"If you're innocent, why are you taking the Fifth Amendment?," Donald Trump used to repeatedly bellow at his campaign rallies. "It's disgraceful," he would tell his MAGA Mob over and over again in 2016. "Only the mob takes the Fifth!" All words that, we just have a feeling on today's BradCast, may soon come back to haunt the disgraced, twice-impeached former President. [Audio link to full show is posted at end of this summary.]

Trump, and his family, and his family business, are now just losing motion after motion, case after case in courts across the country. And the more the losers lose, the more they have to lose.

Among the stories covered on today's program...

  • The BRAD BLOG web server was offline for much of the past 24 hours. We explain what happened and why we're likely gonna need to some shows off in the days ahead in hopes of finally fixing it. (And, yes, we could really use your help!)
  • Of course, if we had an obscene $200 million contract from Spotify (not just $100 million as previously reported), it might be much easier to fix it. But nobody is worth $200 million just to talk on air or on a webstream, no matter how important what they may have to say. But that's especially true for folks like Joe Rogan, who just fills the time with words --- entertaining or otherwise --- that may also have the affect of killing people. Moral of the pathetic Spotify/Rogan story: the company doesn't pay its musical artists nearly enough and, if they have that much extra money lying around to blow on one guy to help spread deadly misinformation, they are also definitely not paying enough in taxes.
  • As to our loser former President and his loser family, Donald Trump and his daughter Ivanka and son Don Jr. lost bigly in New York court on Thursday, where a judge ordered them to answer questions under oath within the next 21 days from state Attorney General Letitia James. She is investigating the family and their business for very clear evidence of years of bank, tax and insurance fraud. Their gambit to sue to the AG to avoid sitting for a deposition has failed and each of them may well consider pleading the Fifth very soon. Ya know, like the mob does.
  • The news was no better for Trump in his hopes of avoiding accountability regarding the insurrection he incited last year on January 6th, in his last desperate bid to steal the 2020 election. On Wednesday, President Biden and the White House counsel rejected Trump's attempt to invoke Executive Privilege to block White House visitor logs from January 6th, 2021.
  • And, also in D.C. this week, the Attorney General there had another victory in court over the Mob Family Trump, when a federal judge allowed him to restore the Trump Organization back into his lawsuit regarding millions of dollars that Trump and his family and his Trump Organization appear to have unlawfully stolen from the non-profit Presidential Inauguration Committee back in 2017. In a stunning ruling by a different judge last year, the company had been released from the lawsuit. But D.C. Attorney General Karl Racine brought evidence to the Court revealing that the unspeakably cheap and greedy Trump Organization inappropriately billed the Committee for about $50,000 in Inaugural weekend hotel rooms that they never ended up using. We explain the sleazy backstory.
  • In somewhat similarly amusing news, out in Colorado, the very Trumpy disgraced and recently arrested Mesa County Clerk, Tina Peters has now declared her intention to run for Secretary of State! Her backstory of recent disgraces --- apparently helping to steal and distribute proprietary voting system software after sneaking into a secure warehouse and turning off security cameras in the middle of the night; being relieved of her duties and barred from overseeing her county's election by a state judge; being investigated for election-related crimes by local, state and federal prosecutors; and being hilariously arrested last week for refusing to turn over evidence that she violated a judge's order by video-taping a court proceeding (among other stuff) --- should make her a top-notch candidate to win the GOP primary for the state's top election official this year! That, even as state Republicans are pretending as if they'd really rather she didn't run at all.
  • Finally, Desi Doyen joins us for our 13th Anniversary Green News Report! Despite almost certainly being the nation's longest-running bi-weekly national broadcast devoted to coverage of our climate crisis, the news on that front continues get largely worse, not better, as revealed again in today's episode. Though, as usual, there is also a bit of very good news on that front to help the medicine go down a bit easier...

Since nobody seems to know much about either, we open the phone lines to listeners to see what we can learn...

There are two stories, one major, the other one only "major" thanks to rightwing media fueling it, that I've wanted to cover more on The BradCast of late, but haven't. Why? Because, in both cases, both stories make little sense to me and the so-called "experts" or pundits out there seem to be ideological, for or against, in one way or another that fails to offer much clarity or insight to either story. [Audio link to full show is posted below this summary.]

So, I figure, if the so-called pundits and experts don't know much and are doing little more than offering their opinions and best-guesses, our callers couldn't do much worse, right? Fact-check: True! Callers came through today with shining colors!

The first story is the dumb Canadian trucker protests over vaccine mandates. As you know, they are attempting to shut down U.S.-Canadian trade across transcontinental bridges in hopes of forcing the government to meet their demands. They have been succeeding at harming the economy in both countries, at least until this weekend when Canadian police finally cleared the crossing at the Ambassador Bridge between Windsor, Ontario and Detroit. That closure threatened some $360 million a day in two-way cargo across the bridge or about 25% of the U.S.-Canada goods trade, according to Reuters.

The otherwise unpopular demonstrations in Canada are being fueled with money from the U.S. and round-the-clock coverage on wingnut cable TV. And, in addition to shutting off trade (leading some automakers to have to shut down some production), the demonstrations have included Trump, Nazi and Confederate flags, as well as protesters urinating on a Canadian war memorial. At a crossing into Montana from Coutts, Alberta, the Royal Canadian Mounted Police say they arrested 11 people blockading the border after learning of a cache of guns and ammunition, including long guns, handguns, body armor, and a lot of ammo and high-capacity magazines.

Can you imagine Fox "News" supporting an actual civil rights protests in this country that included weapons, Nazi flags and urinating on war memorials? But, of course, the dumb protests in Canada have little to do with actual civil rights --- even as I strongly support the right for anybody to protest whatever they want, even dumb stuff like opposition to life-saving vaccine mandates.

The far more dangerous story, obviously, continues in Russia and Ukraine, where the former has now reportedly deployed as many as 130,000 troops on three sides of the latter and where, according to the weeks long insistence from the U.S., an invasion is now as "imminent" as this Wednesday. The U.S. --- and NATO and the EU --- have been warning of an "imminent" attack for weeks now, and one may be. But Russia continues to deny any plans for an attack on the former Soviet state and nobody seems to have any more than best guesses about what the truth is and what will actually happen next.

Perhaps a better question is why is the U.S. so loudly broadcasting what they see as Russia's "imminent" plans to invade --- now said to be as early as this Wednesday. Is it because Russia really is going to invade? Or is there another reason?

We discuss all of that and much more with some terrific callers today --- including one who says he used to work for in Russ for a vodka millionaire, and another who explains that she had been working recently on a construction project at the border crossing into British Columbia from Washington State.

Then, as usual, there are the always-fun callers who completely disagree with me on everything (particularly on life-saving COVID vaccines), and I always enjoy those calls the most! I'll hope you do too!...

Guest: Lynn Bernstein of Transparent Elections NC on intimidation and an independent review of unverifiable ES&S vote systems; Also: Major media failures at Fox 'News', CNN and Washington Post...

On today's BradCast, we are bound and determined to take back the real fight for Election Integrity from the MAGA "Stop the Steal" loons and dupes who have no such interest in anything of the sort, as the Right has attempted to co-opt the idea of "Election Integrity" as part of Donald Trump's efforts to steal the election in 2020...and/or to steal the next one. But even too many weak-kneed Democrats have been frightened off of the fight to secure our nation's vulnerable voting and tabulation systems and ensure public oversight of election results for fear of offering fodder to the MAGA Mob. We're not playing that game. [Audio link to full show is posted below this summary.]

But first up, some pretty dreadful media failures from both the wingnut Right and the non-wingnut Corporate Media. First, after a deteriorating, 50-year old bridge collapsed in Pittsburgh on Friday morning, ironically enough just hours before President Biden's planned appearance in the city to tout his recently signed $1 trillion bipartisan infrastructure bill to repair the nation's crumbling roads and bridges, one Fox "News" host may have jumped the shark when it comes to disinformation from the propaganda news outlet. (Which is not easy!)

Longtime Fox host and news anchor Julie Banderas went off on an embarrassing tear about how "President Biden has been making promises over promises over promises and, as you've noticed, none of them have come true," as she asserted to four others appearing with her, each in their own little silent box. "Back in June of 2021 he started talking about his bipartisan infrastructure deal," she sneered derisively. "There's nothing bipartisan about it! If it was bipartisan, it would have been passed by now!," she continued cluelessly in her rant, slamming the President for failing his vow to "reach across the aisle" to make policy with Republicans. That, she insisted, "has clearly not happened." She was quickly followed by Kayleigh McEnany who concurred. "That might have been the biggest fairy tale of them all," said Trump's former White House Press Secretary.

In fact, Joe Biden's landmark, $1 trillion bipartisan infrastructure bill --- which he was in Pittsburgh to discuss on Friday, fer chrissake --- was passed with nineteen Republicans voting with all the Democrats in the Senate. It was signed into law a full two and a half months ago --- even if word of that promise-kept has yet to pierce the Fox "News" reality bubble.

Sadly, non-wingnut news outlets are not a whole lot better in too many cases of late. On Thursday, a federal judge invalidated the largest offshore oil and gas lease sale in the nation's history. 1.7 million acres were recently auctioned in the Gulf of Mexico after a different federal judge last year, one appointed by Donald Trump, blocked Biden's Executive Order pausing new fossil fuel leases, forcing the Biden Administration to sell off the Gulf. That, even after a scam environmental analysis by Trump's Department of Interior claimed that it would be worse for the climate if Big Oil was not allowed to buy up the leases and expand their drilling there. The Biden Justice Dept. sued to prevent the sale and White House Press Secretary Jen Psaki made clear to reporters back in November that the President opposed the auction, but was left no option by the Trump-appointed Judge to carry it out.

So, Thursday's ruling was a welcome victory for the Administration. But one would have to read the actual stories from outlets like Washington Post and CNN to learn that, because both of those outlets sent out news alerts to mobile phones telling a very different story. CNN's alert screamed: "A federal judge invalidated the Biden administration's oil and gas leases for 80 million acres in the Gulf of Mexico, citing climate change," while WaPo misinformed its readers by declaring "Federal judge throws out Biden administration's massive Gulf of Mexico oil and gas lease sale, faulting its climate analysis."

Wow, if we didn't know better --- or hadn't clicked through to read the actual stories --- it sure would sound like Joe Biden is talking out of both sides of his mouth when he claims to care about climate change and transitioning off of fossil fuels, while carrying out the nation's largest-ever sale of drilling leases in the Gulf! With non-wingnut corporate media like ours, no wonder his approval ratings continue to plummet (despite the fastest growth in the economy since 1984, as the media has also been failing to adequately report, as discussed on yesterday's program!)

NEXT UP...The Department of Justice on Thursday announced that its Election Threats Task Force, formed seven months ago, has made its second arrest. They indicted a 50-year old Nevada man who had repeatedly called the Nevada Secretary of State's office with violent threats on January 7, 2021, just one day after the Trump-incited attack on the U.S. Capitol, promising they were "all going to fucking die". That, after hundreds, if not thousands of similar and worse threats have been issued since the 2020 election against elections officials across the country.

But its not only elections officials forced to face down such attempted intimidation. One longtime Election Integrity advocate, who joins us on today's show, says she has faced similar nightmares in response to her work in a critical swing state, resulting in both in-person intimidation to herself and her family, and a chilling attempt to hack into her home security system.

Our guest is LYNN BERNSTEIN, an aerospace engineer with an expertise in testing satellite systems, who has, in recent years, turned her skills toward fighting for evidence-based elections as founder of Transparent Election NC in North Carolina. The non-partisan group's mission, according to its website, "is to confirm that every eligible vote is counted as the voter intended by working with elections officials to ensure that elections are secure, transparent, robustly audited, and publicly verified."

But, Bernstein contends, there are some in her state who may not like that idea. She has become a critic of North Carolina's recently approved, unverifiable computerized touchscreen Ballot Marking Device (BMD) voting systems made by ES&S, the nation's largest private voting system vendor. Bernstein went public last month on Twitter with some of the threats she began to face after she (a registered and active Democrat) found common ground with the state's Libertarian Party. She helped convince them to exercise their right, under state law, to seek an independent source code and security review of ES&S' unverifiable BMD voting and tabulation systems.

Bernstein offers several chilling details on the intimidation she has faced since the Libertarian Party announced their plans to seek an independent source code review, which will be overseen by the excellent University of South Carolina computer science and voting system expert Dr. Duncan Buell (who has also been a guest on this program). "Elections officials have been in the news a lot about being harassed and threatened," she says. "It seems though that the intimidation of election advocacy leaders happens way more than the public is aware of. I work with people all across the country and privately we discuss it among ourselves, but most won't publicly disclose that they've been hacked or intimidated before."

She also shares her well-researched concerns about the state's controversial new ES&S voting equipment --- which are also used in many other states --- and which experts had strongly advocated against certifying in the closely divided swing-state. "I'm a big proponent of hand-marked paper ballots," says Bernstein. "I think it's just the best record of voter intent. It's a very direct record." She explains how the ES&S BMD systems print out bar-coded paper ballots, supposedly representing voter's touchscreen selections. But those ballots cannot be verified by any voter as actually reflecting their intent. "North Carolina law says that a voter must be able to verify their ballot before casting it. With ES&S's barcode system, it doesn't actually allow the voter to verify their vote before casting it."

During our conversation, Bernstein also offers an endorsement of the state's Libertarian Party chairman who explained in his Party's December press release announcing the review, that "this is not about litigating the 2020 election." She claims that "one of the reasons why he's the perfect person to do this" is because "he has done forensic examinations before" as a former fraud investigator. "When I let him know that this particular ES&S system has never undergone a truly independent source code review, a full comprehensive one, he was shocked, as I think most of us are when we learned of these things."

There's a lot to discuss here, including whether both the state and ES&S will allow the state-mandated review, as we recommit to working to reclaim the real fight for Election Integrity around the nation.

Finally, when it comes to election fraud --- and, arguably, voter fraud --- nobody holds a candle to what Trump and the GOP tried to pull off in 2020. So it's nice to see that the January 6th Committee in the House on Friday, subpoenaed 14 Republicans from seven different states --- all of them won by Biden in 2020 --- who signed their names as duly-sworn "electors" for Trump, on documents fraudulently sent to Congress and the National Archives, in one of the most brazen (and, thankfully, failed) election fraud schemes in the history of this nation...

(Finally Old Enough to Vote!)

If I wasn't already so shell-shocked by the continuing (arguably, worsening) events of the last five or six years, I might have more emotional space to be amazed about the fact that The BRAD BLOG is now 18 years old.

Yes, as of this week we are finally old enough to vote!...

As we head into our 19th year (no, wait, that's impossible...yet isn't!), I am both exhausted and continuously mindful of the fact that whatever we've been able to do here over the past 18 years is solely due to the generosity of those who support and share our work --- including a few who have done so for almost all of those years!

So, to old readers and new --- including those who have discovered The BRAD BLOG thanks to our daily BradCasts across the nation over our public airwaves --- thank you for your generosity, including both your financial support when you can afford it and for your other various means of encouragement that helps us keep going.

You, and only you, have made everything we do possible. Most notably, you've allowed us to continue reporting independently verifiable facts, for good or ill, without fear, favor, or influence from political parties or corporate interests on the critical stuff that actually matters.

Thanks to you, there is no one in the world in a position to tell us to do otherwise. To that end, of course, we also have only ourselves to blame for whatever we produce here. And, frankly, I wouldn't have it any other way...

It's been a rough close of the year for those of us fighting to preserve democracy in these United States against the rising authoritarian tide from the Right. But while it's has been a tough slog for passage of federal voting rights and election protection legislation in the U.S. Senate, there have been several critical victories for fans of democracy in federal court over this past week, as covered on today's BradCast. [Audio link to full show is posted below this summary.]

First up, some quick news on the continuing probe by the U.S. House Select Committee investigating Donald Trump's attempt to steal the 2020 election by inciting an insurrection at the U.S. Capitol on January 6th. GOP dirty tricksters and longtime Trump pal Roger Stone invoked his 5th Amendment right against self-incrimination before the Committee today. While Stone is the first to admit to doing so publicly, he is the third Trump henchman to reportedly have done so to date. In 2019, Stone was convicted of seven criminal felonies, including lying to Congress and obstructing the probe into Russian interference in the 2016 election, before eventually being pardoned for all charges by Trump on his way out of office.

The House Committee appears to now be homing in on the question of, in Vice Chair Liz Cheney's words: "Did Donald Trump, through action or inaction, corruptly seek to obstruct or impede Congress's official proceedings to count Electoral Votes." If so, and if charged with and found guilty of said action or inaction, the former President could face as many as 20 years in prison under federal law.

Fox "News", on the other hand, is already in federal court, facing a $1.6 billion defamation lawsuit by the Dominion Voting Systems company. On Thursday, a federal judge denied the Republican propaganda outlet's Motion to Dismiss the case. That is a major hurdle for the private voting system vendor to have cleared, allowing their case to move on to the discovery and trial phase. Both Dominion and another private election vendor, Smartmatic, have filed several defamation suits against Fox and other rightwing media outlets, as well as Trump lawyers and allies such as Rudy Giuliani [PDF], Sidney Powell [PDF] and MyPillow CEO Mike Lindell [PDF], for their false claims that Dominion and Smartmatic stole the election for Joe Biden. Giuliani, Powell and Lindell's Motions to Dismiss in their similar defamation suits, in which the voting companies are seeking more than a billion dollars in each, were all rejected over the summer.

Next, more good court news came in late last week in the eight different lawsuits now filed challenging the state of Georgia's voter-suppression and election subversion law known as SB202. The measure was adopted by state Republicans earlier in the year on the heels of Trump's evidence-free claim that the 2020 election he lost to Biden in the Peach State was rigged, and after the elections of the state's Democratic U.S. Senators Jon Ossoff and Raphael Warnock in the January runoff.

Late last week the Trump-appointed judge overseeing all eight challenges to SB202, allowed all of them to proceed in full, rejecting the Motions to Dismiss filed by the State and Republican groups that have joined the defendants. Seven of those suits, including those filed by the NAACP, ACLU, Stacey Abrams' Fair Fight organization and the U.S. Dept. of Justice, focus largely on race-based violations of the Voting Rights Act.

The eighth case, filed by the Coalition for Good Governance [PDF], in which I am a named plaintiff representing media, challenges SB202's election subversion clause and several others which, the suit contends, violate the First Amendment of the Constitution. SB202's election subversion clause allows the State Board of Elections to replace county elections officials with partisans, for virtually any reason they like, who can then overturn elections, also for virtually any reason they like. Other provisions of the law challenged by CGG prevent the public and media outlets like our own, from basic election oversight and reporting functions that have been in place for decades if not centuries, such as the right to photograph inside of polling places or during the tallying of absentee ballots.

Earlier this year, in August, U.S. District Judge J.P. Boulee granted an injunction [PDF] on SB202's photography ban in advance of Georgia's November municipal elections. But his ruling last week [PDF] was much broader in allowing all eight challenges to the law to proceed in full toward the discovery and trial phases. It was, as my guest explains today, a major victory for all of the plaintiffs.

We're joined today by MARILYN MARKS, Executive Director of the non-partisan Coalition for Good Governance, to discuss the good news in that case, new developments in her separate, longstanding case challenging the use of Georgia's new, 100% unverifiable touchscreen voting machines made by Dominion Voting Systems and much MUCH more. We haven't spoken on air with Marks, usually a frequent guest, in about six months! So we've got a LOT to catch up with today!

Among the many points in our wide-ranging conversation...

  • Marks offers her reaction to Fox "News" losing its Motion to Dismiss in Dominion's defamation case against them; the conflicting emotions in supporting Dominion in their defamation cases, given that likely nobody in the nation has been tougher on Dominion's terrible voting systems than she has been; and why it is that, as unrelenting as she's been against Dominion for so many years (The Coalition's lawsuit seeks to ban their touchscreen systems across the entire state), the company has never sued her or her organization for defamation.
  • Speaking of the Coalition's case against GA's use of the Dominion touchscreens (which is separate from their SB202 challenge), Marks updates us on a report created for the court by plaintiff's expert Dr. Alex Halderman, finding vulnerabilities in Dominion's voting systems that are so disturbing the federal judge has sealed his report as for "Attorneys Eyes Only," meaning that even Marks has not been allowed to see it But, she notes, Dominion now has access to that report. If so, as we discuss, that means that, under California law (where several counties also use these same terrible systems), the company must now share the vulnerabilities in that sealed report with California's Sec. of State. In turn, CA must then report the vulnerabilities to the U.S. Election Assistance Commission. (The report by Halderman and the vulnerabilities he allegedly found became an issue here in the Golden State earlier this year, just prior to the California Gubernatorial Recall election in September, after Dominon's central Election Management System software was apparently stolen and duplicated under the auspices of a rightwing Mesa County, Colorado election official and released to the Internet during Mike Lindell's failed "Cybersecurity Symposium" in South Dakota.) It is unknown if Dominion has yet to share Halderman's report with the CA Sec. of State, as per state law. Marks notes that Halderman has said the vulnerabilities are "even more serious" than those found in the older Diebold touchscreens GA used to use, before they were banned by this same lawsuit and replaced with the vulnerable Dominion systems. "Dominion has to inform the California Sec. of State within 30 days of getting reports of defects, failures, etc.," she explains, "So yes, it should be happening soon."
  • Marks details why "it was a big victory" that Judge Boulee allowed all of the SB202 cases to proceed, including the one filed by the Coalition. She details how her group's challenge to SBS202 is very different from the other seven that the judge allowed to proceed as well, while he suggested that some of the overlapping cases may be combined in the days ahead. She notes that, despite being a Trump appointee, he appears to be doing a very thorough job of overseeing all of the cases, including points made by both plaintiffs and defendants alike.
  • She clarifies how even if SB202 is struck down in full, state law in Georgia would still allow much of the recent purging of Black Democratic elections officials from county boards of elections, as we discussed with one of those purged, longtime county election officials and voting rights leaders Helen Butler of The People's Agenda on the show earlier in the week. "Unfortunately, you and Helen are right about that," Marks confirms.
  • We discuss --- and have a minor difference of opinion --- regarding a recently dismissed lawsuit in Georgia that challenged the state's 2020 election results. That case, filed by a group named VoterGA, alleged thousands of fraudulent ballots were included in the 2020 results. It was dismissed in recent weeks for reasons of standing that both Marks and I find questionable. Our small disagreement is related to my argument that the case should have been allowed to proceed because, even if VoterGA's complaint was based on false claims of fraud, those who question election results (even those conned by a lying, disgraced former President) ought to be able to examine election results and ballots for themselves, as long as they pay the costs for the exercise and ballots are taken out of the secure custody of elections officials. (That, in contrast to the what we saw earlier this year in the Cyber Ninjas' clown show "audit" in Maricopa County, Arizona.) Marks, a longtime, huge advocate for transparency and public oversight of elections supports that idea, but notes that VoterGA failed to seek such oversight during the period when they could have done so under state law. Further, she explains, the group failed to join earlier efforts to the election to change state law in order to declare paper ballots and digital ballot images to be official public records, fully reviewable by citizens and groups like VoterGA and the Coalition for Good Governance.
  • Finally, Marks also offers her reaction to the recently discovered news that Trump attorney and longtime GOP "voter fraud" fraudster Cleta Mitchell, had been quietly named to an Advisory Board for the U.S. Election Assistance Commission (EAC) earlier this year. Her appointment in April was not publicly reported until November. Mitchell participated from the White House on Trump's infamous January 2nd phone call with GA Sec. of State Brad Raffensperger when the desperate, outgoing President attempted to bully Raffensperger, urging him to "find" enough votes to steal the election for him in the Peach State. The EAC, meanwhile, which Mitchell is now advising, is responsible for certifying voting systems used in the U.S. and helps states and counties on regulations and best practices for federal elections.

There is a lot of important information about elections and election integrity in today's conversation with Marks. Though we better not wait another six months to do it again or we'll have to have a three hour show!...

Also: We finally got boosted!; And, another deadly climate change fueled disaster devastates Midwest...

We've got a lot to catch up with on today's BradCast, after a weekend lost to recovery from our Moderna booster shots. [Audio link to full show is posted below this summary.]

First up, we discuss how things went following Friday boosters for both Desi and myself. For me, as after the second shot, not so good (though much better than actual COVID!) For Desi...it was pretty much business as usual beyond a bit of fatigue. Either way: Go get your shots! Also, just before air, California announced they are re-instituting a statewide mask mandate for indoor, public spaces amid another surge in COVID cases.

Next, 74 people are now confirmed dead in Kentucky alone, and more than a dozen were killed in four other Midwestern states on Friday night after a swarm of very late season tornadoes devastated an eight-state area, as unusually warm December air met with a cold front. Predictably, a climate change-fueled disaster ensued as the states, particularly Kentucky, now wrestle with mass power and water outages amid freezing temperatures for tens of thousands of residents while trying to sift through rubble and continue recovery efforts. Desi details the extreme weather's known connections to climate change and how (and if) corporate media are bothering to cite the causes for yet another deadly, intense, out-of-season extreme weather event.

Then, also breaking over the weekend, the release of a PowerPoint document called "Election Fraud, Foreign Interference & Options for JAN 6". It was obtained by the U.S. House Select Committee investigating January 6, from Donald Trump's former Chief of Staff Mark Meadows. The document was turned over to the Committee as part of a tranche of email and text message documents from Meadows before he decided he would stop cooperating with them. He will now almost certainly face federal criminal contempt charges, just as Trump's former aide Steve Bannon is now facing for also failing to answer lawful subpoenas from Congress.

This latest "smoking gun" document --- a 38-page version of which was circulated after the election last year, and a very similar 36-page version dated on Jan. 5 --- further cements the details behind the broad criminal conspiracy to steal the 2020 election from Joe Biden and the American people by Donald Trump and his minions. In this case, those cronies include the bulk of his Campaign staff and attorneys, much of his White House staff, members of the Dept. of Justice and a whole bunch of elected officials both in Congress and in the states.

We walk through a number of the evidence-free assertions made in the PowerPoint presentation which, according to Meadows, was to be shared with people "on the Hill" on January 5. Among those assertions, that China and Venezuela had "systematically gained control over our election system constituting a national security emergency," after "electronic voting machines were compromised."

Of course, there is zero evidence included in the document for those extraordinary claims. And those referencing Venezuela are known to be nonsense, since they are directly based on my own exclusive reporting at The BRAD BLOG from 2008 to 2010, which Team Trump subsequently lifted, twisted, mangled and bastardized to somehow support their false, easily-disproven and evidence-free narrative.

As to the "national security emergency" cited by the document, Trump was encouraged to declare one in order to then order ballots collected by the National Guard and U.S. Marshalls in all 50 states, to be counted by them once "invalid" and "fraudulent" ballots were somehow removed. Those same National Guard members, Meadows' documents also assert, according to the House Committee, were also to be tasked to "protect pro Trump people" on January 6 during the attack on the U.S. Capitol after Pence refused to go along with the plan to declare the Electoral College votes invalid. The last effort by Team Trump to steal the election was, as we all know, to hurl thousands of his gullible supporters at the Capitol itself in hopes of preventing the Constitutional certification of Joe Biden's legitimate election victory. The subsequent deadly attack was exactly what Bannon blatantly teased on his "War Room" podcast on January 5th. They were all in on it, including a bunch of members of Congress, as the Jan 6 Committee has recently been suggesting.

We explain much more detail on what is revealed by the ridiculous claims in the PowerPoint presentation on today's program, and how the guy --- retired U.S. Army Colonel Philip Waldron --- who reportedly circulated it among the dupes on the Right, actually met with Meadows at the White House as many as 10 times in the run-up to January 6th.

But the main point is this: Donald Trump and his minions employed a coordinated attempt to steal the 2020 Presidential election. It was not haphazard and it was not just low level operatives. And it was not, as media and many Dems still mis-describe it, an attempt to overturn or reverse or question or subvert the results. It was not an attempt to ferret out "voter fraud" or "election fraud". Donald Trump tried to STEAL the 2020 election and this was the "Rosetta Stone" road map for it. It would help the nation understand how close we came to losing what is left of our democracy entirely if it was described in those simple, basic and absolutely accurate terms.

What do about it? That will, no doubt, be the subject of future programs. But, at least today, hopefully, you will understand what happened and what didn't --- along with what they tried to do, and what they failed to do --- so we can all take action to make sure, somehow, something like this can never happen again...

Guest: Activist, author Kenny Bruno on 'DEFCON for Democracy'; Also: Fourth student dies after MI high school gun massacre...

On today's BradCast: It's a grim day in America. But it's one that every American should be paying very close attention to nonetheless. [Audio link to full show posted at the end of this summary.]

First up today, a fourth student, a 17-year old, has died following Tuesday's mass shooting by a 15-year old at Oxford High School in Michigan. The other three victims who were killed, as well as seven other students who remained in the hospital overnight after being shot, were all aged 14 to 17. The shooter used his father's new semi-automatic pistol purchased just last Friday to carry out the massacre. There were still seven more bullets in the weapon when he surrendered to authorities. But, that's "freedom" for ya in 2021 America, apparently.

On Wednesday morning, the Republicans' stolen and packed 6 to 3 U.S. Supreme Court majority met to consider removing the previously long-settled freedom for a woman to determine her own reproductive rights in all 50 states. The case heard at SCOTUS was Dobbs v. Jackson Women’s Health Organization, the last remaining abortion clinic in the state of Mississippi, where legislators have adopted a law that would ban all abortions in the state after 15 weeks of pregnancy. The measure was overturned in lower courts after being found a clear violation of the nearly 50-year old Roe v. Wade precedent set in 1973 and reaffirmed as settled law in 1992's Planned Parenthood v. Casey.

When MS filed their initial appeal at the Supreme Court they sought approval for their then-radical 15-week ban. It was only after last year's death of abortion rights champion, Justice Ruth Bader Ginsberg, and her subsequent replacement on the Court by the far-right Amy Coney Barret just eight days before the 2020 Presidential election, that the state decided to also ask the court to strike down Roe in its entirety.

Little, if anything, has changed legally since 1992 regarding the reproductive rights Constitutionally guaranteed by Roe and reaffirmed by Casey. But the make-up of the High Court itself has changed radically. Its majority has been stolen by Republicans who cancelled the filibuster in the Senate in order to pack three, hard-right Donald Trump appointees onto it. That fact, made clear by MS legislators themselves, led Justice Sonia Sotomayor to aptly ask the state's Republican Attorney General today: "Will this institution survive the stench that this creates in the public perception that the Constitution and its reading are just political acts?"

Good question. Of course, the answer is that those on the political Right don't actually care. As the twice federally indicted Steve Bannon recently noted on his War Room radio show/podcast, Republicans are only interested in "taking over" --- from school boards to the White House --- and whether or not their hardball methods result in "a Constitutional crisis," they really don't care. "We're a big and tough country and we can handle that," he preached to his followers.

To that end, Republican officials across the country are, right now, hoping to break American democracy itself, by installing loyalist Trump party apparatchik in key election administration positions, from precinct judges to county clerks to canvassing boards to Secretaries of State, as Washington Post reported in great detail on Monday. The Plot to Steal the 2024 Election is underway RIGHT NOW. Ignore these warnings at all of our peril.

We're joined today by longtime progressive activist and author KENNY BRUNO who offered a similarly chilling --- and even more direct --- warning at Truthout over the weekend, spelling out how Trump and the GOP have already "laid the groundwork for assuming the U.S. presidency regardless of the result of the 2024 election." He details today how "most of the conditions they would need to execute [their plan] is already in place."

"Often you see it covered, or you see various aspects covered, as if they were disparate things," Bruno explains, "like the treatment of Liz Cheney, the sham audit in Arizona, the repetition of the Big Lie, the new voter suppression laws in 19 states --- covered as if they are disparate things. But the simplest explanation is that they are all part of a plan," he charges, before spelling out exactly how that plan is meant to work between now and the certification of state electors on January 6, 2025.

To "undermine faith in elections" in order to steal a Presidential election, Bruno argues, "you would want radical state legislatures, especially in swing states. You would want a majority of states with a majority of loyal members of Congress. You would want to purge moderate representatives and election officials who might not go along with ending democracy, who might not play ball. You'd want a compliant Supreme Court. You'd want to intimidate the election officials who are left. I could go on...These are things that you need in place. If you look now at Trump and the GOP, most of those boxes are already checked. And they're part of a comprehensive plan."

What --- if anything --- can be done about it? Well, the options in response, as also spelled out by Bruno in his op-ed and on today's program, are not great. But knowing and understanding what is going on is a critical first step. While we have been warning and reporting on this stuff seemingly forever (for example, while the actual attempt to steal the 2020 election was underway in advance of the January 6th attack on the U.S. Capitol), it seems the warnings are not being adequately amplified by either corporate media or Democrats, as Bruno sees it.

He goes on to note that his originally suggested title for his Truthout piece was "DEFCON for Democracy," before the headline was somewhat softened by editors. "I think if you understand the threat to be that severe, then you have to take drastic action. Unless you're talking about it, and preparing people for drastic action, they're not going to understand why it's justified," cautions Bruno. "This is a real threat, it's a real plan. The evidence is that it's being carried out. And if you want to stop it, you might have to take some drastic action."

"I would love to be wrong about the whole thing, to be honest," he concedes. "I think the most important thing at the moment is to talk about it, to call it out. Because if you don't socialize people to the idea that this steal, subversion, gaming of the Electoral College is underway, they won't be ready to accept your actions to defend it."

As noted, it's a grim day and a grim show today, but one that we hope will be well worth your time to listen in full...

As noted on Friday's show, we're standing down for the week from The BradCast, Green News Report, and everything else that we can figure out how to stand down from. We desperately need a break and are hoping that a few days time off will be enough to at least half-way recharge our depleted batteries, restore some peace of mind, and otherwise allow us to catch up with some lost family time.

House holds Bannon in contempt; TX Lt. Gov. pays out for GOP voter fraud; CA GOP's recall boondoggle; Vets dump Sinema; Manchin could dump Dems; TX steals minority House seats; IL boosts Dems (a little)...

We covered a whole bunch of stories on today's BradCast. You'll have to tune in to find out what I have to say about most of them. Suffice to say there was a lot of both good news and bad. Often at the same time. [Audio link to full show is posted at end of this summary.]

Among the many stories covered on today's program...

  • The full U.S. House voted to recommend criminal contempt charges to the DoJ for Steve Bannon's refusal to answer his subpoena for documents and testimony from the House Select Committee investigating Trump's January 6th insurrection.
  • California certifies the results from last month's GOP Gubernatorial recall election, with the state's Democratic Gov. Gavin Newsom winning by the exact same percentages --- to the decimal --- that he won his first term back in 2018. Money well spent, Repubs! And thanks for wasting $300 million taxpayer dollars.
  • Five veteran advisors to Arizona's Democratic Sen. Kyrsten Sinema have had enough. They quit her advisory board for service members with a blistering letter citing her obstruction of democracy and the Biden agenda. The progressive veterans group Common Defense has now turned the letter into a TV ad with a seven figure buy to condemn the obstructionist Dem.
  • MoJo's David Corn reports that West Virginia's obstructionist Democratic Sen. Joe Manchin has a plan to quit the Democratic Party altogether. Manchin disputes the report. Corn stands by it. Either way, it should serve as a reminder of how fraught things are in the Senate right now, how narrow the Democratic majority is, and how the Senate could see Mitch McConnell and the GOP back in control, literally, at any moment. That, of course, would immediately end any hope of passing any part of the Biden, Democratic and/or progressive agenda. Perhaps there's good reason that President Biden isn't calling out Manchin by name for failing to reform the filibuster as many progressive voting rights activists have been demanding?
  • The GOP's ongoing assault on American democracy continues apace, as they plan to gerrymander their way into the House majority in 2022, and then use that control --- along with new election subversion laws in states they control --- to try and steal the 2024 Presidential election in a way they weren't prepared to do in 2020. All of which should serve as a reminder to every democracy loving American that it's time to step up --- even if it means reconsidering long-held, rock-solid beliefs. For example, that extreme partisan gerrymandering is wrong. It is. But is it wrong if it's needed to actually save American democracy? In Texas, new Republican-adopted Congressional (and state legislative) maps steal seats from minorities, despite the fact that the state's population growth --- and two new U.S. House seats to go with it --- is due almost entirely to minorities. Happily, states like Illinois are not taking the matter (entirely, anyway) lying down.

On today's BradCast: Several hours after we got off air from yesterday's program, our first-in-the-nation scoop on the pretty hilarious results of the Cyber Ninjas' Arizona "audit" was confirmed by the national media, including New York Times, Washington Post and CNN, not to mention the Arizona Republic and other local outlets. [Audio link to full show is posted below this summary.]

The main part of our exclusive news yesterday was that Trump's sore-loser, publicly financed, privately purchased and secretly carried out 2020 "audit" in Maricopa County found that the hand-count of 2.1 million hand-marked paper ballots cast there, as tallied by Dominion Voting Systems' tabulators prior to certification, were, in fact, tallied almost entirely accurately. The evidence-free lie that there had been some nefarious conspiracy to hack the Dominion systems on Joe Biden's behalf by communists in China, Cuba, Venezuela, along with George Soros, the "deep state" and "antifa", proved to be the bullshit most of the not-brainwashed Americans had presumed.

In fact, according to the Ninjas' own hand-count, Joe Biden picked up 99 votes over the state certified totals while Donald Trump lost 261, widening Biden's slim margin of more than 10,000 votes in Arizona by another 360. The "audit" hand-count of the state's U.S. Senate race also found a larger margin for the Democratic candidate than certified, though both candidates lost some votes in the Ninjas' count. Republican Martha McSally lost 541 votes, while Democrat Mark Kelly lost just 60, for an overall increase of 481 votes for Kelly, the certified winner.

We were a bit more general and circumspect during Thursday's show than we usually like to be, in our description of those findings while breaking the news in order to protect sourcing. But with the Ninjas three volume report now full released you can download it yourself for inspection. The numbers in the Presidential and Senate race are, however, buried way back in the report's third volume [PDF] for some odd reason. That's another reason we felt it important to break the news before the Ninjas put their purposefully diverting spin on things.

As Phoenix' NPR station KJZZ reported last night, even Randy Pullen, a spokesman for the state Senate and major proponent of the "audit" was forced to concede: "Was there massive fraud or anything? It doesn't look like it."

Today, Arizona's GOP state Senate held a forum to allow the Ninjas and friends to present their findings, though the Senate's feed crapped out about an hour into it (and long before Ninja CEO Doug Logan ever conceded that his hand-count confirmed the previously certified Democratic victories, if he ever offered such a concession. You can watch a replay of the three-hour forum now here.), We'll almost certainly pick up any newsworthy information or legitimate concerns from the hearing and/or the report in the not too distant future, if warranted.

All of this nonsense, of course, is a perfect way to disguise and distract from the fact that the GOP is now a broken political party with absolute no actual legislative agenda. But it comes at a time when when humanity itself is hanging in the balance, unfortunately, and when a legitimate opposition party to the Democrats might be very useful.

Earlier this month, NASA climate scientist and author DR. PETER KALMUS responded to recent calls from President Biden and nations around the world, to reach "net zero" greenhouse gas emissions "by 2050", by citing "two fatal flaws" in that plan: "One is 'net zero,'" he wrote at The Guardian, "the other is 'by 2050'."

Kalmus' argument comes as climate disasters around the world are now happening much sooner, more broadly and more fiercely than long predicted by climate scientists, and as new U.N. reports argue that even if the nations of the world meet their current pledges to reduce greenhouse gas emissions that cause global warming, we will still see catastrophic, humanity-threatening disaster by century's end. That, as a handful of so-called "moderate" Democrats in the House and Senate this week hold up efforts to at least begin facing this challenge, as designed in the Clean Energy Performance Program (or CEPP, offering financial incentives for utility companies to move to renewable energy production) built into the heart of President Biden's proposed $3.5 trillion Build Back Better Act.

"In my opinion, and I think many of my colleagues would agree, the climate science community is pretty surprised by how fast climate breakdown is progressing, in terms of extreme heat, which kicks off the fires, along with the extreme drought in the Western part of the US, the extreme flooding that we've been seeing in the Eastern part of the U.S. All of this is coming a lot faster than we thought as a community," Kalmus tells me, explaining why he is calling for "climate emergency mode" in which "a lot of things in society would have to change pretty drastically and quickly."

When there's an emergency," he argues, "you don't typically just keep doing what you were doing." He notes that most calls for net zero by 2050 assume some sort of negative emissions or carbon capture technology which either doesn't yet exist or, where it does, is not nearly robust enough to remove anywhere near the amount of greenhouse gas that must be removed from the atmosphere to even make a dent in our quickly worsening climate crisis.

He is calling for much more drastic measures --- such as the nationalization of the fossil fuel industry --- than most of the climate scientists and experts we've interviewed on the program, or who are usually allowed to speak in the national media.

While Kalmus concedes many of his arguments "might sound a little too radical" for many now, he believes that with each successive disaster, people will begin to understand more and more the consequences of failing to take appropriate action to meet the moment. He argues that while carbon capture technologies will not save us, neither will kicking the can down to 2050 to reach net zero. That, Kalmus explains, needs to happen more like by 2035 and, he believes, it is actually doable.

His case "might sound a little too radical to some of your listeners," the NASA Jet Propulsion Laboratory scientist (who notes he's speaking on his own behalf) concedes, but "my response to them would be that they haven't fully understood just what an emergency we're in, or just how irreversible the damage that we're doing and leaving for future generations is going to be."

Kalmus, whose research at the nation's space agency employs satellite data and models to study our rapidly changing Earth, warns: "I see what is coming in the future years, and I'm just trying to get people to respond now to what I know is coming. And that's really hard. I take a lot of criticism for that. But I know I'm right. So I keep trying."

"Ten years ago when I was saying similar things, but it wasn't so immediate to people, no one was listening," he says, adding: "Recent years have started to shift that balance. It's just basic physics and it's continuing as we continue to emit these greenhouse gases. So I can say with complete confidence that in the coming years, what I'm saying now that sounds radical to people will not seem radical anymore. I just wish that people would listen now."

Defamation case discovery unearths new details on Trump's attempt to steal the 2020 election; Also: More Trump crime and accountability news...

Of course they knew they were lying at the time. The pathetic thing is, their supporters who they continue to dupe, still believe the lies even today! But just in case anyone needs actual proof of Team Trump's attempt to use a Big Lie to try and steal the 2020 election, new evidence discussed on today's BradCast has been unearthed via the discovery process in one of the many defamation cases now filed against the Trump Campaign and their lawyers, Rudy Giuliani and Sidney Powell. [Audio to full show is posted at the end of this summary.]

According to a report from the New York Times today, a memo written by the Campaign in November, included in a recent motion filed by former Dominion Voting Systems employee Eric Coomer, reveals that even while Trump's attorneys were lying to the public about Dominion having stolen the election (so they could try and steal it themselves) via an insane, evidence-free conspiracy theory involving hacked voting machines, George Soros, China, Cuba, Venezuela and its dead President Hugo Chavez (among others), the Campaign knew it was all nonsense.

None of it stopped their attorney from continuing to try and steal the 2020 election anyway, nor from defaming Dominion (which is suing a bunch of them, along with Fox "News" and other far-right outlets) nor Coomer, its former director of product strategy and security, who they falsely claimed to have been key to Dominion's non-existent strategy to hack the election for Joe Biden. Oh, and the Trumpers also falsely claim that Coomer revealed the whole plot while on a recorded conference call with "antifa", with whom he was supposedly a "member," according to the ridiculous MAGA mob claims....even though there is no such actual organization (and, apparently, no such actual recording. Go figure!)

The Dominion/Venezuela/Hugo Chavez part of the story - which also involves another company named Sequoia, which is suing for defamation as well, and has even LESS to do with any theft of 2020 --- is somewhat our fault. The Powell/Giuliani lies about Venezuela and Chavez and Dominion and Smartmatic were spun from a twisted and bastardized version of my exclusive, investigative reporting from 2008 to 2010. (Reporting that was well-sourced, accurate, independently verifiable, and which happily still stand by.) Thus, we spend some time unpacking the latest revelations in this story for you today, as twisted as it all is.

That story, in turn, helps us kick off a host of fresh accountability-related stories today that are unlikely to end well for any of the Trumpers. Among them...

  • Republican Senators (and Trump lackeys) Lindsey Graham and Mike Lee also didn't buy the bogus fraud narrative that the Trump White House and Campaign were selling, according to Bob Woodward and Robert Costa's new book, Peril. Not that that prevented Graham from tossing in with the criminal conspiracy in Georgia with Trump, Giuliani and others, to try and steal the election in the state. That criminal conspiracy is currently being investigated by Atlanta's Fulton County District Attorney.
  • During a routine scheduling hearing in New York state court, the lawyer for Allen Weisselberg, the Chief Financial Officer at the Trump Organization, who has been indicted along with the company on several felony charges related to an alleged, long-running, tax fraud scheme, described as "sweeping and audacious" by state prosecutors, revealed that new indictments may be coming in the case. Little more was offered as far as who might be indicted and on what basis the attorney made his claims, but there ya go. In the meantime, the judge has pushed the next hearing to July of next year to allow Weisselberg time to review some 6 million pages of documents submitted as evidence in the case, pushing any trial to August or September of 2022 at the earliest. That, of course, presumes Weisselberg, who has worked at the Trump Organization for five decades, doesn't decide to flip on his boss before then to avoid huge fines and years in prison.
  • As to fines (and legal fees) that Trump and/or his businesses may have to cough up, given all of the ongoing legal battles they are defending against, that could become a very big problem for the disgraced former President as well. According to new reporting, occupancy rates are plummeting at Trump's properties, including his headquarters Trump Tower in New York and his tower in Chicago. A $100 million loan for the Fifth Avenue building in NYC has now been placed onto a "debt watch list" by the loan's master servicer, Wells Fargo, due to the quickly falling occupancy rate in the building since the end of last year. And that comes as Trump is reportedly personally on the hook for loans up to $400 million coming due in the next couple of years.
  • And, if you think it's time for us to move on from Trump accountability coverage since he's no longer in officer, well, we've got some bad news for you. We haven't even given up yet on George W. Bush accountability news! Happily, he faced a bit of accountability this weekend for his years of unprosecuted war crimes, courtesy of a U.S. Iraq war vet this past weekend in Los Angeles. We've got the play-by-play.
  • Finally, Desi Doyen joins us for our latest Green News Report, with good news and bad (mostly bad) as the U.N. General Assembly meets this week in New York and much more. Also, remember when the Trump Administration moved the Bureau of Land Management headquarters from D.C. to Grand Junction, Colorado in 2019 to try and pretty much kill the federal agency? Well, that largely worked, with nearly 300 experts, scientists and other employees who chose to resign or retire rather than move their lives across the country for no legitimate reason. Now the Biden Administration's Interior Department is moving the BLM back to D.C.

Today on The BradCast, important, helpful advice for progressives in California's Gubernatorial recall, and we win a first court victory against Georgia's new anti-voting and anti-press freedoms law! [Audio link to full show is posted below this summary.]

But first, Desi Doyen joins us for the latest on the record-smashing deluges in both Tennessee, where at least 22 are dead following 17 inches of rain in less than 24 hours, an all-time record and triple what had been forecast --- and on the Northeastern Seaboard where Hurricane (turned Tropical Storm, Turned Tropical Depression) Henri is wreaking absolute havoc. All just the latest examples of our worsening climate change emergency, as Desi explains.

Next, we had a court victory in Georgia on Friday! The first one, in fact, to knock down a provision of the state Republicans' abhorrent anti-voting bill, SB 202. And, I'm proud to say, it happens to be one of the provisions on which I am the named plaintiff representing the media. The lawsuit, filed by the Coalition for Good Governance (CGG), is one of eight suits currently challenging various provisions of the law. CGG's suit, among other things, challenges a number of anti-First Amendment press freedoms jammed into the statute, along with the voter suppression stuff and the provisions which allow the state to take over county boards of elections and subvert election results.

The specific provision struck down by the federal court [PDF] on Friday, criminalized all photography of voter ballots by the public and/or media. Given the state's new, huge touchscreen voting systems, it's now almost impossible to not see a voter's ballot when media or the public attempt to observe voting inside of Peach State precincts. Unfortunately, in addition to striking that one down, the judge allowed several other provisions in this early challenge to stand, though CGG Director (and frequent BradCast guest) Marilyn Marks told me over the weekend there will be much more to come in this case, as they are deciding whether to pursue reconsideration and/or appeal of several parts of the judge's early ruling. While a small victory, for now, it also establishes that the Coalition has standing to sue in this case and that, too, is encouraging good news.

Next, it's on to the ongoing, idiotic --- but deadly serious --- California Gubernatorial recall, in which Republicans, unable to win regular elections, are hoping to unseat popular progressive Democratic Gov. Gavin Newsom, who is otherwise up for reelection next year anyway. Vote-by-Mail ballots have been sent to all registered state voters (at the cost of hundreds of millions of dollars, thanks to those "conservative" Republicans), but, curiously, while Newsom and the Democrats are calling on voters to vote NO on the ballot's first question ("Should Newsom be recall and removed from office?"), they are calling on voters to leave the second question ("Who should replace him, if he loses on Question 1?") completely empty! "Vote No and go!," Newsom and state Dems have recommended.

As our guest today, ERNEST A. CANNING, a longtime progressive Democrat, both writes at The BRAD BLOG and explains on today's show, that strategy may be extraordinarily ill-considered and could backfire on Dems. Instead, after culling through the records (or lack thereof) of every non-Republican, non-Libertarian candidate on question two of the recall ballot (there are 46 candidates in total), Canning, in his "One Progressive's Guide to the CA Recall," explains why he believes the best strategy for progressives is to vote for the Green Party's Dan Kapelovitz on question two.

Both of the leading party candidates (far-right talk radio host Larry Elder for the Republicans and 29-year old real estate mogul and YouTube sensation Kevin Paffrath for the Dems), among other things, oppose Newsom's common-sense, life-saving mask and vaccine mandates and vow to lift them if elected.

Kapelovitz, on the other hand, a criminal defense attorney, both supports the Governor's science-based mandates that have been so successful in the state, and opposes the recall of Newsom itself on question one. He says he's running to stave off a worst-case scenario, according to Canning, should the currently "dead heat" first question result in the unthinkable removal of the Governor.

We also discuss the questionable Constitutionality of CA's more than 100-year old recall process (built into the state constitution by an anti-corporate Republican-turned-Progressive Party Governor in 1911) which could allow a new Governor to be elected to the nation's most populous state with far fewer votes than the current Governor actually receives to stay in office on the very same ballot. And, there's also the troubling matter that this election could have serious national ramifications. California's 88-year old U.S. Senator Dianne Feinstein may need to be replaced at some point before her current term ends in 2024. If a Republican, like Elder, becomes Governor and appoints a fellow Republican to her seat, control of the U.S. Senate would immediately revert to Mitch McConnell and the GOP.

So, yes, this CA Recall, as dumb as it is, matters. And it's important for progressive voters to pay attention, fill out a hand-marked paper ballot, and hopefully deliver it in person to a polling location or a drop-box by September 14th.

Finally, speaking of rightwing talk radio hosts, we've been reporting on a number of them who used our public airwaves to spread disinformation about COVID deniers and its vaccines, before finding themselves hospitalized or killed by the disease in recent weeks. One of them we've covered since his hospitalization in mid-July is Nashville's popular, nationally-syndicated Phil Valentine. After spending months mocking the seriousness of the virus and making fun of the life-saving vaccines, Valentine was announced dead over the weekend, after weeks on a ventilator, on what was reportedly his 62nd birthday...

[UPDATED] Sometimes we get what we deserve...

UPDATE 7/24/2021: No sooner did I post this item at the beginning of what I'd hoped would be a somewhat celebratory bday week, then my hard drive crashed on my main computer. Incredibly, we were somehow able to get three BradCasts up and on air Monday through Wednesday anyway, even as my hard drive tried to fix itself.

Miraculously, as I thought it was a goner and was ready to toss in the towel by Thursday, it finally showed some signs of life that morning after a couple of desperate tricks or two. I was able to reboot enough to get some of the most important things off of it, and have otherwise been rebuilding from scratch on a new drive since then, in hopes of returning to the real world in time for Monday's show. (HUGE thanks to Nicole for, once again, saving my butt and sitting in for us on Thursday and Friday!)

All of this is a long way of apologizing for my absence over the past week, especially to those who'd sent emails expecting a reply and particularly to those who were kind enough to respond to my birthday plea for donations! You might have expected a "thank you!" email by now, and would have received one, but for the fact that I couldn't answer email all week pretty much until sometime around 2am on Friday night/Saturday morning!

We're standing down for a short, if much needed, respite --- at least from The BradCast and Green News Report --- until after the 4th of July holiday. It may otherwise be quiet around The BRAD BLOG until then, save for Sunday Toons and, well, who knows if anything moves me enough to stop not paying attention for a few days to blog about it. Guest: Coalition for Good Governance's Marilyn Marks on that and separate challenge to state's 100% unverifiable touchscreen voting...

On today's BradCast: With virtually every new voter suppression law adopted by Republicans at the state level since last November's election (there have been about 24 such laws adopted so far, in some 14 states), Democrats and voting rights advocates have been quickly filing lawsuits in opposition. One of those suits --- filed in federal court [PDF] against Georgia's SB202, the one in which I am named as a Plaintiff --- is to have its first major hearing next week. That, as Democrats in the U.S. Senate frantically scramble to get the last Democratic holdout (Joe Manchin) to come on board for federal legislation to counter at least some of the most restrictive elements of the tidal wave of new GOP anti-voting laws at the state level. While the Jim Crow-style voter suppression of the new restrictions being adopted in Republican-controlled states of late have received a fair amount of attention, the provisions in those measures that would allow GOP state legislatures to take over elections --- and even overturn legitimate results --- have received less attention. Over the weekend, the New York Times highlighted, for example, how in "Georgia, members of at least 10 county election boards...At least five are people of color and most are Democrats" have been removed from their posts in recent weeks, "and they will most likely all be replaced by Republicans."

Georgia is not the only state where this is happening. Similar provisions, targeting election officials and even election results, have also been adopted or introduced in states like Kansas, Arkansas and the critical swing state of Florida. But in Georgia, they go even further to target and/or threaten the media itself for simply reporting on elections!

That's where I come in. I am the named plaintiff representing journalists in the Coalition for Good Governance (CGG) lawsuit challenging Georgia's SB202 in federal court. An emergency Motion for Preliminary Injunction [PDF] has now been filed in regard to the media-related aspects of CGG's complaint, in light of the state's impending local election runoffs scheduled for July 13th.

I'm joined once again today by longtime Election Integrity champion MARILYN MARKS, Executive Director of CGG, to discuss why the Press Freedom aspects of her group's broad challenge to the GA law --- far broader than some of the other challenges focused more on the voter suppression aspects only, as filed by the NAACP, the Democratic Party, and Stacey Abrams' Fair Fight, etc. --- have been bumped to a top priority with her filing of an expedited Motion for Preliminary Injunction.

Among the little-reported-on Press Freedoms at stake in SB202, the new law includes a Gag Rule which criminalizes the public, party-appointed monitors and the press’ reporting of absentee mail ballot processing or tabulation problems; A ban on the press Estimating (yes, estimating!) the number of absentee ballots that have been processed during an election tabulation or how many are still to be processed; SB202 even criminalizes photographing voted ballots or the 100% unverifiable touchscreen Ballot Marking Device (BMD) voting systems that voters are now forced to use at all Georgia polling places, despite the state's century-long history of routine press photography and videography of election activities inside of polling places on Election Day. (Yes, the photo used above for today's show logo, or even seeing those voters voting, can now result in felony charges in GA!)

All of these, as Marks and I discuss, are extraordinary restrictions on basic Press Freedoms, and our ability --- my ability in this case, as the named plaintiff, representing media --- to report what is going on during Georgia elections to the public. The law actually turns simply seeing one of the state's huge new touchscreen voting systems, while it's being used on Election Day, into a felony. That would apply not only to media inside a polling place, but also to poll workers, poll watchers and even voters simply waiting in line to vote.

"We are asking the court to address some of these issues before that runoff election [on July 13] happens. We are going to ask the judge to rule in favor of the press," says Marks, hoping that some other media outlets may even submit their own Amicus Briefs to the court in support of CGG's lawsuit. "Other members of the press are quite concerned about the fact that traditional photography, that they have been taking for decades, is not going to be permitted in the mail ballot processing locations," she tells me.

"It is mind-blowing," she continues. "I wouldn't be able to tell you [if I saw something wrong while serving as an observer]. All of a sudden, your reporting is going to be silenced. You would not even know that I had anything to tell you. You would just assume that, unlike in times past, that everything is going fine in Georgia."

Marks also breaks a bit of news by explaining that the Republican National Committee has now moved to intercede in this case to help defend GA Sec. of State Brad Raffensperger's position on the bill. Marks says Raffensperger "essentially insisted on these provisions. Although some of the media consider him to be some kind of a saint [because he declined to overturn the November 2020 election amid entreaties from Donald Trump to do so], this is his bill. His attorneys drafted it. He's the one that wants to crack down on any criticism coming from people like you and me, CNN, New York Times, or any other place."

"The RNC has asked to intervene in our case to protect the Secretary of State. However, interestingly, they have said they are not going to oppose us on the Observation Felony, the Gag Rule, the Estimating Ban, the Photography Ban --- so even the Republicans are not going to try to defend four of these five things that we're going after" in the Motion. A hearing is now set on that Motion for Thursday, July 1.

In addition to CGG's lawsuit challenging SB202, the group has another, separate, longstanding challenge to the state's use of 100% unverifiable touchscreen voting systems. That suit was successful in convincing the federal judge hearing it to ban GA's 20-year old Diebold touchscreen systems before last year's elections. Unfortunately, Raffensperger immediately replaced them with new touchscreen Ballot Marking Devices made by Dominion Voting Systems, which Marks describes as as bad or worse than the previous systems. That case has just now entered its discovery phase and Marks is confident that the same federal judge is quite concerned that the new systems are as insecure, unverifiable --- and, thus, as unconstitutional --- as the old ones she previously banned. A ruling in that case could affect the use of such machines in dozens of states and counties around the country, including states like Pennsylvania, North Carolina, South Carolina, Ohio, Texas and even here in Los Angeles County, where voters are now forced to vote on unverifiable touchscreen systems at polling places.

Lastly, Marks describes the exciting forum scheduled for tomorrow (Tuesday, June 22), co-sponsored by CGG and another one of our favorite non-partisan good-government watchdog groups, Free Speech for People (FSFP), on the dangers of Ballot Marking Device (BMDs) as used in Georgia and many of those other jurisdictions mentioned above. The forum, called "Today's Electronic Voting Machines: An Examination of the Use and Security of Ballot Marking Devices" is scheduled live and online from Noon to 5pm ET on Tuesday. It features a huge number of guests that have been featured over the years on 'The BradCast', including FSFP's Susan Greenhaulgh; Georgia Tech cybersecurity expert Rich DeMillo; notorious University of Michigan white-hat hacker, J. Alex Halderman; Research expert Kevin Skoglund; UC Berkley's Philip Stark, inventor of the post-election Risk Limiting Audit protocol; the legendary Finish cyberseucrity and voting systems expert Harri Hursti, and many others.

Finally, Democrats are teeing up a test vote on Tuesday in the U.S. Senate for their sweeping election and campaign finance reform bill, the For the People Act, now that West Virginia Democrat Joe Manchin has suggested he may be willing to support a compromise version with the 49 other Senate Democrats who have all already signed on to the original bill as co-sponsors. White House Press Secretary Jen Psaki was asked today about President Biden's expectations for that bill and its test vote today, and on the need to reform the filibuster even if Manchin deigns to come aboard. If he does, he would also have to be willing to make changes to the filibuster rule that mandates 60 Senators support such measures, in order to see passage, since no Republicans are expected to support it. But he is not the only Democrat who has opposed long-overdue changes to the filibuster. Arizona's Kyrsten Sinema has also vowed to protect the anti-democratic, Jim Crow-era Senate rule. And now she is being targeted with a huge ad buy for that position, to ratchet up the pressure, by a group of progressives who are running spots in her home state on cable news, as well as during local news and sports programming.
