On today's BradCast, it was (another) very bad day for Donald Trump, but a good day for Hillary Clinton, if anybody was able to notice, thanks to another shameful weekend by the mainstream corporate media. [Audio link to show follows below.]

Our stable genius President didn't make it any easier on himself by beginning his day with a grotesquely offensively comparison of his ongoing Constitutional impeachment inquiry to "a lynching". But it got far worse for Trump (if nowhere near as bad as an actual lynching), when his top diplomat in Ukraine, Bill Taylor, testified before impeachment investigators in the U.S. House. The veteran diplomat and foreign policy elder statesman spelled out, in no uncertain terms --- based on copious, contemporaneous notes --- that Trump had personally tied the release of nearly $400 million in military assistance for Ukraine to a quid pro quo requirement that Ukraine's President publicly commit to investigating Trump's 2020 political rival Joe Biden.

The testimony, according to House impeachment investigators, directly contradicts Trump, numerous top White House officials, and a number of Trump-appointees who offered earlier testimony. It also included a 15-page opening statement from Taylor, accurately described as "damning" by a number of Democrats.

Then, while you may or may not have heard about the news which was buried deep inside weekend papers on Saturday, the State Department --- Trump's OWN State Department --- concluded its years-long probe of emails sent to and from Hillary Clinton's private email server. The report, sent to Congress with little or no fanfare from either the media or the Trump Administration, found "no persuasive evidence of systemic, deliberate mishandling of classified information" by Clinton or anybody else in the Department.

The faux "scandal" that Trump, his campaign and his party disingenuously used to help propel him to office in 2016 has officially ended with a barely imperceptible whimper. That, even as top White House officials from daughter Ivanka Trump to son-in-law Jared Kushner to Steve Bannon to Stephen Miller to Executive Agency heads like Education Secretary Betsy DeVos have all since been found to have carried out government business on private email servers and have even reportedly shared classified information on private texting apps.

We're joined today by longtime media analyst ERIC BOEHLERT to discuss not only the phony "BUT HER EMAILS!" scandal that Trump falsely described during his campaign as "worse than Watergate" --- and which even today results in "Lock her up!" chants at his unhinged campaign rallies --- but the corporate mainstream media's dreadful failure and stunning "whitewash" of its own role in colluding with the Trump Campaign by constantly over-hyping the baseless charges in the run up to the fateful 2016 Presidential election.

"The email story does not exist without the Beltway press," Boehlert tells me, noting their coverage of the end of State Department's probe on page 16 (NYT) and 6 (WaPo) on Saturday. "Most of the network newscasts never even reported on the story over the weekend.

"This email story ran from March 2015 to November 2016," he rails. "This story rolled for months and months. If you take one peek, in September 2015, on average, if you look at the Washington Post --- print and online --- they were publishing two Clinton email stories every day for the month of September 2015. We forget how bad it was. Pick your adjective. Mind-boggling. Numbing. Irresponsible. Reckless. And what's important [is] to not let this happen again."

But, of course, it will, especially given the lack of contrition for this failure evidenced by the story's coverage this weekend. "These are smart people," he says. "They play dumb on an epic scale." Boehlert aptly compares the media's failure in becoming "hugely investigated in this story from the get to" to their similarly reckless coverage of the Bush Administration's claim that Iraq had WMD in the run-up to our disastrous war there beginning in 2003. He also goes on to offer warnings about the Administration's schemes to use the very same playbook in 2020.

"If you're concerned that we're going to have a repeat because the press not only refuses to learn any lessons from 2016, but doesn't even admit there are any lessons to be learned --- look at Joe Biden and the Ukraine. It's happening again. Not as bad as the other, because Trump has inadvertently impeached himself by publicly confessing to colluding with a foreign power. But we saw it in the beginning of this story, a lot of headlines, "Trump and Biden both tainted by Ukraine'. No, they're not. Let's not do that," he pleads.

We discuss why this seems to happen over and over (remember how the media fell for the John Kerry "Swiftboat scandal" in the 2004 campaign?) when it comes to the media's coverage of Democrats, what the media should have done both in 2016 and today, and what Americans can do to help avoid being taken for another predictable ride in 2020.

On today's BradCast: The coverage by the corporate media --- and response by many Democrats --- to Attorney General William Barr's terse, misleading 4-page summary of Special Counsel Robert Mueller's report after two years has, by and large, been atrocious in innumerable ways. [Audio link to show follows below.]

We're joined today by HEATHER DIGBY PARTON, who has been covering the corrupt Trump Presidency for years now, including its various Russia-related storylines and other criminal probes at Salon and Digby's Hullabaloo. Among our several related topics of discussion today: Shameful failures by the media and others to demand independently verifiable evidence of speculative allegations both before the confidential Mueller Report was finally delivered to Barr and the subsequent failure by many of the same organizations and individuals in their credulous reporting of Barr's bare-bones, "very, very clever political document" summarizing the sprawling, two-year probe.

Rather than learning from mistakes, many in the media seem to be repeating them all over again in the wake of Barr's memo, which some justifiably regard as a "whitewash" or "cover-up" by a man who was selected by Trump, in no small part, for his previously stated opposition to the probe and to the very notion that any President can legally be charged with Obstruction of Justice. There's much more related conversation here today --- including on the substance of Barr's letter, Deputy AG Rod Rosenstein's curious complicity, and the GOP's premature victory laps --- but you'll have to tune in to listen.

Also on today's program: Though Democrats led a decisive 248 to 181 vote today (with 14 Republicans) in hopes of overriding Trump's veto of the resolution blocking his phony "national emergency" declaration, the effort fell 38 votes shy of the two-thirds majority needed. In the Senate, where 12 Republicans previously voted with Democrats, 59 to 41, to block the President previously, no override vote will now be held since a two-thirds majority vote is required in both chambers. AP described Trump's overwhelming loss in both chambers as a "victory" for the President today, and it will now be left to challenges in court to block Trump's order diverting billions appropriated by Congress to the military to instead build his border wall. Mexico is still not paying for it.

Then, in a major reversal of their previous legal position, Trump's Dept. of Justice filed documents in an appeals court Monday to support striking down the entire Affordable Care Act ("Obamacare") as unconstitutional. While Jeff Sessions served as Attorney General, DoJ had "only" supported gutting provisions that limited premium prices insurers could charge for the elderly and those with pre-existing conditions. Under Barr, however, the Administration now seeks to kill the entire landmark healthcare law. If successful, as many as 30 million Americans would lose their access to affordable healthcare coverage;

Among the stories covered on today's extremely busy program...

  • Late updates on the devastating mud-flows that have, so far, resulted in the deaths of 17 in Southern California's Santa Barbara County, just north of Los Angeles, following a massive rainfall this week in the area just burned by the largest fire in state history;
  • A federal judge has temporarily blocked Donald Trump's attempt to lift the DACA program, which has protected some 800,000 children of immigrants who came here with their parents through no fault of their own;
  • Just days after announcing their intention to open 90% of U.S. coastline to off-shore drilling, Trump's Dept. of Interior chief Ryan Zinke reverses course, but only for the state of Florida, in what appears to be a political (and unlawful) favor to Florida's Governor Rick Scott, who Trump is supporting in a run for the U.S. Senate;

In election and voting news today...

  • Just minutes before Virginia's House of Delegates convened its new legislative session today, Democrat Shelly Simonds conceded her 94th District race against Republican David Yancey without seeking the second "recount" she is entitled to by state law. The first "recount" resulted in a declared "tie" vote and a random drawing, following a very questionable ballot [JPG] counted for the Republican after the initial "recount" had handed the victory to Simonds by a single vote. (She could still ask for a recount as late as the 17th, if she and the Democratic Party wise up and changes their minds. Republicans absolutely would have demanded such a count had the random drawing gone the other way. They would also have prevented her from being seated until that count was completed. Moreover, I share some disturbing comments from a conversation about all of this with the Voter Registrar who oversaw the election in Newport News, VA.)
  • In the 28th District race for Virginia's House, an appeals court denied the Democrats emergency motion for a new election today, after the Republican was declared the winner by 73 votes even though 147 voters were given the wrong ballot on Election Day last November. (With both of those Dems out, the GOP majority in the VA House has shrunk from 66-34 last session, to just 51-49 as of today, despite Democrats winning 55% of the vote statewide in the Republican gerrymandered state);
  • In North Carolina, a federal court panel issued a landmark and blistering ruling on Tuesday night, finding state Republicans had blatantly gerrymandered the swing-state's U.S. House Districts on a partisan bases to ensure a 10 to 3 majority for themselves, in what the panel found to be a violation of the Constitution's Equal Protection Clause. The court ordered new Congressional maps to be drawn up immediately, in the next two weeks, in time for the 2018 primaries. But Republicans vow to appeal the ruling to the U.S. Supreme Court, which is currently deciding a separate but very similar case on partisan gerrymandering of state legislative districts by Wisconsin Republicans.
  • And today, a divided (and stolen by the GOP) U.S. Supreme Court heard oral argument in a case challenging Ohio Secretary of State John Husted's scheme to purge voter rolls after voters have gone just two years without voting in a federal election, in what Democrats and voting rights advocates argue is a violation of the National Voter Registration Act (NVRA).

Finally today...

  • Trump's Energy Secretary and former Texas Governor Rick Perry sees his scheme to extend the life of coal and nuclear plants under the false guise of "grid resiliency" go up in smoke after all of the appointees on the Federal Energy Regulatory Commission (FERC), most of whom were appointed by Trump, unanimously reject the plan, which was seen as a payoff to a coal baron benefactor of both Perry and Trump. A former Trump Campaign official, however, sees a far more insidious (and laughable) conspiracy.

What. A. Mess. Enjoy!...

On today's BradCast: Big wins for Democrats, a public face-plant for a renowned GOP "voter fraud" fraudster, more on Irma's historic devastation, and the scientific facts behind what helped to make it so devastating, from someone who actually knows. [Audio link to full show is posted below.]

Before we get to the increasingly disturbing situation on the ground following Hurricane Irma in Florida and elsewhere --- and why that storm and Harvey before it were so terrible in the first place --- a few news items of note today. First up: Democrats took over two different state legislative seats in special elections wins on Tuesday, one in Oklahoma and one in New Hampshire. Both races were in districts that Trump won by very large margins last November. The victories for Dems --- including huge reported vote swings from R to D --- are of a piece with a series of other special elections held so far this year, including four in Oklahoma alone.

In, yes, related news, former President Jimmy Carter offered some noteworthy statements on North Korea that President Donald Trump may wish to notice, and also some words about worldwide democracy and the need for public oversight of ballot counting.

In the meantime, following some wildly misleading claims about stolen elections and "voter fraud" in New Hampshire from Kris Kobach, the vice-chair of Trump's so-called "Election Integrity" Commission and Sec. of State of Kansas, panelists and members of his own commission, including NH's own Sec. of State, blasted the GOP "voter fraud" fraudster, to his face, during the Commission's second public meeting, held on Tuesday in...NH!

While Republicans are very quick to use even the most sketchy threads of "evidence" they can possibly discover to claim that our democracy has fallen victim to a massive Democratic "voter fraud" conspiracy --- and that we must take radical steps to prevent it, even if it means millions of our fellow citizens lose their RIGHT to vote --- there is, apparently, a very different standard for "evidence" when it comes to climate change. On that, decades of peer-reviewed evidence and tens of thousands of studies don't seem to do the trick, for some reason. That evidence, is simply dismissed by the GOP's fossil fuel-funded cronies. Now it's costing the U.S. --- and the planet --- bigly.

After an update on the death toll and deteriorating conditions in some parts of Florida following Hurricane Irma, we're joined by Penn State University climate scientist and author DR. MICHAEL E. MANN, to discuss what made Hurricanes Harvey and Irma so historically extraordinary (and deadly) and why now is absolutely the right time, despite claims to the contrary by top officials in the Trump Administration and their fellow wingnut denialist community, to discuss the growing impact of our climate crisis and the relationship between that and hurricanes, flooding, wild fires, drought and more across the globe.

"In a word, warmth," Mann tells me when I ask him why Harvey and Irma, from a meteorological perspective, were so uniquely devastating. "Warm oceans mean more moisture in the atmosphere, moisture that's available for record rainfall like we saw in Harvey. It also means greater intensification of these storms --- and indeed, we saw the most intense hurricane ever in the open Atlantic, Irma, at a 185 miles per hour."

He notes that "over the last three years, when global ocean temperatures have been at their warmest, we've seen the strongest hurricane ever, globally, which was Patricia in the Pacific a couple of years ago, we have seen, obviously, the strongest storm in the Northern Hemisphere [Irma]. We've also seen the strongest storm in the Southern Hemisphere [Winston]."

"We've warmed the global oceans more than one degree Fahrenheit. That amounts to about a 7% increase in wind speeds. That 7% increase in wind speed means roughly 20% increase in destructive potential. It's not coincidental that we're noticing that. That is not a subtle climate signal. That is a very tangible impact that warming is having on the destructive potential of these storms."

Mann goes on to explain how the U.S. is "falling behind" Europe when it comes to investment, and accurate results, in climate and weather forecasts; responds to critics who use "straw men" and denial to "muddy the waters" and "poison the well"; draws an interesting parallel between Superstorm Sandy and the Sandy Hook mass murder, in response to those who say "now is not the time to discuss climate"; explains why he believes, as a professor of meteorology, there are still so many broadcast meteorologists in the dwindling denier community (and casts some of the blame for that on his own Penn State); and why he feels that recent comments about climate change from Sen. John McCain may offer reason for optimism.

"Ironically, the era of Trump, as adverse as it might feel when it comes to climate action, may ironically be creating a divide within the Republican Party that could end up leading to a governing coalition for action on climate," says the ever optimistic Mann near the end of today's conversation...

On today's BradCast --- 12 years to do the day since Hurricane Katrina made landfall --- the disaster from Hurricane Harvey continues in Houston. How bad will it get? And will officials finally take action to avoid more such catastrophes? [Audio link to show follows below.]

Catastrophic flooding from Harvey continues today, as an all-time continental U.S. record of nearly 52" of rainfall has been recorded, two of Houston's reservoirs have over-topped their dams, a levee has been breached South of Houston, thousands of rescues continue, tens of thousands are stranded in their homes and in shelters, and we are still days away from the water receding.

It's difficult to explain how much water has fallen. As noted on today's show, generally speaking, one inch of rain equals one foot of snow. So, if this were snow, it would be 50 feet deep in some places! Seth Borenstein at AP reports "By the time the rain stops, Harvey will have dumped about 1 million gallons of water for every man, woman and child in southeastern Texas." Already, as of Tuesday, he notes, "15 trillion gallons of rain have fallen on a large area, and an additional 5 trillion or 6 trillion gallons are forecast by the end of Wednesday...That’s enough water to fill all the NFL and Division 1 college football stadiums more than 100 times over."

DAVID ROBERTS, environment, energy and politics journalist from Vox.com, joins us to discuss the ongoing disaster --- the type of which he has been warning about for more than a decade --- and what we know and don't about the effect of climate change on this storm and its unprecedented rainfall. We discuss the failure of infrastructure officials, in Houston and elsewhere around the nation, to take appropriate measures to help mitigate, much less adapt to, a quickly changing climate that scientists have long warned will become more and more destructive thanks to the continuing man-made emissions of greenhouse gases from the burning of fossil fuels.

"Take climate change completely out of the equation, you still have a Gulf Coast that's subject to these mega-storms every so often, and is planning terribly for them," he notes. "In your Floridas, your Miamis and Houstons, they're just building everywhere they can, and they are all --- institutionally, by habit and by law --- extremely biased in favor of developing, including in these vulnerable areas." Will the destruction of Harvey finally force officials to take appropriate action?

"These disasters seem like a time --- which are very rare in the U.S. these days --- when we set our petty squabbles aside and come together to help people," observes Roberts, before wondering: "What's going to happen when these kinds of crises are striking different regions of the country regularly? Or every year? Or multiple cities at once, as climate exacerbates all this and makes all these disasters worse? I wonder how our capacity for empathy is going to keep up."

We also discuss some new revelations regarding Exxon's decades long private knowledge and public denial of global warming, and Energy Secretary Rick Perry's recently commissioned Energy Dept. study on the effect of renewable energy on the power grid and its relationship, if any, to hastening the demise of the coal industry.

Then Desi Doyen joins us for Green News Report special coverage of the Harvey disaster and, speaking of Exxon, news of refinery shutdowns and toxic petrochemical spills amid the flooding at two of its units in Houston.

Oh, and Donald Trump showed up in Texas today and reportedly turned the appearance into a rally "in front of a few hundred Trump supporters who somehow managed to know exactly where the president was doing the briefing," according to Dallas Morning News' pool reporters. "What a crowd, what a turnout," he said...

On today's BradCast, we pick up with the news that broke at the end of yesterday's show, as a federal court in Texas had --- yet again (for at least the 6th or 8th time, nobody can even keep it straight anymore!) --- found the state's Photo ID voting restriction to be discriminatory, and intentionally so, against racial minorities. [Audio link to show follow below.]

We're joined by journalist and author ZACHARY ROTH, formerly of MSNBC, now of The Daily Democracy, to discuss what he describes as "the Rasputin of voting laws. It just refuses to die."

But, while it may or may not finally be dead forever, U.S. District Court Judge Nelva Gonzalez Ramos has "permanently" struck down both the strict Photo ID law passed by Texas Republicans in 2011 (SB 14) and the amendment to it (SB 5) passed just this year in response to her previous rulings finding that the GOP law was written to intentionally and disproportionately disenfranchise racial minorities.

Roth finds that both of Gonzalez Ramos' rulings, on SB 14 previously and on SB 5 now, are "incredibly careful, well-reasoned and cogent. What she found in Wednesday's ruling is that the new, modified voter ID law that Texas passed this year does not do nearly enough to fix the problems of the original law that led to it being blocked." He says that she found, in fact, some elements of the new amendment make it "even more racially discriminatory" and include harsh new penalties that "appear to be efforts at voter intimidation" which, he describes as a "remarkably strong statement from a judge about a state's intentions."

The biggest questions now are: a) Will the 5th Circuit Court of Appeals, the most conservative in the land, overturn the lower court (they didn't last time)?; b) Will the stolen Republican majority on the U.S. Supreme Court do so?; c) Will SCOTUS finally block all such discriminatory Photo ID laws nationally?, and; d) Perhaps the biggest question: Will Texas finally be bailed back in to the Voting Rights Act's provision requiring federal pre-clearance for all new voting laws in jurisdictions with a long history of racial discrimination? (Texas was covered under that requirement until SCOTUS struck down the VRA's list of such jurisdictions in 2013. Meanwhile, courts have now blocked three different discriminatory voting laws there in just the last eight days!)

We discuss all of that and more with Roth today, including why the GOP has been working so hard, for so many years, to enact this law; the lack of any evidence that it is actually meant to prevent fraud; the Trump DoJ's reversed position on this case; several other recent cases regarding redistricting in TX in which state Republicans were also found to have intentionally discriminated against minorities; and Roth's 2016 book, The Great Suppression: Voting Rights, Corporate Cash, and the Conservative Assault on Democracy.

Then, we received a number of interesting responses this week to my recent discussion with Middle East expert Juan Cole regarding Trump's flip-flop decision to remain in Afghanistan. We share some of those responses --- regarding oil pipelines and opium production --- along with Cole's e-mailed responses to them.

And, finally, Desi Doyen joins us for the latest Green News Report' and a number green-related stories that have broken since, including on Ryan Zinke's Interior Department review of whether or not to shut down a number of National Monuments, Rick Perry's Energy Department review of whether renewable energy threatens the nation's power grid, and Hurricane Harvey which is now set to barrel into the Texas Gulf coast and linger for days, with a huge amount of rainfall along with it...

On today's BradCast: It's been 29 years since NASA's chief scientist, Dr. James Hansen, offered landmark testimony to the U.S. Senate in June of 1988, explaining that scientists had determined with 99% certainty, as the New York Times reported it at the time, that record atmospheric warming since the 1950s "was not a natural variation but was caused by a buildup of carbon dioxide and other artificial gases in the atmosphere." [Audio link to show follows below.]

Of note in the Times coverage at the time --- headlined "Global Warming Has Begun, Expert Tells Senate" --- there was nobody quoted from the fossil fuel industry offering denial to the basic scientific facts about which Hansen and others testified that day, based on temperature records going back (at the time) 130 years, and finding that the first five months of that year had been the hottest on record. (The record temperatures that year don't even rate among the top 20 anymore.)

"It is time to stop waffling so much and say that the evidence is pretty strong that the greenhouse effect is here," Hansen told the paper after his 1988 testimony. "Global warming has reached a level such that we can ascribe with a high degree of confidence a cause and effect relationship between the greenhouse effect and observed warming,'' he testified to the Senators. ''It is already happening now.''

The panel of scientists warned that "If the current pace of the buildup of these gases continues, the effect is likely to be a warming of 3 to 9 degrees Fahrenheit from the year 2025 to 2050." They were pretty much exactly on target, so far, with those projections. Then Senator Timothy E. Wirth (D-CO), chair of the Committee, responded: "'As I read it, the scientific evidence is compelling: the global climate is changing as the earth's atmosphere gets warmer. Now, the Congress must begin to consider how we are going to slow or halt that warming trend and how we are going to cope with the changes that may already be inevitable."

In the 29 years since --- particularly in the seven years since the Supreme Court's Citizen United opinion unleashed unlimited fossil fuel industry funds into our electoral process --- Republicans (and some Democrats) have instead figured out how to "cope with the changes" by denying they exist at all, or pretending there is uncertainty about who is responsible for it.

But the science is very clear, even more now than than. (And it was even clear some 30 years prior to Hansen's 1988 testimony, as a clip from a 1958 television program, dug up by Desi Doyen and played in part on today's show, makes evident.) And yet, the President of the United States and his top lieutenants --- among them EPA Administrator Scott Pruitt and Energy Secretary Rick Perry --- have been taking to the airwaves of late to confuse the public with blatant misinformation to distract from the point that man is responsible for all of Earth's warming recorded since the 1950s.

Marking the 29th anniversary of Hansen's testimony, naturalist and author Tony Russell penned a very simple, very clear explanation --- "Global Warming in a Nutshell" --- of the very simple science and math behind global warming, how we know that man is responsible for the 48% increase of heat-trapping CO2 over the past 60 years (CO2 emitted by the burning of fossil fuels lacks a specific carbon isotope, so we can actually measure it!), and what we must do about it...and quickly. He joins us today to discuss that article, and the reasons he wrote it. "I have 9 grandchildren," he tells me, "so they are very much on my mind."

"In some ways, I'm starting to see our situation as desperate," he warns, explaining how it is that we know that disinformation from folks like Pruitt and Perry is simply, and demonstrably, wrong. "When you have warming in the pipeline, with CO2 hanging in the atmosphere that's going to continue to re-radiate heat for tens of thousands of years, and we keep adding new carbon dioxide to the mix, there's no way to stop it. We're loosing a runaway train."

Noting that natural sources, such as oceans and forests, have been able (at least up until recently) to absorb some 50% of the carbon we release, Russell explains: "If you want to stop adding to the CO2 in the atmosphere, then humans have to cut their emissions by 50% from current levels. The figures you see are usually on the order of cutting emissions by 20% by, say, the year 2025. Every year that you hold it at 20%, then 30% will go into the atmosphere. CO2 levels will keep on climbing, more long term warming will be locked in. It really is that simple."

On the same topic, speaking of U.S. Senate testimony that's been too-much overlooked, as Dr. Joe Romm at Climate Progress notes this week, Sen. Al Franken (D) recently "set climate deniers' last strawman on fire" during an exchange last week with Sec. Perry, when the Minnesota Senator pointed out that even the Koch Brothers own climate scientist Richard Muller recently conceded that all of the recent warming in the atmosphere was due to our burning of fossil fuels. We play the remarkable exchange today in full.
