RAW STORY has a statement from Sen. Leahy concerning the subpoenas.

And as Joseph Cannon guest blogged here yesterday, a subpoena was/is needed to begin the impeachment process. Any subpeona issued to Cheney's office and/or the White House. Well, we now have one.

"If Cheney or any of his underlings refuse to comply with a single subpoena --- and that's a very good bet --- he becomes instantly impeachable, on the same grounds that brought down Nixon," wrote Cannon, who knows the topic well.

Stay tuned. It may be a busy summer...

UPDATE 12:06pm PT: In a statement sent to The BRAD BLOG (posted in full below) Sen. Russ Feingold (D-WI), a member of the Senate Judiciary Committee, says "After a year and a half of stonewalling by the Administration...The bipartisan support for issuing these subpoenas demonstrates that both Democrats and Republicans are fed up with the misleading statements from the Attorney General and the Administration about this illegal program."

As Des points out below, top Republicans are now plotting ways to remove Dick Cheney from office. The thinking is that a vacancy in the Veep's office could well provide a berth for one of the 2008 Republican contenders --- McCain or Thompson.

The strategy could work two ways, of course. Anyone who replaces Cheney will get Bush administration "cooties." It won't be easy to wash off the smell by November of 2008.

How to bell the cat? After Downing Street has some excellent suggestions. I have one of my own.

Call on your senators and congressional representatives and ask to have documents subpoenaed from Cheney's office. Which documents? It almost doesn't matter. Documents pertinent to the energy task force. Documents pertinent to the use of torture. Documents pertinent to the Niger forgeries. Anything will more or less do.

All of Cheney's staffers can be subpoenaed as well, on any number of issues. A Congressional investigation of Plame-gate. Haliburton contracts. The refusal to comply with the National Archives. Anything. Everything. All at once.

If Cheney or any of his underlings refuse to comply with a single subpoena --- and that's a very good bet --- he becomes instantly impeachable, on the same grounds that brought down Nixon. Cheney no longer has many friends in Congress. Nobody has his back.

If every person reading these words made the call to his or her House and Senate members, Cheney could well be history. First subpoena, then impeach. That's the plan, and it WILL work.

On January 10th, George W. Bush stood before the nation in a prime-time address and outlined his plan for a so-called "surge" of American troops into Iraq. The explicitly stated purpose of the "surge" was to lower sectarian violence, especially in Baghdad, so that political progress could occur.

"The violence in Iraq --- particularly in Baghdad," Bush admitted, "overwhelmed the political gains the Iraqis had made." The escalation's goal was to cut the level of violence, Bush said, later promising that "If we increase our support at this crucial moment, and help the Iraqis break the current cycle of violence, we can hasten the day our troops begin coming home."

On May 2nd, Bush reiterated that the goal of his "surge" was to bring down the overall amount of sectarian violence in Iraq, saying "The definition of success as I described is sectarian violence down."

Most Americans now agree that the surge is not achieving its intended goal of lowering violence. A CBS/NYT poll in May found that 76% believed the "surge" was either making the situation in Iraq worse, or having no effect whatsoever. Despite the fact that all the "surged" troops are now in place in Baghdad, the second in command in Iraq, Lt. Gen. Raymond Odierno recently conceded that 60% of Baghdad is still out of control.

In the face of a worsening situation in Iraq, military officials have now backed away from the original purpose of the surge-- decreasing the level of violence.

Roger Simon takes Mitt Romney to task on Meet The Press this morning for waffling on the issue of pardons. Romney, who never issued a pardon while serving as Governor of Massachusetts out of respect for jury verdicts, now thinks that Scooter Libby is deserving of a pardon from the current White House occupant. This morning, everyone's talking about this Washington Post profile, which contains the priceless tale of a quietly chuckling Dick Cheney telling Dan Quayle that 43's veep ain't gonna do the traditional funerals-and-fundraisers thang. That was for lesser Vice Presidents.

The Post article plays it cute, in that it begins by denying that Dick is the power behind the throne, and then goes on to prove that very point. Here's one for the 9/11 researchers:

As you know, Dick Cheney recently declared that the Vice President is not really part of the Executive branch of government. Why? Because he doesn't want those snoops at the Information Security Oversight Office to stick their unwelcome noses into Cheney-land. (The job of the ISOO is to oversee how everyone within the Executive branch handles classified material.)

Cheney argues that the Veep has a legislative function, since he casts a tie-breaking vote in the Senate --- a task he has had to perform all of seven times. By this reasoning, the Veep has worked only seven days since January, 2001. Congressional Democrats have crafted the perfect response:

More than that. Dick Cheney has claimed "executive privilege" a number of times, most notably when asked to disclose his energy policy meetings. Legislators have no such privilege. May we see the documents now?

More than that. Do you know the technical grounds for the impeachment charges brought against Richard Nixon? Subpoenas. Nixon ignored them, and so he had to go. Any congressional committee may now subpoena anything it wants from Cheney's office. Not a single document in the joint is protected by executive privilege. Not a single person working under Cheney may claim executive privilege. Dick Cheney has made very clear that he is not part of the executive branch of government.

If Cheney does not comply, he becomes instantly and impeccably impeachable.

Amy Goodman interviews former Marine spokesperson Josh Rushing on Democracy Now about his experiences serving at CENTCOM at the start of the Iraq war. In addition to sending over a Hollywood set designer to build a platform costing hundreds of thousands of dollars, Washington sent political operative Jim Wilkinson, who ran the media operation like a political campaign. According to Rushing, Wilkinson is also "credited with coming up with the line about Gore having invented the Internet," had his hand in the "Brooks Brothers Riot" during the 2000 Florida election recount, and was the guy handing George W. the bullhorn at Ground Zero on September 14, 2001.

Those separate email accounts – email accounts held by people working in the White House and the Office of the Vice President, often with security clearances, but not “.gov” accounts – now threaten to become bigger news. Those alternate accounts, as we know now from work done by the House Judiciary Committee and the Senate Judiciary Committee, and the new report from the House Government Reform and Oversight Committee, both potentially and actually allowed WH and DOJ and OVP personnel to communicate ‘off the books’ up to a point. While theoretically still bound by the rules for preserving presidential records (see below) the 88 government officials with email accounts provided by the Republican National Committee could move with electronic fluidity from their official to their partisan political duties, and back again, with remarkably little scrutiny for the entire four years of Bush’s first term.

So any correspondence about --- for example --- Chandra Levy and Gary Condit, 9/11 and Iraq, anthrax mailings and Judith Miller, will remain lost from public view until the advanced technology of un-deleting can sweep it up from the bottom of whatever files it has been submerged in to date.

Tabling for now such topics as political motivation in the firing and hiring of US Attorneys, the immediate question is, exactly how EARLY did administration personnel start using these alternate email accounts?...

Boo-hoo! I made Tim Griffin cry.

He cried. Then he lied.

You remember Tim. Karl Rove's right hand (right claw?) man. The GOP's ragin' cagin' man.

Griffin is the Rove-bot exposed by our BBC Newsnight investigations team as the man who gathered and sent out the infamous 'caging' lists to Republican state chairmen during the 2004 election.

Caging lists, BBC discovered, were used secretly as a basis to challenge the right to vote of thousands of citizens - including the homeless, students and soldiers sent overseas. The day after BBC broadcast that the Chairman of the Judiciary Committee, John Conyers, sought our evidence on Griffin, Tim resigned his post as US Attorney for Arkansas. That job was a little gift from Karl Rove who made room for his man Griffin by demanding the firing of US prosecutor Bud Cummins.

Last week, our cameras captured Griffin, all teary-eyed, in his humiliating kiss-off speech delivered in Little Rock at the University of Arkansas where he moaned that, "public service isn't worth it."

True. In the old Jim Crow days in Arkansas, you could get yourself elected by blocking African-Americans. (The voters his caging game targeted are - quelle surprise! - disproportionately Black citizens.)

But today, Griffin can't even get an unemployment check. When he resigned two weeks ago following our broadcast, the cover story was that the voter persecutor-turned-prosecutor had resigned to work for Presidential wannabe Fred Thompson. But when Thompson's staff was asked by a reporter why they would hire the 'cagin' man,' suddenly, the 'Law and Order' star decided associating with Griffin might take the shine off Thompson's badge, even if it is from the props department.

Griffin, instead of saying that public service "isn't worth it," should have said, "Crime doesn't pay." Because, according to experts such as law professor Robert F. Kennedy Jr., 'caging,' when used to target Black voters' rights, is a go-to-prison crime.

By resigning, Tim may not avoid the hard questions about caging - or the hard time that might result. When I passed the first set of documents to Conyers (a real film noir moment, in a New York hotel room near midnight), the soft-spoken Congressman said that, resignation or not, "We aren't done with Mr. Griffin yet..."

From Prettyman Courthouse, DC, for the bail hearing today of I. Lewis "Scooter" Libby, where I sat in on the hearing on motions for his pending appeal. Those motions, to keep him free on bail, were unsuccessful as the judge ruled against the defendant.

Approximately 11:30 this morning, U.S. District Court in DC, Judge Reggie B. Walton: “In the interest of full disclosure,” Walton says quietly, “and this may be a sign of the times we live in,” in the wake of his ruling which sentenced Libby to prison, “I have received a number of angry, mean-spirited phone calls and letters regarding the sentence” – “including wishing bad things on me or my family.” – “At first I threw them away, but then I got more letters, even more hateful than the others.” So now, “I’m preserving them – in the event that something does happen [some harm to the judge, presumably]” – the perps can be caught.

The times we live in, indeed. Chalk another smarmy mark up for the noise machine.

On to the bail hearing today: the judge refers to a lengthy footnote in the most recent defense motion which lists a number of convicted criminals who are out on bail – “that list of people out on bail, in white-collar crime cases” [everybody from Martha Stewart on down, out on bail while pursuing appeal] – “I hope that footnote is in there not just because of some assumption that people released pending appeal will include all white-collar defendants.” – “I can’t buy in on that,” Walton says, taking the position that white-collar defendants should be treated the same way as blue-collar defendants, and neither kind of defendant should count automatically on being released on bail pending appeal...

when cindy sheehan's son casey, a loyal enlisted member of the united states army, was killed in combat in iraq, his mother sought an audience with the commander in chief. disturbed that she was rejected in that quest, cindy eventually acquired a five-acre plot of ground five miles from the president's ranch in crawford, texas and named it CAMP CASEY in honor of her son. she used the camp as an outpost for her continued quest to meet with george w. bush, and invited those who supported her cause to join her in texas. over the years the camp has become a haven for iraq and afghanistan veterans opposed to the war and/or its conduct, for peace activists who believe there has to be a better way, for others who simply cannot fathom why the president will meet with oil profiteers, with right-wing religious fanatics, with well-heeled contributors, but NOT with the mother of a son who died serving his country. today CAMP CASEY is as alive as ever.

but when congressional democrats recently backed off of their challenge to the president over funding of the iraq occupation, cindy sheehan reached her point of exhaustion and decided she needed to go home. she put the camp up for sale, and very shortly it became the target of groups supportive of the administration's policies, people who see no problem with the continued needless loss of life in the middle east in support of what amounts to a corrupt oil grab. that's when bree walker stepped in.

this past weekend on her radio program on los angeles' KTLK progressive talk, bree presented cindy with a cashier's check and acquired CAMP CASEY for its original price. her plan is to continue to invigorate the location as a memorial to those who have needlessly and bravely died, and as a monument to all who favor peace, rationality and true free democracy in the United States-- in short, all the causes which have been so flagrantly trampled by the fascist criminals who support and work for george bush.

within the next few weeks a new non-profit organization will be established under which we can all make financial contributions to bree's valuable new outreach and continue the pressure against this administration which has so violently defiled our country and its values. on the weekend of july 7 bree will lead a caravan from southern california to CAMP CASEY for a celebration of cindy sheehan's birthday and of all that cindy has contributed to the cause of truth, peace and justice. until then i invite all of you to express your support to bree for her exemplary patriotism and bravery. you can reach her at breecampcasey@bradblog.com. thank you for supporting this great patriot who has now placed herself squarely in the line of succession which began with nathan hale, patrick henry, paul revere, george washington and their ilk.
