As voters head to the polls in a dozen Super Tuesday states, we cover a number of the problems voters are already reportedly facing on today's BradCast, as well as how Donald Trump or Ted Cruz could actually help save democracy --- and our public airwaves --- by filing some lawsuits! [Link to audio for full show is posted below.]

First up today: The 866-OUR-VOTE Election Protection hotline is reporting a number of problems at polling places around the country so far today, particularly in states that were once covered by Section 5 of the (now-gutted) Voting Rights Act. Problem reports as of this afternoon include long lines at some precincts caused by failing electronic poll book systems, state voter registration and polling location databases being offline and confusion over new Photo ID voting restrictions.

Moreover, as expected, there is trouble once again with touch-screen voting systems in a number of states. Democrats in at least one Georgia precinct were given Republican ballots when they went to vote on their 100% unverifiable voting machines and, in Williamson County, TX, north of Austin, voters are reporting unverifiable touch-screen votes flipping from one candidate to another --- from Trump to Rubio (or someone else) in the cases reported so far.

As usual, here is our friendly reminder that many problems with voting systems, and the results they produce, do not come to light until well after Election Day. So, we will continue to keep our eyes on these issues, as ever. (And here are a few tips from 2014 on what to do about such probs should they happen to you today or in the upcoming primaries!)

Then, we're joined by award-winning journalist and media activist Sue Wilson of the Media Action Center to discuss her new article on how Ted Cruz or Donald Trump could actually help save democracy --- and the fight for facts over our public airwaves --- by filing lawsuits against broadcast outlets that air false propaganda ads purchased by third-party SuperPACs.

"In terms of the rules that television and radio stations have to follow, a candidate is, in essence, free to lie to the public as much as they can get away with, as long as it's one of their own ads, as opposed to the ads that are paid for by these murky third parties," Wilson explains. "But, if you're one of these third parties that's running an ad for a candidate, the TV stations are not required to take those ads at all. And if those ads are found to be false, yes, the candidate has standing to sue, and say, 'I'm going to hold you liable for these false ads that you're making a fortune running and you're not fact-checking.'"

She also goes on to explain how the public can take action as well here, since "we, the voters, are the people who really suffer the most from these ads that flatly lie about candidates and their issues," while, ironically, "you, and I, and everyone else, own the publicly-owned airwaves, but somehow don't have standing to sue radio stations and TV stations if they lie to us."

As you may suspect, it's a very busy program on today's BradCast for some reason.

Heather Digby Parton of Salon and Digby's Hullabaloo and Joshua Holland of The Nation and the "Politics and Reality Radio" podcast join me for coverage of both the political (and perhaps Constitutional) earthquake following Saturday's sudden death of U.S. Supreme Court Justice Antonin Scalia and for the insane Republican Presidential Debate that took place in the wake of that huge news just hours later.

We discuss the bombshell Scalia news and the unprecedented response from Senate Majority Leader Mitch McConnell who immediately vowed to keep President Obama from his Constitutional duty of nominating and appointing a new Justice --- with the advice and consent of the U.S. Senate --- now that the appointment would serve to tip the balance of the Court 5 to 4 toward Democratic Presidential appointees.

Meanwhile, at the GOP debate in South Carolina shortly thereafter on Saturday night, every remaining Republican Presidential candidate called for Senate Republicans to block any nomination made by this President. And, as if that's not insane enough, the entire debate then quickly devolved into a remarkable Pro Wrestling-style shouting and name-calling spectacle which, frankly, left me --- as well as my guests today --- more than a bit gobsmacked and amused.

From the word "LIAR!" used dozens of times by several candidates to the 15-years late Republican debate over who to blame for 9/11 and the Iraq War(!), I think I'm fairly safe in saying we have never seen any Presidential debate like it.

As Ohio Gov. John Kasich said at one point during the madness on display Saturday night, just days before this weekend's GOP Primary in South Carolina (which will be run on 100% unverifiable touch-screen voting systems): "I gotta tell ya, this is just crazy. This is just nuts. Jeezo, man."

Couldn't have said it better myself...

Before our coverage today on The BradCast of Saturday's Democratic Presidential Debate in Iowa, a quick word about the Friday night terror attacks in Paris, courtesy of anti-war activist and author David Swanson, whose response we share at the top of the show. Then, yes, though the DNC apparently didn't want you to know about it, the three Democratic candidates for the 2016 Presidential candidate gathered in Des Moines on Saturday night to hold their second debate of the season. The CBS debate was held less than 24 hours after the bloodshed in Paris and, thus, had more of a foreign policy focus than it otherwise would have, before turning to domestic affairs.

We cover all of the above today. I'm joined for analysis by our reigning post-debate coverage champ, Heather Digby Parton of Salon and Digby's Hullabaloo blog, as well as Fred Karger, former longtime GOP political consultant and 2012 GOP Presidential candidate (and, in fact, the first openly gay Presidential candidate from either major party).

As usual, we try to make sense of it all with analysis and fact-checking that, hopefully, serves to help create a smarter and better informed electorate...

While the nation is getting more progressive by the day, it doesn't appear to be getting much easier for progressives in the corporate media. On today's BradCast, we talk about two progressive journalists both fired from two different corporate media outlets within the past week.

Award-winning syndicated editorial cartoonist, author and columnist Ted Rall joins us to discuss his bizarre firing by the Los Angeles Times last week after the LAPD leaked a 14-year old audio tape of Rall being ticketed for jaywalking to the paper. They claim it disproves a recent claim about the incident made by Rall in an LA Times column last May. Audio enhancement of the poor quality tape, however, suggests otherwise.

Why did the paper trust the LAPD without authenticating a 14-year old audio tape that appeared from nowhere? And was the firing about more than just that one column?

"Look, I pissed off cops. I've done many anti-LAPD cartoons and essays over the years. The LAPPL [Los Angeles Police Protective League] made clear in their blog that they have long been angered by me, and they are crowing about my dismissal. So, just at a bare minimum, think about how disturbing this is," Rall tells me. "The LAPD, or the LAPPL, passed illegally --- basically stole something out of the evidence room --- slipped it to the top editors at the LA Times, one of the biggest and most widely-respected metro-dailies in the United States, in order to get me fired. In order to send a message to other reporters, 'don't screw with cops'."

"This would be disturbing, even if I'd been lying," Rall explains. "Even if I'd been fibbing, this would be the nuclear option." He believes, however, that the professionally enhanced audio tapes completely exonerate him and tells me that the LA Times (who has yet to respond to my request for comment on this) has stayed mum since the professionally enhanced audio has been published.

"This is a huge story. This is an epic example of corruption at the highest levels of government and media. I don't want to use the 'c' word, conspiracy, but it might legally be considered a conspiracy," Rall believes. He tells me he is now considering his legal options against both the paper and the police.

Also on today's program, D.R. Tucker of The Washington Monthly (and, too occasionally, of The BRAD BLOG) joins us to discuss MSNBC's firing of Ed Schultz last week and the impact it may have on corporate coverage of both the TPP and of climate change, particularly following Schultz' remarkable reporting last year which subsequently led to his reversal on support for the Keystone XL pipeline.

"It's not often that you see somebody have a principled change of heart," Tucker explains. "And of course he was pilloried for that by the shills for the fossil fuel industry for daring to change his mind. But he stood his ground, and he basically maintained, right up until the day he was off the air, that the Keystone XL was a bad idea."

Finally, Desi Doyen joins us for the latest Green News Report on Obama's new EPA rules for slashing carbon emissions at power plants in a landmark action to fight global warming...

The longtime former host of the Fox 'News' media critique program, Fox News Watch, took to CNN on Sunday to blast both Fox and his former colleague Bill O'Reilly during an appearance on Brian Stelter's weekend media show, Reliable Sources.

Eric Burns, who worked at Fox for years before finally leaving in 2008, described the channel as a "cult" of "extreme right", and described O'Reilly as both the leader of that cult and a "liar."

"I think it's astonishing that that's the way they operate," Burns said, describing Fox' failure to take any action against their prime time star in light of documented evidence that O'Reilly wholly mischaracterized and/or blatantly lied about his coverage of the Falklands War, bombings in Northern Ireland, the murder of nuns in El Salvador, and the suicide of a key player in the JFK assassination saga, to name just a few cases recently brought to light by others in the non-wingnut media.

Burns went on to describe [video posted in full below] how O'Reilly has been caught telling "numerous lies" over the years by, among others, former MSNBC host Keith Olbermann who used "all the evidence possible" to detail the fabrications. But, he explained, because the lies were told at Fox, nobody cared.

"No one expects much out of O'Reilly as a Fox News host," said Burns. "No one expects the truth."

The way to understand what is going on right now at Fox in the wake of the allegations against O'Reilly, Burns explained, "is to make a distinction between the words 'culture' and 'cult'"...

I was interviewed over the weekend by OpEd News' Joan Brunwasser on the death of the recent 'Recounts for the Rich' legislation that had been sailing through the CA legislature until The BRAD BLOG's exclusive exposé detailing exactly what it would mean for citizen election oversight highlighted the dangers of the provision and helped to kill it.

See my thoughts on that, the Dems who were helping to pass the terrible Republican bill, some other recent voting news (both good and bad) for California, and a few other related thoughts (like who I really blame for all the Supreme Court disasters of late) in my interview with Joan...

Late last week, the twenty conclusions of the U.S. Senate's report on the Bush-era's secret CIA torture and detention program was leaked and published by McClatchy.

As we noted on Friday, when we also published the report's disturbing conclusions [PDF], the 6,600-page study, based on first-hand CIA documentation, reveals massive illegalities and war crimes by everyone from CIA contractors to agents to higher level officials at that agency and others.

The report is said to detail wide-spread crimes that are not only in violation of U.S. law, but also international laws which our nation has an obligation to enforce, thanks to treaties we have long been a party to. And, if we don't enforce those laws and hold the criminals accountable for lawlessness such as torture, all the rest of the nations signed on to such treaties along with us, such as the UN Convention against Torture, have a legal obligation to do so.

The prohibition against torture under that treaty is absolute for all nations. "No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture," according to Article 2 of the treaty.

All of that comes on the heels of revelations that the CIA itself had used the computers of the U.S. Senate Intelligence Committee in an attempt to sabotage the committee's report.

Yet, with a report that important and a story that big, not a single U.S. network "news" show on Sunday found the time to even mention the report. Not NBC's Meet the Press with David Gregory, not ABC's This Week with George Stephanopoulos, not CBS' Face the Nation with Bob Schieffer, not Fox "News" Sunday with Chris Wallace.

On Friday, we mentioned that the U.S. Senators who recently voted to release 500 redacted pages of the report (we're still waiting on the White House to take action to redact and release it), argue that release is necessary to avoid this country ever going down this same path again.

We opined in response that "only actual prosecution will deter that eventuality", that "As long as those who committed such vile and abhorrent crimes are not actually held accountable, all of this will almost certainly be repeated in the future," (by both us and other nations) and that "if we fail to prosecute, we will also have little ground to hold other rogue countries accountable for the same crimes in the future."

The fact that the twenty, very easy-to-read bullet point conclusions from the U.S. Senate report, which has been years in the making --- as based on first-hand documentation of the crimes --- were released last week, and not even mentioned once on any of the four major Sunday network news shows underscores our point. The release of data is all well and good. But it's only when the perpetrators start being frog-marched to jail that the mainstream corporate media --- and, thus, the American public --- will begin to give a damn about one of the darkest moments in this nation's history.

As of now, at least if Sunday is any indication, evidence suggests that the MSM doesn't give a damn. Therefore, neither will the American people. Thus, we are destined to repeat this abhorrent chapter and, once again, like so many shameful chapters in our recent past, the corporate mainstream media themselves will have played a lead role in helping to make sure that happens.

Now that the East Coast and parts of the southern U.S. have been battered over and again with extreme weather this winter, and while California is in the midst of its worst and longest drought on historical record, the Sunday "news" shows, all at once, decided to cover what they describe as "climate change" --- or, in the words of NBC's Meet the Press host, David Gregory, "The Politics of Weather".

All four of the major Sunday "news" shows --- NBC's Meet the Press, ABC's This Week, CBS' Face the Nation and Fox's Fox "News" Sunday --- covered the matter in various (lousy) ways.

Out of all four of them, just This Week and Face the Nation, bothered to book an actual climate scientist to take part in the conversation with their various bevies of political and journalistic deniers and non-scientists. Only Face the Nation offered a one-on-one with a climate scientist before then bringing on the denier.

Gregory, who Esquire's Charlie Pierce aptly described today as a "noodlebrained bag of useless flesh", tipped his hand last Friday by announcing excitedly via Twitter that MTP would be "Debating Climate change" on this week's show with Rep. Marsha Blackburn (R-TN), one of Congress' top carbon industry proponents and global warming deniers and Bill Nye "The Science Guy", a mechanical engineer turned TV science personality. No actual climate scientists necessary, apparently, to "debate" climate change in Meet the Press World.

Pierce called the embarrassing exchange "every bit as grim as you can imagine", and it certainly was. Here's just part of his scathing, dead-on-the-money response to it...

A number of unhappy "good government" groups will file a lawsuit against the Federal Election Commission next month, in hopes that the courts will force the FEC to enforce the federal campaign finance laws that the FEC is, supposedly, there to enforce.

The organizations are particularly unhappy about Karl Rove's Crossroads GPS "behemoth" outfit, which has raised hundreds of millions over the last several years to elect Republican candidates to office, recently receiving a pass from the FEC, even after the agency's Office of General Counsel found reason to believe Rove's group clearly violated campaign finance laws.

The news about the groups' intention to file suit was offered on the KPFK/Pacifica Radio BradCast this week by my guest, Craig Holman, the Government Affairs Lobbyist for Public Citizen's Congress Watch. Public Citizen, along with the Campaign Legal Center, Center for Media and Democracy, and Protect Our Elections filed the initial complaint over campaign spending in 2010 by Rove's then new non-profit 501(c)(4) organization. They now plan to sue the FEC for failing to do their job, Holman explained on the show on Wednesday. [Disclosure: Protect Our Elections is a campaign created by VelvetRevolution.us, an organization co-founded by The BRAD BLOG, though we weren't personally involved with either the complaint or the upcoming suit.]

"What's happened with the Federal Election Commission is," Holman explained during my interview [posted in full at the end of this article], Senator "Mitch McConnell [R-KY], back in about 2008, realized that even though he can't get Congress to rescind campaign finance laws --- and he certainly can't sell the public on rescinding campaign finance laws --- he realized that if he were to appoint three Republican Commissioners to the FEC, he could ensure that the campaign finance laws don't get enforced. And that's exactly what has happened." Holman detailed how three-to-three deadlock votes on whether to pursue further action in most of the campaign finance rulings by the three Democratic and three Republican Commissioners on the FEC has increased "nine-fold" since 2008. A deadlock vote effectively ends the matter, even if wrong-doing had been found by the investigative staff, as is the case here.

In the original complaint against Rove's Crossroads GPS, the FEC's Office of General Counsel (OGC) found that the group had spent a majority of its funding on campaigning in 2010. If so, that's a violation of the law, since Rove's group should have filed with the FEC as a political committee, rather than as a 501(c)(4) which is supposed to be a non-electioneering "social welfare" organization. As a political committee, funders would have to be immediately disclosed, but as a (c)(4), the identity of those funding Rove's organization can remain a secret....
