If you haven't already, you should read Glenn Greenwald's full take, published earlier this week, on the Obama DoJ's astonishing invasion of Fox "News" reporter James Rosen's work as a journalist by naming him as an unindicted co-conspirator in order to access his email, phone records and more in the course of the Obama Administration's criminal investigation into an alleged leak of classified material by State Department official Steven Jin-Woo Kim.

(For a somewhat different take on the matter, Jack Shafer's column at Reuters "What was James Rosen thinking?" is smart and worth reading, even as I find it uncomfortably close to flat out blaming the victim.)

To his credit, Greenwald's consistent stance over the years on this issue --- from his documentation of outrageous attacks on journalists and journalism during the Bush Administration, to outrageous attacks on journalists and journalism during the Obama Administration (much of which he references in his report linked above) --- earn him a lot of cred here. It has also earned him scorn from both the Right and supporters of the Obama Administration.

What has made all of this additionally amusing/maddening over the past week, however, has been the hypocritical turn by the Right and Fox "News" --- now that one of its own has been caught in the buzz-saw. Suddenly, they are outraged --- outraged! --- over the chill on journalism and journalistic freedom and the assault on the First Amendment now that it's the Obama Administration that is doing it and, I should add, now that it's being done to them. Recall, they didn't much care --- supported it, in fact --- when there were similar attacks on journalists at New York Times and Washington Post by the Bush Administration. Or, more recently, under Obama, against journalists like Julian Assange at WikiLeaks just a year or two ago. As discussed during my 2010 interview with legendary "Pentagon Papers" whistleblower Daniel Ellsberg, then Fox "News" contributor Sarah Palin, for example, called for Assange to be hunted down like a terrorist "with the same urgency we pursue al Qaeda and Taliban leaders".

True, the Obama Administration has taken the Bush War on Journalism to a whole new and disturbing level, but essentially he's simply continuing --- arguably, fulfilling --- the long-stated, long-supported-by-the-Right positions of the previous Administration. And they are the exact same positions they supported even just a year or two ago when calling for the prosecution of Assange!

It's a pretty clever win-win scam by the Right, in truth. Slam Obama as being "soft on national security!", and then yell and scream about it (justifiably so, in this case) when he takes action to prevent leaks "in the name of national security".

In an update to his full story, Greenwald added the following thoughts along with a short Meet the Press video from 2006 that you need to see. While watching it, please note how favorite Rightwing/Bush Administration son Bill Bennett was pushing for everything that the Right and Fox "News" now claim to be outraged about today. (They really should be outraged about it today, by the way. But they should have been equally outraged about it back when they and Bennett were actually arguing in support of heading straight down the slippery slope we are now gliding down at breakneck speed)...

• A military judge agreed that U.S. Army Private Bradley Manning's pre-trial confinement, for having allegedly leaked classified diplomatic cables, was excessively harsh, but refused to dismiss the charges against him. Instead, the judge reduced 4 months from Manning's potential life sentence that he hasn't even received yet while being jailed for 2 years and 8 months, so far, waiting for his day in military court. The judge also delayed the start of his trial for another 3 months in the bargain.

• 26-year old activist and Internet prodigy and pioneer Aaron Swartz killed himself after what his family describes as bullying by a federal prosecutor who filed 13 felony charges against him --- with potential penalties of nearly 50 years in prison --- for something that has never been a crime and has no victims.

Meanwhile, just a few weeks earlier...

• Britain's largest bank, HSBC, was slapped on the wrist with a $1.9 billion settlement (a few weeks of profit) for having knowingly laundered billions of dollars for drug cartels and terrorist organizations and rogue states after federal prosecutors in the U.S. decided that any harsher punishment --- such as larger fines or taking them to court or, God forbid, sending any single one of their employees or board members to prison for even a day --- would potentially result in bankruptcy for the "too big to jail" international bank.

And, a few weeks before that...

• Oil giant BP pleaded guilty to 11 counts of manslaughter and other criminal charges related to the massive oil spill and deaths of 11 men on the Deepwater Horizon oil rig in the Gulf of Mexico in 2010. They agreed to pay $4.5 billion in fines (they made more than that in profit alone in the third quarter of 2012) over a five year period. Nobody would face any jail time in the settlement.

Yet, all the while...

• NRA stooges continued to pretend that their big bad assault weapons are responsible for keeping this country safe from big government tyranny.

What the fuck is wrong with this picture, those people, this Administration, our Dept. of Justice, and this country?

Speaking to a crowd of supporters from the balcony of Ecuador's U.K. Embassy last Sunday, WikiLeaks founder, Julian Assange, demanded that the United States end its "war on whistleblowers" --- a war that, Assange said, not only threatens WikiLeaks but "the freedom of expression and the health of our societies." The U.S., he said, must choose between returning to the "revolutionary values" upon which it was founded, or "lurch off the precipice, dragging us all into a dangerous and oppressive world under which journalists fall silent under fear of prosecution."

Assange credited citizen activism for the fact that Britain did not carry out its unlawful threat last week to "storm" Ecuador's Embassy, stating:

Assange called upon the U.S. to "pledge, before the world, that it will not pursue journalists for shining a light on the secret crimes of the powerful."

"There must be no more foolish talk about prosecuting any media organization, be it WikiLeaks or be it the New York Times," he declared. "The U.S. Administration's war on whistleblowers must end."

The controversial Assange went on to call for the release of "one of the world's foremost political prisoners, Bradley Manning," noting that the former Army Intelligence Analyst had just "spent his 815th day of detention without trial. The legal maximum is 120 days."

Manning is the U.S. Army Private alleged to have released classified material to Assange's WikiLeaks. Legendary Pentagon Papers whistleblower Daniel Ellsberg, during a late 2010 interview with Brad Friedman, described Manning as a "patriot" for his release of the documents.

Undaunted by a U.K. threat to "storm" Ecuador's London embassy if the Latin American nation refused to hand over WikiLeaks founder Julian Assange to British authorities, this morning, Ecuador granted Assange's request for political asylum.

At a press conference in Quito, Ecuador's foreign minister Ricardo Patino strongly denounced the threat received from the U.K.: "Today we've received a threat by the United Kingdom, a clear and written threat that they could storm our embassy in London if Ecuador refuses to hand in Julian Assange."

Ecuador's decision to grant asylum in the face of the U.K.'s threat have not only triggered a diplomatic row but have threatened to tear apart the very fabric of international rule of law, according to experts. Where one could anticipate Sweden's denouncement of Ecuador's asylum decision as "unacceptable", as it summoned Ecuador's ambassador to Stockholm, the British threat to storm Ecuador's embassy was described by University of Australia Professor of International Law Don Rothwell as "extraordinary" and a "significant violation" of Article 22 of the 1961 Vienna Convention on Diplomatic Rights that could "find its way before an international court."

As Ecuador's foreign minister issued an angry denouncement of the U.K. threat, noting that his nation was "not a British colony", American filmmaker Michael Moore called on his friends in the U.K. to mount a protest of the U.K. threat outside Ecuador's London embassy. Occupy Wall Street protesters called for "people to take part in a 24/7 occupation of the British consulate in New York." Reuters reported a "clash between protesters and British police outside of Ecuador's embassy."

But, as discussed in a must-read opinion piece by Mark Weisbrot of the UK Guardian, the very concept of an international rule of law is open to question given the impunity by which the United States and its allies have operated both at home and abroad...

WikiLeaks founder, Julian Assange, has taken refuge in Ecuador's Embassy in London, where he has applied for political asylum, stating:

Ecuador, which, two years ago, offered Assange asylum and which also has an extradition treaty with the U.S., confirmed that it is considering Assange's asylum application, but stated that its decision to do so, "should in no way be interpreted as the government of Ecuador interfering in the judicial processes of either the United Kingdom or Sweden," according to CNN.

Assange, an Australian, as we previously reported, has maintained that the sex charges against him, and Sweden's request for extradition from England where Assange has been staying since the charges were initially filed against him, are being utilized as an excuse to ultimately transport him to the U.S. for political persecution.

Assange suffered a significant legal setback last week when the UK's Supreme Court dismissed his application to reopen his appeal against extradition. He was scheduled to be extradited to Sweden in nine days.

UPDATE 6/20/12: In a public email, the advocacy group, RootsAction alleges:

The group has an on-line petition requesting that Ecuador grant asylum, which can be signed here.

Meanwhile, the UK's Guardian reports that Assange's asylum request could prove an empty gesture. Absent "giving Assange Ecuadorian diplomatic status...there seems no way in which he can get to Healthrow, let alone Ecuador, without being arrested for breach of his bail conditions," the Guardian reported.

The question now is: Did Boortz incite murder over our public airwaves and should he be prosecuted for it? Moreover, will complaints be filed by the public at the FCC's website (hit the "Take Action" button there, if you'd like to file your own complaint), demanding an investigation and prosecution for the potential crime and/or sanctions against the affiliate stations who broadcast it to the public?...

Who coulda guessed it? And, once again, a nation built on the premise of self-governance owes its continuing great thanks to WikiLeaks and Bradley Manning.

While prepping for tonight's Mike Malloy Show (which I will be busy guest hosting all week), here are just a few of the items which caught my eye so far today...in no particular order...

• Record amounts of cash being spent by labor unions and the (supposedly grass-roots) "Tea Party" on tomorrow's Supreme Court election in Wisconsin, as the race between the unabashedly pro-Walker Justice David Prosser and Asst. Attorney General JoAnne Kloppenburg has turned into a proxy battle between the two clashing ideologies right now in WI. A defeat of Prosser would tilt the court's 4-3 majority from Right-leaning to not Right-leaning. The race is also seen as a bellwether for upcoming recall elections of GOP state Senators likely to occur there in the near future, as Ernie Canning reported on earlier today at The BRAD BLOG.

• Nuclear triage. Workers at the Fukushima Daiichi nuclear plant in Japan are dumping 11.5 tons of "low-level" radioactive water into the ocean to make room in filled storage containers for the more radioactive water leaking from reactor Unit 2. They say they have "no choice," but to dump that water (with radiation levels 100 times over the legal limit) as they must continue injecting new water to cool the plant's four crippled reactors, even as the radiated water floods out. Over the weekend, workers were unsuccessful in their attempt to use polymer, sawdust and newspaper (BP "JunkShot" anyone?!) to plug an 8 inch crack in a flooded tunnel at Unit 2 said to be gushing highly radioactive water, at 100,000 times legal levels, into the ocean.

• Transocean, the owner of the BP oil rig which blew up last year in the Gulf killing 11 workers (9 of them from Transocean) has apologized for referring to 2010's safety record as the company's "best year ever". They have not, however, apologized for issuing enormous bonuses to their executives in the bargain.

• A sweeping new election law in Florida is working its way through the GOP-controlled state legislature along predictably partisan lines, just in time for the 2012 Presidential election there. Some of the proposed changes will make it much more difficult for non-partisan voter registration groups, such as the League of Women Voters, to do their work, and will likely lead to a huge increase in "provisional" (and, therefore, frequently uncounted) ballots. Leon County's highly-respected Supervisor of Elections Ion Sancho has called the bill "a travesty".

• Former U.S. State Department spokesman P.J. Crowley --- recently forced to step down for referring to the treatment of alleged WikiLeaks leaker Bradley Manning as "stupid" --- compares WikiLeaks to the New York Times. The paper's Editor-in-Chief, who has been bashing Julian Assange and WikiLeaks themselves of late, even though the "paper of record" has written hundreds of stories based on WikiLeaks documents, will not be happy. • After relentlessly bashing Democrats for cuts to Medicare vis a vis the 2010 health insurance reform bill, Republican Congressman Paul Ryan plans to largely do away with the program entirely as part of the GOP's proposed budget plans to be revealed shortly.

• Even Republican state Senators in Maine are beginning to become uncomfortable with the radical statements and extremist behavior of the state's new GOP Governor Paul LePage and are asking him to "tone it down". Beginning to see the writing on the wall, boys?

On Thursday night, Comedy Central's Stephen Colbert waded into the HBGary muck with an explanation of the scam that the cyber-security intelligence firm, along with two other firms (government contractors all) were putting together for law firm Hunton & Williams on behalf of Bank of America, in hopes of discrediting journalists and organizations that supported WikiLeaks.

As readers of The BRAD BLOG likely know by now, a parallel $12 million scheme was being hatched by the same law firm and same three cyber-security firms on behalf of the U.S. Chamber of Commerce, targeting me and my family, as well as other citizens and progressive organizations the U.S. Chamber had regarded as their enemies.

(I was likely targeted due to my roll in The BRAD BLOG's co-founding of the non-profit, non-partisan VelvetRevolution.us which has, since late 2009, been running a StopTheChamber.com campaign to expose the insidious, mafia-like tactics of what has become the largest, most extreme corporate lobbying outfit in the nation. Relatedly, late last week, VR filed a complaint with the D.C. Bar Association against the three H&W attorneys heading up these schemes. By the way, though I didn't notice it while watching a Tivo'd verison of the interview above on Thursday night --- so don't know if it was in the actual broadcast, or just added online, by someone --- PC Magazine noticed a curious anomaly at the 3:22 mark of the above video. For no more than a moment, the infamous Guy Fawkes mask from V for Vendetta, often used as a sort of trademark by the "hacktivist" collective Anonymous (the group which inadvertently exposed both of the above described plots when they broke into HBGary's corporate servers and stole the emails describing all of this) is briefly superimposed over Colbert's face, for reasons unknown --- but amusing.

If we have learned anything from WikiLeaks, it's that we must consider the words emerging from the mouths of our political elites as the equivalent to a magician's sleight-of-hand.

During the transition between the Bush and Obama administrations, an astute observer could gain far greater insight on the direction of the new administration by ignoring the then President-elect's lofty rhetoric and focusing instead upon the fact that he chose the Wall Street-connected Larwrence Summers and Timothy Geithner, as opposed to Paul Krugman and Joseph Stiglitz, to serve as his chief financial advisers.

Today, Egypt remains in the midst of a genuine, yet to be completed, democratic revolution. So far, it has produced the resignation of President Hosni Mubarak and a dissolution of Egypt's parliament. However, it has not, as yet, led to real "regime change". Mubarak's hand-picked cabinet remains. So does Vice President Omar Suleiman, whom a May 14, 2007 U.S. Diplomatic cable referred to as "Mubarak's consigliere," and whom Middle East expert Lisa Hajjar refers to as "Egypt's Torturer-in-Chief".

Egypt and the world --- and, indeed, the several other Middle Eastern nation's now seeing similar popular uprisings --- would do well to ignore public remarks by the U.S. President and Secretary of State to the effect that they supported the democratic aspirations of the Egyptian demonstrators and an end to the Mubarak presidency. While their public condemnations of violence against the press and the Egyptian people were appropriate, their reported behind-the-scene effort to have Suleiman lead a "so-called" transitional government speaks volumes.

To understand not only the why of Egypt's democratic revolution --- and many other similar popular revolts now under way in that part of the world --- but also the U.S. response to it, one must understand both the history of an ostensibly benevolent but quietly brutal U.S.-led corporate Empire and the role played by the covert dimension of Empire, particularly as described in Part IV of The BRAD BLOG's five-part 2009 special series on "The History of CIA Torture."* Suleiman, it must be remembered, long served as the chief of Egypt's General Intelligence Service, where he served as the key point man for the U.S., in what what we've described as "surrogate torture" as well as extraordinary rendition...

It's strange, difficult and a bit uncomfortable reporting on the $12 million U.S. Chamber disinfo plot and smear campaign after finding myself (and my family), much less VelvetRevolution.us (VR), the non-profit organization co-founded by The BRAD BLOG, as direct targets of it. As you might have assumed, there is much going on behind the scenes that I can't report on at this time, but I've been happy to see some fairly decent coverage --- even by some in the print MSM, if not much in the broadcast media yet --- of this important, disturbing and still developing story.

It's easier to talk and opine on what I've learned about the plot, as I've been doing in a lot of media interviews over the past week (a few of those radio appearances are linked below), than it is to actually report on it, per se. Yet, there have been several noteworthy points and advancements in the story over the past week since I originally covered it in depth here on Monday.

New information being dug up over the last several days, since I initially reported on this story in depth at the beginning of the week, now indicates that the Chamber Plotters had likely intended to use cyber attacks and hacks against us as well.

Those key updates, and the very quickest of backgrounders for those unfamiliar with the sordid tale up until now, follow below...

A few quick followups tonight to my lengthy story from this morning on the proposed $2 million per month plot created for the U.S. Chamber of Commerce to use tools and techniques from the so-called "War on Terror" against U.S. citizens, journalists and groups who opposed their strong-arm lobbying tactics.

As noted, one of those they'd planned to target in hopes of discrediting in their nefarious scheme was yours truly, as well as my family, and VelvetRevolution.us, the non-profit, non-partisan organization co-founded by The BRAD BLOG. I was specifically targeted personally as the Chamber's first, "Tier 1" opponent in a Power Point presentation prepared for the nation's largest corporate lobby's law firm Hunton & Williams (H&W) by the three cyber-security/intelligence firms, HBGary Federal, Berico Technologies & Palantir Technologies. The triumvirate called themselves "Team Themis" in the plots developed for the U.S. Chamber to fraudulently discredit opponents and for a very similar scheme made for Bank of America to try and disrupt WikiLeaks.

So here are a few items following up on our previous report...

Here's what happened last night in Egypt (late last night in U.S.):

And with that, Egypt effectively "vanished from the Internet" yesterday as the uprising against a repressive, U.S. backed regime began to take full bloom and, as of this hour, continues to rage.

Meanwhile, back in these United States, folks like Sen. Joe Lieberman are pushing a bill, the "Protecting Cyberspace as a National Asset" act, to make provisions for a U.S. government "Internet Kill Switch" to allow them to do the same. Now why would folks like Lieberman want that?

The latest revision of this bill, according to FastCompany, "bans judicial review over executive decrees" to take down all, or portions of, the Internet.

On a very related note... Thanks to the Internet, you can watch the uprising in Egypt going on as we speak, via Al Jazeera English's streaming live coverage here, just in case you find that CNN and the others are still offering wall-to-wall coverage of Charlie Sheen. You can also follow ongoing Twitter reports on Egypt via the #Jan25 and #Egypt hashtags.

And on another very related note... The recent uprising, revolution and new government in Tunisia was triggered, in no small part, thanks to a U.S. diplomatic cable published by WikiLeaks detailing the corruption of the ruling family. That revolution helped spark the one going on right now in Egypt, where the people have taken to the streets to challenge the thirty-year, iron-fisted rule of Hosni Mubarik, a long-time U.S. ally.

WikiLeaks has now released U.S. cables describing "routine and pervasive" use of police brutality and widespread torture by the Egyptian state, our allies, against "criminals, Islamist detainees, opposition activists and bloggers," as The Guardian describes the leaked cables today.

In Yemen, another ally of the U.S., citizen protests inspired by Tunisia and Egypt are also reportedly underway. And this morning, rumors of unrest in Syria were also spreading via Twitter.

With very real democratic revolutions happening in the Middle East --- one of the purported excuses once given for the U.S. invasion and mass murders in Iraq --- coming about through peaceful uprisings (but for governmental aggression in response) there, thanks in no small part to WikiLeaks, wouldn't folks like Joe Biden be wise to reconsider his recent, offensive assessment of WikiLeaks founder Julian Assange as a "high-tech terrorist"?

Perhaps not. Perhaps the Vice President has good reason to stand by that astonishing incitement of violence against a private Australian citizen and an organization neither charged with, nor convicted of, any crimes against the U.S.. After all, we have, for decades, been propping up the repressive Egyptian regime with billions of dollars in funding and armaments. And, by way of reminder, it is being reported that the tear gas canisters being hurled against Egyptian citizen demonstrators right now are clearly and proudly marked as "Made in the U.S.A."

But, of course, "they hate us for our freedoms." So remind us again, Mr. Vice President, who are the terrorists --- high-tech or low-tech --- here?

So, despite all the sturm und drang, despite all the outraged comments from both Republican and Democratic officials, despite all the calls for its founder Julian Assange to be assassinated without trial, criminal charges of any kind, or any due process whatsoever, despite the Vice President of the United States even smearing him as a "terrorist" on network television, it turns out there has been no substantive damage at all from leaked documents published by WikiLeaks and their partner media outfits, according to Mark Hosenball at Reuters, as based on interviews with government officials.

In short, as Salon's Glenn Greenwald describes it today, "To say that the Obama administration's campaign against WikiLeaks has been based on wildly exaggerated and even false claims is to understate the case. But now, there is evidence that Obama officials have been knowingly lying in public about these matters."
