In response to concerns about the militarization of local police, which America has seen on shameful display in Ferguson, MO following the police killing of Michael Brown, President Obama indicated during a presser last Monday that there could be some change coming.

"There is a big difference between our military and our local law enforcement, and we don't want those line blurred," he said about the horses which long ago left the barn. "That would be contrary to our traditions."

He added: "I think that there will be some bi-partisan interest in re-examining some of those programs."

On Saturday, Obama announced an official review of the Pentagon's "1033 Program" which, since 1990, has transferred, for free, some $4 billion worth of surplus military equipment, such as Mine-Resistant Ambush Protected (MRAP) vehicles, armored Humvees, high-caliber weapons, aircraft, armed drones and silencers, to local law enforcement agencies around the country. As CNN has just reported:

President Barack Obama has ordered a review of programs allowing for state and local enforcement to buy military equipment, a senior administration official said Saturday.

The decision follows public criticism of the use of such assets recently in Ferguson, Missouri.

The review will touch on several points, including

-- Whether such programs and funding are appropriate;

-- Whether state and local enforcement agencies have the necessary training and guidance after getting such equipment;

-- Whether the federal government is sufficiently auditing the use of equipment obtained through federal programs and funding.

White House staff --- including members of the Domestic Policy Council, the National Security Council, the Office of Management and Budget --- will lead the review in coordination with Congress, according to the official.

Reuters adds that "relevant U.S. agencies including the Departments of Defense, Homeland Security, Justice and Treasury," will also participate in the review.

Last week, we reported on the small, but seemingly growing bi-partisan support for re-thinking the federal militarization of local law enforcement agencies. The rightwing New American, citing some of our coverage, has more on the bi-partisan calls for reform, noting that the "SWAT Lobby" (yes, apparently there's a "SWAT Lobby") is now working to defend the program.

On this week's BradCast we interviewed Rep. Hank Johnson (D-GA), a proponent of blocking the transfer of this kind of militarized equipment and for including accountability measures for the billions of dollars worth of equipment which has already been given to local agencies.

"My main hope is to stop the flow of this military grade equipment to local law enforcement agencies throughout America," Johnson told us during the interview on KPFK/Pacifica Radio. "We've been flooding the streets with this surplus military weaponry, and I think the situation in Ferguson exemplifies what happens when you have too much powerful equipment in the hands of folks who don't have the judgment or the training to utilize it properly." The latest version of Johnson's "Stop Militarizing Law Enforcement Act" [PDF] is here. The Congressman had begun work on the legislation long before Ferguson erupted, but is finally receiving recognition for that effort. Now, it seems, he and other proponents may have some support from the White House. But, we'll see. These "reviews" have a way of disappearing into the ether. Legislation like Johnson's, on the other hand, is what is needed to really make a difference in this shameful practice, which has, in truth, become little more than a way around the long-standing Posse Comitatus Act (1878) which expressly limited the use of federal military personnel to enforce local and state laws.

I was joined on this week's KPFK/Pacifica Radio BradCast by Rep. Hank Johnson (D-GA), to discuss his "Stop Militarizing Law Enforcement Act" [PDF] which he plans to introduce when the U.S. House returns from their endless recess in September.

He's been at work on the bill long before the local "RoboCops" hit the streets when Ferguson, Missouri blew up recently after the police killing of Michael Brown. As Johnson described the legislation in his March 2014 USA Today op-ed, presciently headlined "Small town American shouldn't resemble a war zone", the bill would "ban MRAPs, other armored personnel carriers, drones, assault weapons and aircraft" from being transferred to local police departments under the Pentagon's "1033 Program" and "ensure that the Department of Defense undertakes an annual accounting of what's been transferred, by whom and to whom to prevent military items from being auctioned on eBay or sold to friends."

But has the horse already left the barn on this issue? And does the Congressman stand a chance of getting his bill through our broken U.S. Congress, even with some apparent bi-partisan support for curbing police militarization from folks like Republican 2016 Presidential hopeful Sen. Rand Paul, who recently called for the same in a Time magazine op-ed? You'll have to listen below to hear Johnson's thoughts on those questions.

After the Congressman left, I discussed a few other related items, such as the voter registration drive now taking place in Ferguson, and took a bunch of calls on all of the above, including at least one amazing one, in which the caller named "Al" insisted that "minorities are in worse shape than they've ever been" in this country. He says that "since 1965 we have been going down hill as a nation." Hmm... I wonder what might have happened during that year to make him feel that way?

Pete Peterson claimed to 'agree' with Rand Paul's position on voting restrictions, but won't say why, even after the KY Senator flipped

The leading Republican candidate for Secretary of State in California does not want to go on record as to why he once claimed to agree with Sen. Rand Paul (R-KY) that GOP polling place Photo ID restrictions are "offending people".

Pete Peterson is, according to a mid-April Field Poll [PDF], leading a large field of candidates of all parties to become the next chief election official in the Golden State. He's a public policy adviser at Pepperdine University's Davenport Institute (which is funded in part by Charles Koch) and, according to that poll, leads his nearest competitor, Democratic state Sen. Alex Padilla, by double-digits in the state's upcoming June 3rd "Top-Two" primary contest.

Earlier this month, Paul offered a wobbly position on Republican polling place Photo ID restriction laws, at first seeming to buck his own his own party's years-long strategy to impose such disenfranchising statutes in states around the country. "Everybody's gone completely crazy on this voter ID thing," the Senator told the New York Times during an an interview. "I think it's wrong for Republicans to go too crazy on this issue because it's offending people."

On the day the NYT article ran, Peterson --- a Republican running for statewide office in a very "blue" state --- quickly allied himself with Paul, tweeting that he "agree[d] w Rand on his points re voter ID".

But, as we noted when The BRAD BLOG covered Paul's remarks, the Kentucky Republican and 2016 Presidential hopeful, was cagey in his comments to the Times. He didn't declare such laws to be wrong, per se, even though they may serve to remove the voting rights of millions of otherwise perfectly legal (and largely Democratic-leaning) voters. He said only that such restrictions were "offending people". He also later seemed to flip his position on the matter.

Just after the initial comments, however, and Peterson's tweeted claim to agree with him, we asked the candidate to clarify exactly what it was that he was agreeing with in Paul's remarks...

That's the best you've got, 'Senator Freedom & Liberty'?...

Sen. Rand Paul (R-KY) is running for President. There's little question of that. But he's got a lot to get ahead of if he hopes to have a prayer of doing so successfully.

Namely, as even the Rightwing HotAir site observes, he's got some race issues to deal with, such as "his old comments on the Civil Rights Act, his father's newsletters, having the 'Southern Avenger' on staff, even agreeing with Cliven Bundy about federal land-use practices before quickly denouncing him after his comments about blacks went viral."

So Paul has been spending the last year or so on an occasional outreach tour to African-American communities, trying to smooth things over. His latest stop was in Memphis on Friday, where he met with black pastors and, afterward, very softly --- though in terms that will reverberate in a 2016 GOP Presidential primary nonetheless --- broke with his party's orthodoxy on discriminatory polling place Photo ID restriction laws. Sort of...

President says 'all of us should be accountable' for military action against Syria; Places ball in Congress' court...for now...

That headline shouldn't have to be ALL CAPS, since it's the rule of law and all, barring a "national emergency", which clearly this is not. But it's a reflection of how much Executive Power has changed over the past several decades, particularly over the last one.

It's also a reflection of how much many "experts" and pundits had expected an announcement that military action was about to happen, or had already had. That's not what the President's remarks today turned out to be about.

In a statement from the Rose Garden --- with the chanting of anti-war protesters heard in the distance --- President Obama announced that "after careful deliberation," he has "decided that the United States should take military action against Syrian regime targets," in the wake of their alleged August 21 chemical weapons attack against more than 1,400 citizens in a Damascus suburb.

Charging the attack "presents a serious danger to our national security," Obama said military action against the regime "would be designed to be limited in duration and scope," and meant to "hold the Assad regime accountable for their use of chemical weapons, deter this kind of behavior, and degrade their capacity to carry it out."

He explained that while the military is prepared "to strike whenever we choose...our capacity to execute this mission is not time-sensitive; it will be effective tomorrow, or next week, or one month from now. And I’m prepared to give that order."

And then, here was the most newsworthy portion (even if it shouldn't be so):

But having made my decision as Commander-in-Chief based on what I am convinced is our national security interests, I’m also mindful that I’m the President of the world’s oldest constitutional democracy. I’ve long believed that our power is rooted not just in our military might, but in our example as a government of the people, by the people, and for the people. And that’s why I’ve made a second decision: I will seek authorization for the use of force from the American people’s representatives in Congress.

Over the last several days, we’ve heard from members of Congress who want their voices to be heard. I absolutely agree. So this morning, I spoke with all four congressional leaders, and they’ve agreed to schedule a debate and then a vote as soon as Congress comes back into session.

"All of us should be accountable as we move forward, and that can only be accomplished with a vote," he explained, dropping the ball squarely back into Congress' court --- for now.

He also stated that while "the country will be stronger...and our actions will be even more effective" with a Congressional debate and vote to back action, he says he believes he has "the authority to carry out this military action without specific Congressional authorization." He did not state what that "authority" is, however, nor if he will exercise it should Congress vote against authorization, as the British Parliament surprisingly did earlier this week.

The President further offered his argument as to why the United States must take action in this case. [The complete text and video of Obama's remarks are posted at the bottom of this article.]

Congress is not currently scheduled to reconvene from their summer break until September 9. The President did not call them back into session earlier, and, as we pointed out several days ago, while many members have signaled they are willing to come back, if called upon by the President to do so, few if any have actually called on Congressional leaders to summon members back to Washington on their own.

That the President is appearing, for now, to follow the rule of law and the Constitution, and hand back some power to Congress that has, for so long, been usurped by the Executive Branch, left many on Twitter both pleased and agog today. Here's a sampling...

So...funny thing. After yesterday's BradCast on KPFK, I drove the delightful Desi Doyen (of our Green News Report) out to The Young Turks' studio where she was scheduled to guest host once again last night. Two minutes or so before airtime, the third guest-host had yet to arrive. Guess who was drafted into last-minute duty?

Unshaven, jacket-free and prep-less, the show went on. With Desi, myself, and the great Jimmy Dore on board, it was an all-KPFK/Pacifica Radio episode of TYT, to boot!

We discussed, among other things, the mass stabbing in TX yesterday (where nobody died!); Rand Paul's claim that Republicans and he are civil rights champions; Obama's attempt to slash Social Security; and the plan for a vote in the U.S. Senate on a gun sale background check bill.

Lee Fang at Think Progress offers devastating coverage in response to Sen. Rand Paul (R-KY)'s recent claim to The Street's Mallory Factor (video here) that those who pollute streams with benzene should be thrown in jail.

"I don’t want to pollute the water. I don’t want to pollute streams," said Paul, "If you dump benzene in the stream, I want you to go to jail."

Really, Senator? Are you calling for the billionaire Koch brothers --- likely two of your biggest and wealthiest fans --- to be thrown in jail then?

As Fang details, Koch Industries was indicted by the DoJ in 2000 for knowingly dumping "at least 91 metric tons of uncontrolled benzene in its liquid waste streams" at its Corpus Christi refinery, and for conspiring to cover it up in an attempt to deceive regulators.

After George W. Bush took office in 2001, however, "his Attorney General John Ashcroft dropped 88 counts against Koch for the benzene spill and cover-up" in exchange for a guilty plea to falsifying documents and a $20 million fine (a settlement from $350 million in potential fines.)

The Kochs made out pretty well in exchange for their $32,200 contribution to the 2000 Bush campaign. The job killing Koch brothers are making out even better under Barack Obama. But more on that later. [UPDATE: Those thoughts now here.]

Suffice to say, neither the Kochs, nor anybody who works for them, went to jail for "dump[ing] benzene in the stream," as Paul is calling for, even as he calls for doing away with even more environmental regulations in his remarks to The Street.

As we've been highlighting of late, the Republicans have been on a tear against clean air and water regulation by the EPA recently, and have shown themselves willing to partner with their various front groups in the media, at the U.S. Chamber of Commerce, and with folks like the Koch brothers to simply make stuff up about such regulations "killing jobs", in their 2012 "mother of all wars" to retake the White House.

Sanders introduces 'Medicare-for-All,' single-payer bill in Senate; Paul argues it would 'enslave' physicians...

With the backing of the AFL-CIO, National Nurses United, and the International Federation of Professional & Technical Engineers, Sen. Bernie Sanders (I-VT) and Rep. Jim McDermott (D-WA) simultaneously introduced the American Health Security Act of 2011, a Medicare-for-All single-payer system.

The move triggered a "provocative, interesting discussion," as Sanders described it, during a Health, Education, Labor, and Pensions subcommittee hearing in the Senate last week in which the Vermont Senator squared off with Sen. Rand Paul (R-KY) (see video below). Sanders and a physician-witness agreed that treating healthcare as a "right" is consistent with the Hippocratic Oath. For his part, Paul, a self-certified physician, claimed that the establishment of healthcare as a right would turn physicians and their staffs into slaves, with the possibility of police barging into their houses at night to arrest them. Paul's theory that medical care for all "enslaves" doctors and all of those who choose to work in their offices, would no doubt come as a surprise to many physicians who live comfortably in single-payer countries, like the wealthy UK physician interviewed by Michael Moore in Sicko!

Dr. Paul's remarks underscore the extent to which ideology has obscured a basic reality that the core problem is not the ability of American physicians to deliver quality healthcare, but the absurdity of a society which places a greater value on accumulating obscene wealth in the hands of the privileged few above the health and very lives of its citizens...

It is vital that the American people come to appreciate the danger to liberty as well as community posed by doctrinaire libertarianism.

Despite widespread coverage of Rand Paul's absurd criticism of the provisions of the 1964 Civil Rights Act as applied to private businesses, there has been a dearth of analysis as to how this absurdity was brought about by the serious intellectual deficiencies in doctrinaire libertarian philosophy; a philosophy which led to a second astounding Rand Paul remark.

In the face of horrendous safety records on the part of both Massey Energy, which had been found to have violated federal safety regulations thousands of times over the past several years, and BP, which had steadfastly fought off safety measures for deep water oil rigs, Rand summarily dismissed the significance of both the deadly West Virginia mine disaster and the deadly explosion at BP's deep water facility that has produced the worst oil spill in U.S. history with the cavalier, "accidents happen."

What Rand Paul has done is open a window into "libertarianism," which, contrary to the current Wikipedia definition, does not merge into "anarchism." The principle distinction arises because, as explained by Noam Chomsky, anarchism challenges not only authoritarian government but all authoritarian societal structures, including the work place.

Libertarians like Ron and Rand Paul focus exclusively on individual liberty vis-a-vis the government. They fail to appreciate that, especially in the 21st Century, the removal of government as a check against unfettered corporate wealth and power leads to "the tyranny of a corporate controlled economy"...
