On today's BradCast: It's official. Our former President has now been found liable by a federal jury for sexual assault. And, it's not a matter of partisanship, but a matter of facts and evidence. The Republican Party has now clearly become a Party of Terrorism in these United States. [Audio link to full show follows this summary.]

Among the stories backing up those assertions on today's program...

  • A federal jury in New York on Tuesday, after no more than three hours of deliberation, found Donald J. Trump to liable for sexual abuse and defamation against magazine writer E. Jean Carroll after what she described as a rape in a New York department store in the 1990s. The jury in the civil case ordered Trump to pay some $5 million in damages to Carroll, even as he continued to lie about her both before and after the jury's unanimous decision.
  • Nations around the world are now warning their citizens to take precautions when traveling to the U.S. due to all the terrorism, specifically the gun-violence by domestic-terrorists which the Republican Party refuses to do anything about. Instead, like Texas Governor Greg Abbott --- who has presided over an untold number of mass murders carried out with AR-15 and similar weapons in his state during his three terms as Governor --- they are pretending (again) that the real issue isn't the easy availability of weapons of war, but "mental health". And yet, at the same time, Republicans like Abbott have slashed hundreds of millions of dollars from, you guessed it, mental health care, even while working hard to both take health care away from folks who need it entirely and make it easier for those with and without mental health issues to buy still more high-powered, military-style weapons.
  • We now know the identities of the 8 killed in the weekend mass murder at the Allen, Texas outlet mall, allegedly carried out by a neo-Nazi who echoed many ideas expressed by Republicans in his social media postings. One Korean American six-year old became an orphan during the weekend rampage as his mother, father and younger brother were all killed in the shooting. Two sisters in grade school were also murdered at the same time, along with a mall security guard and several others.
  • Over the same weekend, a 14-year old girl, miraculously, wasn't killed in Louisiana, even though she was shot in the head by a man who saw shadows outside of his house and started shooting at them. The shadows were of neighborhood children playing hide and seek. But, at least the 58-year old man bravely "stood his ground" against the "threat". Yet another victory for the Republican Party of Terror.
  • All of that as the Dept. of Justice Sentencing Memo we discussed on yesterday's program, "throwing the book" at the rightwing, Trump-supporting militia group Oath Keepers for their seditious conspiracy on January 6th at the U.S. Capitol, included a request for increased penalties for "terrorism" in the addition to the charges for which the conspirators were previously found guilty.
  • If being the Party of Terror by Murder and Terror by Insurrection wasn't enough for today's Republicans, they are now working on adding the Party of Economic Terror to their list of accomplishments. With the "X-Date" now looming for when the U.S. Government runs out of borrowing authority to pay its bills --- including payments for decades of stuff mandated by Congress and Presidents of both parties --- the U.S. is facing the real possibility of default for the first time in its history. That's because House Republicans are, so far, refusing to simply vote to raise or ignore the dumb debt ceiling law unless the White House agrees to cut billions of dollars in spending on food assistance, health care (including for veterans) and much more. If the U.S. defaults on its debts and its ability to pay interest on loans, social security checks and salaries to the military (and much, much more), we could see a financial calamity in world markets and economies as early as June 1, according to the Treasury Department.

    If Republicans shoot the proverbial hostage this time around, the Biden Administration is reportedly considering invoking Section 4 of the 14th Amendment, the text of which states clearly, in pertinent part: "The validity of the public debt of the United States, authorized by law, including debts incurred ...shall not be questioned."

    Under this theory, the Treasury Department would simply continue to borrow, as needed, in order to pay bills already incurred, even if Republicans refuse to lift the Debt Limit. Remember, the Executive Branch is required, by law, to pay bills that Congress already mandated be paid. If the Government runs out of money and can't pay its bills, it would be in violation of myriad laws. On the other hand, if Treasury borrows money to pay our bills without the Debt Ceiling limit being raised by Congress, it would also be violating the law, albeit only that one, dumb one and, arguably, the U.S. Constitution. Harvard Law professor Laurence Tribe explains all of this in a weekend op-ed at the New York Times in which he details his reasons for having changed his mind about the debt limit.

  • But, as Simon Rosenberg observed over the weekend, "If there was a terror org operating inside the US, how would it look any different then what we're seeing," from today's Republican Party? Good question, Simon. If al-Qaeda or ISIS had helped people obtain weapons to kill thousands of Americans, attempted to overthrow the U.S. Government in an insurrection and threatened to crash the U.S. and world economies, I suspect we'd have been in an actual shooting war with them long ago...

It was another deadly weekend in the violent state of Texas, thanks, in no small part to the Republican Party of Mass Murder. But on today's BradCast our focus is mostly on accountability for the rightwing Seditious Conspirators who attempted to overthrow the U.S. Government on behalf of lies told by then-President, Donald Trump. [Audio link to full show follows this summary.]

Last Thursday, leaders of the far-right, racist, Trump-supporting Proud Boys gang were found guilty of seditious conspiracy and many other felonies for their part in attempting to carry out Trump's sore-loser insurrection at the U.S. Capitol on January 6, 2021. The verdict mirrored those from previous trials of both Proud Boys gangsters and far-right Oath Keepers militiamen.

On Friday, the Dept. of Justice "threw the book" at the seditious Oath Keepers in a 183-page [PDF] sentencing recommendation filed with the court for organization leader Stewart Rhodes and the others found guilty along with him earlier this year. DoJ recommended a 25-year sentence for Rhodes and slightly fewer years for eight others.

We're joined today by DR. ALLISON GILL, known to many as "A.G." and host of the Mueller, She Wrote podcast and Twitter handle, which covers the daily travails on the road to accountability for our disgraced former President.

Gill, who plowed through the full Sentencing Memo from DoJ over the weekend, breaks down its key elements, including similar sentencing recommendations to those brought for "treason"; additional penalties sought for an "upward departure" due to "terrorism"; and prosecutors asking the judge for consecutive sentences for each of the convictions, rather than concurrent sentences allowing the convicted to serve multiple years-long sentences at the same time.

"All three of things that I was looking for them to do, to 'throw the book' at these seditious conspirators, all of them were done," Gill told me. "So, I am not sure they could have gone any harder than they did."

Most importantly, we discuss why all of this news about the Proud Boys and Oath Keepers convictions is likely very bad news for Trump, who may soon find himself indicted by Special Counsel Jack Smith on charges that the DoJ has now road tested to excellent results in these other sedition and conspiracy trials.

Also, we get Gill's thoughts on the New York Time's curious (understated bombshell?) reference to records recently sought by Smith in his probe of the sensitive documents stolen by Trump from the White House upon leaving office. In the middle of a Times story last week on the "confidential cooperation of a person who has worked for [Trump] at Mar-a-Lago" and the report of large gaps in the security surveillance footage turned over to prosecutors, there was reference to the Trump Organization's dealing with the Saudi Arabia-backed LIV Golf venture, which is holding tournaments at Trump's golf resorts. For some unexplained reason, the Times reports, there have been "previously unreported subpoenas to the Trump Organization" regarding business with Saudi Arabia. Now what does that have to do with the stolen documents case? Curiously, the Times doesn't elaborate, but we discuss the possibilities.

Then, after some news on the apparent white supremacist who shot and killed 8 and critically injured three others at an outlet mall in Allen, Texas on Saturday and on the man who killed another 8 and injured about a dozen others with his SUV outside of an immigrant shelter in Brownsville, Texas on Sunday, we open the phone to callers mostly regarding the DoJ efforts to finally bring the criminal Trump to heal. Though some duped listeners, you may be bemused to learn, just can't understand why we need to prosecute Trump instead of....Joe Biden?!

If you thought you might have heard the end of Clarence Thomas' year's long crime spree as a lifelong Justice on the highest court in the land, think again. More stunning breaking news of his endless corruption on today's BradCast, along with a whole bunch of other newsworthy stuff.

Among that stuff...

  • Democratic state Rep. Justin Pearson was reseated at the Tennessee State House on Thursday, after the Shelby County Commission in Memphis unanimously elected him to be a temporary replacement for himself after he was expelled last week by the out-of-control, racist, gerrymandered GOP majority. Both he and Rep. Justin Jones (who was reseated on Monday after also being elected unanimously to do so by Nashville's Metropolitan Council) were expelled last week after joining a protest at the state Capitol demanding gun safety measures after 3 children and 3 adults were murdered in a mass shooting at a Christian elementary school in Nashville. The white female Democratic legislator who joined the two Justins in the protest was allowed to remain in her seat. We share some of Pearson's remarks after being selected in Memphis to fill his own seat, and after his return to the House today, where Republicans were debating a bill to censor free speech for college students in the state before they tossed out the rules to end all debate and voted for passage of the pro-Big Government, anti-free speech, racist measure.
  • Hey! Texas U.S. Sen. Ted Cruz has a great idea about how to prevent school shootings! Just arm them up with militarized security personnel! "You know, when you go to the bank, and you deposit money in the bank, there are armed police officers at the bank," he declared late last month when announcing his new federal bills to fund armed security guards at the nation's public and private schools. "Why on earth do we protect a stupid deposit more than our children?," he asked on Twitter. And, just days later, you'll never guess what happened at the Old National Bank in Louisville, Kentucky.
  • On the upside, all of this pro-murder, pro-Big Government, anti-free speech, anti-democracy GOP idiocy is being noticed by Americans, it seems. Our guest on yesterday's BradCast, Simon Rosenberg, one of the few who turned out to be right that last year's midterms would not result in a "red wave," draws our attention today to some noteworthy new polling. After their first 100 days, the new U.S. House GOP majority has an abysmal approval rating of negative 24 points overall, and are a jaw-dropping 48 points underwater among independent voters. Rosenberg observed that while he "could write a much longer analysis" of the new survey, "it isn't necessary. These numbers are truly terrible [for Republicans], and they are in serious trouble." We'll see if he turns out to be as right about 2024 as he was about 2022.
  • Speaking of jaw-dropping. Today's exclusive from ProPublica about even more previously unknown corruption of Clarence Thomas may be even more mind-blowing than their exclusive last week revealing that the corrupt U.S. Supreme Court Justice, "accepted luxury travel from [GOP megadonor Harlan] Crow virtually every year for decades, including private jet flights, international cruises on the businessman’s superyacht and regular stays at his private resort in the Adirondacks" while failing to report any of the hundreds of thousands of dollars in gift travel on his financial disclosure forms, as required by law, for all of those years.

    And now today, we learn that Crow directly paid Thomas actual cash money to purchase the Justice's mother's home and several other lots on the same street that were owned by Clarence. His 94-year old mother is still alive, and still appears to live in the house (rent-free?)that Crow purchased before investing some $36,000 in renovations! Because that's just what billionaire real estate tycoons and GOP megadonors do for their closest personal friends who happen to sit on the U.S. Supreme Court.

    All of that, of course, meshes precisely with Clarence's corruption that we reported on way back in 2011, detailing his unlawful failure to list his wife's $120,000 annual salary from the rightwing Heritage Foundation on his annual financial disclosure forms for some 20 years, and the sweet $500,000 in dark money that his wife Ginni's then-new, non-profit political advocacy group received from Crow back in 2009, just after the infamous Citizens United case was heard by her husband at SCOTUS, and just before Clarence and the other Republican Justices released their opinion in 2010, allowing unlimited dark money to political advocacy groups, like Ginni's, to remain undisclosed.

We've got two guests on today's BradCast, both attorneys, with a bunch of information that you likely haven't heard elsewhere. [Audio link to full program follows below this summary.]

First up, we're joined by KASSIE SIEGEL, Director and Senior Counsel of the non-profit Center for Biological Diversity's Climate Law Institute, and Climate Director for the Center Action Fund, where she leads campaigns and litigation focused on reducing climate-warming greenhouse gases and other pollution.

Siegel joins us today to discuss the recent passage and signing of a landmark law in California, shepherded through the state legislature last month in a special session called by Democratic Gov. Gavin Newsom. The new measure enacts first-of-its-kind provisions to finally cut the knees out from under Big Oil price gouging in the Golden State. Among other things, the law will create a state oversight board that will offer unprecedented transparency into the pricing processes of major oil companies and refineries in the state and, if necessary, impose penalties for exceeding reasonable profit margins. That, in a state where Big Oil has clocked record profits over the past year or so, even as they falsely claim their exorbitant price hikes for gasoline were due to global supply shortages.

The new law grants subpoena power to the state to, for the first time, open the books of Big Oil, an industry that has, literally, gotten away with murder for decades. Naturally, they fought tooth and nail to stop the law's passage, but state Dems overcame the pushback to adopt a measure that could become a model for other states as well as the federal government. The oversight and regulatory scheme may even pave the way for oversight and regulation of other industries like Health Care and Internet providers.

"One of the things that is so important about this new law is that it directly confronts the Big Oil playbook that we see them carrying out," Siegel explains. "Big Oil knows that its days are numbered and it is a declining industry. It is declining first here in California. But they have a plan to maximize their profits and maximize the damage they do on the way out the door. This new bill, the first of its kind in the country, is a really important part of pushing back on that, and protecting Californians from this destructive industry."

There is much more in my conversation with Siegel, including where the measure falls short and where California residents need to push Newsom to keep going farther still.

Next, we're joined by long-toiling BradBlog.com legal analyst ERNEST A. CANNING on two different abortion-related lawsuits in the news this week. One is last Friday's outrageous ruling by Trump-appointed, far-right Christian activist U.S. District Judge Matthew J. Kacsmaryk in North Texas, nullifying the FDA's 20-year old approval of mifepristone, a drug used in the majority of the nation's abortions.

As Canning warned in a really helpful explainer on all of this back in February, Kacsmaryk was threatening to issue a ruling likely to take the drug off the market in all fifty states, even though, as the Dept. of Justice has now argued in their emergency appeal seeking a stay (as filed this afternoon), the statute of limitations has long expired for a challenge to a drug approved as safe and effective during the Clinton Administration. As Canning wrote in February, and as the DoJ argues today, the challengers actually have no standing and no injury to bring the suit in the first place, as the physicians involved neither prescribe nor use the the drug themselves.

The other case discussed is one that Canning wrote about today, detailing the challenge brought by physicians and Planned Parenthood in Idaho, challenging the state's extreme, near-total abortion ban. The state statute includes no exceptions for the life of the mother or even cases of rape or incest, though it allows someone charged with having carried out an illegal abortion in the state to try and prove those exceptions in court. Otherwise, the law mandates 2 to 5 years in prison for someone convicted of providing an abortion, and the suspension of the medical license of a provider who assists in any way.

But the federal lawsuit Canning reports on today is to none of those point. The complaint is a challenge to the state Attorney General's recent legal analysis declaring that Idaho doctors may have their licenses to practice suspended for merely "assisting" in an abortion by simply informing a patient that they may obtain a legal abortion in a different state. The plaintiffs argue that the restriction violates the U.S. Constitution's First Amendment Free Speech clause, as well as the interstate commerce clause and the 14th Amendment's right to due process.

After decades as a litigator, does Canning still have confidence that the federal judicial system, corrupted by the far-right, will still be able to the right thing in these cases, respecting the precedent of long-established caselaw and the U.S. Constitution itself? Tune in to find out...

On today's BradCast: The good news just seems to keep on coming. We'll take it while it lasts! Tuesday brought huge election victories for democracy and progressives in Chicago and Wisconsin! [Audio liNk to full show follows this summary.]

In Chicago, Democratic progressive teacher and union member Brandon Johnson defeated conservative, self-proclaimed "tough on crime" Democrat Paul Vallas to become the new Windy City Mayor in a stunning victory.

But the biggest election of the night, and perhaps of 2023, was the Wisconsin state Supreme Court victory of liberal Milwaukee Judge Janet Protasiewicz over far-right former state Supreme Court Justice Dan Kelly, a Republican activist supported by anti-choice groups who advised his party in their failed attempt to overturn the state's 2020 election. Her victory creates a progressive majority on the high court for the first time in 15 years.

In a closely divided state where elections are traditionally very close, often within 1 or 2 points, Protasiewicz reportedly blew Kelly away by a whopping 11 points as of this afternoon's tally. It was Kelly's second defeat in running for the Supreme Court in as many years.

And it comes not a moment too soon. The Badger State's new, 4 to 3 progressive high court majority will likely face a host of critical issues for both the state and nation in the years ahead, including an 1849 abortion ban which Republicans are hoping to enforce; wildly gerrymandered state and Congressional district maps in one of the most gerrymandered states in the nation; voting rights issues; and hopes by Republicans of trying to steal the 2024 Presidential election.

We're delighted to be joined once again today to discuss all of this good news by Wisconsin's favorite son and progressive journalist, JOHN NICHOLS of The Nation, and co-author, with Bernie Sanders, of the new book, It's Okay to be Angry About Capitalism.

Nichols says Tuesday's mayoral race in Chicago was "one of the most significant election results in the country for urban politics in quite awhile." He describes the previously little-known Johnson as having built a "multi-racial, multi-ethnic, multi-generational rainbow coalition" that propelled him to victory. "He beat the guy that everybody bet was going to be the next mayor of Chicago. Brandon Johnson will take office as a progressive who ran on taxing the rich, reforming the police, and investing money in public education, public health, and public services. A pretty remarkable win."

But the bulk of our time is spent discussing the extraordinary, long-awaited Supreme Court victory in Wisconsin, which, with some $45 million spent on both candidates, clocks in as the most expensive judicial race in U.S. history.

"It was a bitter race. It was an intense race," Nichols tells me in trying to explain Kelly's incredible election night remarks in which he attempted to eviscerate his opponent in one of the most incredible sore-loser "concession" speeches in modern memory. Kelly described the contest as "the most deeply deceitful, dishonorable, despicable campaigns I have ever seen run for the courts," going on to attack Protasiewicz as "a serial liar" who has "demeaned the judiciary."

"It's going to go down in history," Nichols says referring to Kelly's election night outburst. "I've seen bitter concessions. I've seen angry concessions. I have seen refusals to concede. I have never, up until now, seen a concession that literally made people cringe."

We've got a lot to discuss about the new majority on the state's high court; what it means for Wisconsin moving forward; whether Republicans, with a narrow state Senate Special Election victory last night will attempt to impeach Protasiewicz with their newly won, gerrymandered super-majority in the upper chamber; and why Nichols, as he reports at The Nation today, believes this was "the most important election of 2023...for any American who cares about democracy, fair elections, voting rights, and much more."

Despite the good news, however, Nichols reminds us that WI is still a closely divided state, capable of wild swings. "The bottom line is this: Don't take your eyes away from Wisconsin," he advises. "It is a battleground state. This is the state of Robert M. LaFollette, the greatest progressive ever to serve in the U.S. Senate, and of Joe McCarthy, the most reactionary person, I would argue, to serve in the U.S. Senate. Those realities still exist. And this Supreme Court race is a very encouraging result as part of a very encouraging pattern in Wisconsin. But when you take your eyes off the prize, when you aren't paying attention, patterns can shift back."

Finally today, with all of the encouraging news of late, a few reminders that all of this good news at the national level, where Republican policies are wildly unpopular, also means that Rightwingers are embracing violent responses and GOP-controlled states are upping their desperation in hopes of holding on to control by hook and by crook. In many such states, it's not creeping authoritarianism in play, it's actual authoritarianism.

In Tennessee, for example, state Republicans are hoping to expel three Democratic state House members who dared support peaceful protesters calling for gun safety measures following last week's school shooting in Nashville. In Texas, GOP state lawmakers have quietly introduced a bill to allow the Sec. of State to overturn election results in the state's most populous and Democratic-leaning County; and in Florida, authoritarian Gov. Ron DeSantis is deploying Big Government weaponization against those, like the Walt Disney Company, who disagree with his anti-freedom, anti-LGBTQ policies...

The Right's hilarious Anti-'Woke' Chronicles continue; Anti-abortion Trump judge making chumps of SCOTUS majority; FL now where freedom goes to die; GA grand juror says Trump revelations 'gonna be massive'...

Weird. It's almost as if Republicans say one thing but do the exact opposite or something. Especially when it comes to freedom, the First Amendment, personal responsibility, parental rights, Big Government regulations, activist judges legislating from the bench, and...well, tune in to today's BradCast for much more. [Audio link to full show follows below.]

Among the stories helping to highlight all of that today...

  • Wingnut children's book author Bethany Mandel made herself famous this week. Not in a good way...but in an hilarious way, as the GOP's silly and desperate Anti-"Woke" Chronicles continue.
  • In their ongoing Anti-Freedom Crusade, Republicans have now figured out how to gerrymander the federal judiciary. Following a four-hour hearing this week in a federal courtroom in Texas, Trump-appointed, far-right, anti-abortion activist U.S. District Judge Matthew Kacsmaryk appears on the precipice of legislating from the bench to nullify the FDA by banning the abortion drug mifepristone. The medication was approved by the FDA for use more than 20 years ago and has proven to be incredibly safe and effective ever since. It is used in more than half of the abortions in the U.S. But, as Ernie Canning detailed last month, Kacsmaryk shouldn't even be hearing this unprecedented challenge. It should be tossed out entirely for numerous legal reasons that he helps explain, including lack of legal standing and statute of limitations. Nonetheless, the lawsuit filed by foes of reproductive rights comes after Sam Alito, Brett Kavanaugh and the rest of the corrupted rightwing SCOTUS majority told us just last year, when overturning Roe v. Wade, that they were doing so in order to "return the issue of abortion to the people’s elected representatives." Kacsmaryk may be many things, including "arguably the worst judge in the United States." But he is definitely not an elected representative of the people.
  • In news of still more rightwing hypocrisy and lies this week, it turns out that Florida is not "where woke goes to die," as Gov. Ron DeSantis likes to sputter. Actually, it's where freedom, the First Amendment and parental rights, among other things, go to die. This week, the state's Dept. of Business and Professional Regulation filed to revoke the Hyatt Regency Miami's liquor license. Their crime? The venue featured the popular Drag Queen Christmas show last year, allowing entrance by those under 18 if they were accompanied by an adult to see the show featuring stars from RuPaul's Drag Race program on VH-1 and MTV. Parents in Florida now have Big Government to co-parent with them, apparently, thanks to the Presidential ambitions of their hypocritical book banning, First Amendment hating Governor.
  • CNN reports exclusively today that "At least two dozen people --- from Mar-a-Lago resort staff to members of Donald Trump’s inner circle at the Florida estate --- have been subpoenaed to testify to a federal grand jury that’s investigating the former president’s handling of classified documents." That, as part of Special Counsel's Jack Smith's federal probe.
  • The Atlanta Journal Constitution has a much more explosive exclusive today, however, as based on their interview of five members of the Special Grand Jury in Fulton County, Georgia who, after eight months investigating Trump's conspiracy to steal the 2020 election in the state, unanimously recommended criminal charges for more than a dozen people to Fulton County District Attorney Fani Willis. There's a whole bunch of fascinating details in AJC's detailed report. But the biggest bombshell likely comes at the very end, when one of the jurors tells the paper: "A lot’s gonna come out sooner or later...And it’s gonna be massive. It's gonna be massive." 👀

There's a reason we don't spend much time discussing the Right's phony "culture war" BS on The BradCast. Today, we talk about why. [Audio link to full show follows below.]

We go into much more detail on the program, but perhaps the biggest reason is likely that most of these so-called "culture wars" aren't any such thing. But talking about it, helps to make them appear to be such a thing. Whether it's outrage over BLM or CRT or, more lately, ESG, the GOP and FNC and all of their various corporate sponsors (mostly from the oil and gas industry), prefer spending time on ginned-up, phony nonsense to keep their readers, listeners and viewers angry, so they don't notice how the Republican Party has absolutely nothing but pain and thievery to offer them.

When the non-wingnut corporate media and Democrats jump in to respond to those ginned-up issues, sadly, the Right has succeeded in creating yet another "partisan" "culture war" out of whole cloth, in which they are able to claim there is a pitched partisan battle between "both sides". They've been mastering this scam for years, and the media and Dems have been falling for it for years as well.

One might think, for example, that the nation is bitterly divided in the "culture war" over abortion rights, one of the GOP's decades-old stand-bys. In fact, it's not much of a partisan or left/right or Republican/Democratic issue at all. The vast majority of Americans, across party lines, support reproductive freedom. And a recently released detailed survey from PRRI (of about 23,000 people in all 50 states!), demonstrates that there is not one single state in the union where a majority of the population supports the overturning of Roe v. Wade. Not one. Not even in the Deep South.

But maybe if you're furious enough about "ESG" you won't notice the Constitutional freedoms the GOP has just stolen from all of us. What's ESG? Well, the folks who watch Fox "News" almost certainly know what it is. It stands for "Environmental Social Governance." And, while the corporate concept has been around for about 20 years, Republicans, with the encouragement (and lots of money) from the fossil fuel industry, have only recently decided to become furious about it. Yup, they're hoping --- and the media are helping --- to turn it into yet another pretend "culture war".

Republican Presidential hopefuls like Florida's Ron DeSantis, Texas' Greg Abbott and former Vice President Mike Pence are all over those "woke" corporations who consider things like the health of the environment when making investments and other business decisions. As discussed today in some detail, Republicans have now decided that sort of thing must stop immediately! Failing to invest as much money as possible, including public funds, in the fossil fuel industry that is helping to wipe out humanity, will almost certainly result in grandma's retirement fund going bankrupt! Or something. And it now appears we're all gonna be dumb enough (again) to help these fake Fox "News" and fossil fuel industry outrages become a real thing.

Just this once --- hopefully, today only --- we're gonna talk about it so you understand exactly what's going on and how you're getting played...so hopefully we'll all stop falling for these scams over and over again.

Also today, a follow-up to a story we covered last week, when Kris Mayes, the new Democratic Attorney General of Arizona, released documents from her office that the previous Attorney General, Republican Mark Brnovich, appears to have forgotten to release before leaving office in January.

Among other things, the documentation reveals that Brnovich's office spent some 10,000 taxpayer-funded hours in 2021 investigating phony claims of election fraud in the state's 2020 Presidential election, assigning everyone in the office to the matter at one point. And though the probe was completed by March 2022, Brnovich never bothered to release the findings, that there was no evidence the election was stolen from Trump in Arizona, to the public. Instead of letting his state and the nation know, during his failed run for the state GOP nomination for U.S. Senate last year, Brnovich lied about the investigation. He told state lawmakers and the public that his office had found "serious vulnerabilities", even while he was ignoring his own staff's recommendations to come clean about the facts.

We covered those disturbing revelations from Mayes last week. And now, the state's new Democratic Governor, former Sec. of State Katie Hobbs, has filed a complaint against Brnovich with the state bar association. Hopefully, that complaint will result in sanctions or even disbarment for the state's corrupt, former top attorney, who was already under sanctions from the state bar association, as it turns out, when he misled the public last year about all of this.

Explaining the bumpy and uncertain legal path toward protecting --- or ending --- a critical reproductive freedom in all 50 states

The nationwide right to terminate a pregnancy with medication is now at stake in three pending federal lawsuits. One, in Texas, has been filed by abortion opponents. Another has been filed in West Virginia by a manufacturer of one of the drugs used to terminate a pregnancy, after state lawmakers have attempted to ban its use in the state. The third is a complaint from a physician in North Carolina where her ability to prescribe the drug may now be in peril.

The outcome of these three cases may ultimately succeed in protecting nationwide access to abortion rights even in states where Republican lawmakers have attempted to ban all such freedoms.

That said, while unlikely, it's also possible that one of these three cases could result in the elimination of the right to medical abortion in all 50 states...

We're old enough at The BradCast to remember when Republicans used to at least pretend to believe in things like "personal freedoms." But, now that Florida's Gov. Ron DeSantis is preparing a run for President in 2024, things are getting mighty early 20th-century German-y these days down in the Sunshine State. [Audio link to full show follows below this summary.]

The recently re-elected Governor is on a roll. Most notably, over the past year or so, he has adopted a "Don't Say Gay" law, threatening school teachers with dismissal for referencing LGBTQ issues in public schools, and, more recently, his "Stop W.O.K.E. Act" to prevent discussion of race issues and other things that the all-mighty State decides may make the parents of a white, straight child uncomfortable. Also known (ironically enough) as the "Individual Freedom Act," a federal judge recently cited George Orwell's 1984 in describing the law as "positively dystopian" as it has resulted in the state-ordered banning of library books.

But DeSantis isn't cowed by courts of law or even public opprobrium. Last Friday, his State Department of Business and Professional Regulation (apparently, Republicans now love state regulations too?) filed a 27-page complaint against The Orlando Philharmonic Plaza Foundation, seeking to revoke their liquor license. Why? Well, last December, for the eighth year in a row, they featured a performance of the popular Drag Queen Christmas national tour and "violated Florida statutes" by allowing parents to bring their children, according to the state's complaint. (So much for "parental choice," which GOPers also used to pretend to believe in.)

Perhaps all of that wouldn't be so bad, if Floridians knew they could hold elected officials accountable at the ballot box. Sadly --- and predictably --- the Governor and his henchmen in the state legislator in Tallahassee are working to make that more difficult as well. Last year, DeSantis signed Senate Bill 524. In addition to giving him a personal special "elections crimes" police force (which he immediately abused by ordering the round-up of former felons at gunpoint and on camera for "voter fraud" even though most had been told by the state they were allowed to vote in 2020), the measure also mimics a law recently adopted by Texas that resulted in a huge percentage of vote-by-mail ballots being rejected in 2022.

The new provision mandates that vote-by-mail voters include a drivers license or social security number on their absentee envelope when casting their vote. However, there's no easy way for voters to know which one of those two numbers will match the number on their registration record and ballots will be rejected without a perfect match. The Texas version of the same law --- being pushed as "model legislation" by the far-right Heritage Foundation in several GOP-controlled states --- resulted in preliminary ballot rejection rates as high as 38% in several counties during last year's primaries.

Now, the bipartisan Florida Supervisors of Elections Association, comprised of elected county elections chiefs, are pushing back against the new law. They argue unanimously in a new report [PDF] that it will result in disenfranchised voters, as well as increased costs to counties and security issues for elections.

We're joined today by ION SANCHO, Florida's legendary, former Leon County Supervisor of Elections who served in the elected position for nearly 30 years before resigning in 2016. He explains the many concerns about the new measure and why it is that election officials around the state are so unanimously troubled by it.

"Even though a majority of the Supervisors of Elections are Republicans, they cannot stomach what they see the Florida legislature doing, because it's real simple --- it's not fair," Sancho tells me. "Every Supervisor of Elections in the state can see that this is simply a partisan attack on voters that the Governor is trying to suppress. That offends them."

The new law, he fears, will be "a logistical nightmare" for election officials. "This whole process --- that we carefully spent a decade building to ensure that legal voters could cast and have that ballot counted --- is under direct threat, and by individuals who haven't a clue about how Florida elections work. Because these recommendations came from Heritage Action, the political arm for the Heritage Foundation."

Sancho is hopeful that some of the Republicans in Tallahassee will listen to the elections officials. "Because where this will blow up, the first election under these new rules," will be the state's March 2024 Presidential Preference Primary, "where you've got to two apex Republicans, possibly, on the ballot. And you don't want that election to melt down. These rules could destroy the Presidential primary in Florida. And wouldn't that put some egg on DeSantis' face."

So well respected by his peers that he was selected by them to oversee the ultimately-aborted 2000 Presidential recount in the state, Sancho charges that "Governor DeSantis has really declared war on any human being that has a different political ideology than himself. It's shocking."

Nonetheless, DeSantis, after winning in 2018 by less than half a percentage point, was re-elected to a second term by a landslide last November, even as Republicans elsewhere in the nation had a very difficult election. Why did he do so well last year? Sancho offers his thoughts on that as well today. And, yes, it has to do with the "tremendous impact" of the Governor's new special election crimes police force and a resulting "complete collapse of African-American voting" last year in the state. But that, Sancho seems confident, is likely to turn around in 2024...at least if their votes are allowed to be tallied.

We're still fighting for accountability after all these years on The BradCast. So why should today be any different? [Audio link to full show follows this summary.]

We kick off today's program with a word or two on our 19th Anniversary of independent investigative journalism, blogging, broadcast, muckraking and trouble-making as we now officially enter our 20th(!) year of doing so at The BRAD BLOG! While I had some thoughts on all of that this morning at the blog, one point of particular pride remains the ongoing billion-dollar lawsuits by voting machine companies against Trump attorneys Rudy Giuliani and Sidney Powell (as well as Fox "News" and a bunch of their on-air hosts.) The reason for the pride is that no small part of the false claims made against Dominion and Smartmatic after the 2020 election by Trump's huckster attorneys spring directly from inaccurate interpretations of accurately reported exclusives at The BRAD BLOG many years ago, particularly in regard to American voting systems and Hugo Chavez.

By the time those defamation suits come to an expensive end, however, it's likely that both Powell and Giuliani will have been disbarred wherever they are currently still licensed to practice law. Just last month, for example, Rudy faced a hearing before the D.C. Bar Association where he is likely to be disbarred for the phony lawsuits he (and Powell) filed on Trump's behalf, falsely claiming fraud following the 2020 election.

Donald Trump's lawyers --- there are lots of them --- have been getting sanctioned in state and federal courts left and right over the past couple of years. But none, to my knowledge, have yet to be disbarred. That could be changing soon for both Giuliani and Powell. And, finally, as of last week, for John Eastman. He's the main attorney behind Trump's failed effort to have Vice President Mike Pence steal the election for him during the joint session of Congress on January 6, 2021, when Joe Biden's Electoral College victory was finally certified after the deadly insurrection at the U.S. Capitol.

Late last week, the State Bar of California announced that Eastman is being charged with "multiple disciplinary counts." He faces 11 charges arising from allegations that he "engaged in a course of conduct to plan, promote, and assist then-President Trump in executing a strategy, unsupported by facts or law, to overturn the legitimate results of the 2020 presidential election by obstructing the count of electoral votes of certain states." The Office of the State Bar's Chief Trial Counsel says he will seek disbarment of Eastman before the State Bar Court. This is serious stuff for an attorney.

We're joined today by former Utah Asst. Attorney General and former University of Utah associate law professor, MICHAEL TETER, who now serves as Managing Director for The 65 Project. The group, named for the approximately 65 failed lawsuits Team Trump filed after the 2020 election, describes its work as "a bipartisan effort to protect democracy...by holding accountable Big Lie Lawyers who bring fraudulent and malicious lawsuits to overturn legitimate election results, and by working with bar associations to deter future abuses by establishing clear standards for conduct that punish lies about the conduct or results of elections."

The group has filed ethics complaints against loads of scammy Trump attorneys across the country and, as Teter explains today, against elected officials who are also licensed attorneys, like Sen. Ted Cruz and Attorney General Ken Paxton, both of Texas, for their fraudulent legal efforts to steal the 2020 election for Trump and rob millions of Americans of their perfectly legal votes.

"It's a solid case," Teter tells me today, regarding the CA State Bar's case against Eastman. "There are no disputes about the facts, quite frankly. Everything that John Eastman was doing and engaging in in 2020 and early 2021 has been well-documented. Those efforts clearly violate the rules of professional conduct that every lawyer swears to abide by. There are no 'slam dunks' in this world, but I think this is a very strong case and the bar wouldn't have brought it forward if it didn't think so, as well."

We discuss how rare cases like these are --- or used to be --- and how much State Bars really aren't prepared for cases like these. It's one of the reasons, Teter explains, that it has taken so long to bring many of these Trump attorneys before the Bar.

"The disciplinary processes set up in the states are not set up in a way to protect democracy or protect the abuse of the legal system" the way Team Trump has abused it. Usually, he says, they examine one page complaints, where an attorney has overcharged a client or something. "The bars need to adjust their thinking and their approaches to make sure they are protecting democracy."

Teter argues that most of the cases brought by Trump and his attorneys after the 2020 election were never meant to win. They were simply meant to allow members of Congress and others to argue that the 2020 results were in dispute. "They knew they didn't have the law or the facts. They were using the court system as a political tool, as part of their propaganda."

"So when they lost these lawsuits it didn't create any disincentive to continue. They got out of them what they wanted," Teter explains. "These bar associations are not used to lawyers using the legal system in this way and they need to get caught up. They need to start thinking about the abuse of the legal system, the abuse of law licenses in this way."

We've got a lot to discuss today with Teter, including the remarkable number of Trump attorneys now facing court sanctions, disciplinary charges and potential disbarment. That, he says, has at least made it more and more difficult for Trump --- and his acolytes like failed 2022 Gubernatorial candidate Kari Lake in Arizona --- to find lawyers willing to represent them.

"MAGA has a new meaning now," Teter quips, "which is Making Attorneys Get Attorneys."

And finally today, as we're on the Trump Accountability beat again (was there ever a time when we weren't?), potentially good news out of New York today, where the Times reports that Manhattan District Attorney Alvin Bragg has begun presenting evidence to a grand jury seeking criminal charges against Trump himself, related to his hush money payoffs to porn star Stormy Daniels in the run up to the 2016 Presidential election...

It's another crazy day in MAGA Land on today's BradCast, as Accountability Season gets a very good start even before the 2022's Election Season fully wraps up. [Audio link to full show is posted below this summary.]

Among our stories today from Accountability Season...

  • BREAKING at the top of today's program: Stewart Rhodes, founder of the far-right Oath Keepers clan (and former BradCast guest!) is found guilty of seditious conspiracy for his involvement in the January 6, 2021 insurrection at the U.S. Capitol. Fellow Oath Keeper Kelly Meggs was found guilty as well. Both now face as much as 20 years in prison on the sedition charges alone. They, and others, were also charged with Obstruction of an Official Proceeding and more. Perhaps our former President who inspired them should begin to be concerned.
  • Speaking of the former guy... Earlier this month, Kremlin-linked Russian businessman Yevgeny Prigozhin, known as "Putin's Chef", boasted on social media that "we have interfered, are interfering and will interfere" with U.S. elections. "Carefully, precisely, surgically and in our own way, as we know how to do." A week or two later, longtime GOP operative Jesse Benton --- who worked for Ron Paul, Rand Paul, Mitch McConnell and Donald Trump, among others --- was found guilty on six counts related to money laundering some $100,000 for another Russian businessman before the 2016 election. He was charged with helping to funnel money to both the Trump campaign and RNC that year. As it happens, both Benton and seditious conspirator Rhodes both got their start in politics working as aides for Rep. Ron Paul. Benton is now married to Paul's granddaughter. He was charged last year (along with yet another BradCast guest --- who died shortly after being charged) just months after Trump had pardoned Benton for separate charges against him regarding campaign finance violations and bribery during the 2012 election. We 'splain the full sordid story and Russian collusion along with wistful memories of Tibetan monks and nuns and Al Gore from back in the day when Republicans used to pretend to care about unlawful campaign donations from foreign sources.

And from Election Season...

  • Welp, the days are getting crazier and crazier in Arizona. On Monday, the deadline for counties there to certify election results before the state certifies all results next Monday, the Board of Supervisors in Cochise County voted against doing so. They claim they will reconsider the matter on Friday. That, despite any evidence of fraud or voting system failure in the Republican-leaning county. Katie Hobbs, the state's Democratic Sec. of State and apparent Governor-elect, quickly went to court yesterday in an attempt to force Cochise to certify their result as, she argues, they are required by law. If they don't, all of the county's voters may be disenfranchised and the results of at least one U.S. House race would flip from Republican to Democratic, along with the statewide contest for Superintendent of Public Instruction. Moreover, any remaining chance for Abe Hamadeh, the GOP candidate running for Attorney General, to overcome his current 510-vote deficit against Democrat Kris Mayes, would almost certainly be gone. As the Arizona Republic's EJ Montini snarks today, if Hobbs was gaming the system to somehow help state Dems this year, as MAGA Republicans baselessly claim, "she really, really stinks at cheating"!
  • Meanwhile, Georgia voters are proving to be really, really good at early voting. They shattered all-time records for doing so on Sunday and again on Monday of this week, outpacing both Presidential and other general elections alike in the state's current runoff election between Sen. Raphael Warnock (D) and Herschel Walker (R) for \ U.S. Senate. The big turnout could be a good sign for Democrats, though that's not certain. The long wait times it is causing for many voters around the Peach State, however, is a certain disgrace. (More on all of that, I hope, on tomorrow's show.)

And in other matters...

  • A bipartisan "Respect for Marriage" bill has been passed by the lame duck U.S. Senate to protect same-sex marriages following corrupt U.S. Supreme Court Justice Clarence Thomas' recent opinion with the overturning of Roe v. Wade arguing that marriage equality should be one of the next rights stolen by the Court from the American people.
