Video by Democratic Sec. of State Candidate in California Critical of CA SoS Bruce McPherson's Certification and Lack of Security Requirements for Diebold Touch-Screen Systems...
By Brad Friedman on 10/31/2006 3:08pm PT

Democratic Secretary of State candidate, Debra Bowen has released a new video ad on her campaign website showing how easy it would be for hackers to break into a garage where pre-programmed, election-ready Diebold touch-screen systems are now being "stored securely" by poll workers around the state.

Such a break-in could allow them to easily manipulate a single Diebold touch-screen machine to implant a virus on it would could then pass itself from machine to machine, resulting in an entirely flipped election. Nobody would ever know.

We have long since been critical of CA Sec. of State Bruce McPherson's re-certification of Diebold voting systems after his own technical advisory board at UC Berkley had advised him the machines could be tampered with in dozens of ways.

His further lack of enforcement of security requirements for the use of the systems --- he has sat by and allowed them to be sent home for weeks ahead of the election with poll workers on so-called "sleepovers" --- is both an outrage and a violation of his own state requirements and federal law.

Yesterday, we detailed (with photographs) how San Diego County Registrar Mikel Haas has been handing thousands of such hackable voting machines to poll workers in his county since October 16th of this year. Those irresponsible "sleepovers" now allow those poll workers --- or anyone who may wish to access the machines in their garage --- a full 3 weeks prior to the election to find the 60 seconds needed to flip every race in San Diego County.

Bowen's Diebold "sleepover" break-in ad can be viewed at her campaign website. It's also posted in full below...

California Secretary of State Has Difficult Relationship With the Truth
McP Squares Off, Falls on Face, Against Non-Lying Opponent Debra Bowen in Live Debate
By Brad Friedman on 10/19/2006 11:35am PT

We spoke about the Democratic, and actually qualified candidate for California Sec. of State Debra Bowen yesterday.

So, equal time. Let's talk about the completely unqualified, partisan mouthpiece, the current Schwarzenneger-appointed California Secretary of State and accomplished liar, Bruce McPherson.

Oh, and as the end of yesterday's debate revealed, he's also a loathsome human being.

The two debated before the San Francisco Chronicle editorial board. It was broadcast live --- now available to watch on the web --- and very informative. Here are some thoughts of ours on several of McP's obfuscations lies comments during the debate.

NOTE: Quotes of his below aren't always exact, but damned near. With one of McP's quotes, however, we had to go back and check three times, just to make sure we heard him right. We did. And we're appalled.

He actually said, "Under Secretary of State Bowen, if that ever happens, I will tell you, the blind and disabled will not be eligible to vote privately and independently."

Bowen replied gracefully by saying his comment was "shameful" and "not [McPherson's] finest moment."

Our personal replies to that appalling comment, and McP's host of other lies, follow below, and are far less charitable. As you may know, the election for California SoS may prove to be the most important race for the future of the nation's electoral system. Our snarky, point-by-point rebuttal to the truth-challenged McP --- who is working for the voting machine companies, not the voters of California --- follows in full...

Debra Bowen States the Obvious...Necessarily...
By Brad Friedman on 10/18/2006 5:30pm PT

Is this sort of thing actually necessary? Apparently it is.

While the following 10 items seem painfully obvious, apparently these no-brainer items need to be issued as a "Voter Bill of Rights" by CA Secretary of State candidate Debra Bowen, given the mess we currently face (made possible, in no small part, by the hapless, duplicitous current CA SoS Bruce McPherson)...

1. The Right To Register To Vote.
2. The Right To Vote.
3. The Right to Vote In A Tamper-Proof Election.
4. The Right To Vote On Paper.
5. The Right To Have Each Vote Counted Accurately.
6. The Right To Have Election Results Properly Audited.
7. The Right To An Open, Transparent, Public Process.
8. The Right To Elections Officials Who Operate Free of Partisan Influence.
9. The Right To Know that Elected Officials Are Free From the Influence of Campaign Contributions From Voting Machine Vendors.
10. The Right To Find Out How Money Is Being Raised And Spent In The Political Process.

Have we mentioned that Bowen's victory in defeating McPherson is perhaps one the most important elections in the country if we hope to ever see Electoral Integrity in this country again? Sign on to support here...

UPDATE 10:28pm PT: Bowen and McPherson debated today. Video here. Haven't gotten to watch it yet, but McP would never out and out lie would he? Not before an important editorial board, right?

UPDATE 10:33pm PT: Whoops! Just watched the first five minutes and he already did! Go figure...I suspect there are many more to come.

UPDATE 10/18/06 4:37pm PT: Holy cow! Lies o' plenty! And more! Full coverage of the debate now here...

Internal Memo from SoS Office to County Election Officials Informs That Any CA Voter is Entitled to Choose Paper over Plastic!
Apparent Response by Republican State Officials to Our National Call for Emergency Paper Ballots Causes Concern for Some...
By Brad Friedman on 10/16/2006 6:35am PT

Every California voter who wishes to vote on a paper ballot in this year's general election may do so, The BRAD BLOG has learned, according to an October 3rd, 2006 memo issued by the California Secretary of State's office!

The terse, single-page internal memo, sent to "All County Clerks/Registrars of Voters/Vendors" on CA SoS stationery (download complete memo here [PDF]) instructs elections officials across the state that they should "have an adequate supply of paper ballots" if electronic voting machines should break down or "if a voter chooses not to vote on electronic equipment."

Written by CA's Asst. SoS, Susan Lapsley, the memo was issued in apparent response to our recent call for Congress to introduce and pass immediate "Emergency Paper Ballot" legislation. While bills were subsequently introduced in both the House and Senate, neither chamber succeeded in voting on the legislation before adjourning for the election recess. Eagle-eyed BRAD BLOG readers may remember Lapsley as the one behind the Busby/Bilbray fax to Congress, declaring the Republican Bilbray the winner of the recent CA50 U.S. House Special Election to replace "Duke" Cunningham weeks before it was certified, while thousands of votes remained to be counted --- and well after we had already exposed that the tainted election included voting machine "sleepovers" with poll workers in the days and weeks prior, in contravention of both state and federal law.

Lapsley's memo was written just after Congress adjourned and prior to the letter [PDF] we sent last week, along with more than 50 other Election Integrity organizations and leaders, to all 50 Secretaries of State and Governors calling on them to institute immediate plans and procedures for Emergency Paper Ballots.

The good news here, as we see it, is that all California voters across what Diebold refers to as "the country's largest voting market" may now demand paper ballots when they go to the polling place this year. This will be crucial in counties such as San Diego and San Joaquin, where the Registrars of Voters have chosen to side with the voting machine companies instead of the voters by supplying only hackable touch-screen Diebold voting machines for their citizens this year.

In enormous Los Angeles County, which includes some 8 million voters, such dangerously unreliable touch-screen systems are used only for early voting. It seems clear, however, from Lapsley's memo, that even early voters in LA County may now choose to vote on paper ballots instead!

From the CA SoS' memo...

[A]ll county elections officials shall have an adequate supply of paper ballots, as determined by the elections official, available at the voting locations for use in the event of a temporary loss of the ability to use electronic equipment, or if a voter chooses not to vote on electronic equipment.

This back-up supply can be absentee ballots or other option as determined to be reasonable by the elections official. If absentee ballots are used at the polls the voter need NOT apply for an absentee ballot in order to be able to use it to vote at the polls. You may also use paper provisional ballots to satisfy voters wishing to vote on paper in the event that DRE counties do not have a sufficient supply of absentee ballots to satisy the needs of the precinct voters. In such instances, the ballots of verified eligible voters who wish to vote on paper and are provided a provisional ballot to do so should not be treated as a provisional ballot cast but, rather, as a regular ballot.

Seems clear enough to us. And, we believe, it's very good news for the voters of California in general.

With that in mind, however, some Election Integrity Advocates have expressed concern about the vagaries and other dangers of the Lapsley memo, including the Democratic Secretary of State candidate Debra Bowen and election attorney Paul Lehto, both of whom we have immense respect for...

By Brad Friedman on 7/28/2006 6:51pm PT

Mimi Kennedy of Progressive Democrats of America (PDA) and Emily Levy of California Election Protection Network (CPEN) appeared smartly today in my usual weekly Friday slot on The Peter B. Collins Show. Somehow, from somewhere, off to the side of a blistering hot stretch of highway in the middle of the Great Plains, I found a computer and net access from which I could secretly listen in (don't tell them.)

A busman's holiday.

They were all three tremendous on the topic mess that is the Busby/Bilbray CA50 election fiasco and on the anti-American, democracy-hating, truth-averse San Diego County Registrar Mikel Haas and his facilitating partner-in-crime CA Sec. of State Bruce McPherson. They offer a few hints as well about what's to come on those topics within the next few days (and what it is that's been keeping me from getting fully off the grid for the last week or so.)

Give 'em a listen...

-- Mimi and Emily on the Peter B. Collins Show, 7/28/06 [MP3]

And one quick personal word about Peter B... He has, nearly single-handedly, devoted more air time time to the issue of Electoral Integrity over the past year or so than just about anybody else across the entire media spectrum. Not just with my weekly appearances, but with many other guests and discussions on the same issues. For that, this country owes him an enormous debt of gratitude. Especially while the bulk of the media still fails to deal with this issue head on. PBC's willingness to use his platform for the public good, instead of distraction, is not to be "misunderestimated". Thank you, Peter. I'll be back. Though hopefully not too soon. ;-)

The Top Three (Latest) Spin/Lies of the San Diego County Registrar of Voters
By Brad Friedman on 7/19/2006 2:05pm PT

I'm getting ready to go out of town for a bit, and will need to rely on 6 or 7 of you to help keep San Diego County Registrar Mikel Haas' misleading statements and out-and-out lies from making their way into "conventional wisdom".

He's working hard to cover his ass right now in regard to his horrendous administration of the June 6th U.S. House special election between Francine Busby and Brian Bilbray, in which he allowed programmed, hackable, election-ready Diebold electronic voting machines to become effectively decertified (at both the state and federal level) when he sent them home with poll workers for days and weeks prior to the election. As he well knows, that means he allowed illegal votes to be cast on those decertified voting machines used across the entire California 50th congressional district.

There are loads of articles on all of this today in the San Diego papers and on the local television news websites. That's all good, in general, even though the reporters continue to allow Haas to pass on his knowing obfuscations, and the media is usually too lazy or ill-informed to bother to call him on it. So that's your job now! Especially while I'm otherwise on and off the grid over the next several weeks trying to sneak in some much needed R&R.

(On that note, I'm leaving ASAP, but am scheduled to appear live tomorrow night on Catherine Crier's CourtTV show at 5pm ET. Probably will have to do it from Vegas, where I'll be nearby. Currently RFK Jr. is booked along with me on tomorrow's show.)

So, very quickly before I scram, here are are Mikel Haas' top three spins, lies and misleads of late that he's shoveling out to media, as witnessed in coverage over just the past 24 hours on San Diego's Channel 8, Channel 10, the North County Times and the San Diego Union-Tribune, just to name a few. (Channel 10 and the U-T story had the worst of them)

Please help such media out by giving them the facts to counter Haas' ass-covering spin, misleads, red-herrings and bald-faced lies. Here are his latest Top Three most dangerous, disingenuous and misleading whoppers...

(And a Quick Hit on Ed Schultz with the Great Jim Lampley)
By Brad Friedman on 7/18/2006 11:12pm PT

Just off the air from the Mike Malloy show. And yes, before I came on he did comment that when touched the screen of the Diebold voting machine he used to vote in today's Georgia primary, it was touching the ass of Satan. If you missed it, his interview with me follows. It was a lively one. We discussed trouble at the Georgia primaries, the Busby/Bilbray sleepover mess, Diebold skullduggery in the California Secretary of State's office, and all manners of democracy crumbling.

He asked me to stay over for an additional segment after the top of the hour, when we had a....skeptic call in from Sacramento who believes I'm "a phony." Which is always fun, of course. Glad to meet the critics. Enjoy...

-- Brad on Mike Malloy Show, 7/18/06 [MP3, appx 40 mins]

Also, I had meant to post this a couple of weeks ago, so will take the opportunity to do so now before I hit the road for the next bunch of weeks and may become scarcer than I'd like (but I really need a break. Big time. So please forgive me) This is audio from the Ed Schultz when NBC/HBO sports anchor Jim Lampley was sitting in for Schultz show a day or two after our Emergency Busby/Bilbray Townhall in San Diego. I'm on with him for just a quick few minutes, but he gave one of the kindest and most generous introductions I've ever received. Lampley is a terrific hero himself, and was kind enough to show up to support us at the San Diego event with his wife Bree Walker (whose new show in Los Angeles, I hope to be doing soon as well. Like Lamps, she's aces!)

UPDATE: SoS Now Claims They've 'Abandoned' Previous Procedures, but --- in Yet Another Apparent Violation of State Law --- Have Failed to Issue Any New Ones!
By Brad Friedman on 7/9/2006 1:56pm PT

From BlackBoxVoting.org yesterday...

the California document called "Procedures for Approving, Certifying, Reviewing, Modifying and Decertifying Voting Systems" has disappeared from the secretary of state's Web site --- a remarkable coincidence, since many citizens are looking for it.

They want to know how it is that the Secretary of State can claim procedures were followed, given the sorry state of security and accuracy in many of the voting systems now being used in California.

See the BBV link for more details, and a "found copy" of the document via Archive.org.

According to Joseph Holder, the lead plaintiff in the VoterAction.org lawsuit against the State of California to halt the use and purchase of Diebold touch-screen voting machines, "Within the last month the link was still there and working."

But now it's gone. Go figure.

BBV sends the following update this morning...

We've posted an update. (1) Sec. State claiming they've abandoned the Procedures (2) In California, it's illegal to abandon or modify regulations without public hearings etc (3) Therefore Sec. State appears to be claiming that the Admin Procedures present in both [former Secretaries of State] Bill Jones and Kevin Shelley's tenure were "drafts" and somehow not "real" --- but the law says they have to create regs then, and the creation of regs requires...you guessed it, public notice, public involvement, public comment.

[Current Secretary of State, Bruce] McPherson's been in office for a year and a half and has created no regs. Do they exist or not? If so, why aren't they following them and if not, can they support the claim that the Procedures in place were "drafts" and "not real" and if hat's the case, why haven't they created new ones as they are required to do?

Election Integrity Advocates told Hand Count Fees to be $6000/day, While Media told Fees Would be $2000-3000/day
ALSO: No Documents for Ballot Chain of Custody, Machine Audit Logs, 1% Random Audit, as Requested by Hand Count Filing, Have Been Produced by San Diego County Registrar's Office Despite Demand for $6000 Payment Due Tuesday...
By Brad Friedman on 7/9/2006 6:05am PT

The San Diego County Registrar's office seems to be playing games with the amount they are attempting to charge for the cost of a manual hand count request as filed for accountability in the June 6th Busby/Bilbray U.S. House special election.

As well, the office has so far refused to produce any of the documents requested by the voter who filed for the hand count as required by California state law.

As we reported originally, the SD County Assistant Registrar of Voters, Tim McNamara, had informed an Election Integrity advocate via email that the cost of such a count was estimated to be "in the range of $110,000 to $130,000 and would take approximately 24 to 30 working days." The total estimated cost would be $6000 per day. (Complete email from McNamara at bottom of this article.)

However, a story from Friday's North County Times in San Diego on the manual hand count request (they, inaccurately, call it a "recount request") quotes an estimate from the RoV's office that is less than half that size:

Registrar of voters spokesman Mike Workman said that county counsel is now reviewing Jacobson's request for a recount...a process which can cost the requesting party as much as $2,000 to $3,000 a day, Workman said.

Further, SD County Registrar Mikel Haas has FedExed a letter to Barbara Gail Jacobson, the requester of the manual hand count, informing her that she must pay $6000 by 3pm this Tuesday, July 11th, to begin the count which he estimates in his letter will to be "between $120,000 and $150,000."

His letter also failed to include responses to numerous documents requested, such as chain of custody logs for ballots and voting machines, any of the audit logs from the machines used on election day, or any of the information requested on precinct voter breakdowns as allowed to the requester by state law (CA Election Code 15630 and other related sections) before such a hand count can begin.

All three sets of numbers for the fees associated with the count also failed to give any accounting for how the fees to be charged have been set. (Complete letter from Haas is also at the end of this article.)

"I have received no responses to any of my requests for information," Jacobson told us. "Not even any information on the required 1% manual audit that was supposed to have been done prior to the certification."

With three different sets of numbers now given from three different RoV sources, the question arises as to how they come up with such numbers in the first place.

All of the estimates, even the lowest of them, are far higher than similar quotes from other California country Registrars, as we reported previously. The highest of the numbers quoted by Haas come to nearly one dollar per vote, while in Orange County, CA, the registrar is reportedly charging some 14 cents per vote for a similar count.

Why the disparity in all of these numbers? It would be good to know.

Election Reform watchdog organization VelvetRevolution.us has taken up a collection for the costs associated with the entire legal battle over the Busby/Bilbray election. Contributions may be made here.

Meanwhile, Haas seems to be continuing his public misinformation campaign concerning the so-called Diebold voting machine "sleepovers"...

Why the Busby/Bilbray Election Matters (or Should) to the Entire Nation...
(HINT: It's not about Busby or Bilbray or San Diego or even California!)
By Brad Friedman on 6/26/2006 12:02pm PT

My reporting here, and the concerns expressed about the Busby/Bilbray election results as announced, have little or nothing to do with Francine Busby or Brian Bilbray or even, in particular, the June 6th U.S. House special run-off election in California's 50th congressional district.

It has only a tiny bit more to do with San Diego. And only slightly more than that to do with California.

It has everything, however, to do with democracy. Across the entire country. As opposed to any one race in any one area.

If I've not been clear on that until now, please allow me to set the record straight.

The concerns I've reported --- and will continue to report --- over the blatant disregard for the rule of law and clear illegalities endorsed and encouraged by the SD County Registrar of Voters, Mikel Haas, and apparently approved at this point by California's Secretary of State Bruce McPherson, have everything to do with the future viability of democracy in this country in general, and a perhaps naive hope that there's a chance in hell that taking action now will help to salvage a shred of legitimacy for this November's election.

That can only happen if action is taken now, however, directly in regard to the Busby/Bilbray election results as announced.

As far as I can see it, what happens in regard to Busby/Bilbray will be America's last, best, and only hope of affecting any real election reform prior to the November 7th general election. That's why, for me, this has become "Line in the Sand" time.

Never, in the two-and-a-half year history of The BRAD BLOG have I set aside almost everything else in order to cover and raise attention to a single story --- to the exclusion of almost every other story --- for such a long period of time as I have done since the original coverage of this matter the day after the June 6th election.

Since then, I've stated many times in both written and spoken words that I don't actually give a damn who won the Busby/Bilbray race and that I didn't even much bother to follow any of it prior to Election Day. I've got no dog in the hunt and only care that the person who actually received the most votes is the one that was declared the winner. At this point, there is absolutely no way of knowing who actually won.

The fact of the matter is that just two or three months after both the federal certification oversight body (NASED) and California's own Secretary of State issued emergency "security mitigation requirements" in light of newly discovered and massive vulnerabilities in Diebold's voting systems, those security requirements were entirely tossed out the window when all of the machines were sent home with poll workers for overnights in the days and weeks prior to the election. In doing so, the machines themselves were effectively rendered illegal and uncertified for use in any California election, and at the federal level as well.

Unless something is done, the same thing is about to happen in elections across this entire country.

(NOTE: Lou Dobbs will be covering this issue on CNN tonight I am told. Including interviews with some of the poll worker sources we gave them after originally reported on them here at BRAD BLOG.)

I'd have hoped that more media, candidates, individuals and even Election Reform organizations would have come to understand the national significance of what all the sturm and drang here has actually been about. If they haven't, that's likely my failing. So I'll try again to make both myself and the stakes here crystal clear...

What happens here and now --- in regard to this race and its results as announced --- will send a signal to elections administrators across the country. The signal will be one of two...

Waytago Bruce!
By Brad Friedman on 6/24/2006 4:42pm PT

Congratulations to California Sec. of State Bruce McPherson!

Not only did you succeed in running the first federal election --- with illegal/decertified voting machines --- since massive vulnerabilities have been discovered in the Diebold systems you okayed for use (against state laws), but you've also now received an 18% pay raise in the bargain!

According to yesterday's Sacramento Bee, your pay will increase by $23,265 to a full $154,875 just after you run your next illegal election in November!

Nice work if you can get it! Not that he's not worth it, of course. Here's a video to give you an idea what $154,875 buys for California these days. (The following video and details explaining it were originally posted at BRAD BLOG here back in February, when McPherson was acting as if he didn't know for sure if he'd re-certify Diebold in the state. Nice acting, Bruce! It was dang-near believable!)

(Hat tip Bruce Sims, who pays closer attention to California's elections --- by far --- than Bruce McPherson has ever done. And Sims does it on his own damn dime. For free! And also, unlike McPherson, doesn't have Diebold employees actually doing his work for him!)

By Brad Friedman on 6/16/2006 8:04am PT

PBS' News Hour with Jim Leher covered electronic voting as it occurred in last week's California primary. Suffice to say, while the report was "balanced" strongly towards a pro e-voting position, there were a number of points worth noting, and which underscore the points I've been making re: the illegalities in the Busby/Bilbray election fiasco.

======
UPDATE: Thanks to David Edwards, the video of the report is now available here: Video in Streaming Flash format...
======

1) Virtually every shot of a Diebold touch-screen voting machine shown in use on Election Day last week in the story, clearly reveals the (nearly-inexplicably) opaque plastic door designed into these systems as being closed over the view window of the so-called "Voter Verifiable Paper Audit Trail" (VVPAT) printer --- begging the question of how many voters actually bothered to verify their so-called "paper trail" when using these machines.

2) One long-time poll worker is asked what he's seen so far this year with the new voting machines. "Confusion," he replies. Then he goes on to report that voters are supposed to confirm their choices on the screen instead of via the "paper trail"...

SPENCER MICHELS: Don LeBlanc manned the polls in Stockton.

Will they get to look at the paper trail to see if they've voted correctly?

DON LEBLANC: Well, you look on the computer screen.

SPENCER MICHELS: But not the paper itself?

DON LEBLANC: No, that's for the computer --- that's for the people at the office.

SPENCER MICHELS: All right.

3) Computer Scientist David Jefferson from Lawrence Livermore National Laboratory, who examined the systems for CA Sec. of State Bruce McPherson, in light of the recent Utah analysis of Diebold touch-screen systems revealing they could be hacked with two minutes of physical access and no password necessary says (Francine Busby campaign, please take note!)...

Tells BRAD BLOG that 20% margin win is 'a major victory for grassroots organizing'
Plans to continue investigating reported problems in today's elections around the state...
By Brad Friedman on 6/6/2006 9:37pm PT

Updating this item with the latest news on top now. See 'below the fold' for the earlier reports, and the map of Bowen's enormous win!

1:04a PT... I just got off the phone with Senator Bowen where she's just heard from Senator Ortiz who has conceded!

It was a remarkable win, in many ways, given the 56% undecided in the state just a few days ago, and the fact that she was outspent by Ortiz, who also ran TV spots over the weekend (Bowen didn't run any, by the way.)

I asked her then to what she attributes this victory (with a whopping 20%+ margin) to?

"I think it's a major victory for grassroots organizing. People sent out messages to their email lists, to their friends. We used the net and the blogs to get our message out. I think it's also that people are beginning to understand if you don't make sure that elections mean something, you will lose your democracy."

(The BRAD BLOG was one small part of that netroots efforts with our recent endorsement and interview of Bowen, which was crossposted over at Huffington Post. You guys did all the rest!)

Was she surprised? "I really had no idea what to excpect. The 56% undecided a few days ago was rather...unnerving."

So what's the message that needs to get out between now and November? "People need to take a look at what's happened in the Secretary of State's office. The issues with voter registration and his certification of these voting machines....I mean look at what happened today with the problems around the state. I'm concerned about what happened in Kern County...and I won in Kern County!"

Will you be looking into it? Even though you won it? "You bet I will!"

Our kind of patriot. (Some of those meltdowns reported earlier here.)

Glad it wasn't a squeaker. I gotta be up in about 5 4 hours to do a radio show...And tomorrow's gonna be another big day. I just have a feeling...Congrats Senator! We'll be right there with you through November!

See below for earlier reports from the evening and map as of 1:04am...

California Primary Election Eve Complaint, Filed Within the Hour in LA Superior Court Claims E-Voting Tabulators Placed in Room with Internet Access, in Close Proximity to Uncertified Tabulator Software
Complaint Filed by Plaintiffs Cindy Asner and Peace & Freedom Party Chair, Declaration Filed by Green Party Election Inspector, Several Troubling Details Alleged...ALSO: Voter Given Wrong Ballot in Winograd Race on Diebold Touch-Screen Early Voting Machine...
By Brad Friedman on 6/5/2006 4:04pm PT

UPDATE 6:56pm PT: Judge Denies Injunction! Suit Dismissed! Details follow in an update following our original coverage...

A last-minute Election Eve compaint has been filed in a Los Angeles courtroom within the hour calling on LA County's registrar of voters, Conny B. McCormack to immediately remove Diebold elecronic voting machine tabulators, said to have illegal access to the Internet as well as uncertified tabulation software, from counting rooms at the county's main facility in Norwalk, The BRAD BLOG has learned.

The plaintiffs in the case are Cindy Asner and Cynthia Henderson, LA County Chair of the Peace and Freedom Party.

The emergency filing, being heard at this hour, is based on an affidavit filed today by Green Party election system inspector, John Wenger, a PhD and retired software engineer from Northrup Grumman who has been tracking LA County's use of electronic voting machines over the past month along with several other inspectors from both the Green and Democratic parties. The BRAD BLOG spoken at length with Wenger over the weekend, and has reviewed a draft version of his declaration being filed with the suit. (The final version of Wenger's declaration is now posted at the end of this article.)

Los Angeles county is the largest voting area in California. The state is holding its Primary Election tomorrow. Touch-screen Diebold voting machines --- now shown to be hackable and highly vulnerable to malicious tampering at both the point of the voting machine itself and its central tabulator software --- are used for early voting only in LA County. Though early voting in LA began several weeks ago and ended last Friday, tabulation of votes cast during that period will not begin until the polls close on Tuesday evening at 8pm PT.

The race is an important one to Election Integrity advocates since state senator Debra Bowen is running in a primary race in hopes of winning the Democratic nomination to take on Republican CA Sec. of State Bruce McPherson who has been a supporter of vulnerable electronic voting machines, including Diebold's, in the state. As well, the LA County Registrar of voters, Conny B. McCormack has been a long-time supporter of Diebold and their election equipment and has even been featured, via photograph and endorsement, on promotional brochures distributed by the controversial Ohio company. (See graphic below.)

This year's primary is also being closely watched due to a Democratic primary challenge by anti-war candidate Marcy Winograd against powerful pro-war Democratic U.S. House Representative Jane Harman in the state's 36th U.S. Congressional district.

Further, another troubling detail about Diebold's touch-screen systems in the county was revealed on Friday of last week when The BRAD BLOG received an email indicating that one voter at least --- Michael Shure, a political commentator on Sirius Sattelite's The Young Turks radio program --- who voted on the Diebold touch-screen machines was given the incorrect ballot.

Shure, who lives in CA's 36th congressional district noted that his touch-screen ballot gave him the option to vote for Rep. Henry Waxman, who is running unopposed in his U.S. Congressional primary, instead of the Winograd/Harman race which should have been on his ballot.

"Unbelievable," Shure wrote in his email. "Had I not known, as I am sure many voters don't, who my Rep. was, and what district I live in, I would have been voting for someone else."

Indeed, Shure's experience underscores further dangers of combined precincts using elecronic touch-screen voting machines as Los Angeles offers during the early voting period when voters may go to any early voting location and cast their ballot on machines which --- supposedly --- offer them the appropriate ballot for their particular district.

The experience has left the Winograd campaign wondering how many other voters may have missed out on the opportunity to vote in that contentious race and whether or not they may need to file a challenge to the election in order to find out.
