'This is Code Red. We can call for voluntary rationing because that polls better, or we can lead', says likely 2018 gubernatorial candidate...
By Brad Friedman on 3/20/2015 12:37pm PT

Out here in California --- for those of us now living directly "on the front edge of a climate crisis", as MSNBC's Chris Hayes describes it in the interview below --- it's both extraordinarily unusual and incredibly welcome to hear a politician with ambitions for higher office speak as frankly as Lt. Gov. Gavin Newsom (D) does here.

But with temps in the high 90s over the past week here in Southern California (in March!) and new data from NASA finding the state may well run out of surface water completely in just a year's time, it's very good to see someone with the courage to say what needs to be said.

Newsom describes the state's voluntarily water conservation measures to date, in the face of our record-shattering drought, as "small ball".

"I think we're going to have to move to mandatory rationing," he notes bluntly. Hayes appears surprised in response, noting that calls for mandatory rationing are "essentially anathema in American political vocabulary."

"This is serious," Newsom responds in turn, detailing the crisis the state is now facing. "This is Code Red".

"We can call for voluntary rationing because that polls better, or we can lead. And I guess at the end of the day, we have to ask ourselves 'Are we just stewards? Or are we gonna step up and step in and actually share our private thoughts --- trust me, private thoughts are ample around some requirements for mandatory reductions --- or we can continue to play the finger in the wind politics that, frankly, has put us in this crisis in the first place."

'No one expects much out of O'Reilly. No one expects the truth'...
By Brad Friedman on 3/9/2015 6:53am PT

[This article now cross-published by Salon...]

The longtime former host of the Fox 'News' media critique program, Fox News Watch, took to CNN on Sunday to blast both Fox and his former colleague Bill O'Reilly during an appearance on Brian Stelter's weekend media show, Reliable Sources.

Eric Burns, who worked at Fox for years before finally leaving in 2008, described the channel as a "cult" of "extreme right", and described O'Reilly as both the leader of that cult and a "liar."

"I think it's astonishing that that's the way they operate," Burns said, describing Fox' failure to take any action against their prime time star in light of documented evidence that O'Reilly wholly mischaracterized and/or blatantly lied about his coverage of the Falklands War, bombings in Northern Ireland, the murder of nuns in El Salvador, and the suicide of a key player in the JFK assassination saga, to name just a few cases recently brought to light by others in the non-wingnut media.

Burns went on to describe [video posted in full below] how O'Reilly has been caught telling "numerous lies" over the years by, among others, former MSNBC host Keith Olbermann who used "all the evidence possible" to detail the fabrications. But, he explained, because the lies were told at Fox, nobody cared.

"No one expects much out of O'Reilly as a Fox News host," said Burns. "No one expects the truth."

The way to understand what is going on right now at Fox in the wake of the allegations against O'Reilly, Burns explained, "is to make a distinction between the words 'culture' and 'cult'"...

I hate having to agree with Fox Opinion Channel personality Megyn Kelly, but I can't dispute her point about the bizarre segment on the February 8 edition of MSNBC's Melissa Harris-Perry, in which Harris-Perry actually asked outgoing Attorney General Eric Holder to quack like a duck.

Granted, MSNBC's weekend programming hasn't been the same since Chris Hayes left Up in 2013 to host his weeknight broadcast All In, but this segment was just too daffy. Holder, who answered graciously nonetheless, seemed to know that something had gone off the rails; while responding to Harris-Perry, he seemed to be second-guessing his decision to participate in the interview.

Reportedly, there has been a lot of second-guessing at the network, and it's not hard to understand why. MSNBC has a credibility problem --- though its not about ducks or even Brian Williams --- but a segment on the February 9 edition of The Ed Show unintentionally highlighted its magnitude...

I'm on the road this week, but was able to carve out a minute or two upon learning that some in our trusted news media seem to have lied about the Iraq War! Can you believe it?!

As Jon Stewart declared on The Daily Show last night: "The media is on it! Now this may seem like overkill. But for me, no, it's not overkill. Because I am happy. Finally, someone is being held to account for misleading America about the Iraq War!"...

By the way, when MSNBC's Rachel Maddow produced her excellent Hubris: Selling the Iraq War documentary in 2013, to mark the tenth anniversary of our invasion, she cited the blatant and knowing lies that resulted in the war. While congratulating her on the fine work, we also took the time to document just some of the many lies told and/or facilitated by NBC and MSNBC themselves which helped lead us into that disaster in the first place...

But 2012 docs suggest resignation - even impeachment - would let the apparently repeated domestic abuser off far too lightly
TWO wives AND children allegedly beaten by federal judge with lifetime appointment...
By Brad Friedman on 9/19/2014 6:24pm PT

[A version of this article now cross-published by Salon...]

Over the last 48 hours or so, during which time I've been largely off the grid on jury duty, the story of wife-beating U.S. District Court Judge Mark Fuller has finally taken off in the corporate media, as well as among a number of the elected officials who would be responsible for impeaching the 2002 George W. Bush lifetime-appointee to the federal bench.

I couldn't be happier to finally be playing catch-up on this story for a change, as calls for accountability for the federal judge from Alabama's Middle District have now become a "virtual chorus" over these last few days. The state's Governor, as well as both of Alabama's U.S. Senators and its entire Congressional delegation, save for one member (Rep. Mike Rogers), have now called for Fuller's resignation and/or impeachment.

His resignation, however, and arguably his impeachment, would be far too generous for Fuller, as I'll discuss below, given previous allegations --- by his first wife --- that mirror what we now know about him, concerning drug and alcohol abuse, as well as physical abuse of both the first wife and their children...

ALSO: Two Alabama Congresswomen, a Democrat and a Republican, call for accountability, possible impeachment by the U.S. House...
By Brad Friedman on 9/17/2014 12:33pm PT

On Tuesday night's All In with Chris Hayes on MSNBC, at the end of a segment on the NFL's growing domestic violence controversies, he finally delved into the outrageous case we've been reporting in great detail since early August, when Alabama's federal U.S. District Court Judge Mark Fuller was arrested and charged with beating his wife bloody in an Atlanta hotel room.

Hayes plays audio from a portion of the 911 call from Fuller's wife, including the segment in which it sounds as if she is being repeatedly struck, as later cited by the 911 dispatcher. "Please help me. He's beating on me," she is heard crying afterward.

Hayes' brief segment on the Fuller wife-beating case --- with a promise to cover the story more in the future --- begins just after the 4:00 minute mark in the video below...

Atlanta Police say that when they responded to desperate 911 call from the Ritz-Carlton on the night of August 9, the wife's face and legs were bloodied and bruised, and that it appeared she had been dragged around the room by her hair. The room smelled of alcohol, but Judge Fuller appeared to otherwise be unscathed.

Several weeks after his arrest, Fuller took a plea deal in exchange for a pre-trial diversion program that will allow him to avoid prosecution and have his record entirely expunged after completion of once-a-week domestic violence counseling for 24 weeks. That, despite indications two year ago that he had also beaten his previous wife and had both drug and alcohol problems.

Unless he resigns or is impeached by the U.S. Congress, the George W. Bush-appointee to the federal bench in the Middle District of Alabama will continue to serve out his lifetime appointment for $200,000/year.

Two Congresswoman from Alabama, a Republican and a Democrat, have now called for accountability in the case of Fuller. They are the first members of Congress to speak out on the matter, despite outrage expressed from a number of elected officials in both the House and Senate over the NFL/Ray Rice domestic abuse scandal...

By Brad Friedman on 9/15/2014 7:13pm PT

On Monday's Politics Nation with Al Sharpton on MSNBC, during a segment on the NFL/Ray Rice domestic violence scandal, the issue of the wife-beating U.S. District Court Judge Mark Fuller finally made it on to air, thanks to MSNBC contributor Goldie Taylor who was joining Sharpton along with CBS Sports Radio reporter Dana Jacobson to discuss the latest in the NFL case.

Fuller, as The BRAD BLOG has been fairly relentlessly covering over the past month, was arrested for beating his wife bloody in a hotel room in August, before being allowed to take a plea deal allowing him off the hook with a pre-trial diversionary program that would expunge his record entirely, and leave him to continue his life-time appointment to the federal bench in the Middle District of Alabama. Fuller, a George W. Bush appointee, can only be removed from his $200,000/year job via impeachment by the U.S. Congress.

While the Rice case has been covered extensively over the past week by both the corporate media and elected officials, following the public release of a video showing the NFL star knocking out his wife in a hotel elevator, the Fuller matter has received very little coverage. As we reported last week, it's also received very little outrage from elected officials in Congress who might otherwise have brought articles of impeachment by now, had their been video tape of Fuller's bloodied wife pleading for an ambulance and help from police at Atlanta's Ritz-Carlton hotel in early August.

Following a segment concerning the 16 female U.S. Senators who wrote to NFL Commissioner Roger Goodell last week to demand a "zero tolerance policy" for domestic abusers in the league, Taylor noted the irony of the Senators failing to call for the impeachment of Fuller, despite the fact that, unlike in the NFL, those elected officials actually have direct control over the removal of federal jurists from the bench.

Beginning at around the 7:10 mark in the video posted below, in response to Sen. Kirsten Gillibrand (D)'s appearance on Sunday's Face the Nation on CBS explaining the Senators' demand for accountability from Goodell, Taylor broached the topic of Fuller...

GOLDIE TAYLOR: ...But what I have to ask Sen. Gillibrand and the others who signed that letter --- I am very pleased and very proud that they stood up and called the NFL out on this --- but what about Judge Mark Fuller down in Alabama? Why haven't they called for his impeachment? Why this case [Rice], and why not the other [Fuller]? I've heard a lot of people talk about this...

REV. AL SHARPTON: Mark Fuller, for our viewers who don't know, is a federal judge who had been...

TAYLOR: Absolutely, a federal judge...who beat his wife here in Atlanta, got a diversionary program, but no one has called for his impeachment...

SHARPTON: ...and still on the bench!

TAYLOR: ...why not that?

SHARPTON: Still on the bench.

TAYLOR: ...and still on the bench, and still has his job.

DANA JACOBSON: Because the NFL is in the spotlight right now, and I think that's a big part of it...

Note to Jacobson: The "NFL is in the spotlight right now", because you folks in the corporate media have finally helped put them there. That's fine, and certainly long overdue. But you can also help put a member of the federal bench who sits in judgment of others, and who arguably beat his wife far more viciously than Rice did, and who also appears to be a repeated wife abuser, in that same spotlight.

As a Twitter user aptly commented tonight in response to the MSNBC segment this afternoon, "#MarkFuller is more of a threat to society than Ray Rice ever will be."

True. In any event, thanks to Taylor for finally bringing this issue to MSNBC viewers. Perhaps it'll catch on. It damned well should.

Here's the complete video from the 9/15/2014 episode of Politics Nation with Al Sharpton. Much more of our coverage of this case is linked below it...

Of course they do...
By Brad Friedman on 8/20/2014 7:05am PT

From Juliet Lapidos at NYTimes...

On Sunday the Rev. Al Sharpton, the civil rights activist and television host, mentioned that voter turnout in the Ferguson, Mo., area was a mere 12 percent in the last election, and pledged to help boost that number with a registration drive. Twelve percent, he said, was "an insult to your children." He wasn't the first to think of channeling the anger over Mike Brown's death in this particular direction. Twitter users on Saturday noted voter registration tables in front of the makeshift memorial where the unarmed teenager was shot by a police officer.

Encouraging more participation in the democratic process in a community that feels alienated from political power - hence the demonstrations - seems like an obviously good idea; and one that's particularly compelling because it's so simple. Voting is an alternative to protesting in the streets.

And yet, the executive director of the Missouri Republican Party, Matt Wills, denounced the plan.

Mr. Wills told the right-wing website Breitbart: "If that's not fanning the political flames, I don't know what is. I think it's not only disgusting but completely inappropriate."

On another right-wing site, Red State, Dan McLaughlin also argued that there was something indecent about the registration drive. Ferguson presents an opportunity for "Right and Left" to find "common ground," he wrote. But "the minute you turn your energies into just another effort to register Democratic voters and fire up the Democratic base in advance of an election," he argued, "the harder you make it to keep the common ground from vanishing in the fog."

Who said anything about "register[ing] Democratic voters"?

"Voter registration for #Ferguson residents is at the QT & the crime scene. SIGN UP. Get on the juries, choose your leaders," tweeted attorney and activist @ReignOfApril. "Voter Registration is a brilliant way to honor #MichaelBrown's memory. It's a positive reaction to horrible situation," wrote @Koursey in reply.

While the city of Ferguson is two-thirds African-American, the vast majority of their police force and almost all local elected officials are not.

"Though whites make up just 29% of the city's residents," reports MSNBC's Zachary Roth, "five of Ferguson's six city council members are white, as is Mayor James Knowles. And six of the local school board's seven members are white."

"We warned people about these kinds of things," John Gaskin of the Missouri NAACP told Roth. "Who hires the police officers? The police chief. Who hires the police chief? The mayor. Who hires the mayor? Who elects the council folks?"

As the Times' Lapidos goes on to note, "Mr. Sharpton did not say that the residents of Ferguson should vote for Democrats; he said they should vote, full stop." She adds: "Isn't it telling that both Mr. Wills and Mr. McLaughlin make no distinction between voter registration and Democratic registration?"

For the record, Ferguson's local elections are nonpartisan.

* * *

(Separately, kudos to the Times' Lapidos for describing those two websites for what they are, "right-wing", rather than usual "conservative". It must not have been easy to get that past the Times' editors, even though it's completely accurate.
