Today on The BradCast: As the year grinds toward another bizarre, unbalanced close, America tries to pick up the pieces and keep moving forward. So do we. [Audio link to full show is posted below.]

Among the stories covered on today's program...

  • On the heels of Sen. Joe Manchin's stunning weekend announcement that he was breaking his promise to the President and his party to support the Build Back Better Act, which includes nearly $600 million to fight climate change and help coal miners in Manchin's home state, the nation's largest mining union is hoping that the West Virginia Senator will reconsider his decision. Among the funds in BBB is money earmarked for victims of black lung disease as well as tax incentives to help ex-miners from the dying industry and to protect its union workers. While Manchin makes millions from the coal industry via the coal brokerage firm he founded, which is now owned by his son, he doesn't appear to give a damn about the industry's actual miners.
  • A few additional thoughts today on why the corrupt Democratic Senator from West Virginia --- who is killing the most progressive climate and social spending agenda in the nation's history (after every single Republican in Congress has refused to support it in anyway) --- is still needed in the Democratic caucus. For a start, without him, there would have been no American Rescue Plan (which sent $1,400 checks to Americans earlier this year, expanded the Child Tax Credit program to send $300 per child each month to parents, and helped get hundreds of millions vaccinated), nor would President Biden have been able to seat a record number of federal judges in the first year of his Presidency. Without Manchin as a Democrat --- love him or hate him --- Mitch McConnell and the Republicans would be in the Senate majority right now and none of Biden's many critical accomplishments to date would have happened.
  • So, why did Manchin decide to break his promise to his party and the President on BBB? Steve Clemons reports that while negotiations between the two Joes had been moving forward, even if slowly, the thin-skinned Senator didn't like being singled out by name in a statement from the White House --- even though the statement was largely encouraging about the state of negotiations. Lame. But we think that even that explanation is likely little more than excuse for Manchin's betrayal. We explain why.
  • Next, the remarkably transmissible Omicron variant of the coronavirus is spreading at an absolutely unfathomable speed in the U.S. just before the Christmas holiday, according to the latest CDC numbers out this week. In little over a week, it appears to have gone from just 3% of cases to 73% of cases nationwide, all but edging out Delta entirely. There are one or two possibly encouraging pieces of news about the new variant, but it will still be a matter of weeks before we know if those potentially reassuring points will come to pass. In the meantime, a whole bunch of people are going to get sick and many are likely to die. Almost all of those who get severely ill and face both hospitalization and death will be those who refused to (or couldn't, for legitimate reasons) get vaccinated, including with a critical booster shot.
  • Among those who received a booster shot recently --- in secret --- is former President Donald Trump. That, after suggesting in September he was unlikely to get one. Turns out he's a liar. Who knew?
  • Amidst the disturbing news of Omicron's lightning surge, and the hospitals that are likely to become overwhelmed very shortly across the nation (many already are), President Biden addressed the nation from the White House on Tuesday afternoon. He shared the Administration's plans to try and minimize the coming damage. Biden announced that the federal government will spend more than a billion dollars on free home COVID test kits; instructed the Pentagon to be prepared to deploy more than 1,000 National Guard troops to help overcrowded hospitals handle the coming testing, infection, and hospitalization surge; is activating FEMA to deploy additional hospital beds where hospitals are overrun, and to have ambulances on standby to help transport patients from one overrun hospital to another where a bed may be available. He reiterated the need for everyone to get vaccinated and explained what families should and shouldn't do over the coming holidays. We share his address in full today, and offer a few thoughts in response.

If you're feeling a bit nauseous of late, hopefully it's not COVID. But it could very well be the effects of trying to keep up with the roller coaster of federal court rulings we've been reporting on The BradCast of late. Or it could be due to trying to keep up with the President of the United States changing moods every few hours these days, as he vacillates between vindictiveness and desperation just over two weeks from Election Day. [Audio link to today's full show follows below summary.]

On Thursday, Donald Trump refused a request from the Governor of California for a Major Disaster Declaration following the spate of record wildfires we've seen in the Golden State over the past month, amid record heat and drought fueled by climate change. Some 8,500 fires this year have resulted in more than 4 million acres burned this year alone --- twice the all-time record for the state --- with nearly 2 million acres scorched in six major wildfires over just the past month. A thousands structures have been leveled and 31 people have died in recent blazes, as five of the six largest fires in California history have taken place this year.

But Trump --- who despises California because we don't vote for him --- has long threatened to cut off FEMA emergency funds to the state, dismissing climate change as a cause, citing leaves and dead trees as the reason for the massive fires and demanding better forest management in the state. That, despite the fact that the vast majority of California's forests are federal lands, which are supposed to be managed by....the Trump Administration.

White House spokespeople spent Friday morning explaining that California's request for federal aid "was not supported by the relevant data that States must provide for approval and the President concurred with the FEMA Administrator's recommendation" against it. That recommendation, however, according to Trump's former DHS Chief of Staff Miles Taylor over the summer, was ordered by a cruel and vindictive Trump himself. But by Friday afternoon, just before air time, someone must have pointed out to Trump that more of his voters live in California than in any other state in the union. Or, they just told him how bad he looked, just over two weeks from Election Day, in refusing federal aid to people who have lost everything due to no fault of their own, especially in a state which had been running a $5.6 billion budget surplus until Trump's disastrously bungled response to the coronavirus resulted in a $54 billion deficit here instead.

It's clear that Donald Trump doesn't even care about his own voters, if they live in a state that won't help him win a second term. He cares about only himself. Period. But, whatever it takes. We're happy for the late breaking news that he finally reversed his cruel idiocy moments before airtime today.

Keeping up with the roller coaster of Trump's mood swings, however, is only marginally less nauseating than keeping up with the roller coaster of recent federal court rulings on voting rights this year! As we've been reporting over the past several weeks, in state after state after state, lower courts have general found in favor of efforts by Democrats and voting rights advocates to make voting easier and safer during the pandemic, as the Trump Campaign and Republican Party have sued virtually everywhere to prevent that from happening. But time and again, well-reasoned, Constitutionally sound rulings by U.S. District Court judges have been overturned at the appellate and Supreme Court levels, often in deference to state legislatures, or simply because SCOTUS has decided its too late to change an election rule or law, even not doing so might disenfranchise tens of thousands of voters in violation of federal law and the Constitution itself.

As University of Kentucky election law professor JOSHUA A. DOUGLAS, author of Vote for US: How to Take Back Our Elections and Change the Future of Voting, asks this week in a CNN editorial, if the courts are supposed to protect the right to vote, why aren't they doing so?

Good question, which Douglas joins us to discuss on today's program. He also has some good, if troubling answersto that question, which Amy Coney Barrett will not be making any less troubling when her SCOTUS confirmation is rammed through the U.S. Senate to seat her on the High Court before Election Day.

"It is frustrating," he tells me, "because the Constitutional right to vote is supposed to be one of our most foundational precious rights, and the courts are supposed to be a check on legislative majorities that try to rig the system, rig the rule of the game to keep themselves in power. That's the whole point of judicial review in these Constitutional cases involving voting rights, and the courts are refusing to do that right now."

But Douglas has good suggestions as well, for how we can begin to correct this sickening course that has resulted, in no small part, from the packed rightwing courts which have been stripping more and more rights from voters over the past decade or so.

"Congress does have the Constitutional authority to regulate elections in a lot of ways under Article 1, Section 4 of the US Constitution, referred to as the Elections Clause," he argues, "which gives states the first right in regulating elections, but says Congress may also alter or amend those regulations." Moreover, he continues, "we have to think on a long term strategy on enshrining the Right to Vote as a textual matter in the US Constitution. Because if these judges are 'textualists', then having explicit language conferring the right to vote, which the Constitution does not currently have, is a much stronger legal argument."

Finally, Desi Doyen joins us for our latest Green News Report, which --- speaking of Barrett --- examines the apparent climate science denialism of the Justice-in-Waiting, as revealed during her Senate confirmation hearings this week. And, just before we finish up today, the breaking news that the U.S. Supreme Court will be deciding whether Trump may violate the Constitution by excluding undocumented immigrants from Congressional apportionment following this year's decennial U.S. Census...

On today's BradCast: How bad is Donald Trump's Administration response to the COVID-19 crisis? Bad enough that "a guerrilla network" of high school kids seem to be doing a better job of getting some much-needed life-saving protective gear to medical workers than the federal government itself, at least in one state so far. [Audio link to show follows below.]

If you tried to fail any worse than the Trump Administration and his GOP acolyte Governors around the nation (Hello, Florida's Gov. Ron DeSantis!), you'd be hard-pressed to fail as thoroughly as Trump has managed to, in virtually every aspect of the COVID-19 crisis. His deadly incompetence is continuing to help drive up infection rates, hospitalization rates and deaths in the U.S., even now, some five months into the pandemic. In Florida, the state's incompetent and very Trumpy Governor is at least finally admitting that they do not have nearly enough rapid tests to keep up with the explosion of new cases in the state after DeSantis reopened opened businesses far too early in the spring. But, even as FL hit a national record on Sunday of 15,300 newly confirmed cases in a single day on Sunday (more than most entire nations!), he continues to keep hospitalization rates a secret, despite promising last week to begin reporting them transparently to the public.

For their part, the Trump Administration is at least pulling back on one element of their shambolic crisis management. After being sued by 17 states this week, the Administration has walked back its vow to withdraw visas from foreign exchange students attending schools which refuse to open their classrooms to deadly in-person classes five days a week beginning next month. Other than that, the Administration response continues to go from horrific to even more horrific, if that's even imaginable.

NBC News reports today that, according to internal Health and Human Services documents they've obtained, shortages of Personal Protective Equipment (PPE) persist across the country as cases and hospitalizations and death rates continue to surge in major metropolitan cities and rural areas alike. The Strategic National Stockpile and Federal Emergency Management Agency (FEMA) are still only able to fulfill about 30% of the requests for PPE for front-line medical and long-term care facility workers across the country, according to the federal documents, despite the President's ability to invoke the Defense Production Act to commandeer manufacturing facilities to meet the nation's needs.

Meanwhile, some high school kids in Atlanta, Georgia have taken it upon themselves to actually do something about the problem. We're joined today by SHOURYA SETH, high school senior and Chief Operating Officer for Project Paralink, a grassroots organization built with his friends to combat the coronavirus pandemic with the decentralized production producing and distribution of PPE to health workers. So far, they've managed to manufacture and donate more than 420,000 units of PPE, from face-shields to masks to more than 1,500 locations.

They've also gained some corporate support for their efforts, which are now joined by nearly 1,000 volunteers in the work to distribute much-needed protective gear in at least four states, to date. Seth says they have distributed to Georgia, Florida, Tennessee and Alabama, though he tells me today they've recently begun working with California, New York, New Mexico and the Navajo Nation as well, for what they describe as "decentralization for social good" and "localized disaster relief".

Recently, he explains, "some hospitals had gone back to the position where they were only left with one week of supplies. And it was just, you know, really frustrating to see that the federal government was not doing anything about it." The project's ultimate goal, Seth explains, is to replace, or at least augment, FEMA's efforts with "Parapod Relief Stockpiles" all over the nation. He describes the project as "a guerrilla network of sorts [to] get the PPE supplies delivered faster than the federal supply chain." He also tells me that Paralink has already even outpaced FEMA in at least one respect in Georgia.

"Recently we actually passed FEMA in the donation of face shields," says Seth. "We didn't really see any coordination, at least on the gubernatorial level or the city level. On June 11th, FEMA put out a public press release, giving out state-by-state PPE data. When we looked at Georgia, what we found out was that FEMA had, at that time, only been able to produce 189,000 face shields, while we had been able to produce 370,000 face shields, essentially doubling the output. And the funny part is, some of the donations we made were to FEMA! So while we had been overproducing we had also been donating to FEMA!"

Seth tells us how how the project came about as an effort to improve food delivery logistics before the COVID crisis struck. They then decided to modify their algorithms to turn to PPE manufacturing and delivery.

"Just before the surge of cases, we started to notice a very, very slow downward trend in the cases. And we realized a lot of people, like Dr. Fauci, were talking about a second wave of the pandemic coming during the winter. We wanted to create the stockpiles in states to prepare for the future," he says. "A lot of the Republican-controlled state governments were ignoring those warnings, but we understood according to virologists, according to common sense, the cases were going to rise again." So, they sprung into action.

Seth also offers his own feelings about whether schools should be opened for in-person classes, as the Administration is now insisting upon, and asks for your help in growing the project. "If you have any sort of questions, inquiries, or ways that you can help us out, reach out to us!"

So, if you're worried about the next generation, today's conversation is likely to make you feel much better about their ability to handle --- and fix --- so much that we've already screwed up for them.

Then, another bit of encouraging and progressive news, this time from the Joe Biden Campaign today. The presumptive Democratic Presidential nominee announced a massive climate plan aimed at combating climate change and spurring economic growth by overhauling America's energy industry with a proposal to achieve carbon-free renewable power across the entire country by 2035. The ambitious plan echoes that offered during the Democratic primary campaign by then rival Jay Inslee, Governor of Washington state. The ambitious progressive plan would more than doubles the resources and halve the time-frame that Biden had previously proposed during the campaign. The effort to tackle our climate crisis would also, as Desi Doyen explains today, serve as a massive infrastructure jobs engine to help the U.S. climb out of the pandemic, it's accompanying economic crisis, and systemic racism, as the proposal requires that 40 percent of the money spent on clean energy deployment goes to historically disadvantaged front line communities, which have been among the worst and first victims of the climate crisis. It's a New Deal-like proposal that some might even call a Green New Deal --- if that phrase didn't startle delicate Republicans so.

Finally, we close with our latest Green News Report, as the nation attempts to deal with an extended extreme heat wave amidst our coronavirus crisis; as oil and gas companies go belly up, while both leaving environmental disasters for tax-payers to clean up and making sure their executives get huge bonuses on the way out the door; and as one venerable environmental group goes all in on ad buys highlighting Trump's deadly, parallel denial of both COVID-19 and climate change...

COVID-19 surging in U.S. at record rates as hard evidence confirms that yes, Trump told his 'people' to 'slow the testing down, please'...

Seriously, at some point American officials will need to be prosecuted for mass murder for their criminal delinquency and deceit in dealing with the coronavirus pandemic, which has, so far, in just four months, cost the lives of more than 122,000 Americans. Those prosecutions should begin (if not end) with the man currently serving as President of the United States. That is particularly true in the wake of his criminal admission at his Death Rally in Tulsa last week, when he admitted that he told his "people...slow the testing down, please!" The White House later said Donald Trump was just joking, but when asked if he was kidding, he publicly admitted otherwise. "I don't kid," he said, "let me just tell you, let me make it clear." And we now have hard evidence on today's BradCast to prove that, perhaps for the first time, he was finally telling the truth. [Audio link to full show is posted below.]

On Wednesday, confirmed new coronavirus cases in the U.S. set a single day record of more than 38,000. At the same time, hospitalizations are rapidly increasing in a number of states around the country, including states such as Florida, Texas, Arizona and Oklahoma, where denialist Republican Governors reopened for business far too quickly, in direct contradiction to almost all health experts.

As states like New York, New Jersey and Connecticut --- hit hardest and earliest at the beginning of the pandemic --- have seen case numbers and hospitalizations plummet, they've instituted quarantine restrictions on travelers from some of the currently hardest hit states. As of Wednesday, the list included Alabama, Arkansas, Arizona, Florida, North Carolina, South Carolina, Utah and Texas.

When asked what he would say to the leaders of some of those states, including Florida, whose Republican Gov. Ron DeSantis had issued a quarantine on travelers from the NY metro area early in the pandemic (while failing to mandate appropriate restrictions in his own state), New York's Democratic Governor Andrew Cuomo said today: "You played politics with this virus and you lost. You told the people of your state and you told the people of this country, White House, don't worry about it. Just open up, go about your business, this is all Democratic hyperbole. Oh, really? Now you see 27 states with the numbers going up. You see the death projections going up. You see the economy going down. It was never politics, it was always science. And they were in denial."

Well, many of them are still in denial. And not just denial, but taking purposeful, affirmative efforts to lie to their people about COVID-19 numbers in their own states. The expert who ran Florida's once-lauded COVID-19 tracking website, but was fired because, she says, she refused to manipulate the data, sent out a warning this week. She charges that officials have been "instructed this week to change the numbers and begin slowly deleting deaths and cases so it looks like Florida is improving next week in the leadup to July 4."

In West Virginia, the state's Republican Gov. Jim Justice, a billionaire coal baron, has forced out the commissioner of the state's public health bureau because he didn't like the numbers she was reporting, as cases rise in at least 11 counties. He had previously lauded her at regular COVID-19 press briefings where she spoke. She was not at his latest briefing on Wednesday and released a statement upon her forced resignation that night, urging state officials "to stay true to the science".

Meanwhile, as the head of the U.S. Centers for Disease Control and Prevention (CDC), conceded that the infection rate in the U.S. is likely 10 times higher than the number of cases currently reported (that's 23 million probably infections, instead of the official 2.3 million reported as of today), states like Texas are seeing not just increased cases, but spiking hospitalizations, which have doubled over the past week. In Houston, ICU beds were 97 percent full by Wednesday. (In Florida, Gov. Ron DeSantis has barred hospitals from reporting those numbers anymore.) Even Republican Gov. Greg Abbott is now warning of the state's "massive outbreak", while still failing to mandate masking or even allowing local officials in Houston or anywhere else to do so on their own.

And yet, with all of that, Donald Trump really has told his "people" to "slow the testing down." Talking Points Memo's Josh Kovensky has been documenting the refusal by the Dept. of Health and Human Services (HHS) and the Federal Emergency Management Agency (FEMA) to approve extensions for federally funded testing at 13 sites across five states, including Texas. Where more than 40 such sites were once funded by the federal government across the country, only 13 sites remain, and they have been told by the Trump Administration that those resources will end on June 30th, despite desperate requests from officials in Texas, Illinois and Pennsylvania for the much-needed aid to continue.

That's just a taste of today's program, which raises the very serious question: Should these people be held accountable for the thousands --- perhaps tens of thousands --- of American citizens who are likely to die, thanks to their purposeful efforts to ignore science and health officials for purely brazen political purposes?

The deadly denial about the coronavirus is a fast-motion mirror of the Republican denial, for brazen political purposes, regarding climate change. Today we close with some accountability and/or attempts at accountability on that front in our latest Green News Report, in which Minnesota's Attorney General has now filed a consumer fraud lawsuit against Exxon, Koch, and the American Petroleum Institute, citing, by way of just one example, a "proprietary" document from Exxon warning about the dangers of "CO2 concentrations in the atmosphere...due to fossil fuel combustion" that "will cause a warming of the earth's surface" and "dramatic environmental effects before the year 2050." That prescient, on-the-money document is dated October 16, 1979, before Exxon went on to spend millions of dollars over decades to misinform the public that climate change due to the burning of fossil fuels was little more than a hoax. Desi Doyen joins us for that attempted accountability and a bit more that has actually succeeded in a refreshingly encouraging GNR today. And it comes not a moment too soon...

Among the stories covered today...

  • The deadly and dangerous fallout continues from Donald Trump's assassination of Iranian General Qassem Soleimani, with Democratic and Republican members of Congress from both the House and Senate, blasting the Administration for failing to provide evidence of an "imminent attack" which might have legally justified Trump's targeted killing of the second most powerful public official in Iran. Members who attended classified briefings by top Administration officials on Wednesday were outraged by the failure of those officials to provide the information they claimed they had regarding the killing. Without that information, Trump's targeted assassination of Iran's top military general was very possibly in violation of both domestic and international law. But are Democrats enraged enough to bring another article of impeachment over it?;
  • Not all Congressional members were upset by the classified briefing. Some, like Rep. John Rutherford (R-FL), charged that members such as Rep. Pramila Jayapal (D-WA), who claimed after the briefing that Trump "recklessly assassinated" Soleimani with "no evidence of an imminent threat or attack", was actually an "Ayatollah sympathizer" who was "divid[ing] our country" (Seriously. That's what he said. Rutherford's challengers this year are Donna Deegan and Christopher Eagle on the Democratic side, and 20-year Navy vet Dr. Erick Aguilar in the August Republican primary in the state.);
  • In related matters, as we surmised based on available evidence during yesterday's BradCast, U.S. officials today are now confirming their belief that the Ukrainian Airlines passenger jet that crashed minutes after takeoff from the airport in Tehran on Wednesday was, in fact, shot down by an Iranian missile. The crash killed all 176 on board just hours after Iran's non-lethal ballistic missile revenge attack on Wednesday in response to Trump's killing of Soleimani last week. Officials in the U.S., Ukraine and Canada (which lost 63 residents in the tragic disaster) believe Iran might have mistaken the passenger flight for a military response from the U.S. that night. Along with the 56 killed during a stampede amidst the massive funeral processions for Soleimani, the death toll of Trump's action has been extraordinary. How any of this has made Americans safer is anybody's guess;
  • In election news, a new, landmark study [PDF] was released this week by computer scientists, cybersecurity and voting systems experts at the University of Michigan. It finds that new, touchscreen computer Ballot Marking Devices (BMDs) --- which we have long been warning about, and which are now proliferating the country in advance of the critical 2020 Presidential election --- are "extremely unsafe" and vulnerable to undetectable hacking.

    Most alarming (at least to those who haven't heard the same loud warnings from BradBlog.com and The BradCast for many years now) is that the researchers found that in a mock election, where they had rigged the new voting systems to misprint a voter selection on the computer-marked paper ballot printouts, more than 93% of voters failed to notice that their vote had been changed by the computer! 93%!

    And yet, these all-new, vulnerable, 100% unverifiable touchscreen voting systems are now being deployed to battleground states like Pennsylvania and Georgia and North Carolina, and even to the nation's most populous voting jurisdiction, Los Angeles County, in advance of this year's elections! We explain the study's disturbing findings and what you can do to try and avoid having your vote lost to a touchscreen Ballot Marking Device in your home jurisdiction;

As my guest details on today's BradCast, it's not immigrants who are currently posing a threat to those living on our southern border, it's lawless federal agents encroaching on private lands to build an unnecessary and dangerous border wall. [Audio link to show is posted below.]

But, first up: the Department of Justice rounded up dozens of gang members and indicted them on Tuesday as part of a criminal conspiracy for "attempted murder, kidnapping, maiming, and conspiracy to distribute methamphetamine." No, they weren't "violent inner-city thugs" or "murderous MS-13 immigrant gangsters", they were white supremacist members of the Arkansas-based New Aryan Empire. Oddly enough, Donald Trump hasn't mentioned them during any of his false, anti-immigrant rants at campaign rallies and State of the Union addresses.

Meanwhile, it appears that Trump will most likely sign the compromise deal struck between Congressional Democrats and Republicans this week to fund the federal government and avoid another shutdown, even though he will get less than he could have had if he'd accepted the deal he backed out of last year before shutting down the federal government over his new demand for $5.7 billion to build a border wall. Sean Hannity of Fox "News" and wingnut talk radio fame has now backed off his earlier charge that "any Republican that supports this garbage compromise" would have to explain themselves. He now appears to be supporting the compromise, while calling for the President to declare a "national emergency" to steal more tax-payer money for a wall. With that permission from his Fox "News" handlers, Trump will almost certainly sign the agreement.

In all, as Trump points out, the deal allocates $23 billion for border security --- a lot of money for Democrats to agree to if, as Trump lies, they favor "open borders". It's also a lot of money period. But, record national debt and annual deficit spending do not appear to be a problem for pretend "fiscally conservative" Republicans in Congress. The Treasury Department announced yesterday that the national debt has now topped $22 trillion for the first time in history, after increasing more than $2 trillion since Trump took office under GOP leadership in Congress. The landmark comes thanks, in no small part, to the Trump/GOP's unpaid-for $1.5 trillion tax cuts.

And while both Democrats and Republicans in Congress are hoping that Trump signs their compromise border security agreement to keep the government open, Trump's U.S. Customs and Border (CPB) agents are busy breaking into private property and threatening to seize private lands owned by Americans who have lived and worked on the banks of the Rio Grande at the U.S. southern border for generations.

Bulldozers and other heavy machinery is now reportedly rolling into wildlife sanctuaries in South Texas' Rio Grande Valley and the National Butterfly Center in Mission, TX has filed a restraining order this week to stop them after, the Center charges, CPB broke into a fence on its private property, cut the lock, and replaced it with its own.

We're joined today by the Center's Director MARIANNA TREVINO-WRIGHT to explain the federal government's intrusions on their 100-acre butterfly refuge, wildlife center and native species botanical garden. The Center, part of the North American Butterfly Association (NABA), regards CPB's behavior as unlawful and unconstitutional according to a lawsuit "filed in December of 2017 as the result of the government's actions on our property in July of 2017, more than nine months before a Congressional vote, or any funding appropriation for 'border wall'," Trevino-Wright emphasizes.

We discuss, among other things, the 28 laws and environmental regulations --- "including the Solid Waste Disposal Act, the Clean air Act, the Clean Water Act, the Migratory Bird Treaty Act, the Native American Graves and Repatriation Act, and the Native American Religious Freedom Act" --- that the Department of Homeland Security has waived since Congress approved 33 miles of new border fencing in the area last year to allow construction of the barrier, and the federal government's use of Eminent Domain already underway to confiscate private lands for Trump's wall. Trevino-Wright details the devastation that awaits butterfly species, as well as other insects and native wildlife with the construction of the wall on the property of both the Center and the neighboring 91,000 acre Lower Rio Grande Valley National Wildlife Refuge.

She says insects and animals will be "sentenced to death" thanks to flooding that will occur between the mighty Rio Grande River and the concrete base of the planned 30 foot wall where they will become trapped. Moreover, the accompanying LED "blitzkrieg all-night bright lighting every 150 feet on the wall, will result in catastrophe for sensitive nocturnal creatures and "lead to greater environmental damage". And, no, Trevino-Wright tells me, many butterflies and birds are not able to fly over a 36-foot concrete and steel barrier. She describes the wall as an "abomination", Trump's claims of an humanitarian and violent criminal "crisis" at the border to be nonsense, and why residents in the area are far more worried about criminals within law enforcement agencies than they are about those crossing the border unlawfully or ferrying drugs into the country. "Conflict or property damage or terrorist acts by those who support this agenda are actually what we're more concerned about," Trevino-Wright adds.
