Today on The BradCast, the transition officially begins and the prospect of years of progressive policies begin to roll back. [Audio link to show posted below.]

Donald Trump met with President Obama at the White House today for a chilly, if cordial transition meeting, as the world continues to try and make sense of it all. Joining us to help in that task today is award-winning opinion journalist and our old friend Heather Digby Parton of Salon and the Hullabaloo blog, back by popular demand. She was with us to warn, on the day Trump entered the race in June of 2015, that he would be a force to be reckoned with, while so many others scoffed.

Today we examine, among many other things, the media's role in helping to normalize Trump while demonizing Hillary Clinton, and we begin to process just some of the dangers that the 'President-elect' now presents to not only Obama's eight years of progress, but to the world and the planet. For example, see Sen. Tom Cotton (R-AR) minimizing waterboarding again, and suggesting that torture will once again be back on the table --- just as Trump had promised during the campaign.

"What I saw [on Election Night] was the [media's] shift to suddenly seeing Donald Trump as a normal politician," Parton explains. "The campaign has been disappeared. That odious campaign that we just watched him run. The one where he promised to lock up his rival, torture terror suspects, put guns in schools, the most horrifying agenda we've ever seen from a major party candidate, and delivered in the most cretinous fashion that it's ever been delivered --- that is gone. There is no remnant of it in the media. What we're seeing now is a nice, mainstream Republican candidate who appealed to 'Real Americans' and spoke to their needs, and we need to welcome him. A lot of the commentary is that Democrats really need to reach out to him and to his followers and make up for the fact that they were so rude to him."

We try to un-disappear some of Trump's "disappeared" campaign promises a bit today, while noting that there is now little, if anything, to stop the very worst of those them --- from torture to massive tax cuts to gutting any and all financial and environmental regulations --- from being adopted by the new Administration and a compliant Congress and Supreme Court. We also discuss the role that Obama and the Democrats have in Republicans' ability to revive the very worst of the George W. Bush Administration war crimes and more, since they refused to bring accountability previously. And, speaking of accountability, Parton offers her thoughts on progressives who voted for third parties this year.

Finally, Desi Doyen joins us for a our first Green News Report since the election, for a look at what President Trump will mean for the environment, energy and the UN climate agreement....

On today's BradCast, the Presidential Primary battle between Hillary Clinton and Bernie Sanders becomes a fight over the official party platform and whether progressive reform can actually happen from within; Donald Trump wants the U.S. to torture again; and California goes to pot. [Audio link to show posted below.]

In the wake of this week's horrific terror attack at Turkey's Ataturk Airport in Istanbul, the presumptive GOP nominee Donald Trump wants to "Make America Commit War Crimes Again" as he calls for the U.S. to once again implement torture policies such as waterboarding. In the meantime, new Pew polling shows Trump's support from nation's outside of the U.S. is dismal, often in single digits. While back here at home, according to new Quinnipiac poll out today, he remains "neck-and-neck" nationally with presumptive Democratic nominee Hillary Clinton whose favorability ratings are also dismal, though not as bad as Trump's.

But as Bernie Sanders supporters quickly move toward Clinton, representatives for the two popular Democratic rivals hash out the party's official platform document to be adopted by delegates at the Democratic National Convention in July.

Salon political reporter Ben Norton joins us to discuss progress of the talks, specifically the Clinton camp's refusal to allow a demand for a $15/hour federal minimum wage mandate in the non-binding party manifesto, as well as the failure by Clinton surrogates to agree to more progressive language on a number of issues, from Israel to fracking to trade policies.

Norton goes on to report that the fight between surrogates for the two candidates at the DNC Drafting Committee's platform talks echoes the long Democratic primary race, suggesting, as he sees it, that the party, ultimately, may not be able to reform from within. "You have the Sanders' appointees pushing for more progressive measures, and the Clinton appointees opposing those measures. I think in some ways, we did see some progress, but overall I think there's reason to be pessimistic for a potential Clinton presidency, given the way that this has represented itself at the DNC committee drafting," Norton explains. "It really reflects the war going on within the Progressive community."

Real progressive policy change, he argues, will require new candidates to step up at the local and state level --- even as independents or under the banner of a third party, if necessary --- to take up the fight and seek office, he notes, just as Sanders did when he initially ran for office in Vermont decades ago.

Finally today, more calls for 'Texit'! California announces that an initiative to allow the recreational use of marijuana will be on the statewide ballot this November, and Colorado finds that teen use of pot has actually fallen below the national average since the state adopted a similar policy in 2014.

While Trump and Cruz and Rubio and Kasich all played nice last night at the 12th(!) Republican Debate of the 2016 primary season, they also got away with some pretty remarkable nonsense on trade, education, Social Security, war, torture and much more.

Joining me today to rebut not only the candidates, but also some of the CNN moderators passing off inaccurate and disproven bullshit as legitimate Presidential debate questions, are journalist David Dayen of The Fiscal Times and Salon (and more!) and John Amato, creator and publisher of the infamous Crooks and Liars blog (who joined us on his birthday, nonetheless! On today's BradCast, we try to make sense of the amazing GOP debate in New Hampshire on Saturday, the final one before tomorrow's First-in-the-Nation primary in the Granite State.

First, I offer a very few quick reminders and action items for those interested in fighting for Election Integrity during tomorrow's primary in NH. This, in a state which uses hand-marked paper ballots, but refuses to actually verify that results are accurately tallied by the state's oft-failed, easily-manipulated Diebold optical-scan computers before announcing results to the public. (For a reminder of the nightmare that occurred on that system back in 2008, you can peruse our Special Coverage here.)

Then, I'm joined for today's post-debate coverage and analysis by two progressive bloggers who have been consistently right for years --- Heather Digby Parton of Salon and Digby's Hullabaloo and Martin Longman of Washington Monthly and Booman Tribune --- to discuss where Rubio, Cruz, Trump and the others, including the corporate media, went wrong on Saturday night...and, unfortunately, for so many years prior.

From Rubio's remarkable on-stage meltdown to Cruz' ability to lie with amazing impunity (even when he is actually called out as a "flat-out liar" by CNN!) to the danger that Trump's ability to "win" may hold for both Republicans and Democrats alike.

And, as if that doesn't give us all enough to cover today, we take the time to call out the corporate U.S. media (and the Obama Administration) for allowing this mind-bogglingly precarious moment in U.S. history to even have come about in the first place...

While the "news" networks covered Donald Trump and his comments about John McCain all weekend, we cover a bit of what they did not on today's BradCast.

First, the climate crisis comes home, as two different climate change-related disasters on California and Arizona freeways over the weekend (one drought related, one flood related) were averted --- just barely.

Then, we're joined by Dr. Yosef Brody, president of Psychologists for Social Responsibility to discuss the disturbing new independent 542-page report [PDF] commissioned by the American Psychological Association (APA), confirming that top officials at the APA colluded with the Bush Administration to approve CIA and Dept. of Defense torture techniques after 9/11. The APA then spent the next decade covering it up and smearing the whistleblowers at Brody's organization.

The findings of the new report, and the scandal in its wake, has touched off a shakeup at the top echelons of the organization. The report by a former federal prosecutor reveals "a complete and utter failure of psychological ethics," Brody tells me. "What it's saying is that what we critics have suspected for about a decade now --- that senior [APA] staff have been currying favor with the Pentagon and the CIA, effectively facilitating torture. And to top it off, they've engaged in this very sophisticated, decade-long coverup."

It was all done, he explains, to protect the Bush Administration from legal liability for war crimes, allowing them to describe their "enhanced interrogation techniques," with the blessing of the APA, as "safe, legal, ethical and effective", when they were anything but.

"This is really about a culture of corruption at the top of the largest organization of psychologists in the world," says Brody, about the APA's complicity. "We're talking about war crimes here, ultimately. And we're talking about a health professional association!"

Then, some politics: First, #BlackLivesMatter protesters disrupt Democratic Presidential candidates Martin O'Malley and Bernie Sanders at the progressive Netroots Nation conference over the weekend. And then, can Al Franken be blamed for Donald Trump's controversial comments about the war record of John McCain? Maybe. I explain all of that on today's BradCast!...

I'm joined today on The BradCast by VICE News' investigative journalist Jason Leopold to discuss the exclusive documents he obtained concerning the drugging of detainees during interrogations after 9/11. Also, Leopold, who has spent quite a bit of time lately as a reporter at Guantanamo Bay, discusses why President Obama may suddenly be in a hurry to keep his promise to shut down the controversial facility.

Also, after defending Jeb Bush on his Iraq comments on yesterday's show, I'm forced to offer a retraction today in light of Jeb's second attempt to answer the same question. It is clear that he's at least as dumb as his brother, and certainly too dumb to be President of these United States.

We were back live today for the first BradCast on KPFK/Pacifica Radio since the holidays.

First up, a few incomplete words on the breaking news of today's horrific terror attacks at the satirical Charlie Hebdo newspaper in Paris.

Then, BRAD BLOG's legal analyst Ernest A. Canning joined us to discuss his own father's detention and torture (including water-boarding) under the Japanese Kempetai at the notorious Shanghai Bridge House during WWII. After the war, his father, James Robert Canning, testified against his captors [PDF] at the Hong Kong War Crimes Trials, where some members of the Japanese Imperial Army received life sentences --- and, some, the death penalty --- for many of the same crimes against humanity carried out by the U.S. in the wake of the 9/11 attacks [PDF], as Ernie wrote about here recently.

Then, we cover what we hope might be the last report of the 2014 election, the (good news on several accounts) solution to the great Maine Ballot Mystery!

A former Governor of Virginia is expected to be sentenced to a long stay in prison. The same fate has befallen governors in states across the United States, including in nearby Maryland, Tennessee, and West Virginia. A former governor of Illinois is in prison. Governors have been convicted of corruption in Rhode Island, Louisiana, Oklahoma, North Dakota, Connecticut, and (in a trumped-up partisan scam) in Alabama. The statewide trauma suffered by the people of states that have locked up their governors has been...well, nonexistent and unimaginable.

Locking U.S. presidents up for their crimes is a different story. Former President Richard Nixon's understanding that whatever a president does is legal has not been challenged since he made that comment. The Washington Post --- not exactly a Nixon supporter --- has the same understanding now. The Post recently justified the latest proposal to re-ban torture by explaining that even though torture was already banned, President George W. Bush tortured and therefore had found a legal way around the law. In other words, because he hasn't been prosecuted, what he did was legal.

If there is a downside to the recently released executive summary of the U.S. Senate Torture Report [PDF], it can be found in the extraordinary lengths to which it goes to demonstrate a long-established fact: Torture is ineffective as a means for extracting actionable intelligence.

Emboldened by that focus, U.C. Berkeley Law Prof. John Yoo authored a response to the Senate Torture Report by way of a recent, Los Angeles Times op-ed. In 2002, while serving as the Deputy Assistant U.S. Attorney General, Yoo authored a memo that green-lighted CIA torture following the 9/11 attacks. The memo, according to UC-Irvine's renowned constitutional law professor Erwin Chemerinsky, should now serve as the basis for the prosecution of Yoo for war crimes. Shielded by the Obama/Holder Dept. of Justice's refusal to prosecute, Yoo shamelessly argued in his Los Angeles Times editorial that the newly released Senate Torture Report had shifted [emphasis added] "the debate beyond legality to effectiveness."

The issue of torture's "effectiveness" is not and never has been an appropriate subject for "debate." Robert Colville, the U.N. High Commissioner for Human Rights makes that clear in referencing the U.N. Convention against Torture, an international human rights treaty to which the U.S. is a signatory. "Torture is prohibited absolutely, in all circumstances, at any time," he explains in regard to the treaty signed by President Ronald Reagan. "It cannot be practiced in war, in peace, during emergencies, during internal instability, any circumstances whatsoever."

Those legal proscriptions apply not only to those who carry out torture but also, under the principle of "command responsibility," to high level officials who facilitate or fail to prevent torture by their subordinates.

As I revealed in my five-part series on the History of CIA Torture: Unraveling the Web of Deceit back in 2009, for me, torture is exceedingly personal. In late 1942 my father, James R. Canning, was waterboarded at Shanghai's Bridge House, an infamous torture chamber --- something that entailed a frightening, traumatic and "exquisitely painful," six-hour ordeal. He eventually signed a "false confession" stating that he was a British agent, even though he knew it wasn't true and even though he believed at that moment he was signing his own death warrant.

This Partial Trial Transcript [PDF] includes my father's testimony at the 1948 Hong Kong War Crimes Trials. It exposes the hypocrisy in the Obama/Holder DoJ's failure to apply the same ("command responsibility") legal standard to Yoo, former Vice President Dick Cheney --- who now proudly declares "I'd do it again in a minute!" --- and other high-level, Bush administration officials.

In 1948, that "command responsibility" standard was used to convict Lt. General Eiichi Kinoshida, who received a life sentence even though there was no evidence he personally participated in torture.

If we are indeed, as proclaimed by Sen. Diane Feinstein (D-CA) in her Forward to the Senate Torture Report, a "nation of laws," President Obama will heed the calls now being made by the ACLU, Human Rights Watch and even by The New York Times to appoint a special prosecutor who would investigate the crimes the CIA allegedly committed at the behest of Cheney et al --- crimes that appear as heinous and more so than those that were inflicted upon my father and his fellow civilian inmates during World War II...

It's difficult to know where Rightwingers are now when it comes to the release of today's remarkable, horrifying, redacted 528-page executive summary [PDF] of the U.S. Senate Intelligence Committee's 6,000-page report on Bush-era CIA torture.

"Torture never happened!," they used to say. Then, "Okay, it happened, but it wasn't torture!" Then, "Okay, torture happened, but it was necessary!" Now, "This report is just meant as a distraction from America's real problem: ObamaCare!"

You get the idea. So did legendary syndicated cartoonist and blogger Tom Tomorrow (aka Dan Perkins), and he's been covering it with brilliant, dead-on satire for years. With the release of the Senate report, almost a decade in the making, we're posting a few very-much-related Tom Tomorrow toons from over the years below, as self-selected by Perkins on Twitter today.

"It's not as if we've learned nothing in ten years," he tweeted. "In a 2004 cartoon, I still had to explain what 'waterboarding' was."

And, as he also made clear, none of what we are learning today is ultimately a surprise. "Presumably if the cartoonists knew about it, the White House did as well."

They did indeed, as a glance at these toons from over the years makes clear yet again...

GUESTS: CA Green Party Sec. of State candidate David Curtis; Investigative journalist Jason Leopold...

I was proud to have the 2014 Green Party candidate for CA Sec. of State David Curtis (in photo on the left, not smiling), as my first guest this week on the KPFK/Pacifica Radio BradCast. While he and I disagree on a few important things (like Internet Voting, which he still hopes for, despite our Twitter conversation last month), there's one thing we certainly agree on: It was outrageous that he was excluded from today's SoS candidates debate held by the Sacramento Press Club. That, despite the fact that he recently polled higher than two of the candidates who were invited to participate.

[CORRECTION: On air I said that the CA statewide primary was June 2 this year. In fact, it's on Tuesday, June 3. The deadline for voter registration by mail for the primary is May 19th. You can register online here. Apologies for the error!]

As my second guest this week, I was also proud to welcome back investigative journalist Jason Leopold on the heels of his Guardian interview with Dr. James Elmer Mitchell (in photo on the right, smiling), one of the central architects of the Bush/Cheney-era CIA torture program. The interview was Mitchell's first since turning the skills he acquired as the chief psychologist at a U.S. Air Force survival school --- where U.S. troops were trained in how to avoid false confessions and propaganda under enemy torture --- into a program to use torture techniques to extract...the truth(?)...from Al Qaeda prisoners after 9/11. While we aired a few never-before-aired clips from Leopold's interview with Mitchell, there are more now available right here.

Given that every Sunday network news show decided to completely ignore it, I thought it my duty to read the entirety of the leaked findings from the U.S. Senate Intelligence Committee's report on CIA Torture and Detention on the air during this week's BradCast on KPFK/Pacifica Radio.

You're welcome, war criminals!

Also on this week's show, the continually growing evidence of the success of "Obamacare" (and a caller who self-identifies as "full on Left. I'm not even liberal, I'm further Left than that", who takes me to task for citing the facts) --- and why it's time for Dems to grow a pair and start running to not just retain the Senate but also take the U.S. House.

A word or two on home-grown Rightwing extremist terrorism and the fecklessness of the Dept. of Homeland Security which, thanks to bullying from Republicanists and Fox "News", cowered from and retracted their report on same back in 2009 despite the mounting death toll ever since.

Late last week, the twenty conclusions of the U.S. Senate's report on the Bush-era's secret CIA torture and detention program was leaked and published by McClatchy.

As we noted on Friday, when we also published the report's disturbing conclusions [PDF], the 6,600-page study, based on first-hand CIA documentation, reveals massive illegalities and war crimes by everyone from CIA contractors to agents to higher level officials at that agency and others.

The report is said to detail wide-spread crimes that are not only in violation of U.S. law, but also international laws which our nation has an obligation to enforce, thanks to treaties we have long been a party to. And, if we don't enforce those laws and hold the criminals accountable for lawlessness such as torture, all the rest of the nations signed on to such treaties along with us, such as the UN Convention against Torture, have a legal obligation to do so.

The prohibition against torture under that treaty is absolute for all nations. "No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture," according to Article 2 of the treaty.

All of that comes on the heels of revelations that the CIA itself had used the computers of the U.S. Senate Intelligence Committee in an attempt to sabotage the committee's report.

Yet, with a report that important and a story that big, not a single U.S. network "news" show on Sunday found the time to even mention the report. Not NBC's Meet the Press with David Gregory, not ABC's This Week with George Stephanopoulos, not CBS' Face the Nation with Bob Schieffer, not Fox "News" Sunday with Chris Wallace.

On Friday, we mentioned that the U.S. Senators who recently voted to release 500 redacted pages of the report (we're still waiting on the White House to take action to redact and release it), argue that release is necessary to avoid this country ever going down this same path again.

We opined in response that "only actual prosecution will deter that eventuality", that "As long as those who committed such vile and abhorrent crimes are not actually held accountable, all of this will almost certainly be repeated in the future," (by both us and other nations) and that "if we fail to prosecute, we will also have little ground to hold other rogue countries accountable for the same crimes in the future."

The fact that the twenty, very easy-to-read bullet point conclusions from the U.S. Senate report, which has been years in the making --- as based on first-hand documentation of the crimes --- were released last week, and not even mentioned once on any of the four major Sunday network news shows underscores our point. The release of data is all well and good. But it's only when the perpetrators start being frog-marched to jail that the mainstream corporate media --- and, thus, the American public --- will begin to give a damn about one of the darkest moments in this nation's history.

As of now, at least if Sunday is any indication, evidence suggests that the MSM doesn't give a damn. Therefore, neither will the American people. Thus, we are destined to repeat this abhorrent chapter and, once again, like so many shameful chapters in our recent past, the corporate mainstream media themselves will have played a lead role in helping to make sure that happens.
