stayed that way had he won the AG election. Herring's district, however, is currently seen as a toss-up. While the VA House is predominantly Republican, a GOP victory in the special election to replace Herring in the state Senate would swing the balance of that chamber over to Republicans as well.

Given the way Virginia forces the majority of voters to vote on 100% unverifiable electronic voting systems, and that the majority of votes cast on paper ballots are first tallied and then "recounted" by electronic optical-scan computers (either correctly or incorrectly, who knows?), we'll never know who voters really wanted to win this year's AG race. But this, apparently, is, as they say, "close enough for government work". Voters in VA deserve, and should demand, a much more transparent and overseeable system for the most crucial element of their system of self-governance.

Barring any surprises, Herring will be sworn into office in January, along with Democratic Governor-elect Terry McAuliffe and Lt. Governor-elect Ralph Northam.

Herring now up by more than 800 over Obenshain after second day of three-day re-tally in one of state's closest ever elections
PLUS: A few observations...

The "recount" is not going well so far for Virginia state Senator Mark Obenshain (R). What had been the closest statewide race in history, while still close, is beginning to open up for state Senator Mark Herring (D), who had been previously certified by the State Board of Elections as the "winner" of the November 5th state Attorney General's race.

After two days of what suffices for a "recount" in the Old Dominion's election to replace outgoing Republican AG Ken Cuccinelli, Herring's state-certified 165 vote lead prior to the "recount" expanded to more than 800 votes on Tuesday, out of more than 2.2 million cast. According to the Democrat's campaign, more than 70% of the votes have now been re-tallied across the commonwealth as of Tuesday night. The three-days of re-tallying will end Wednesday, with a three-judge panel in Richmond making the final determinations on any challenged ballots by Friday.

Herring may have hired MN Sen. Al Franken's election recount attorney to represent him in VA, but the three-day affair there, so far, is nothing like the epic six-month-plus post-election hand-count in the 2008 U.S. Senate race between Franken and his Republican opponent Sen. Norm Coleman.

There, every single paper ballot was examined publicly, by hand. The time it took was, in no small part, due to the transparent thoroughness of the counting, but perhaps much more to Coleman's attempts to challenge everything he possibly could, arguably as a way to forestall what would become a very short-lived filibuster-proof Democratic super-majority in the U.S. Senate once Franken was finally seated in July of 2009.

In Virginia, as we've described several times in detail, the "recount" process is barely a count at all, given that most votes in the state are still cast on 100% unverifiable (and unrecountable) Direct Recording Electronic (DRE, usually touch-screen) voting systems. The rest of the votes are cast on paper ballots, but those are tallied by often-inaccurate, easily-gamed optical-scan computer tabulators, either correctly or incorrectly --- without a hand-count, there's no way to know. By Virginia's "recount" statute, almost all of those paper ballots are simply being run through the same optical-scanners again, rather than examined by human beings. The exception is ballots that register no vote for either candidate during the re-scanning. Those are then set aside and examined by hand during the "recount".

But, in a race as close as this one, there are more than enough paper ballots to flip the results from one candidate to the other during such a post-election tally.

In this case, however --- at least as of Tuesday night --- it's not looking good for Obenshain, as Herring is racking up more newly tallied votes than the Republican in almost every locality where there have been any changes to the totals at all...

Post-election battles in closest ever statewide race could run through Christmas and include a partisan 'nuclear option'...

Election 2013 is but a memory --- good or bad --- for much of the nation. But, in Virginia, election officials, attorneys and partisans will still be busy as elves throughout much of the holiday season, and potentially even beyond, determining final results of the statewide November 5th Attorney General's election this year.

Last week, on the day before Thanksgiving, Virginia's Republican AG candidate Mark Obenshain filed for a recount [PDF] of the incredibly close race at the Richmond Circuit Court. Two days prior, his Democratic challenger Mark Herring had been certified by the state as the winner of the race by just 165 votes out of more than 2.2 million votes cast early last month.

Should those state-certified results hold, Herring would replace Republican Ken Cuccinelli as Virginia's AG. Cuccinelli was unsuccessful in his own run for Governor in November against Democrat Terry McAuliffe. Along with the Democratic win in the Lt. Governor's race as well, a Herring victory would result in the first time since 1969 that Democrats held all three statewide offices, and the first time in twenty years that Virginia will have a Democratic AG.

A "recount", in Virginia, however --- as we've documented previously (see last section of this article) --- amounts to much less than it may seem, given the technology used in the state and some of the ridiculous "recount" laws specified by the Virginia election code [PDF].

As bad as those "recount" statutes are, however, a margin of 165 votes could certainly be reversed, even in a state where most votes are currently recorded (either accurately or inaccurately, who knows?) by 100% unverifiable Direct Recording Electronic (DRE, usually touch-screen) voting systems, and where the rest are tallied (either accurately or inaccurately, who knows?) by paper-ballot optical-scan tabulators that will be used once again to "recount" (either accurately or inaccurately, who knows?) most of the state's paper ballots.

Yes, that's right. Hundreds of thousands of 100% unverifiable electronic votes cast in the closest statewide race in VA state history cannot be "recounted" now in any meaningful way. For those votes, state election code specifies that, during the "recount", election officials will merely recheck the voting machine computer printouts from Election Night to make sure the certified results match. Meanwhile --- and short of a court order --- votes that were cast on paper ballots will simply be run through the same optical-scan computers that tallied them the first time, after they've been reprogrammed to set aside all ballots which the scanner sees as an over vote, an under vote or a write-in vote in the AG's race. Those set aside paper ballots, at least, will then be examined by hand, in public, by actual human beings.

As ridiculous as the VA "recount" statute is, the "contest" law --- another procedure which the candidate who loses the "recount" may file thereafter --- is even more ridiculous. But, depending on the results of the "recount", that may be the only option Obenshain is left with...and it could result in a GOP "victory", even with fewer recorded popular votes, presuming there are enough heavily partisan Republicans in the VA state legislature...

The report is "spooky" for a lot of reasons, not the least of which is that I am named in the report, as one of the targets of an extraordinary $12 million espionage plot by the loathsome, rightwing U.S. Chamber of Commerce.

Let's end this week far better than it began

On Tuesday, Virginia state Sen. Creigh Deeds (D) was stabbed multiple times in his own home, by his son Gus who, having reportedly had a mental evaluation the day before, was not kept overnight, due to lack of bed space in western Virginia.

Gus shot himself to death that morning, after stabbing his father who was airlifted to the hospital in critical condition as of Tuesday night.

Today, Sen. Deeds was released from the hospital in "good" condition, and returned to Twitter to send this message his many supporters...

UPDATE 11/25/2013: Deeds was interviewed by the The Recorder today and blames the beauracracy of the local community services board for releasing his son from an emergency custody order for lack of a bed space just 13 hours before the tragedy occurred. Some local hospitals have said, since the incident, that they did have room, but were not contacted...

"I hope we can make a positive change as a result of this tragedy," [Deeds] told The Recorder. "I hope the justice we can get for my son is to force change in the delivery system for mental health services."

"I am alive for a reason, and I will work for change," Deeds said. "I owe that to my precious son."
