• After a bit of breaking news on yet another failure to indict a white cop who killed a black man (in NYC), it's a quick (if disturbing) update on the continuing election recount mystery in Maine.

• The U.S. House race in Arizona's 2nd Congressional District (Rep. Gabby Giffords old seat) is headed to a "recount", as the state plans to "recount" ballots on the same faulty electronic optical-scan computers that tallied them in the first place. Pima County, AZ election law attorney Bill Risner joins us to discuss his lawsuit [PDF] against the state's plan for the "recount".

Dr. Michael Mann, Penn State University climate scientist and author of The Hockey Stick and the Climate Wars: Dispatches from the Front Lines responds to the disturbing climate change-related story line on a recent episode of Aaron Sorkin's The Newsroom on HBO as we separate scary climate fact from even scarier climate fiction. Mann also comments on the seemingly very encouraging news out of Germany this week, suggesting that fossil fuel companies are seeing "the writing on the wall". The good news: The guy who created the infamous "Hockey Stick Graph" is actually the optimistic one, for a change!

• Finally --- as relevant as ever this week --- it's the 50th anniversary of the "Free Speech Movement" kicked off by activist Mario Savio's inspiring speech at the UC Berkeley sit-in in 1964 ("There's a time when the operation of the machine becomes so odious, makes you so sick at heart that you can't take part! And you've got to put your bodies upon the gears and upon the wheels, upon the levers, upon all the apparatus") and the 30th anniversary of the world's worst industrial disaster at the Union Carbide plant in India in 1984. Letter to 11th Circuit from Goodlatte (R) and Conyers (D) seeks update on special probe into battery arrest of Judge Mark Fuller...

The bi-partisan leadership of the U.S. House Judiciary Committee has sent a letter to the U.S. Court of Appeals, 11th Circuit, seeking an update on their investigation into the August domestic battery charges and prosecution against Alabama federal Judge Mark Fuller.

Judiciary Committee chair Bob Goodlatte (R-VA) and ranking Democrat John Conyers (D-MI) sent the letter on Monday to the circuit's Chief Judge Ed Carnes and to Judge Gerald Tjoflat who is heading the Special Committee convened by the 11th Circuit to investigate the wife-beating incident by the George W. Bush-appointed federal jurist.

The letter from the House Judiciary Committee raises the possibility of impeachment of Fuller. The missive follows a vow by Alabama Rep. Terri Sewell (D) to seek articles of impeachment against Fuller in the U.S. House, as well as calls by the rest of the state's Congressional contingent who have stated that the U.S. District Court Judge should resign his lifetime appointment to the federal bench.

Fuller was arrested on the night of August 9th, after his wife made a disturbing 911 call from an Atlanta hotel room requesting an ambulance, while telling the operator that the judge was "beating on her". (The audio of the call, in which she is heard being struck, is posted at the end of this article.) Police found Fuller's wife Kelli bloodied and bruised along with other signs of violence in their Ritz-Carlton hotel room. He has been allowed by the state court to enter a pretrial diversion program and will have all charges dismissed, as if the incident never happened, once he successfully completes a program of once-a-week visits with a domestic abuse counselor.

Whether or not charges against Fuller are dropped by the state judge, the U.S. Congress may impeach and remove him from his $200,000/year lifetime appointment.

The letter (posted in full below) says "The allegations against Judge Fuller raise serious, substantial and troubling questions that have been the focus of constant attention and close monitoring by the Committee on the Judiciary since August 2014 when reports first appeared of his arrest for a violation of state criminal law"...

Razor-thin margin, failed tabulators, untallied ballots, terrible 'recount' provisions leave Barber-McSally contest unsettled...

Yes, we're still working on Election 2014 around here. As we've told you many times, problems in elections often take days, weeks or even months or years to reveal themselves, even after the mainstream media has long since moved on.

Last week we told you about the "recount" that awaits the GMO labeling ballot initiative in the state of Oregon and the amazing appearance of 21 "new" mystery ballots that flipped the results of a state Senate recount in Maine. And now, a "recount" lies ahead for the one remaining "too close to call" U.S. Congressional election in Arizona's 2nd Congressional District.

The state's first-ever "recount" of a Congressional race will be very different from the one that will be carried out for Oregon's Measure 92 and --- as demonstrated via a federal court ruling issued on Thanksgiving Day that disallowed the tally of some 133 provisional and early ballots before today's state certification of the race --- much more controversial. We can only hope no mystery ballots appear, as occurred in the still-unexplained contest in Maine.

The razor-thin contest in AZ-2 is between incumbent Rep. Ron Barber (D) and his challenger Martha McSally (R). Out of some 220,000 votes cast in the AZ-2 race --- in Pima and Cochise Counties --- the paper ballot computer tabulators report a margin of "victory" for McSally over Barber of just 161 votes, according to results posted by the Sec. of State.

The U.S. House seat in Arizona's 2nd District was formerly occupied by Rep. Gabby Giffords (D) until she was critically injured in a 2011 mass shooting that killed six and wounded 13 during a public event in Tucson. After Giffords' resignation following the shooting, she was replaced in a special election by Barber, one of her top staffers who was also shot twice himself during the massacre. Barber then went on to defeat McSally in the 2012 general election by less than one percent.

Prior to today's certification of this year's rematch, there were a number of oddities and controversies during the tabulation period. Among the problems, the reported Election Night failure of the paper ballot optical-scan computer tabulators in Cochise County to read a number of memory cards from the Early Voting period. Those sensitive cards store results of precinct-scanned paper ballots. They had to be flown by helicopter to another county before their contents could be discerned (even though paper ballots existed that could have simply been counted by human beings, rather than relying on electronic tallying systems.)

In addition to the troubling ruling last week by the U.S. District Court and the flawed electronic tabulation of some early ballots, local election integrity experts are also concerned about the state mandated process for "recounting" the ballots, a process which includes using the same flawed electronic scanners once again to determine if the initial scan was carried out accurately...

Well, I've been remiss over the years since 2012 in covering the BENGHAZI!!! "scandal" on these pages.

So allow me to make up for some of that lost time today, with this article just out from AP tonight:

WASHINGTON (AP) --- A two-year investigation by the Republican-controlled House Intelligence Committee has found that the CIA and the military acted properly in responding to the 2012 attack on a U.S. diplomatic compound in Benghazi, Libya, and asserted no wrongdoing by Obama administration appointees.

Debunking a series of persistent allegations hinting at dark conspiracies, the investigation of the politically charged incident determined that there was no intelligence failure, no delay in sending a CIA rescue team, no missed opportunity for a military rescue, and no evidence the CIA was covertly shipping arms from Libya to Syria.

In the immediate aftermath of the attack, intelligence about who carried it out and why was contradictory, the report found. That led Susan Rice, then U.S. ambassador to the United Nations, to inaccurately assert that the attack had evolved from a protest, when in fact there had been no protest. But it was intelligence analysts, not political appointees, who made the wrong call, the committee found. The report did not conclude that Rice or any other government official acted in bad faith or intentionally misled the American people.

The House Intelligence Committee report was released with little fanfare on the Friday before Thanksgiving week. Many of its findings echo those of six previous investigations by various congressional committees and a State Department panel.

The article continues describing the findings of the House Intel Committee report which its Republican chair Rep. Mike Rogers (MI) and Democratic ranking member Rep. Dutch Ruppersberger (MD) announced today. Among those findings, in response to the epic reports of a "stand down order" said to have been issued by the CIA or the State Dept. or the White House, AP reports: "None of that is true, according to the House Intelligence Committee report."

You get the idea.

Nonetheless, as AP notes, "the eighth Benghazi investigation is being carried out by a House Select Committee appointed in May." That special select committee, convened by Congressional "conservatives", is set to cost tax payers some $4 million. How very "conservative" of them.

It's been happening for years now. On the day after elections like last Tuesday's, media figures begin navel gazing to figure out how pre-election polls, created by dozens of independent pollsters using dozens of different methodologies, could all find the same thing but turn out to be so wrong once the election results are in.

The presumption is that the results are always right, and if they don't match the pre-election polling, its the polling that must be wrong, as opposed to the election results.

On Wednesday morning, after Tuesday's mid-term election surprise in which Republicans reportedly won handily in race after race despite pre-election polls almost unanimously predicting much closer races or outright Democratic victories, FiveThirtyEight statistics guru Nate Silver declared "The Polls Were Skewed Toward Democrats".

His analysis of aggregated averages from dozens of different pollsters and polls this year found that the performance of Democrats was overestimated by approximately 4 percentage points in Senate races and 3.4 points in gubernatorial contests. Silver's assessment relies on a "simple average of all polls released in the final three weeks of the campaign," as compared to the (unofficial and almost entirely unverified) election results reported on Tuesday night. He doesn't suggest there was anything nefarious in the polling bias towards Dems this year, simply that the pollsters got it wrong for a number of speculative reasons.

Citing the fact that nearly all of the polls suggested Democrats would do much better than they ultimately did, when compared to the reported election results, Silver asserts it wasn't that the polls were more wrong that usual, per se, but that almost all of them were wrong in a way that appears to have overestimated Democratic performance on Election Day.

"This year's polls were not especially inaccurate," he explains. "Between gubernatorial and Senate races, the average poll missed the final result by an average of about 5 percentage points --- well in line with the recent average. The problem is that almost all of the misses were in the same direction."

Silver is much smarter than I when it comes to numbers; I'm happy to presume he has the basic math right. But he seems to have a blind spot in his presumption that the pre-election polls were wrong and the election results were right. That, despite the lack of verification of virtually any of the results from Tuesday night, despite myriad and widespread if almost completely ignored problems and failures at polls across the country that day, and despite systematic voter suppression and dirty tricks that almost certainly resulted in election results (verified or otherwise) that were skewed toward Republicans...

RWers finally become 'believers' concerning 'liberal conspiracy theories' about vote flips on 100% unverifiable touch-screens...

By our count, Virginia is now the 7th state to report touch-screen voting flipping in the 2014 election (though we may have missed a few in Pennsylvania and elsewhere).

During Early Voting, prior to today's mid-term, we've covered 100% unverifiable touch-screen votes reportedly flipping on screen in Texas (D to R), in Illinois (R to D), in Tennessee (NO to YES on anti-choice initiative), in Maryland (R to D) and in Arkansas (unclear which direction the votes were flipping in several different counties), and in North Carolina, where votes were said to be flipping from D to R in the crucial, neck-and-neck U.S. Senate race there.

Now, "Republicans and Democrats alike" are reporting votes flipping in a U.S. House race in Virginia Beach and Newport News, and one of the Republican candidates involved has supplied a video tape of the flipping votes cast on the town's Diebold AccuVote touch-screen systems...

Judge Fuller's attorney again downplays first wife's allegations of domestic violence, substance abuse as 'rhetorical questions'...

It's been a very busy few weeks here of late, just trying to keep up with all of the roller coaster court rulings (here's the latest, and its not good), thanks to GOP voter suppression laws around the country. (Your donations to our efforts in that regard help a great deal --- thank you and please!)

So, with a very few minutes pause in the voter suppression action on Friday morning, we were finally able to catch you all up with the latest in the Judge Mark Fuller wife-beating case on Friday.

Naturally, no sooner did we do so, when a few more noteworthy events happened in the case...

Recently, the attorney for U.S. District Court Judge Mark Fuller (Middle District of Alabama) described the incident where the federal judge was arrested and charged for beating his second wife bloody in an Atlanta hotel room in early August as overblown.

This week, his attorney went further in describing allegations that Fuller similarly beat his first wife as little more than "nonsense" and "gossip".

Also this week, Fuller's most famous "victim", former Alabama Gov. Don Siegelman (D), has finally spoken out about the entire sordid business.

Fuller's Alabama attorney Barry Ragsdale says that it was only after the release of a video showing an NFL superstar knocking out his then-fiancée in a hotel elevator in Atlantic City that people began to care in the least about a federal judge who, according to the police, repeatedly struck and kicked his second wife Kelli and dragged her around the hotel room by her hair.

"It got caught up in the Ray Rice and NFL scandals, and it's gotten lumped into a category of domestic violence that I don't think it belongs in," Ragsdale said in his attempt to marginalize the incident on behalf of his client, according to the Montgomery Advertiser. "There was not a beating, kicking or slapping in this instance," he says.

Really? Is that the case? Well, aside from the wife, the police and the evidence at the scene suggesting otherwise, let's review the audio from Kelli Fuller's 911 call again to help determine if Ragsdale's claim is credible.

Since the audio, as we originally posted it here last month, was buried inside of a longer video segment from Chris Hayes' MSNBC show, we've taken the liberty to pull out just the audio from the call itself, as played on MSNBC, to put it into its own standalone video for easy reference. Here ya go...

Really, Mr. Ragsdale? No "beating, kicking or slapping in this instance"? The 911 audio evidence strongly suggests otherwise, as did the lacerations and bruises reportedly found on Kelli Fuller's face and legs, the hair found on the floor in the room, and the blood discovered in the bathroom when police responded at the Ritz-Carlton.

We wonder if Fuller, a 2002 George W. Bush lifetime appointee to the federal bench (unless he resigns or is impeached by Congress) with a record for failing to recuse himself when presiding over trials of political opponents, would be impressed with the audio evidence from the 911 call and the testimony of police if it was presented in his court room.

In any event, Ragsdale went on to describe the reaction from the public and the calls for the federal Judge's resignation and/or impeachment from the entire Alabama Congressional delegation (including both of the state's U.S. Senators and all five Congressmen and women), the state's Governor, senior federal judges, and all sorts of newspapers from Alabama (here, here and here) to Washington D.C. as merely "overblown"...

Case against GOP Photo ID voting law in Lone Star State is very different than recent cases before the Court, plaintiffs argue
UPDATE: Texas responds, blames 'emergency' on plaintiffs' rush to have case tried before the election...

Attorneys for U.S. Congressman Mark Veasey (D-TX) and other plaintiffs have filed an Emergency Application[PDF] with the U.S. Supreme Court, seeking to restore a lower court ruling that struck down the law last week as intentionally discriminatory and an unconstitutional poll tax. That initial U.S. District Court ruling was subsequently stayed by the 5th Circuit Court of Appeals earlier this week.

Veasey's application was followed by the filing of another Emergency Application [PDF] by the United States Department of Justice (DoJ). Both were filed with Justice Antonin Scalia who oversees the 5th Circuit. Scalia has instructed the DoJ to respond by 5p ET on Thursday.

Both applications to SCOTUS were filed in the case of Veasey v. Perry in which a U.S. District Court, after a full trial on the merits, imposed a permanent injunction, preventing the State of Texas from implementing the nation's strictest photo ID law, Senate Bill 14 (SB 14).

The District Court determined that, if implemented, SB 14 could disenfranchise more than 600,000 registered Texas voters who are disproportionately black and Hispanic. The District Court not only ruled that SB 14 violated the U.S. Constitution, the Voting Rights Act (VRA) and amounted to an unconstitutional poll tax, but expressly found that it was passed as the result of deliberate and willful racial discrimination.

The emergency petitions ask that the Supreme Court lift the U.S. 5th Circuit's 11th hour stay of the injunction so as to prevent electoral chaos and confusion in the rapidly approaching November election. In the first petition, the Veasey plaintiffs argue that what the 5th Circuit did in this case --- stay a permanent injunction that was issued on the basis of a District Court finding of intentional discrimination after a full trial on the merits --- was "virtually unheard of" in the annals of American jurisprudence.

Plaintiffs contend that the 5th Circuit misapplied a leading Supreme Court case, Purcell v. Gonzalez [PDF] (2006) pertaining to the issuance of injunctions on the eve of a pending election. That case does not, as the 5th Circuit ruled, mandate a per se rule that always precludes changing a law immediately prior to an election. The DoJ contends that no such per se "rule exists, and the court of appeals clearly and demonstrably erred in failing to apply the established stay factors."

Instead, plaintiffs forcefully argue, "The Purcell principle", mandates that an appellate court give deference to the factual findings of the District Court. The 5th Circuit, they add, erred by ignoring the requirement of Purcell that Texas prove it would likely succeed on an appeal. The 5th Circuit also erred, they say, because it failed to balance the state's allegations about possible confusion that might ensue from implementing pre-SB 14 law against the "actual" confusion, chaos and mass disenfranchisement that the District Court, based upon uncontested evidence, concluded would occur if SB 14 is enforced in the November 4th election (early voting begins in TX on October 20th).

"Imagine that a state passed a law, six months before an election, stating that 'Negroes cannot vote,'" the plaintiffs write. "It would be ludicrous for an appellate court to turn around and stay that injunction because of some per se rule that election laws can never change immediately prior to elections"...

Making shit up about alien invasions of one form or another is a long family tradition for the Republican U.S. Congressmen from CA...

California Congressman Duncan D. Hunter (R) is in the middle of an amusing kerfuffle after claiming that he was told by unnamed U.S. Border Patrol agents that "ISIS is coming across the southern border," and will soon be "bombing American cities [after] coming across from Mexico." Most disturbing, he also said that while several of the Islamic terrorists had already been nabbed by federal agents, more have most likely slipped through and are amongst us even now!

"I know that at least 10 ISIS fighters have been caught coming across the Mexican border in Texas," the Congressman told a dubious Greta Van Susteren on Fox "News" earlier this week. Though those 10, luckily, were taken into custody, Hunter added, "you know there's going to be dozens more that did not get caught by the Border Patrol."

The Dept. of Homeland Security, however, has denied the claim, calling it "categorically false, and not supported by any credible intelligence or the facts on the ground." The Mexican Embassy has similarly disputed it. Politifact investigated the matter, before describing it as "incorrect and ridiculous" and rating it a "Pants on Fire" lie. And now other Republicans are being forced to grapple with how and whether to back up their colleague or not.

Nonetheless, Hunter Jr. is sticking by his alarming claim.

But this is hardly the first time a California Congressman named Duncan Hunter went on record, on television, during the heat of a campaign to simply make shit up about scary aliens sneaking across the border to come into our country and undermine our very way of life.

As The BRAD BLOG highlighted in 2007, Hunter Jr.'s father, now-retired Rep. Duncan Hunter Sr. --- who held the same Congressional seat his son holds now --- offered a similarly outrageous and apparently bald-faced lie while pretending to run for President that year.

Then, as now, Republicans were in the middle of attempting to enact disenfranchising Photo ID voting restrictions in the lead up to the election, akin to the very same ones blocked by the Supreme Court in WI and struck down as discriminatory and an "unconstitutional poll tax" by a federal judge in TX last night.

During a PBS-sponsored Republican Presidential debate that year, in response to a panelist's question, Hunter the Elder offered a blatant whopper about non-citizens "being round up [and] herded into the polls" to vote, claiming, with no apparent evidence to back him up whatsoever, that "we've seen that in California" in past elections.

Like Boy Hunter's recent claim on Fox "News", Father Hunter's response to debate moderator, Atlanta Journal-Constitution's Cynthia Tucker, appears to have been simply made up out of (nearly) whole cloth...

Dems use report to correctly cite need to fix part of Voting Rights Act broken by SCOTUS, but here's what they also aren't telling you...

A new 206-page report from by the non-partisan Government Accountability Office [PDF] finds that Republican-enacted polling place Photo ID restriction laws in states such as Kansas and Tennessee resulted in lowered voter turnout among African-Americans as well as younger and recently-registered voters.

The study will likely serve as yet more important evidence to rebut the disingenuous, cherry-picked claims by Republicans over the years that Photo ID voting restrictions do not affect minority participation.

As The Hill reports today...

Voter ID laws helped contribute to lower voter turnout in Kansas and Tennessee in 2012, according a new study by the Government Accountability Office.

Congress's research arm blamed the two states' laws requiring that voters show identification on a dip in turnout in 2012 - about 2 percentage points in Kansas and between 2.2 and 3.2 percentage points in Tennessee. Those declines were greater among younger and African-American voters, when compared to turnout in other states.

"This new analysis from GAO reaffirms what many in Congress already know: Threats to the right to vote still exist," [Senator Patrick Leahy (D-VT)] said in a statement. "That is why Congress must act to restore the fundamental protections of the Voting Rights Act that have been gutted by the Supreme Court."

The report, according to Leahy's full statement, "also found scant evidence of voter fraud that the new laws that ostensibly are designed to discourage."

I'm on a number of deadlines today, so haven't gotten to peruse the actual report yet, but let me note a quick point or two, based on The Hill's reporting on the GAO study, which was requested by Democratic Senators Leahy (VT), Durbin (IL), Schumer (NY), Nelson (FL) and independent Sanders (VT), all of whom are co-sponsoring legislation to fix the part of the Voting Rights Act that the U.S. Supreme Court gutted last year in its notorious 5-4 decision...

Well, here's some good breaking news from the federal courts today, for fans of democracy anyway...

One of the most aggressive gerrymanders in the country is unconstitutional, according to a divided three-judge panel in Virginia. In 2012, President Barack Obama defeated Republican Mitt Romney by three points in the state of Virginia. Nevertheless, Republicans control eight of the state's eleven congressional districts. Yet, according to an opinion by Judge Allyson Duncan, a George W. Bush appointee, the maps that produced this result are unconstitutional and the legislature must "act within the next legislative session to draw a new congressional district plan."

Although this will permit the 2014 elections to be run under the old maps, new maps must be in place by 2016 (assuming, of course, that this decision is not reversed on appeal). As Virginia currently has a Democratic governor, Gov. Terry McAuliffe will be able to veto any plan which is unfair to his fellow Democrats, while the GOP-controlled legislature will no doubt push for a map that serves Republican interests. Because the current maps favor Republicans so strongly, however, the likely result will be maps that are much more favorable to Democrats.
