The Secret Koch Brothers Tapes...

By Brad Friedman on 1/22/2013 12:14pm PT

Palm Beach Post's George Bennet wrote last week about how so-called "Tea Party" groups seem to be running away from the "Tea Party" name in places like Florida.

The South Florida Tea Party, for example --- the one that helped launch the national career of Sen. Marco Rubio and hosted Donald Trump while he was initially pretending to think about running for President --- is changing their name to the National Liberty Federation.

"As Tea Party groups go," observes Steven Benen at MaddowBlog, "the South Florida Tea Party was one of the bigger and better organized outfits."

But it's little wonder these folks are running from the name. Their popularity, and their name brand, is now plummeting along with the fortunes of the Congressional Republican Party. As Bennet notes, even Rightwing pollsters like Rasmussen are finding that support for the "Tea Party" movement is absolutely cratering...

By Ernest A. Canning on 1/17/2013 10:18am PT

While the short answer is that it is no doubt protected against criminal prosecution by the Speech or Debate Clause of the U.S. Constitution, one can't help but think of how the successive efforts by radical 'Tea Party' Republicans, first during the manufactured "fiscal cliff" crisis, and now by way of holding a figurative gun to the head of the nation's and world's economy, in order to extract concessions that would destroy the New Deal safety net (see two Jan. 14 segments of the Ed Schultz show below), resembles the crime of extortion, perhaps even treason.

For those of us who live in California, this latest round of GOP hostage-taking comes as no surprise. Year-after-year, the CA GOP utilized the Golden State's requirement of a 2/3 vote for passage of either spending or revenue enhancing measures as a means to force austerity, such as former Republican Gov. Arnold Schwarzenegger's draconian $15 billion cuts to education and health care. By refusing to pass a budget, the CA GOP at one point forced the state controller to issue $2.6 billion in IOUs. And, all during the CA GOP reign of economic terror, the Golden State's budget deficit expanded --- reaching an indebtedness in excess of $20 billion despite those massive cuts.

Democracy struck back. The percentage of CA voters who are registered Republicans dropped to less than 30%. During the 2012 election, CA voters passed a relatively progressive, revenue-enhancing tax measure supported by Gov. Jerry Brown (D) by a wide margin and the GOP's ability to hold the state hostage was eliminated when Democrats achieved a super-majority in the state legislature.

As a result, fiscal sanity was restored. CA is now on track to achieving a budget surplus even as $5.2 billion has been added to the state's school, university and health care budgets.

It is appropriate that President Barack Obama, who unfortunately lacks a record of holding fast to principle, has, so far, stated that he will not give in to the latest extortion demands concerning the upcoming need to raise the debt ceiling once again. But, given the nature of the far greater damage to both the U.S. and even global economy that could be wrought by the Congressional GOP's latest round of hostage-taking, can the nation or the world await a subsequent election to deal with extortion by an organization, the so-called 'Tea Party,' that is funded and controlled by the rapacious billionaires Charles and David Koch, whose Koch Industries was described by William Koch, David's twin, as a form of "organized crime?"

Two 1/14/2013 segments of MSNBC's The Ed Show addressing GOP hostage-taking on the debt ceiling follow below...

"I didn't leave the Republican Party, it left me." – Former FL Republican Gov. Charlie Crist, 9/6/2012

"Anyone from New York or New Jersey who contributes one penny to the Republican Congressional Campaign Committee should have their head examined." - Rep. Peter King (R-NY), 1/2/2013.

In the wake of the Jan. 1, 2013 decision by House Speaker John Boehner (R-OH) to postpone a vote on Hurricane Sandy relief until after the 113th Congress was sworn in, NY Rep. Peter King's sense of betrayal, which he described as "a knife in the back" in a remarkable floor speech, is understandable, but his proposed remedy is woefully deficient.

The only way that Republicans in an entire region of the country --- the Northeast --- can achieve meaningful representation in the 113th Congress may be by way of a massive party switch. The increasingly rare breed of "moderate House Republicans" may soon only be left with the choice of emulating the late Sen. Arlen Specter's 2009 party switch, by either becoming Democrats or by becoming independents who will caucus with the Democrats.

Of course, that didn't work out terribly well for Specter either...

Vast majorities of gun owners, and the American people as a whole, agree in favoring new gun safety measures...
By Brad Friedman on 12/17/2012 6:42pm PT

"If we're going to get past this almost hysterical fear of trying to do anything at all on gun rights," MSNBC's Rachel Maddow asked on Friday during her breaking coverage of the mass shootings at the Sandy Hook elementary school in Newtown, CT, "if we're going to try to puncture the myth that anything to reform or rationalize gun laws is absolutely, politically impossible as a categorical thing, what would happen if we just started at the edges?"

"What would happen if we just started with what even members of the NRA say they want from national gun laws? Because they want a hell of a lot more than we've got right now," she correctly noted. "The organization that they're a member of may not admit that, but when you poll their members, even they want improvements."

She is absolutely right. And so is the rank and file membership of the National Rifle Association when it comes to many of the most pressing gun safety issues. The numbers (read on) are unequivocal. They want what their leadership does not, and by huge margins. The con-men and scam-artists who run the terrorist-enabling NRA racket, on the other hand, as usual, are absolutely bloody wrong.

If we could reform gun safety laws just enough in this country to meet the wishes of the vast majority of the NRA membership, we would be leaps and bounds beyond the deadly political quagmire we have been languishing in as a nation --- thanks to the insidious liars and profiteers of the NRA leadership and the cowardly politicians afraid to take them on --- for at least a decade in this country.

The NRA's loudest and most dishonest voice is its Executive VP and chief political strategist Wayne LaPierre. He is opposed to any and all legislation that might stand a chance of making Americans safer, claiming a twisted and tortured view of the Bill of Right's 2nd Amendment as a prohibition against any and all such legislation...

A few items of late that have caught our eye, but we haven't had time to cover in detail. So, you get the Readers Digest versions for now. You're welcome!

Susan Rice and the Democrats once again succumb to the demands of terrorists.

• Whodathunkit? But questions arise about the legitimacy of the claims made by Fox' latest wannabe James O'Keefe, about that video purporting to show an "unprovoked attack" by "union thugs" outside the capital building in Lansing, MI this week. The most amazing part? Someone at The New York Times --- yes, that New York Times --- is one of those actually noticing the big honkin' edit in the middle of the video, rather than just reporting it all as unquestioned fact.

Eric Holder spoke about the need to protect voting rights at the John F. Kennedy Presidential Library. We have more than a few bones to pick about it, but we'll just point you to the actual speech for the moment.

• What's the difference between this and just stealing? House Republicans secretly --- secretly --- authorized $500,000 in tax payer dollars to defend the unconstitutional "Defense of Marriage Act". More of that small government "conservatism", apparently.

• Finally, for now, the critically acclaimed Zero Dark Thirty, the new theatrical film about the manhunt for Osama Bin Laden, reportedly glorifies the torture that led to his capture and killing, even though no torture whatsoever actually led to his capture and killing.

Discuss.

By Ernest A. Canning on 12/6/2012 3:43pm PT

45 Democratic lawmakers in the U.S. House are calling on Congressional leadership in both chambers to cut $100 billion from a "bloated nuclear weapons budget" as part of the ongoing so-called "fiscal cliff" negotiations.

Rep. Edward J. Markey (D-MA), a senior member of the House Energy and Commerce Committee, issued a press release citing the letter sent to House Speaker John Boehner (R), Minority Leader Nancy Pelosi (D) and Senators Harry Reid (D) and Mitch McConell (R) charging that "Our oversized nuclear weapons arsenal fails to reflect historic reality" and that "Our spending on radioactive relics of the past requires a reality check" after the successful conclusion of the Cold War.

The 45 House Dems list unnecessary current expenditures for "refurbishing a nuclear bomb that no one wants…a Uranium processing facility we do not need…a nuclear bomber when the ones we have will last for decades."

The letter, (posted in full below) implores leadership:

Cut Minuteman missiles. Do not cut Medicare and Medicaid. Cut nuclear-armed B-52 and B-2 bombers. Do not cut Social Security. Invest in the research and education that will drive our future prosperity, not in weapons for a war we already won.

While the letter from the largely progressive Congressional members appears to be a rational step in the right direction, it raises additional questions. Among them: (1) Given that two nations, the U.S. and Russia, possess 95% of the world’s nuclear arsenals, and given that each nation’s individual arsenal is capable of destroying all life on the planet many times over, does it make sense to simply trim only $100 billion from an estimated $640 billion in nuclear weapons expenditures scheduled over the next ten years? (2) Why not couple the immediate request to trim $100 billion from the nuclear weapons budget with a call for a joint resolution of Congress calling upon the President to initiate negotiations under the auspices of the U.N. for a multilateral Treaty that would entail the eventual dismantling of all nuclear arsenals?...

From Henry Decker at The National Memo (where, by way of full disclosure, I'm also a fairly regular contributor)...

For the second time in a week, conservative Rep. Tom Cole (R-OK) is breaking with his party on a hot button issue.

Last Tuesday, Cole made headlines for disagreeing with House Speaker John Boehner and advising his fellow Republicans to accept President Barack Obama’s offer to immediately extend tax cuts on incomes under $250,000, while negotiating a broader deal involving tax cuts for the wealthiest Americans.

During a Sunday morning appearance on ABC’s This Week, Cole offered his advice on the other issue that has animated Republicans in the weeks since the election: U.N. Ambassador Susan Rice’s response to the September 11th attacks in Benghazi, and her potential nomination as Secretary of State.

When Dan Senor — the former spokesman for the Coalition Provisional Authority during the Iraq War, and the chief foreign policy advisor to Mitt Romney — suggested investigating “whether or not Susan Rice should be blamed” for the Obama administration’s response to the Benghazi attacks, Cole reminded Senor of the Bush administration’s false claims that Saddam Hussein was stockpiling weapons of mass destruction.

“We saw President Bush out front defending something wasn’t true too,” Cole noted. “Maybe we should ask those guys some questions too.”
...
In both cases, Cole is not adopting the Democratic position; he opposes raising tax rates for the wealthy, and he does not appear to support Rice (although he did not say whether or not he would vote to confirm her if he were in the Senate.) Instead, Cole seems to be trying to divert his party from embracing hopeless political positions. Just as Cole correctly identified that the White House has all of the leverage in the tax cut debate, so too does he seem to realize that a public battle over Rice could lead to some very uncomfortable questions about the Bush administration’s record — a history that the Republican Party would rather stay buried.

GOP Rep's incompetent attorneys won't contest mistabulated race...
By Brad Friedman on 11/20/2012 10:28am PT

In what UPI's Gabrielle Levy describes as a "passive-aggressive" Facebook post, Republican Rep. Allen West conceded to his Democratic challenger, Patrick Murphy, in FL's 18th Congressional District this morning.

Here's the first part of West's post...

For two weeks since Election Day, we have been working to ensure every vote is counted accurately and fairly. We have made progress towards that goal, thanks to the dedication of our supporters and their unrelenting efforts to protect the integrity of the democratic process. While many questions remain unanswered, today I am announcing that I will take no further action to contest the outcome of this election.

While there are certainly still inaccuracies in the results, and the actions of the St. Lucie County and Palm Beach County Supervisors of Elections rightly raise questions in my mind and for many voters, after much analysis and this past weekend's recount in St. Lucie County, our legal team does not believe there are enough over-counted, undercounted or fraudulent votes to change the outcome of the election.

While a contest of the election results might have changed the vote totals, we do not have evidence that the outcome would change. Given the extremely high evidentiary hurdles involved in a successful challenge, I will not ask my generous supporters to help fund a drawn-out, expensive legal effort with little chance of success. Therefore, we will not contest the certification or challenge the seating of Congressman-elect Murphy.

Serving the people in the House of Representatives has been among the highest honors of my life, but this seat does not belong to me, or for that matter, to any individual. It belongs to the people.

I want to congratulate my opponent, Patrick Murphy, as the new Congressman from the 18th Congressional District. I pray he will serve his constituents with honor and integrity, and put the interests of our nation before his own.

With West's concession, however, there are still a few points to keep in mind moving forward...

PLUS: Whose Ox Got 'Gored'? Republicans and Democrats switch sides in the fight for election integrity...
By Brad Friedman on 11/19/2012 1:29pm PT

It was a crazy weekend --- and that may be an understatement --- in St. Lucie County, Florida, as the fight continued over the questionable, completely unverified-by-humans, and extremely close computer-reported election results between Rep. Allen West (R) and Patrick Murphy (D) in the U.S. House race for Florida's 18th Congressional District.

Two things, if nothing else however, have become clear. 1) The Florida Democrats supporting the unverified computer-tallied results, which reportedly offer a slim margin in Murphy's favor, have become virtually indistinguishable from the Republicans who supported George W. Bush over Al Gore in the state during the 2000 Presidential Election debacle, and for the same, unjustifiable and partisan reasons. 2) Allen West has terrible and incompetent election attorneys.

Here's a recap of all that has happened --- and there has been quite a bit --- over the weekend, since we last covered the race on Friday, just after a St. Lucie Circuit Court judge denied West's motion demanding a retabulation of all eight days of Early Voting ballots in the county and just before the county's Canvassing Board took up the same issue shortly thereafter in what became a seven hour meeting of the board to determine how to proceed.

(And all of that in the wake of a previous partial retally of three out of eight days worth of early votes had resulted in the unexplained disappearance of some 800 votes when the same paper ballots were run through the same machines a second time due to unexplained "issues" with the electronic tabulation systems the first time around. That initial re-tally had resulted in a net gain of some 500 votes by West.)

The insane weekend events included a two-day machine "retabulation" of all Early Voting ballots in St. Lucie (one of three counties, along with Martin and Palm Beach, that make up FL-18); the discovery of more than 300 previously-untallied early ballots in the same county; new computer-reported tallies resulting in pick-ups by both candidates, for an overall gain of nearly 300 votes by the current leader Murphy; and a County Supervisor of Elections who ended up spending the weekend in the hospital...

Could be most monumental proceedings since Watergate, expose illegalities of plutocratic 'war on democracy,' catapult movement to amend the Constitution after 'Citizens United'...
By Ernest A. Canning on 11/18/2012 1:42pm PT

Lisa Graves, of The Center for Media and Democracy [CMD], is "asking citizens to contact their Senator and demand hearings on the way 'dark money' has stealthily influenced the election." The CMD's proposal includes a specific demand that Charles and David Koch be subpoenaed to testify --- something which, Graves explains, the oil and chemical magnate brothers evaded some 15 years ago when U.S. Senator Fred Thompson (R-TN) blocked efforts to force them to testify about their use of front groups to influence elections.

Unlike the GOP, whose calls for "Watergate-style" Benghazi hearings have been described as "political theater," the incoming 55-member Senate Democratic Caucus is in a position to conduct a broad and thorough set of hearings that could expose the ever-present threat to the very survival of democratic governance by what former Vice President Henry A. Wallace described as "the American fascist."

Coming within the context of near universal opposition to the flood of corporate money that drown out the voices of ordinary citizens, such hearings could also serve to catapult growing calls to not only overturn the infamous Citizens United decision but to end the concept of "corporate personhood" and establish that money is not "free speech."

The United States Senate has not been in a position to conduct hearings of such monumental import since Sen. Sam Ervin (D-SC) chaired the Senate Select Committee to Investigate Campaign Practices aka the Senate Watergate Committee...

GOP Congressman likely to contest results after final certification
ALSO: Brad discusses long-time failure of the electronic tabulation systems used in the West/Murphy race on Thom Hartmann's TV show...
By Brad Friedman on 11/16/2012 3:55pm PT

[Now UPDATED at bottom of story.]

A Circuit Court Judge in St. Lucie County today denied Florida's Republican Rep. Allen West's motion to order a re-tally of all Early Voting ballots in the county, after a partial re-tally of Early Votes last Sunday resulted in the disappearance of some 800 votes in the FL-18 U.S. House race between West and Democratic challenger Patrick Murphy.

It the second denial for West, a "Tea Party" favorite, in a Florida court room, where he had previously filed a motion to impound paper ballots and voting systems before all ballots had even yet been run through them.

Today, according to the Palm Beach Post, "Circuit Judge Dan Vaughn said he did not have the authority to issue an injunction ordering the recount."

"In denying West's motion," the paper said, "Vaughn noted the [St. Lucie County] canvassing board is considering the issue at a meeting this afternoon. The judge also said that West has other legal remedies - specifically mentioning a statute that allows a candidate to contest an election within 10 days of the final certification of results. That certification is scheduled for Tuesday."

Murphy's attorney argued in response that there was "no basis for a full recount of early votes and if the canvassing board orders a full recount of them, the Murphy campaign will go to court to try to block it."

"If the canvassing board were to decide that they want to do that without any evidentiary basis to do so, we'll be back before your honor with a motion for injunctive relief against them doing it because under the law the statute that we cited for your honor they have absolutely no right to do it," the Post quotes Murphy attorney Gerald Richman as arguing in court today.

No "evidentiary basis"? Really? A partial selection of ballots --- just the last three days of eight days of Early Voting --- are re-tallied by the same machines that tallied them originally, but give a completely different result the second time they are tallied and that isn't "evidentiary basis" for re-tallying all of the votes? If that isn't a basis for a full public hand-count of all ballots, I'm not sure what is. Unfortunately, without a court order, thanks to the state's Republican legislature following the 2000 Presidential Election debacle in that state, it's illegal to hand-count paper ballots once they've been tallied by an electronic machine.

[Update: See bottom of story for update on what happened at the canvassing board on Friday, and much more!]

I was on Thom Hartmann's TV show, The Big Picture, last night to discuss the FL-18 U.S. House mess where West currently trails Murphy by a very slim margin, according to oft-failed, easily-manipulated, paper ballot optical-scan computers made by three different private companies in the three different counties that make up Florida's newly redistricted 18th Congressional District.

As we've covered in detail here at The BRAD BLOG, a margin of some 2,400 votes out of some 330,000 votes tallied as of last Friday was dwindled down to just under 2,000 votes as of last Sunday when St. Lucie County --- one of the three, along with Martin and Palm Beach Counties, that make up FL-18 --- carried out a partial re-tally of Early Voting ballots due, they say, to an unexplained "issue" on the Diebold optical-scan systems used to tally those ballots in the county.

In the bargain, some 800 votes seem to have disappeared according to the new Diebold tally. Both candidates lost votes in that partial re-tally --- where they ran the same ballots through the same machines, which counted them differently this time than they did previously --- but West ended up gaining some 500 votes on Murphy in the bargain.

Nonetheless, at this time, West is still some 250 votes shy of a mandated state "recount" which is triggered when the margin is .5% or less. Currently, the margin is just eight one-hundredths of a percentage point shy of that mark, at .58%, with West having filed his court for an expanded re-tally of all Early Voting ballots in St. Lucie earlier this week. While his court motion had called for a full re-tally of all Early Votes in St. Lucie, the motion failed to request a re-tally of either Election Day votes, absentee ballots or any of the ballots in FL-18's other two counties, for unexplained reasons (the West campaign has not replied to our queries on that) as we also discussed on Hartmann's show...

West did file an amended complaint this morning before the hearing, seeking a re-tally of absentee ballots in St. Lucie as well, after the campaign claimed they had found "significant problems" with the records for some of those votes, charging that the number of absentee ballots in some precincts exceeds the number of voters listed as casting absentee ballots there...

Supporters of controversial Repub and Dem opponent Patrick Murphy deserve full hand-count of all ballots in all FL-18 counties...
By Brad Friedman on 11/14/2012 6:53pm PT

A court hearing has been set for Friday in St. Lucie County, Florida, to hear arguments by Republican Rep. Allen West, who is now seeking a recount of all Early Voting ballots cast in the county.

Over the weekend, some 800 votes simply appear to have vanished from the tally in Florida's 18th District razor-thin U.S. House race between West and his Democratic opponent Patrick Murphy (D), after an unexplained partial re-tally of ballots cast during the last three days of Florida's eight days of Early Voting in the county, one of three that make up the new FL-18.

With very good reason, West is demanding that all Early Voting ballots be re-tallied in St. Lucie, on the heels of the unexplained "issues" with memory cards in the Diebold electronic optical-scan tabulators that county officials cited vaguely as the reason for Sunday's partial re-tally.

Where the extreme and extremely controversial West and his supporters have claimed the election is being "stolen" on behalf of Murphy --- a claim for which we are aware of no actual evidence --- The BRAD BLOG has now twice reported in great detail (first here and then here) on the oft-failed, easily-manipulated electronic systems, made by three different companies, in each of the three different counties (St. Lucie, Martin, and Palm Beach) that now constitute FL-18.

Why West has failed to demand a full hand-count of all ballots, in all three counties, as opposed to just the Early Voting ballots in St. Lucie, is a question that West's campaign has yet to resolve for us. Our queries to the campaign, to date, have gone unanswered.

Whether a hand-count, versus another machine count by the same faulty machines, is even allowable in Florida, remains to be seen, since the state's Republican-majority legislature, following the 2000 Presidential Election debacle in the state, insanely mandated that paper ballots, once tallied by a computer, could not be examined by hand.

A mandatory "recount" (a re-tally by the same machines) is required in Florida when the margin between the two top candidates is 0.5% or less. The margin in FL-18 is now just 249 votes shy of that threshold.

Given that 800 votes seem to have simply disappeared without explanation --- Murphy lost 667 and West lost 132 votes during Sunday's partial re-tally, decreasing Murphy's lead over West by 535 votes in a race where just 1,907 votes (out of some 330,000 votes cast), or 0.58%, now separate the two --- and given that the different tally occurred while re-scanning the very same ballots on the very same machines, it's almost beyond comprehension that both parties, at this point, aren't calling for a full, public hand-count of all paper ballots in all three counties in hopes of determining who really won and who really lost the race.

At this point, who knows if the machines were right the first time they tallied the same ballots, or the second time they tallied the same ballots, or, for that matter, either of the times they tallied the same ballots? Anybody else without a partisan dog in this hunt, other than us, beginning to see the problem here?...
