Guest: Matthew Menendez of Brennan Center for Justice
Plus: Rain in L.A.; Rightwing Aussie PM ousted; GOPers for climate action; Liberty U. students respond to Sanders...
By Brad Friedman on 9/15/2015 5:16pm PT

On today's BradCast: The most incredible, embarrassing nonsense you may not have even heard about is going on in the otherwise great state of Kansas, thanks to their extremist rightwing Republican legislature and Governor Sam Brownback.

But, first, it rained in Los Angeles today! Yes, amidst a record 500-year drought, rain actually counts as news these days. I explain, along with Desi Doyen who was also there to witness it. (Oh, and here's that harrowing fire footage we described in today's show.)

As if that's not crazy enough, a group of House Republicans are introducing a resolution that calls for climate action in advance of Pope Francis' visit next week and historic address to Congress, in which he is expected to make the case for taking action to curb global warming (and, also, in favor of the Iran peace deal.)

And that's not the only good news today. Australia's crazy rightwing Prime Minister Tony Abbott was ousted last night in a late night coup by his own party, paving the way for a new Prime Minister who actually believes in stuff like climate change and marriage equality!

But then, of course, our main topic today: More on what the hell is the matter with Kansas. Brennan Center for Justice's Democracy Program attorney Matthew Menendez joins us for an update on the cases he (and a number of other groups) have filed against Brownback on the heels of legislation the Governor signed that would defund the entire state Judiciary system if the courts have the temerity to strike down Brownback's legislation concerning education funding and restructuring (rigging) the judiciary.

"What they passed says if the outcome in a particular lawsuit came out a particular way, then the entire judicial appropriations was no longer valid," Menendez explains. Well, guess what? The court has just found against the state! So, now what?

"This is very troubling," Menendez tells me, detailing how the plaintiffs have been forced to seek a stay on the court's ruling (in their favor!) in order to keep the GOP law from kicking in and defunding the entire court! "In America, where we firmly believe --- or profess to --- in separation of powers, it's essential that judicial salaries not be threatened if legislators disagree with one of their rulings."

So much for the "conservative" belief in the Constitution's co-equal branches of government. Menendez tells me what has just happened in KS, where the cases are now, and what is expected to happen next in what he says could turn into "just a complete constitutional crisis."

Finally, on yesterday's program we played some of 2016 Democratic Presidential candidate Bernie Sanders' remarks at Jerry Falwell's Liberty University as he attempted to reach out and find common ground with some of the 12,000 "conservative" students in attendance. Today, we hear from some of those students as they react to Sanders' speech. Suffice to say, reaching out to those who think they don't agree with you may be a very wise thing to do in today's divided and divisive media world.

With military analyst Harlan Ullman & former AIPAC staffer M.J. Rosenberg
PLUS: Climate change hits home (again); Sanders speaks at Fallwell's Liberty University...
By Brad Friedman on 9/14/2015 5:48pm PT

On today's BradCast, the politicization of the Iran peace deal by Israel and the Right in the U.S. is having serious consequences for both.

Military analyst, adviser, author and former naval commander Harlan Ullman --- credited with creating the 'Shock and Awe' doctrine (no Leftie peacenick, he!) --- joins me to explain why he believes the Iran deal is "potentially a strategic game-changer for the positive," and how Republicans and Israel are both wrong to oppose it.

"This agreement, if it is enforced and if it works, gives all sorts of strategic opportunities that will make the entire world safer," he tells me. "For whatever reason, Republicans and [Israeli Prime Minister] Benjamin Netanyahu don't want to accept that, in large part because of their hatred and disagreement with the Obama Administration."

He believes "a more objective view needs to prevail," but warns that the Obama needs to take special measures to ensure the deal remains enforced. (While I agree with Ullman on the issue, in general, you'll see that there is much we do not agree about when it comes to just about everything else! So, I'm happy to find common ground with him on these points!)

Then, former American Israel Public Affairs Committee (AIPAC) staffer, turned senior Congressional staffer, turned columnist M.J. Rosenberg, joins me to discuss his recent column on the fall of the nation's once-most powerful Jewish lobby which, after spending millions to try and defeat the Iran deal, may have succeeded only in destroying itself. He explains why he believes that AIPAC made a fatal miscalculation in turning the fight against the agreement into a partisan issue. In the process, Rosenberg says, they have severely weakened the bi-partisan power they once wielded in both Congress and at the White House.

Until now, he tells me, both Republicans and Democrats in the House and Senate would "just roll over and play dead when Israel, the Israeli government or AIPAC wanted anything. If AIPAC says 'vote no', you vote no." But those days, he believes, are now over and that's good news, as he describes it, for both Palestine and Israel. He goes on to note that the group no longer represents "the way most American Jews think" and now serves the interests of only "right wing Jews in Israel and right wingers here. Peace is not something that they believe in."

Two fascinating conversations on today's show!

Also on today's BradCast: Bernie Sanders seeks 'common ground' as he speaks to 12,000 students at Jerry Falwell's Liberty University; Climate change consequences continue to hit home, from massive rainfall in Japan to massive wildfires now devastating huge swathes of Northern California...

Guest: NatSec journo Shane Harris on his startling Daily Beast exclusive
Also: New Presidential politics and polling news and MUCH more today...
By Brad Friedman on 9/10/2015 6:11pm PT

Today's BradCast is packed with news from top to bottom. Please buckle up before listening.

First, Big Oil's deceptive scam in California (as discussed on yesterday's show) has succeeded, for now, as Dems pull landmark legislation that would have called for a 50% cut in petroleum usage in the state.

Then, new polling finds Bernie Sanders overtaking Hillary Clinton now in Iowa, as well as New Hampshire, while the party's internecine battle over more debates continues. On the GOP side, candidates not named Trump are flailing as they desperately try to get attention. It's not working --- neither is their lost hopes of scuttling the Iran peace plan.

Next, author and national security correspondent Shane Harris joins us to discuss his disturbing new exclusive at The Daily Beast on 50 U.S. intelligence analysts now reportedly charging that the U.S. has been "cooking" its intel on ISIS.

The still-unnamed military intelligence analysts working for CENTCOM, as Harris explains, are reportedly seeing some of their own reports manipulated by higher-ups. "Key pieces of [their analyses] that they feel are very important [are being] taken out, not given the proper context, [and] in some cases making it look like ISIS and al Qaeda are weaker than these analysts actually believe they are."

So are these charges akin to the way intel on Iraq and WMD was manipulated by the Bush Administration in the 2002/2003 lead-up to war, as revealed by the notorious Downing Street Memos ("the intelligence and facts were being fixed around the policy")? Or are these claims more akin to the hyperventilation over unsubstantiated allegations from the Right concerning Benghazi?

Harris tells me his reporting suggests it is more likely the former than the latter, though it remains unclear who is behind the alleged manipulation of intel and how high up it might go, even if proven true. "What I think is notable is that these 50 --- actually 52 --- professionals who are doing this every day, to go against their bosses, to take this to the IG is a very bold move. They feel very strongly that they have a case," he explains. "I've never seen anything like this. Usually whistle-blowers are in ones and twos, but for a group of people en masse to complain like this is certainly unique in my experience as a reporter."

We discuss who may be behind the alleged "cooking" of the intel and whether President Obama or the White House is somehow directing all of this as the Bush/Cheney Administration was doing in the case of the manipulated intel on Iraq. Tune in for Harris' response to those questions and many others, in what seems, at least as of now, a startling, if still-developing story.

Finally, our latest Green News Report is also a very busy one today, and not only because it includes several fresh examples of Sarah Palin's unparalleled ignorance...

More than 600,000 lawfully registered voters will be disenfranchised during 2015-2016 elections unless the 5th Circuit Court promptly acts...
By Ernest A. Canning on 9/9/2015 1:43pm PT

Early last month, a three-judge, U.S. 5th Circuit Court of Appeal panel affirmed the lower District Court's finding that Texas' draconian polling place Photo ID restriction (SB14), which threatens to disenfranchise 608,470 legally registered voters (and many others not already registered), violates federal law.

That ruling marked the third occasion in which a federal court has expressly found that the TX Republicans' strict ID law disparately impacted minorities and the poor. "Hispanic registered voters and Black registered voters," the 5th Circuit appellate panel observed in their recent ruling, "were respectively 195% and 305% more likely than their Anglo peers to lack [the requisite Photo] ID" now required to cast a vote at the polls under SB 14.

While the ruling ostensibly struck down SB14, finding it in violation of Section 2 of the Voting Rights Act (VRA), as we have previously explained, those 600k+ lawfully registered voters remain at risk of disenfranchisement during this Fall's 2015 elections and the 2016 Presidential cycle because the appellate panel failed to lift an "emergency" stay of the District Court's original permanent injunction intended to prevent enforcement of an unlawful Photo ID statute.

The failure of the appellate court to lift the stay on the lower court's no-uncertain-terms ruling may not have been problematic if, as contemplated by the 5th Circuit decision's mandate, the case were to be promptly returned to the District Court, which it directed to re-examine a separate issue --- whether the TX Legislature had a "discriminatory purpose" when it enacted SB14. That prompt remand would have permitted the District Court to fashion an interim remedy. Indeed, in its decision, the appellate panel suggested that the District Court issue an order directing TX to accept valid voter registration cards, in lieu of a very narrow handful of state-approved Photo ID, for all voting-related purposes. The 5th Circuit panel also, perhaps somewhat naively, called upon TX to cooperate in the prompt fashioning of that remedy.

Oh, that silly 5th Circuit panel...

Guest: Wichita University's Beth Clarkson, PhD, on her theory and KS Sec. of State's attempt to block her citizen audit of touch-screen systems showing unexplained vote increases for the GOP in large precincts
Also: NM Sec. of State charged with 64 criminal counts...
By Brad Friedman on 8/31/2015 5:42pm PT

Whether statistician Beth Clarkson, PhD, head of Wichita University's National Institute for Aviation Research, is ultimately proven correct, today's must-listen, in-depth interview with her on The BradCast should remind us all, once again, why neither election officials nor voting systems are simply to be trusted.

Without the ability to carry out public oversight, democracy vanishes. That's what's happening right now in the state of Kansas, where Sec. of State Kris Kobach is attempting to block Clarkson's legal attempt to audit touch-screen voting system "paper trails" in Sedgwick County (Wichita), the state's most populous county.

Confirming a theory initially reported by two other statisticians in 2012 [PDF], Clarkson has found that computer-reported results from larger precincts in the state, with more than 500 voters, show a "consistent" statistical increase in votes for the Republican candidates in general elections (and even a similar increase for establishment GOP candidates versus 'Tea Party' challengers during Republican primaries). Those results run counter to conventional political wisdom that Democrats perform better in larger, more urban precincts.

The larger the precinct size, she explains on today's program, the higher the percentage of the vote for the GOP candidate. Clarkson finds "that is the case, and that is a relationship that is unexplained and very troubling." Previously, statisticians Francois Choquette and James Johnson found a similarly unexplained relationship while examining reported vote totals in Iowa, New Hampshire, Arizona, Ohio, Oklahoma, Alabama, Louisiana, Wisconsin, West Virginia and Kentucky.

Even more disturbing, in hopes of further testing her theory, Clarkson has filed a lawsuit under the state's public records act in hopes of auditing some of the so-called "paper trails" from the state's unverifiable touch-screen voting systems, but Kansas Sec. of State Kris Kobach (a long-time GOP vote suppression champion) is fighting her access to those records in court. Kobach's full response is here [PDF]. The response from the Sedgewick County Election Commissioner Tabatha Lehman is here.

Clarkson tells me she believes the statistical pattern she confirms in KS is evidence of rigged elections.

"There have been a few theories advanced," to explain the statistical pattern. "The one I find most probable is that the voting machines are being manipulated. Their vulnerability seems to me a fairly high-probability explanation for this particular pattern. It fits exactly what you'd expect to see if people are flipping the votes within voting machines."

While I've been skeptical of the general theory for some time, for reasons that I explain during the program, Clarkson makes a compelling case, particularly for the ability of the public to oversee their own elections by examining the voting systems in question. If the public is not allowed to examine the so-called "paper trail" of these god-forsaken machines, what good are they?

"Suspicion isn't proof," Clarkson is careful to note. "The reason I'm suing for the paper records is because an audit can provide proof. Statistics are not going to be convincing to most people over the long term because they don't understand the math, and you don't believe what you don't understand. But an audit is fairly straightforward and the results should be fairly definitive."

She adds that Kobach's attempt to keep her from examining paper logs and tapes makes little sense, particularly when they concern elections which are long enough ago that the results may no longer be officially contested. "Voting is important and we want to keep those records secure so we can be assured of the accuracy of the count. But they're so secure now, nobody gets to see them."

Also today, as if we needed yet another reminder of why neither electronic voting systems nor election officials are simply to be "trusted", on Friday, New Mexico's Republican Sec. of State Dianna Duran --- like Kobach, also a long time "voter fraud" fraudster --- was charged with 64 criminal counts related to embezzlement, fraud, money laundering, violations of the Campaign Practice Act, tampering with public records, conspiracy, and a Governmental Conduct Act violation.

(For longtime BRAD BLOG readers, the new charges against Duran may sound vaguely familiar.)

Former MD Governor turned Presidential candidate equates constricted debate to a 'decree of silence'...
By Ernest A. Canning on 8/31/2015 1:20pm PT

Standing at a podium before the Democratic National Committee (DNC), within arms length of DNC Chair and 2008 Hillary Clinton national campaign co-chair, Rep. Debbie Wasserman-Schultz (D-FL), former Maryland Governor and now a 2016 Democratic Presidential candidate Martin O'Malley slammed the DNC for what he described as an "unprecedented" effort to "rig" the 2016 nomination process. (See video of O'Malley's DNC speech below).

Speaking at the DNC's Summer Meeting in Minneapolis over the weekend, O'Malley described the Party's decision to severely constrict the timing and number of Democratic Presidential primary debates (six total, just four before Primary voting begins) as "cynical." The DNC edict also imposes a punitive exclusivity clause that would prevent any candidate from participating in the DNC-sanctioned debates if they took part in any other unsanctioned debate. This contrasts sharply with the 26 Democratic Presidential primary debates that took place during the 2007-08 election cycle --- a process that was described as "an important factor in underdog Barack Obama's victory" over then front-runner Hillary Clinton.

This time, the first Democratic Presidential primary debate has been delayed until Oct. 13, 2015 --- four days after the deadline for unaffiliated NY voters to register to vote in the state's April 19, 2016 Democratic primary. O'Malley added that the one debate in New Hampshire, now scheduled on Saturday, Dec. 19, has been "cynically wedged in the high point of the holiday shopping season so that as few people watch it as possible."

"Four debates and only four debates --- we are told, not asked --- before voters in our earliest states make their decision," O'Malley said. "This sort of rigged process has never been attempted before. One debate in Iowa. That's it. One debate in New Hampshire. That's all we can afford."

O'Malley's charge, and palpable tension with party chair Wasserman-Schultz at the weekend event, echo a familiar process of establishment party politicians looking out for what they perceive as their own best interests, if not that of rank and file supporters...

Guest: Journalist Colleen Kimmett...
By Brad Friedman on 8/28/2015 5:59pm PT

Both Hurricane Katrina and Cindy Sheehan's 'Camp Casey' protest outside of George W. Bush's Crawford, TX pretend-ranch took place 10 years ago this week. On today's BradCast, we commemorate both with some personal remembrances from our live on-air coverage of both events at the time.

First, where we are today: As Dubya came out from years of (justifiable) hiding today to speak at a rebuilt school in New Orleans, journalist Colleen Kimmett joins us to discuss the successes and failures of the privatized charter school system that was allowed to take over in New Orleans following the Katrina disaster.

Then we dig deep into the audio archives to revisit some of our on-the-ground, round-the-clock radio coverage of Sheehan's historic anti-war protest in August of 2005 --- including the remarkable on-air moment on Sunday evening, August 28, 2005 when we first received the jaw-dropping National Weather Service bulletin warning of Katrina coming ashore.

Both landmark national events intertwined on our radio coverage from 10 years ago, and, as we discuss on today's program, marked a key turning point for our nation, our wars, and the entire Bush Presidency.

Finally, our latest Green News Report looks back at Katrina's devastation, looks forward to NASA's new warning that at least 3 feet of sea level rise is now "locked in," and the new report from Citigroup finding that moving to renewable clean energy will actually be less expensive than sticking with our current fossil fuel status quo...

[Photo above of Jeff Keys, Cindy Sheehan and Joan Baez courtesy of "Alaska Gyrl" Kim Terpening, who happened to be on air with us in Crawford as the NWS bulletin came across the wires. And here are some of those photos I mentioned on the show today of Karl Rove happily glad-handing the pro-Bush, anti-Sheehan demonstrators in Crawford at the very same moment that Katrina was drowning New Orleans.]

UPDATE 8/29/2015: As 'PDiddie' (who expertly curates BRAD BLOG's Sunday Toons each week) reminds me in comments below, he was also in Crawford at the very same time! Also, too, see @NTXProgressive's fantastic Storify, which includes a bunch of great photos (including one of us) from the time capsule, documenting moments from 'Camp Casey' in Crawford --- and even as Katrina rolled ashore...

Standing up to the NRA after Roanoke & a horrifying U.S. gun death toll
PLUS: Denying global warming on Katrina's 10th anniversary; Trump's ugly nativism gets uglier; Good news for Dems in new poll; Marriage dead-enders in KY...
By Brad Friedman on 8/27/2015 5:53pm PT

On the heels of yesterday's horrific on-air murders in Virginia, and as guns claim one life every 16 minutes in the U.S., the father of one of the Roanoke victims vows to stand up to the NRA and "cowards" elected to office who fail to take action to help prevent gun violence. On today's BradCast we look at the numbers, the jaw-dropping death toll in this nation, and what, if anything might ever be done about it.

For the record, as WaPo details, we've now had 247 mass shootings in the 238 days of 2015.

Also on today's busy program...

• Louisiana's Republican Governor and also-ran 2016 GOP candidate Bobby Jindal pretends [PDF] global warming had nothing do with Hurricane Katrina as Obama comes to New Orleans to commemorate the 10th anniversary of the devastating storm.

• New national poll finds Hillary Clinton, Joe Biden and, yes, Bernie Sanders would all trounce Trump and the other GOP front-runners if the election was held today...and if we had a national election...and if all voters who wanted to vote were allowed to vote...and if those votes were actually counted and counted accurately.

• Donald Trump's ugly nativism gets even uglier as the Republican establishment gets desperate.

• Kentucky dead-ender County Clerk defies still more federal court orders and denies same-sex marriage licenses --- and all marriage licenses --- in her county, under the ridiculous premise of "religious freedom".

On today's live BradCast from the KPFK/Pacifica Radio Network studios in sweltering Los Angeles...

• Breaking news from today's on-air shooting in Roanoke, VA.

• Some fallout and followup from a few recent BradCasts. (The one we referenced with AT&T/NSA whistleblower Mark Klein is here. The one we referenced about the Malaysian Airlines flight shot down over Ukraine, with 27-year CIA analyst Ray McGovern, is here. The story about the illegal Texas voting restriction that is still disenfranchising voters even after being found illegal by three different federal courts is here. My interview about it with attorney Ernest A. Canning is here.)

• Why Donald Trump actually matters (and not just to Republicans) and why Democrats might think twice about being quite as gleeful about his potential (likely?) nomination.

• And then, a whole bunch of listener callers discussing all of the above and much more on today's live show.

• Finally, Desi Doyen joins us for the latest Green News Report on the heels of Planet Earth's hottest month in recorded history...

Guest: Journalist David Roberts of Vox.com...
By Brad Friedman on 8/25/2015 3:58pm PT

Over the weekend, supposedly moderate, supposedly reasonable 2016 GOP Presidential candidate Carly Fiorna discussed climate change --- for four long minutes --- with Yahoo News' Katie Couric. In the bargain, as climate journalist David Roberts of Vox.com noted, "everything she said was wrong." Really wrong.

Roberts joins me on today's BradCast to dissect Carly's clap-trap, and to discuss a new report from those lefty, environmentalist, tree-huggers over at Citi GPS (the research arm of Citigroup), finding that moving to clean renewable energy now, in order to try and help mitigate climate change, is ultimately less expensive for the world than sticking with our current fossil fuel economy status quo.

"Moderate Republicans have decided that outright science denial is no longer working for them," Roberts explain in regard to Fiorina's bizarre climate comments. "They've concluded that it makes them look old and cranky and backwards, and it's hurting them with young people and Latinos. So there's at least a small collection of Republicans who have started thinking 'How do we oppose doing anything without denying the science?' That's the dilemma that's in front of them. That's what Fiorina is trying to solve here."

The results, for the failed businesswoman and failed U.S. Senate candidate, as we discuss point-by-point --- from her silly claims to Couric about wind farms and birds, to the one about solar power requiring "huge amounts of water" --- were as disastrous as her failed reign as CEO of HP.

"Republicans have spent so long dug in on this stupid science debate over climate change," Roberts tells me, "they haven't bothered to notice or look around or educate themselves at all about what's going on in this area. So, now they are leaving science denial behind --- slowly but surely --- [and] wandering out into this territory where they know almost nothing. They're just stepping on rakes everywhere."

Summarizing Citi's new report, Roberts explains its findings this way: "It's basically, 'Do you do the same thing you're doing at enormous risk, or do you take this alternative route which costs about the same and avoids this enormous risk?' At the end of all this they basically say, 'Why would you not do this? It's got so many benefits and so little downside. Why aren't we doing that?' And, of course, why we aren't has everything to do with politics."

"If you want to say that the transition to clean energy is going to destroy the economy, then the burden of proof is on you at this point, because there's so much research saying otherwise," he adds during our wide ranging --- and kinda fun --- conversation!

Also on today's show: Glenn Beck's coming-soon tyranny apocalypse; Bernie Sanders and Donald Trump both continue to surge in New Hampshire polling...

Guests: Attorney Ernest A. Canning; Financial journalist David Dayen...
By Brad Friedman on 8/24/2015 5:45pm PT

First up on today's BradCast, financial journalist David Dayen joins us to explain why the Dow Jones Industrial average plummeted 1000 points over the past two trading days, whether or not you should be worried about it, and how the U.S. is missing a golden opportunity in the bargain.

Then, BRAD BLOG's legal analyst Ernest A. Canning joins us to explain why --- even after the 5th U.S. Circuit Court of Appeals recently found Texas Republicans' polling place Photo ID voting restriction to be discriminatory and illegal (just as the lower U.S. District Court did last year and just as the federal government did well before that) --- the GOP's voting restriction is, increcibly, still in effect anyway and may serve to disenfranchise some 600,000 lawfully registered (largely Democratic-leaning) voters during the 2016 Presidential election.

Canning wrote about the disturbing situation in detail last week in an article at The BRAD BLOG and explains the mess in brief on today's show: "It seems nonsensical to say a law has been struck down but it is still in force. But that's basically where we stand right now."

"This law has a discriminatory impact --- it disparately impacts minorities and the poor," he says, citing the Appeals Court's latest decision. "You now have this identical finding three successive times in court dating back to 2012, and here we are in 2015 and we're having to worry about whether that discrimination is going to occur again in 2016."

Also on today's BradCast: Texas health care situation is still among the worst in the nation; Trump wows 'em in Alabama; California is NOT in chaos (no matter what disinformed Republicans may tell you); And fall-out from my rant last week about the excellent new British government findings on the safety and efficacy of e-cigs; and more!...

Also: Bernie Sanders & ignoring corporate media are good for you too...
By Brad Friedman on 8/21/2015 5:46pm PT

No, I wasn't just blowing smoke when I told you many many months ago that vaping (quitting tobacco and moving to e-cigs) is a life saver and that those who were trying to restrict its use were helping to kill people unnecessarily.

A new independent expert study out this week, commissioned by the UK government's Public Health England (PHE), underscores exactly that, as we discuss at the top of today's BradCast.

As the new study finds, e-cigs are "around 95% less harmful" than tobacco cigarettes; there is no evidence that vaping is a "gateway" to tobacco smoking; horrible reporting has misinformed the public to believe that e-cigs are as dangerous as tobacco; vaping helps smokers quit and saves lives; and that public officials (shamefully, many of them Democrats!) should be encouraging smokers to move to vaping, rather than discouraging the use of e-cigs, since they are harming the public by doing so.

All stuff we've told you long ago. And here's another study, a major one, proving that The BRAD BLOG and The BradCast had it right to begin with.

Speaking of stuff we've told you long ago, we then move back to Presidential politics and how --- as we told you on the day he entered the race in mid-June (before almost anybody was taking him seriously --- they are now!) --- Donald Trump has blown up both the 2016 campaign and the Republican Party along with it.

Today's latest high-larious examples include both Jeb Bush and Scott Walker absolutely falling over themselves trying to figure out and/or flip-flop on their positions on immigration (and "anchor babies" and Constitutional birthright citizenship) and the latest embarrassment for now-disgraced Republican favorite Josh Duggar and the rest of his Republican Party.

Finally, we finish with an adult politician, Democratic 2016 Presidential candidate Sen. Bernie Sanders, and his extended response this week (you're welcome!) to corporate media failure in covering the substance of important campaigns and why he refuses to attack Hillary Clinton just to please them...

While its recent decision upheld a lower court finding that the state's Photo ID law was discriminatory, more than 600,000 lawfully registered voters could be disenfranchised in 2016 anyway...
By Ernest A. Canning on 8/21/2015 6:35am PT

The recent decision by a unanimous three judge panel of the U.S. 5th Circuit Court of Appeal in Veasey v. Abbott was greeted as "very good news." After all, it marked the first occasion in which a federal appellate court made an express finding that a state-enacted polling place Photo ID law violated the provisions of Section 2 of the Voting Rights Act (VRA).

The appellate panel affirmed the lower U.S. District Court's finding late last year that a Texas polling place Photo ID law (SB 14), which threatened to disenfranchise 608,470 already legally registered voters (and many others not already registered), disparately impacted minorities and the poor. "Hispanic registered voters and Black registered voters," the 5th Circuit appellate panel observed in their recent ruling, "were respectively 195% and 305% more likely than their Anglo peers to lack [the requisite Photo] ID" now required to cast a vote at the polls under the Texas law.

This was the same conservative appellate panel whose "emergency" stay of the lower court's injunction on SB 14 last year, in all likelihood, helped to facilitate the illegal disenfranchisement of as many as 600,000 lawfully registered voters during the 2014 mid-term election. That "emergency" stay was subsequently affirmed by a sharply divided Supreme Court, whose right-wing majority elevated the risk of confusion that could arise by an eleventh-hour, court-ordered change in election laws above the risk that hundreds of thousands of lawfully registered voters could be illegally disenfranchised by reason of the Texas Photo ID law. Both the 5th Circuit and the SCOTUS majority handed down that ruling, although, at that point, neither court was in a position to contest the District Court's finding that SB-14 not only violated Section 2 of the VRA but that the Photo ID statute had been enacted for a discriminatory purpose.

The SCOTUS decision last year, as The BRAD BLOG observed at the time, belied the contention made by the Supreme Court majority in Shelby County v. Holder, the 2013 case that gutted the VRA, that their destruction of Section 5 pre-clearance requirements for new election laws in states with a history of discrimination, "in no way affects the permanent, nationwide ban on racial discrimination in voting found in [Section] 2." In truth, per last year's decision, racial discrimination in voting will be allowed in those cases where a court order upholding that "ban" is issued too close to an election.

This case provided a classic example of the damage wrought by the gutting of Section 5. Prior to Shelby County, Section 5 mandated that Texas prove that its Photo ID statute woulds not have a disparate impact on minority voting rights before the Photo ID law could take effect. In 2012 a unanimous three-judge panel of the D.C. Circuit Court of Appeal refused to grant Section 5 pre-clearance to Texas' SB 14 precisely because of its disparate adverse impact upon minorities and the poor. Absent the Supreme Court's troubling decision in Shelby County neither the current, ongoing costly litigation on SB 14, nor the mass 2014 disenfranchisement would have ensued.

The new 5th Circuit panel's decision affirms that SB 14 has the effect of discriminating against racial minorities and the poor. Yet it failed to lift a stay that it imposed on a supposed "emergency" basis. Instead, it vacated the District Court's "discriminatory purpose" finding and remanded the case back to that court for further adjudication....
