As I discuss near the top of today's BradCast, we are now in what amounts to a Cold Civil War on Democracy in this nation. The greatest direct threat we have ever faced to our Constitutional Republic since the Civil War is now playing out in our ongoing election. [Audio link to show is posted below this summary.]

As it turns out, that threat to what Joe Biden describes as "the soul of our nation", does not come from a foreign power, but from the President of the United States himself and his party of henchmen and supporters who are now attacking the very core of our Republic: the right to vote and to have that vote counted as cast. That right is now under direct assault in a way not seen since the Jim Crow era. And while the GOP has been using the guise of preventing "voter fraud" to wage similar battles in recent years, they aren't even trying to hide their direct assault on democracy anymore. They are simply using every (so far, peaceful) means possible --- legal and extra-legal --- to try and prevent legal voters from voting and lawfully cast ballots from being counted.

Unfortunately, they have packed enough stooges onto their stolen U.S. Supreme Court at this point, that they may pull it off...unless the pro-democracy forces simply overwhelm them between now and the close of polls next Tuesday night. Get busy, people. Only the fate of the Republic and...yes, human civilization, as Desi Doyen highlights yet again in our Green News Report today, are at stake.

Among the stories reported on today's show, as our trench warfare coverage continues...

  • Good news for democracy in Minnesota! A federal judge has ordered a mercenary contractor hiring armed para-militia to stalk polling places to stand down after violating federal voter intimidation laws. The company, Atlas Aegis, must also reveal who has been funding their program. The case is a victory for plaintiffs including the Minnesota chapters of the Council on American-Islamic Relations and League of Women Voters, as well as the group Free Speech for People (FSFP) whose lawyers brought the case. We spoke with FSFP attorney Ron Fein last week on the show, the day after the voter intimidation suit was filed in federal court;
  • Good news for voters in Texas! A Trump-appointed federal judge has found Gov. Greg Abbott's exemption for voters and pollworkers to his statewide mask mandate to be in violation of the Voting Rights Act. Masks must be worn inside of all polling places across the Lone Star state of today's ruling. The victory comes not a moment too soon, after several polling officials have already become sickened, poll sites were closed due to sick workers, and maskless poll watchers were said to have been using their presence to intimidate minority voters. That, in a state where the Republicans who have long controlled it went all the way to the Supreme Court to deny almost all voters under the age of 65 the right to request an absentee ballot due to fear of the spiking coronavirus pandemic. It's also another victory --- and a reversal of fortunes --- for the good folks at FSFP, including Senior Counsel Courtney Hostetler, who spoke with us on the show about their case in September, when its outlook then appeared grim;
  • More good news for democracy in Texas! A $31 million effort to improve access to the polls in the nation's third-largest voting jurisdiction, Harris County, which includes Houston, appears to have paid off big time. NBC News reports that more voters have now cast ballots there during early voting than were cast in the entire 2016 election. The increased turnout is thanks to expanded and innovative voting options, such as Early Voting sites that stay open later, some that stay open for 24 hours, and drive-thru polling places. The County's stunning turnaround in a state with notoriously low voter turnout comes after Dems won every countywide office in 2018, increased the elections budget from $4 million under GOP control to $31 million now, and with the hiring of innovative, 33-year old County Clerk Chris Hollins in late summer. Naturally, state Republicans have been challenging virtually every innovation to make it easier for voters to vote in the state's largest county. And while Gov. Greg Abbott has succeeded in limiting ballot drop-off locations to just one per county (from a dozen previously planned for sprawling Harris County, which is larger than Rhode Island), GOP attempts to block drive-thru voting have been denied by the state's all-Republican Supreme Court. Another new case was filed by Republicans this week, however, seeking to actually invalidate the votes of more than 100,000 voters who lawfully cast drive-thru votes during Early Voting.
  • On Monday, the U.S. Supreme Court's issued an appalling ruling that blocks tens of thousands of lawfully cast mail-in ballots postmarked by Election Day from being counted in Wisconsin if they arrive after Election Day due to, for example, slowdowns in U.S. Postal Service delivery by Trump's new Postmaster General. Criticism from legal experts and voting rights advocates of the embarrassingly error-riddled concurring opinion filed by GOP operative turned GOP activist Justice Brett Kavanaugh was swift. We discussed that factually deficient and laughable concurrence with Slate legal journalist Mark Joseph Stern in detail on yesterday's show. Among the egregious errors in the opinion was Kavanaugh's citing of Vermont's election laws. The Sec. of State of Vermont has now written a letter to the Court in response, demanding that the opinion be corrected to include actual facts about the state's voting laws, instead of the phony claims Kavanaugh made as he works toward using his lifetime appointment on the Court to steal this year's election on behalf of the man who appointed him to it;
  • Finally, as mentioned, Desi Doyen joins us for our latest Green News Report, as a record fifth hurricane in a single season slams storm-weary Louisiana today; Trump opens the nation's last protected tropical rain forest to commercial logging; China and Japan vault ahead of the U.S. in their pledges to reach net-zero carbon emissions; and the case is made for Joe Biden to expand the Supreme Court if we are to have any chance of combating our swiftly worsening climate crisis.

On today's BradCast: It's the conversation that everyone in America who gives a damn about democracy needs to be having. And, not in the days just before this November's election --- when it will be too late to do anything about it --- but RIGHT NOW. [Audio link to full show is posted below.]

In Florida, the top Democrat in the state's House of Representative is sounding an "urgent" alarm. He says that absentee ballots in the perpetual swing-state could be gamed by the Trump Administration using the U.S. Postal Service to slow the return of ballots. In the Sunshine State, any ballots that don't arrive at County Headquarters by 7pm on Election Day may not be included in the results. Minority Leader Kionne McGhee is calling for barcodes to be added to absentee ballots so that voters can track whether they have been received by election officials, so that they may otherwise vote in person on Election Day if necessary.

While calling on the state's Republican Governor to take action that would also help Republicans (who voted at a higher rate by mail than Democrats in 2018), a Trump Campaign spokesperson dismissed McGhee's concerns as "an absolutely bogus conspiracy theory by Democrats." (And you know how Trump hates conspiracy theories.) Of course, Republican willingness to commit fraud, especially in Florida elections, is anything but a "conspiracy theory". In fact, Donald Trump himself, just this year, has already committed absentee ballot voter fraud in the state. So, apparently, has his Press Secretary Kayleigh MacEneny. Former GOP superstar Ann Coulter definitely did so. And so, it seems, did Derek Chauvin, the former Minneapolis cop charged with the murder of George Floyd. Chauvin, a property owner in Florida, where he is also a member of the state Republican Party, reportedly voted in the state's elections in 2016 and 2018, despite working and living in Minnesota, in what a Florida attorney and candidate for Pinellas County Supervisor of Elections this year describes as a third-degree felony.

Democrats, meanwhile, have been jailed for much less than what both Trump and Chauvin are accused of having done in Florida.

Presumptive Democratic Presidential nominee Joe Biden is similarly worried about what the current President and his party may do to undermine the 2020 contest, telling The Daily Show's Trevor Noah this week that his "single greatest concern" is that "this President is going to try to steal this election."

Stolen or not, despite Trump's plummeting favorability ratings, this year's critical general elections will be anything but a cakewalk for Democrats amid the added challenge of coronavirus. Tuesday's disastrous primary election in Georgia was just one example of how Republicans are able to disenfranchise tens, if not hundreds of thousands of votes through the use of overly complicated, faulty and unverifiable touchscreen voting machines and electronic pollbooks in combination with poll closures and mail-in ballots that never reach voters at all or fail to arrive back at county headquarters in time to be legally tallied.

Moreover, as a new study [PDF] out this week from the Center for Election Innovation and Research finds, new voter registration rates in 13 different states they examined --- many of them key battlegrounds --- have fallen dramatically since the virus emerged in March and April. After all of those states saw increases in registrations in January, as compared to the same month in 2016, the numbers fell over a cliff compared to the same months four years ago. With DMVs closed in many states, automatic voter registrations have also not occurred since the virus emerged, and many states still fail to offer online voter registration. At the same time, voter registrations by third-party groups have similarly all but vanished as organizations have been unable to carry out their planned spring outreach campaigns.

Longtime voting rights journalist and author ARI BERMAN of Mother Jones joins us on today's program to discuss all of this and much more. His latest article for the magazine, headlined "How the Coronavirus Handed the GOP New Ways to Squash the Vote," details some of the extraordinary measures that Republicans around the country, in state after state, are attempting in hopes of suppressing the vote in 2020. That, combined with the challenges of a global pandemic, could result in big trouble for voters of all stripes this year.

Citing the recent primary election disasters in Georgia, Washington D.C., Wisconsin and Nevada (where, he says, polling place consolidation resulted in the last vote being cast during last Tuesday's primary after 3am on Wednesday!), he warns: "If we don't figure out how to do Vote-by-Mail efficiently, and also how to vote in person efficiently, and also how to do this in a pandemic, we're looking at a possible and likely disaster in November."

We discuss the "ridiculous law" in Texas that disallows voters under 65 years of age from citing fear of coronavirus as a lawful excuse for requesting an absentee ballot; the effort by Republicans in the Iowa legislature this week to prevent their own Republican Sec. of State from sending absentee ballot applications to all of the state's registered voters this November (in hopes of avoiding the very well run primary last week in which he did exactly that); and other ways in which the 2020 elections --- our last firewall against full-on authoritarianism --- could become the nation's latest nightmare. Berman tells me "litigation alone" by Democrats is "not going to be sufficient" to solve this perfect storm of problems.

"These conversations have to happen now," he cautions. "States are running out of time. They're running out of money. Coronavirus is increasing in a lot of places. So I'm really, really concerned," he says. Join the club, Ari. On the upside, Berman also discusses how you can help RIGHT NOW to overcome many of these shameful challenges.

Looks like we gotta lot of fact-checking to do today...

The good news for today's BradCast is that, thanks to so much breaking news on yesterday's show, we've got at least one encouraging new piece of news on a story that we had to bump yesterday regarding Donald Trump's absentee voter fraud felony in the state of Florida. Between that and the false claims made by him and U.S. Attorney General Bill Barr and Arkansas Sen. Tom Cotton (in the pages of the New York Times, shamefully enough) charging that "antifa" is behind the violence seen at some of the mostly peaceful protests across the country over the past week and a half, we've got a lot of fact-checking to do on today's program. [Audio link to full show is at bottom of summary.]

First, Times staffers are livid that that the paper of record gave space to Cotton for an editorial on Wednesday calling for U.S. military troops to be deployed across the country against U.S. citizens under the Insurrection Act. The far-right Republican Senator charged in the piece that "cadres of left-wing radicals like antifa [are] infiltrating protest marches to exploit [George] Floyd's death for their own anarchic purposes." His remarks echo those of Trump, who, on Sunday, declared (falsely) that antifa will be designated as "a Terrorist Organization". In fact, antifa is not an organization. It's a movement of people who oppose fascism and authoritarianism and there is no such federal designation for domestic organizations, even if antifa was one. But the calls of Trump and Barr and Cotton echo what the Times itself described as "misinformation" just two days earlier in an article debunking that myth and several others related to the protest and being circulated widely (and falsely) on social media.

Moreover, the charge that antifa is behind the violence at protests is contradicted by intelligence reports this week from both the FBI and DHS, which find little evidence of antifa involvement, but seem to find plenty of evidence that rightwing white nationalist groups have organized to instigate chaos at otherwise peaceful demonstration around the nation. Continuing video tape evidence of police violently abusing peaceful protesters, including on Wednesday night after many of the demonstrations had otherwise calmed down, doesn't help either. But this week Twitter reported they'd shut down a European white nationalist group posting as "@ANTIFA_US" and tweeting out, for example, messages with a brown raised first emoji and declaring: "Tonight's the night, Comrades. Tonight we say 'F--- The City' and we move into the residential areas... the white hoods.... and we take what's ours."

While that account has been shut down, the white nationalists on the street have not all been. We still do not know the identity of the white man with full face gas mask (pictured above) and a black umbrella, who strolled down the sidewalk in front of the Minneapolis AutoZone last week with a hammer by his side, casually smashing each window of the store. Protesters tried to stop him and to identify him before he slipped away, leading Minnesota Attorney General Keith Ellison to post the video of the man on Twitter, along with the remark: "This man doesn't look like any civil rights protester I have ever seen. Looks like a provocateur. Can anyone ID him?"

And yesterday, in Las Vegas, AP reported on terrorism charges filed against three Nevada men with ties to a rightwing extremist group. They were arrested on Saturday heading to a protest on the Strip after "filling gas cans at a parking lot and making Molotov cocktails in glass bottles," according to the criminal complaint obtained by AP. Two of the men, according to an informant, "discussed causing an incident to incite chaos and possibly a riot, in response to the death" of George Floyd. They are all said to be members of the anti-government "boogaloo" movement, advocating for a new civil war.

It seems its easier to find strawmen to blame for years of systemic racism rather than take responsibility for it. That seems to be what Trump, Barr, Cotton, Fox "News" and all the rest of those looking for someone else to blame for Floyd's death and the resulting outrage seem to be doing. It doesn't seem to be working. But that won't stop them from trying to play a whole bunch of folks just months before the next Presidential election.

Speaking of...as we reported several weeks ago, Donald Trump --- who has been making myriad false claims about absentee voter fraud for weeks now --- is, himself, a voter fraud criminal after illegally voting in Florida this year, by absentee ballot, despite having no lawful permanent residence in the state.

While he claimed late last year to have moved his permanent residence from New York to his Mar-a-Lago club in Palm Beach, his original 1993 agreement with the city when he purchased the property and turned it from a single-family residence into a commercial club, required that nobody could actually live there. So, yes, that is voter fraud, and people in Florida have been charged and even jailed for much lesser infractions of the Sunshine State's elections code.

Yesterday, the Washington Post reported another noteworthy point or two on this story, with yet another update to it today. On Wednesday, the paper reported that Trump, when he filed his Florida voter registration [PDF], listed the White House at 1600 Pennsylvania Ave. as his "legal residence". That means his legal residence is not in Florida and he is, therefore, not allowed to vote there. A month later it appears he tried again, this time specifying Mar-a-Lago's address as his "legal residence." It's unknown what happened in the 31 days between the first and second registration, but maybe Florida generously granted him a mulligan. Of course, that still doesn't make his declared residence at his commercial property in Palm Beach a legal domicile in the state.

Making his case even worse, on Monday, during his infamous phone call with the nation's Governors (in which he described peaceful protesters as "terrorists" and instructed the Governors to "dominate" them or he would send in U.S. troops to do so), he stated: "I live in Manhattan". Oops. That prompted Democratic election attorney Marc Elias to tweet: "Sounds like New York may have a good claim for taxes. And Florida for voter fraud."

And, on that point, the Post updated its story today with the news that a Florida resident has now filed a formal election fraud complaint against Trump, which is what we've been calling for weeks! Under Florida law, the state is now required to investigate the complaint. And because it's a violation of state, not federal, law there is nothing to my knowledge that should prevent the President from being charged with felony voter fraud there. He did it. He should be charged with fraud.

When we painstakingly detailed the voter fraud by former GOP superstar Ann Coulter more than a decade ago after she illegally lied about her address in Palm Beach on her registration application and then unlawfully voted at a precinct she was not entitled to vote in, the state slow-walked their investigation until the statute of limitations ran out. (She also got a helping hand from a former FBI boyfriend). We'll hope that Florida Law Enforcement doesn't try something similar here. Though it would be much harder to do in this instance, given that the crime happened just months ago in this case.

On today's BradCast: Yes, the President of the United States, Donald Trump, committed voter fraud while serving as President of the United States. And, speaking of elections, we had a few on Tuesday in California, Wisconsin and Nebraska. [Audio link to full show is conveniently posted below.]

But first up today, if Trump is accusing someone else of doing something, it's a near certainty it's because he's doing it himself. While he's been busy pretending in recent weeks that Democrats steal elections by absentee voting, it turns out it was Trump himself who actually committed voter fraud in the state of Florida this year when he voted in the Sunshine State's primary election in March by absentee ballot. No, voting by absentee is not a crime or fraud in and of itself (as he continues to claim). But voting in the state of Florida --- in-person or via absentee --- without having a lawful permanent domicile there is, in fact, a felony.

As Washington Post recently documented, thanks to some digging by attorneys, historians and neighbors of Trump's Mar-a-Lago Club, Trump signed an agreement in 1993 that turned Mar-a-Lago from a single family residence into a commercial club. It cannot be both at the same time under state law, despite Trump's recent assertion on a Palm Beach application for approval of a boat dock at his seaside club that the club was his "personal residence".

As the facts started coming out that Trump's claim to have moved his residence from New York to Florida last year was, in fact, unlawful, he quietly rescinded the application for a new dock this week. But he can't rescind the fact that he committed voter fraud in the state of Florida by falsely claiming residency there and then voting unlawfully in their March primary elections. If it was anyone else (any Democrat, anyway), charges would be brought. But, like former GOP superstar Ann Coulter, who also blatantly and knowingly committed voter fraud in Palm Beach, Florida (as The BRAD BLOG meticulously and indisputably documented years ago), Trump will probably find a way to eventually get off the hook for his voter fraud crimes as well. He shouldn't. Even if that means waiting until he's out of office to bring criminal charges against him. Republicans have jailed, fined, deported and otherwise thrown the book at others for far lesser election-related crimes in recent years.

That, as Trump is claiming a bogus (if unspecified) crime by former President Obama that he and Fox "News" have now dubbed "OBAMAGATE" in apparent hopes of tarring Trump's presumptive Democratic challenger, Joe Biden, somehow. The pretend scandal seemly has something to do with Trump's former National Security Advisor Michael Flynn, who twice pleaded guilty in federal court to lying to federal officials about his contact with Russian agents prior to Trump's inauguration and about being an undeclared agent of Turkey even while serving as National Security Advisor. But, despite Trump describing "OBAMAGATE" as the "biggest political crime in American history, by far!," so big, in fact, that it "makes Watergate look small time", neither the President nor Fox "News" seem to be able to explain either what the crime is, or why Trump says that his own Constitutional powers as President allow him to commit any crime he wants, while that same Constitution didn't apply to President Obama apparently (even as there is no evidence to demonstrate that Obama committed any such crime.) It was, however, quite amusing when a guest on Fox "News" recently pointed out that little problem with Trump's otherwise ingenious plan.

Then, we're joined by longtime, champion progressive blogger HOWIE KLEIN of Down With Tyranny to discuss Tuesday's Special Elections for the U.S. House in California and Wisconsin and a big win for progressives in Omaha during yesterday's primary elections in Nebraska. Progressive Democrat Kara Eastman trounced former Republican Ann Ashford, wife of former conservative Democratic Rep. Brad Ashford, to win the Democratic nomination for the U.S. House in Nebraska's 2nd Congressional District. Eastman will run against hard right Republican Trump loyalist Donald Bacon in November, after the incumbent Congressman defeated her by about 2 points in 2018. Klein argues that it sometimes takes a couple runs at it before progressive candidates are able to unseat incumbents. He believes Eastman, a strong supporter of a Medicare for All single-payer universal health care system, has a very good shot at flipping the seat from red to blue this year, fueled by the populist progressive grassroots support that lead to her landslide win on Tuesday

Meanwhile, the news was not as good for Democrats in the two U.S. House Special Elections yesterday. In Wisconsin's 7th Congressional District (so gerrymandered by Republicans that it stretches across 26 different rural counties!), Republican Tom Tiffany easily defeated Democrat Tricia Zunker by about 15 points. As Klein tells me, however, she did better than Clinton in that district, which went for Obama in 2008, Romney in 2012 and to Trump by about 20 points in 2016.

The most stinging loss of the night for Dems had to be in California's 25th Congressional District, where establishment-backed Democratic candidate Christy Smith appears to have lost to Republican Mike Garcia by about 12 points (at least with 82% of ballots now tabulated). This is the seat vacated late last year by freshman Democratic Rep. Katie Hill, who resigned amid a revenge porn and ethics scandal. Klein explains how and why the Democrats lost on Tuesday, and blames much of it on a lack of support --- and, at times, opposition --- from the conservative Democratic Congressional Campaign Committee (DCCC). That election, by the way, is the one that Trump and Republicans were pretending over the weekend was being "stolen by Democrats!"

As co-founder of the BlueAmericaPAC with Heather Digby Parton of Hullabaloo and John Amato of Crooks and Liars, Klein also details several progressive U.S. House candidates today who could use your support in upcoming primaries around the country. Several of them are facing contests with incumbent establishment Democrats over the next two months as nearly 20 different states have yet to hold their primary elections this year...

On today's BradCast: Why Donald Trump finally buckled in his demand for border wall funding and how the unprecedented government shutdown helped distract all of us from the Administration's new policy that endangers children by officially allowing blatant religious discrimination --- at least against religions other than Protestant. [Audio link to show follows below.]

On Friday, Trump caved. He finally agreed to reopen the federal government --- at least temporarily --- after five weeks and the longest shutdown in U.S. history. He pretended he'd made a "deal" with Democrats. In fact, he simply agreed to continue funding the government at its previous levels until February 15. He received zero dollars for his border wall in the bargain, while suggesting during bizarre, inaccurate and, at times, graphic remarks at the White House that, without some sort of "deal" for a wall, he would either shut the government down again in three weeks or declare a "national emergency" to take the money to build it from elsewhere.

There were many reasons Trump finally buckled today, including increasing anger from lawmakers in his own party, plummeting poll numbers, news that the IRS was in "panic mode" without enough workers as tax season begins, and flight delays up and down the Eastern Seaboard thanks to a shortage of Air Traffic Controllers, according to the FAA. But there were at least two stories that the Administration, no doubt, was eager to get off the front pages today and over the weekend.

One, a stunning report from NBC News Thursday night that Trump's son-in-law and senior advisor Jared Kushner had been rejected for top secret clearance in 2017, for a host of reasons, by two career security professionals at the White House, only to have that security recommendation overruled (along with similar rejections for "at least 30" others!) and granted to him by a Trump appointee. Also, Trump's longtime supporter and dirty trickster Roger Stone --- who helped lead the "lock her up!" charge against Hillary Clinton with the release of hacked emails by WikiLeaks --- was arrested in Florida on Friday morning by FBI officials and charged with seven counts of lying to Congress, witness tampering and obstruction of justice by a grand jury convened as part of Robert Mueller's Special Counsel probe. Following the GOP's fake "outrage" about national security concerns related to Clinton's private email server, which Stone helped amplify, there's no small amount of irony here with his arrest on the heels of news that the Trump Administration appears to have forgone top level security concerns altogether in order to allow Kushner and others access to the nation's most closely guarded intelligence materials.

Trump's "deal" to temporarily reopen the government may have served to change the news cycle for a few hours, but it didn't endear him to Republican extremists like Ann Coulter, whose critiques late last year led Trump to break his agreement with lawmakers and demand $5.7 billion for a southern border wall resulting in the five week shutdown. Today she deried him as "the biggest wimp ever to serve as President."

While all of these nightmares have been unfolding in recent weeks, few noticed that the Trump Administration's Health and Human Services Department quietly approved a very controversial waiver to allow a Protestant South Carolina group called Miracle Hill Ministries to discriminate against Muslims, Jews, Catholics and atheists in the placement of foster care children. We're joined by criminal justice reporter AKELA LACY of The Intercept today to explain this very real and disturbing outrage which very few have noticed, and how the Administration's partnership with "Religious Right" Republicans under the guise of "religious freedom" is now officially sanctioning religious discrimination in the U.S.

"South Carolina is saying that the foster care statute in HHS rules and regulations does not specify religion as a characteristic on which they are not allowed to discriminate. They say that the foster care program statute says that agencies that receive federal funding can't deny parents based on race, color or national origin, but that because that statute does not specify religion, the request that Miracle Hill accept these families is outside of the law," Lacy tells me, noting that state law in South Carolina bars this sort of discrimination, as do federal non-discrimination laws that the Administration appears to be ignoring.

"The other really scary part of this," she notes, "is that, aside from these individual waivers, eighty Republican lawmakers signed a letter to the President in May asking for even further repeal of these federal protections against discrimination. So this is not just something that is being advocated for on a state-by-state basis. This is a quiet effort from the right to change these rules in the interests of mostly Christian organizations."

Describing a similar waiver request from Texas --- which also seeks to allow discrimination against LGBTQ families as well --- she says (real) advocates of religious freedoms and civil liberties fear the South Carolina precedent is likely now to spread to other states, other federal agencies, and other matters that reach well beyond foster care while much of the media continue to be distracted with the ongoing Trump chaos...

So --- in addition to the news of the day --- we take a precious few minutes on today's program to reminisce a bit with longtime BradBlog.com legal contributor ERNEST A. After a few words on Canning's latest article at the blog on the "Political Revolution" embodied by the new freshman class of progressive U.S. House members and the many challenges they are now facing down in D.C., we discuss some of the lessons learned and important stories covered at our little, independent, reader- and listener-supported website over the past decade and a half.

Many of the stories we broke years ago --- too numerous to link here, on everything from electronic voting concerns and voting rights to climate change and much more --- have since become part of the national consensus as well as many popular calls for reform. That, even as much (but not all) of our independently verifiable, evidence-based news coverage was marginalized or dismissed by many in the corporate media years earlier. We discuss just a few of those stories today --- too numerous to detail here --- as we look both back and forward on this latest milestone. We also offer thanks to the many who have made all of it possible over the years, from our blogging contributors, to radio affiliate partners, to various whistleblowers (publicly known and unknown) over the years.

  • At the same time, federal aviation unions issued a dire warning about the ongoing effects and potential critical dangers of the shutdown.
  • We share a heartbreaking story about a 10-year old girl who suffered a broken wrist in stoic silence for a week, because she was frightened to tell her father, a Dept. of Homeland Security employee forced to work without pay.
  • Billionaire crypt-keeper and Commerce Dept. Secretary Wilbur Ross took to the airwaves to, essentially, call 800,000 federal workers whiners for needing to use food banks to feed their families, when they could just go out and get a bank loan instead to cover costs until the federal government reopens.
  • In the U.S. Senate, Mitch McConnell finally allowed votes on measures to reopen the government, one from Rs and one from Ds. Both failed to get the 60 votes needed to overcome filibuster, though the D version --- which did not include funding for Trump's border wall --- received more votes than the R version in the GOP-majority Senate.
  • And Trump's former attorney Michael Cohen learned that he may have to appear before both House and Senate Committees next month, despite threats to his family by the President of the United States.
  • Finally. Desi brings us the latest Green News Report, with more bad news about the shutdown and Greenland's melting ice shelf, but some encouraging news on a huge majority of Americans who now appreciate the threat of climate change and on the amazing teen climate activist taking on the corporate powers and millionaire/billionaires at Davos this week...

On today's BradCast, guest hosted by me, Angie Coiro – a passel of news and analysis as we wrap up the week.

First, the latest updates on Michael Cohen's close personal buddies/clients, all of whom are running from him as fast as they can. AT&T’s internal memo (well, hardly internal now) cleaves every connection with him so surgically you can all but catch a whiff of smoke from the cauterization. But how much of what we’ve learned adds up to a breach of law?

Another division – except this one is ongoing, long, and ragged: the gulf between Candidate Trump and his doppelganger occupying the White House. Said doppelganger detailed his new plan to get the price of medications under control. He took the usual opportunities to bash other countries (many of whom don’t have this problem), and President Barack Obama. What he didn’t do is consult Candidate Trump on what he’d promised on this same issue – which is missing from the new plan.

Republicans inside and outside the White House have taken disturbing aim at a sadly vulnerable target: John McCain, of all people. McCain is inching toward the close of his life with terminal cancer. That’s joke fodder for a White House aide, responding to McCain’s opinion on Gina Haspel with “he’s dying anyway” (ha ha ha! No, not funny). His war record was fodder for appalling lies on Fox News. And his intentions for his own funeral – good lord, how do you criticize anyone for their own funeral plans? – met with snide disapproval from Orrin Hatch.

Of course all three have apologized. For whatever that’s worth.

After that, a quick look at the repeating pattern of the now-iconic Disillusioned Middle-American Trump Voter.

And finally, a long conversation with political commentator and author Sally Kohn. Her book The Opposite of Hate explores breakdowns in society as massive as the Israeli/Palestinian divide and the Rwandan genocide. She met people who’ve slowly, tentatively built or rebuilt relationships severed by those political explosions. Maybe the most striking example: the woman who cheerfully sits down for tea with the man who murdered her family.

On today's BradCast, the attempt at verifiable citizen oversight of election results from the 2016 Presidential race gets underway in Wisconsin, and gets stopped dead in its tracks by a Trump legal filing in Michigan. All of that, even as more actual Republican voter fraud (yes, real voter fraud) is revealed by media and rewarded by Donald Trump. [Audio link to show is posted below.]

The state of Wisconsin officially began its *"recount" of some 3 million ballots cast in the 2016 Presidential election today, in the state where Trump reportedly defeated Hillary Clinton by just over 22,000 votes. Unfortunately, several of the largest jurisdictions have decided to simply re-tally their hand-marked paper ballots by the same optical-scan computers which tallied them (either correctly or incorrectly) in the first place. That, despite a host of computer science, security and voting systems experts who continue to argue as loudly as they can (including in recently filed court documents), the only way to know for certain how voters voted is to hand-count those ballots.

Meanwhile, in Michigan late today, where Trump reportedly won by just over 10,000 votes out of nearly 5 million counted, the Trump Campaign filed an objection to Green Party candidate Jill Stein's request for a "recount" there. That legal maneuver will successfully delay the start of counting, which had been scheduled to begin on Friday in the state, until sometime next week. That's a disturbing development, given that all states are federally mandated to have final certified numbers completed by December 13th. It's an echo of the successful GOP efforts to stall and then block entirely, the statewide Florida "recount" in 2000. In a statement in response late today, Stein describes the Trump filing this way: "The Trump campaign's cynical efforts to delay the recount and create unnecessary costs for taxpayers are shameful and outrageous."

At the same time, Trump's brain-addled supporters are buying his lie about "millions" having "voted illegally" in the 2016 election. They have fallen for it thanks, in no small part, to so many years of irresponsible reporting on the matter by corporate media over our publicly-owned airwaves. And yet, so far, the only "illegal" votes that have been found in the 2016 election (four cases in total) were all documented to have been cast by Republicans.

Nonetheless, as we have reported on very high profile Republicans like Ann Coulter and Mitt Romney and Newt Gingrich and many others committing actual voter fraud and voter registration fraud over the years, Trump has now hired a voter fraud felon (see this from 2006) for a top White House national security advisory role. All of that American madness and much more on today's BradCast...

Stephen Bannon doubles-down after revelations, joins long list of prominent Repubs flouting laws designed to prevent voter fraud...

In an epic rant on Friday's BradCast, Brad Friedman eviscerated the hypocrisy revealed, once again, by the apparent voter registration fraud of Donald Trump's newly appointed top campaign boss.

Following the show, and the The Guardian's initial revelations of Stephen Bannon's improprieties, the former chairman of the Alt-right Breitbart "News" site has seemingly doubled-down by re-registering at a different residence in the Sunshine State, one at which he also does not seem to actually reside, according to the paper.

Stephen Bannon, recently appointed as chief executive of the Donald Trump 2016 Presidential campaign, has become the latest addition to a significant and seemingly ever-growing list of high level Republicans who appear to have committed false residency voter registration fraud, as initially reported by The Guardian's on Friday. It is a form of voter fraud that cannot be prevented by polling place photo ID restrictions long sought by Republicans claiming to be concerned with fraud at the polls.

The Guardian first reported that, during two separate periods, Bannon, who currently resides in California, works primarily in Washington DC and New York and also stays at the "'Breitbart embassy,' a luxurious $2.4 million townhouse beside the Supreme Court in Washington DC ", registered to vote in Miami-Dade County, Florida by falsely claiming that he resided in homes he'd rented for his ex-wife, Diane Clohesy. The second home where Bannon was registered from 2014 until two weeks ago was "vacant and due to be demolished to make way for a new development."

Under Florida law, an individual must actually live in the county where he or she is registered to vote. "Willfully submitting false information on a Florida voter registration, is a third-degree felony punishable by up to five years in prison," The Guardian noted, citing Sunshine State elections code.

Those pesky laws --- even amidst wholly disingenuous and easily-disproven GOP claims of a "voter fraud epidemic" amongst Democratic voters --- haven't kept either Bannon or a host of other well-known Republicans from flaunting them...at least until getting caught...

Today on The BradCast, it seems the Republican Party's Presidential nominee can't keep alleged criminals from running his own campaign --- but he wants the American people to trust his plan to keep them out of the country?! [Audio link to today's show posted below.]

Donald Trump may want to carry out some of that "extreme vetting" he has planned for immigrant refugees hoping to come to the U.S., on his own campaign staff. Credible new reports today reveal that Trump's newest campaign chief, Stephen Bannon --- hired after two previous ones were fired --- was charged with domestic violence in the 90s and allegedly threatened retribution against the victim, one of his former wives, for testifying against him.

Separately, it appears that Bannon, previously the chief executive for the far-rightwing Breitbart "News" site, also may have committed voter registration fraud and possibly tax evasion, by registering to vote in a state where he doesn't appear to have ever lived. (Since finishing today's show, the Guardian has now posted a second story to report that, since their first exclusive, Bannon has now moved his Florida voter registration to a different residence.)

If the new evidence reported today holds up, Bannon's case, as I detail on today's program, would be just the latest example of another very high profile Republican who appears to have committed the type of election-related fraud that Republicans disingenuously claim Dems are carrying out, and for which the GOP continues to enact voting restrictions that disproportionately block minority voters at the polls.

As discussed on today's program, we have covered, at The BRAD BLOG, on The BradCast, and in many other publications, in great detail and documentation over the past decade or more, the many cases of actual, well-documented voter and voter registration fraud carried out by the likes of GOP superstars like Ann Coulter, Mitt Romney, the former Sec. of State of Indiana, and a host of many other high-profile Republicans. That long list includes many who have, themselves, long called for "anti-fraud" measures meant only to make it harder for certain perfectly legal voters (Democratic-leaning ones) to participate in U.S. elections.

On today's BradCast, the ugly fight over Presidential campaign 'bigotry' and the righteous battle by Native Americans to block another massive oil pipeline from being constructed in the Dakotas. [Audio link for show is posted below.]

After Hillary Clinton's Reno, NV address today, calling out Donald Trump for mainstreaming "alt-right" White Nationalism in his campaign, and Trump describing her as a 'bigot' in return, we head up to North Dakota, where thousands of Native American tribal members are camping out near the confluence of the Missouri and Cannonball Rivers to protest and, hopefully, block the construction of the massive Dakota Access Pipeline.

David Archambault II (pictured above), Chairman of the Standing Rock Sioux tribe, joins us to explain his concerns about the $3.7 billion dollar project set to pump crude oil 1,200 miles from the Bakken shale region down to refineries in southern Illinois. The tribal leader details the growing prayer camp protest where thousands are now in a stand off with state and federal officials, as well as Dallas-based pipeline owners, Energy Transfer Corporation which, he says, received approval from the U.S. Army Corps of Engineers to build the pipeline across sacred ancestral lands and the tribe's water supplies without appropriate consultation with the sovereign nation.

Archambault explains how the decision to route the pipeline near their reservation was made after determining that any breach of the pipeline there would effect fewer people than an alternate route near metropolitan Bismark, ND. The American Indians, he argues, are once again being forced to pay a price for resource exploitation by others.

"What we look at are not only our ancestral sites, but we are looking at future generations. It may not be impacting our drinking water today or tomorrow, if it does go through, but we have to look after the kids that are not even here yet," Archambault tells me. "So there's a serious issue here with these Dallas-based corporations that are driven by greed and money to get a project done at all cost. And the cost that has to be paid is a burden placed on tribes."

"Ever since we learned about this, we said 'Stop, don't come here. It's a half-mile away from our reservation.' It seems like the company out of Dallas, the Corp of Engineers [and] the federal government does not listen. Right now what's happening is tribes are helping people remember that we are here, and we still exist, and we are a strong voice, and to take notice."

He goes on to detail the "State of Emergency" declared by ND Gov. Jack Dalrymple (R) in response to the protest, the charge in his NYTimes op-ed today that "the state has militarized my reservation", as well as the federal court hearing on Wednesday in Washington D.C. where he is suing in hopes of an injunction to block the construction.

On today's BradCast, a few words on why Donald Trump's remarks about 'Second Amendment people' is more disturbing than he or the RNC or the NRA or Fox 'News' or actual voter fraud criminal Ann Coulter would like you to think.

Also today, three Republican appointed federal judges restore Wisconsin's unlawful Photo ID voting restriction (for now), a federal court in Texas officially restores the right to vote this November to 600k legal, already-registered voters, and I take a whole bunch of listener calls on all of the above.

Plus, Desi Doyen joins us for the latest Green News Report, with several stories that sound more like science fiction horror films than reality. Sadly, however, all of those stories --- including a plan to release genetically-modified mosquitoes to fight Zika in Florida --- are all too real...

Today, Ohio's Republican Gov. John Kasich became the 16th major candidate to enter the GOP race for the 2016 Presidential nomination --- for some reason.

On today's BradCast, I'm joined by Buckeye State journalist John Michael Spinelli of Ohio's influential progressive blog Plunderbund.com to discuss the second term Governor's record and why he might be running.

All of that, even as Donald Trump skyrockets beyond the front of the pack (told ya so!) in the latest Washington Post/ABC News national poll of GOP voters. (Though there is a small but noteworthy caveat.)

We've spent no small amount of time over the years here at The BRAD BLOG calling out the duplicity, hypocrisy, cruelty and even felony crimes of Ann Coulter.

We've personally run her off the radio waves, helped discourage otherwise legitimate news outlets from giving her airtime, lest they damage their own credibility, helped her become persona non-grata at CPAC (where she was previously queen), and helped to document, in no uncertain terms, her own, personal, multiple cases of voter fraud in at least two different states.

People used to ask why we even bothered with her. She was and is, after all, clearly a horrible person with grotesquely ugly, hateful and violent views, and a years-long proclivity for propping herself and her career up at the unapologetically cruel expense of others.

But Ann Coulter mattered. As a GOP Superstar, she helped set the agenda for a huge segment of the nation (whether the chumps, rubes and suckers she helped to influence even knew it, much less were willing to admit it.) And few were able to respond to her bullshit effectively to set the record straight.

The good news, as Heather Digby Parton explains in a detailed column at Salon this week, Coulter, officially, no longer matters. Her books no longer sell, she is no longer the darling of the news networks and, as even she admits, she now has a very difficult time getting booked anywhere, much less being able to sell her once-popular, book-shaped screeds.

"They're ignoring me now!," Coulter whined last month to New York's Annie Lowrey in an article headlined "Ann Coulter Wants to Know Why She Doesn't Make You Mad Anymore".

"Coulter has found herself struggling to annoy, enrage, and otherwise provoke the mainstream media or the left," Lowrey reports. "Bloggers have left her alone. Twitter has left her alone. The networks have left her alone. 'Nobody will debate me!' she said. 'There's been no ABC, NBC, CBS for me on this book!'"

Parton's brief, if detailed history of the once-very relevant rightwing polemicist is actually quite fair (far more than we would have been), as is her conclusion in Salon analysis, explaining why it is --- particular at the dawn of this new Progressive Age --- that Ann Coulter, simply, no longer matters...

We covered too much on the KPFK/Pacifica Radio BradCast this week to go into great detail here, but the common thread seemed to be: Stamping out Zombie Myths.

In other words, those popular lies and deceptions that never seem to die on everything from e-cigs and vaping to the death penalty to Ann Coulter's voter fraud to Fox "News" propaganda on global warming and polling place Photo ID laws (too many of those to link here) to the fight for marriage-equality in Mississippi.

In other words, there was a lot packed in to this week's 58 minutes, including a lot of bullshit to dispel, a bunch of great callers, and even one who totally disagreed with me on e-cigs and children. That was fun.

P.S. During the show, a caller questioned the facts of a quote I read on air from a press release issued today by the Freedom to Marry organization, citing the first Mississippi mayor to call for marriage equality in the state. The quote in question was from the group's President Evan Wolfson, who said in the statement: "More same-sex couples are raising children in Mississippi than in any other state."

The caller, appropriately, challenged the veracity of the statement, and I promised I'd look into the details, since I had just received the release prior to air time and didn't have the details handy. Now I do. Here's where that claim comes from...
