On today's BradCast, the latest breaking news on the weekend terror attacks in New York, New Jersey and Minnesota, and on the massive, broken gasoline pipeline in rural Alabama.

First up, the latest on what we know (and don't) about the exploded and unexploded pipe and pressure cooker bombs in NY and NJ and the stabbings at a mall in MN over the weekend, following the arrest of a suspect in the NY and NJ attacks after a shootout with police on Monday morning. We also have responses to all of the above from President Obama as well as Presidential candidates Donald Trump (who blames Clinton and Obama) and Hillary Clinton (who accuses Trump of aiding the terrorists' cause.)

Then, after a quick update on the D.C. Circuit Court of Appeals temporarily blocking construction of the Dakota Access Pipeline in North Dakota late on Friday, we're joined by Alabama Media Group's natural resources reporter Dennis Pillion on the massive pipeline rupture in his state, resulting in a state of emergency in six states, gasoline shortages in the Southeast and, according to the latest estimates from the Colonial Pipeline company and the EPA, the release of some 336,000 gallons of gas into the environment near an abandoned coal mine in Shelby County.

"They are still, ten days after this leak was discovered, having issues accessing the area right around the leak. Those estimates are based on the size of a mining retention pond that has collected a lot of this gasoline," Pillion tells me.

The massive pipeline rupture, as he reports, was discovered by happenstance last week, during an on-the-ground inspection of the abandoned mine after the inspector noticed an overpowering smell of gasoline. As luck would have it, most of the gas from Colonial Pipeline's broken Line 1 --- which pumps some 1.3 million barrels of fuel every day from refineries in Houston, TX through nearly a dozen states up to Linden, NJ --- has reportedly ended up in an old retaining pond from the coal mine. The toxic fumes have made it difficult for emergency responders to begin clean up or for journalists to confirm the official information while they are still barred from the area entirely.

"We don't know when it would have started leaking," Pillion says. "Colonial does says they monitor their lines twice a week by air, looking for evidence of leaks --- dead vegetation, sheens on water, that kind of thing. And they said they did not notice anything in their air patrols, nor did they notice by volume that they were losing product." That's right. They inspect the underground pipeline twice a week from an airplane.

Pillion brings us up to date on what we know (and don't) about the spill and its clean up at this time, while officials from the pipeline company, as well as federal, state and local officials respond to the disaster. He also offers the latest from local environmental groups who remain concerned about dozens of endangered and threatened species of fish and snails found nowhere else in the world but in the nearby Cahaba River.

Finally, as Clinton and Trump are now reportedly tied in polls across 13 swing states, Obama offers impassioned remarks at the Congressional Black Caucus Dinner in Washington D.C. on the imperative of voting in this year's Presidential Election...

Today on The BradCast, it seems the Republican Party's Presidential nominee can't keep alleged criminals from running his own campaign --- but he wants the American people to trust his plan to keep them out of the country?! [Audio link to today's show posted below.]

Donald Trump may want to carry out some of that "extreme vetting" he has planned for immigrant refugees hoping to come to the U.S., on his own campaign staff. Credible new reports today reveal that Trump's newest campaign chief, Stephen Bannon --- hired after two previous ones were fired --- was charged with domestic violence in the 90s and allegedly threatened retribution against the victim, one of his former wives, for testifying against him.

Separately, it appears that Bannon, previously the chief executive for the far-rightwing Breitbart "News" site, also may have committed voter registration fraud and possibly tax evasion, by registering to vote in a state where he doesn't appear to have ever lived. (Since finishing today's show, the Guardian has now posted a second story to report that, since their first exclusive, Bannon has now moved his Florida voter registration to a different residence.)

If the new evidence reported today holds up, Bannon's case, as I detail on today's program, would be just the latest example of another very high profile Republican who appears to have committed the type of election-related fraud that Republicans disingenuously claim Dems are carrying out, and for which the GOP continues to enact voting restrictions that disproportionately block minority voters at the polls.

As discussed on today's program, we have covered, at The BRAD BLOG, on The BradCast, and in many other publications, in great detail and documentation over the past decade or more, the many cases of actual, well-documented voter and voter registration fraud carried out by the likes of GOP superstars like Ann Coulter, Mitt Romney, the former Sec. of State of Indiana, and a host of many other high-profile Republicans. That long list includes many who have, themselves, long called for "anti-fraud" measures meant only to make it harder for certain perfectly legal voters (Democratic-leaning ones) to participate in U.S. elections.

And, as if Trump's "extreme vetting" for his own campaign staff hasn't yet failed spectacularly enough by now, we end today's show with still one more brand new example! Yes, it's an epic romp through recent historical GOP hypocrisy on today's BradCast. Buckle up, and please enjoy responsibly!...

Guest: Princeton computer scientist, vote system 'hacker' Andrew Appel...

Today on The BradCast, exceedingly powerful hacking tools from the NSA make their way to the black market as concerns about hackable U.S. election systems continue to raise concerns just weeks before our next Presidential Election. [Audio link to the show posted at end of article below.]

A shadowy hacking organization, thought to be a foreign entity, has made a set of hacking tools --- thought to have been purloined in some fashion from another shadowy hacking organization, thought to be the NSA --- available to the highest bidder. The vulnerabilities exposed by the malware tools suggests that the NSA is aware of serious, heretofore unknown vulnerabilities in worldwide computer networks, about which they have failed to notify the commercial vendors who produce the hardware and software found to be at risk.

The issue has raised disturbing questions and no small amount of outrage about the NSA's practice of keeping such vulnerabilities a secret, for their own cyber-offensive purposes, despite the risk it poses to our critical, commercial cyber-infrastructure.

In a somewhat related issue --- as we've been yelling and screaming about for more than a decade --- vulnerabilities to U.S. voting and tabulation computers have long been a threat to the nation, but are only now being taken (somewhat) seriously by corporate media, the U.S. government, and, as I report on today's program, at least one of the major political parties.

A man who knows all about the above --- if only because he was, as we reported back in 2007, one of the first to hack an electronic voting system in the U.S. after he purchased five Sequoia AVC Advantage voting systems for about $82 on the Internet (the same "closely guarded" systems, still used in states like NJ, PA, VA and LA, were originally sold for about $10,000 a piece) --- is Andrew Appel, Professor of Computer Science at Princeton University. (That's him in the photo above with one of his voting machines.)

Appel, who Politico recently noticed in Ben Wofford's excellent recent article, "How to Hack an Election in 7 Minutes", has been writing about both of these issues of late.

On the NSA matter, Appel tells me today: "They should not hoard the vulnerabilities in the hope the NSA can use them to spy on everybody else. The assumption the NSA is implicitly making is that nobody else will be able to find these bugs and vulnerabilities and use them to spy on us, and do banking transactions in our name, and read our emails." That, he explains, is a huge mistake and a grave disservice.

On the continuing concerns about U.S. voting systems and the Dept. of Homeland Security's very recent attempt at helping local election officials before November 8, he cautions: "Security is not something you can just patch on by some sort of 'critical infrastructure security squad' that descends and surrounds your house with the National Guard. It's got to be built in to all the software we buy." He adds ominously, in describing the type of voting systems used across the country: "Whoever got to install the software most recently is the one who gets to decide what kind of results are reported."

Appel, tends to concur with my general assessment that it's largely too close to the election to make real changes to protect our voting systems. He also shares the warning I've tried to give so many years about the real vulnerabilities to our electronic voting and tabulation systems."In this country, most election fraud has been conducted by insiders, who have access to how the votes get added up." But, he also goes on to offer a few proactive measures --- including "witnesses in each polling place just at the close of polls" to independently track numbers as originally reported by the voting systems --- that, he says, can still be taken to try and safeguard results.

Trump 'pivots', reaches out to African-American voters, forgets to tell the rest of his party...

Donald Trump's newly celebrated 'pivot' to becoming a 'maturity' as a Presidential candidate, as declared by some Republicans and some in the corporate media, may be far less of a 'pivot' than he and his surrogates are pretending, especially in his new attempts to woo African-American voters.

On today's BradCast [audio link posted below.], we take a look at some of the claims of Trump's surrogates, and how they stack up against reality. (Hint: Taking out a newspaper ad calling for the death penalty for five African-American kids found completely innocent of a horrible crime doesn't seem a particularly smart way to woo the African-American vote.)

Similarly, if the GOP wants to reach out to minority voters, they have a very peculiar way of showing it, as Republican Party officials, operatives and Governors --- from CA to NC, from NJ to MI --- re-double their efforts to keep 'certain' voters from being able to cast a vote at all this November.

BIG BREAKING NEWS just before going to air for today's BradCast! [Link to complete audio below.] The full, very conservative U.S. 5th Circuit Court of appeals has just issued a very surprising and very encouraging ruling finding that the Texas GOP's long-contested Photo ID voting restrictions are, in fact, a violation of the federal Voting Rights Act!

Moreover, a federal court in Wisconsin issues an order allowing those without GOP-approved Photo IDs to be allowed to vote anyway. And, Day 2 of this year's insane Republican National Convention results in the official nomination of Donald J. Trump for President of the United States.

First up, the very encouraging breaking news out of Texas, where the most conservative appellate court in America has just undercut one of the nation's most draconian Republican Photo ID voting restrictions. Conservatives had been hoping --- despite the lack of voter fraud that could possibly even be deterred by the law --- that the full 5th Circuit would overturn the rulings of court after court after court all finding the GOP law has both a racially discriminatory intent and effect. But it looks like it was not to be. The 5h Circuit's 203-page ruling [PDF] today finds the law in violation of the Voting Rights Act and remands the case back down to the lower court (where it had already been found both unconstitutional and in violation of the VRA), in order to find a remedy that may allow for something like an affidavit to be signed by voters who do not have the strict type of ID now required by Republicans to cast a vote at poling places under the controversial law.

Some 600,000 already legally registered Texans had faced potential disenfranchisement during this fall's Presidential election. That is now looking much less likely, even as the remedy still needs to be fashioned and the case could still go to the U.S. Supreme Court. However, even a tie there would revert the case back to today's very positive ruling by the 5th Circuit. In related news, a federal court struck a "critical blow" to the Wisconsin GOP's version of the same law. The court there has ordered that state to implement a program to allow voters without the newly-requisite Photo ID to vote anyway, by signing an affidavit.

A lot of legal votes may have just been saved today in those two states, as well as in others where similar laws are being challenged by voting rights advocates and/or considered for passage by other Republican-controlled legislatures.

Then, it's on to our somewhat-truncated (due to the above) coverage of Day 2 of the RNC in Cleveland, where the GOP officially nominated Trump as their standard bearer on Tuesday. Comedian Jimmy Dore of Pacifica Radio's Jimmy Dore Show and The Young Turks joins us from Cleveland with a report on his bizarre (if not totally surprising) conversations with Republican delegates at the convention. He then goes on to offer his own impassioned case as to why he, a longtime Bernie Sanders supporter, will not support Hillary Clinton this year, and believes that a Trump Presidency would ultimately be no worse, and perhaps even better for the country, than a Clinton Presidency.

Suffice to say, I disagree with my friend Jimmy on a number of points, despite his well-argued case, in our very lively and spirited conversation today. All of that and much much more in another fast-paced edition of The BradCast! Enjoy!

After coverage of responses from all three remaining candidates (Trump, Clinton and Sanders) to last night's reported results, and where they will each go from here, we take a look at some of the reported problems that folks had casting their votes, particularly here in Los Angeles County (the nation's largest voting jurisdiction).

Are the problems being reported in California as "just chaos" (LATimes) and "mired in voting problems" (HuffPo) as bad as some are reporting them to be? The main concerns, at this hour, seem to involve failed electronic ballot readers at L.A. polling places (which don't actually tabulate votes anyway) and voters forced to cast Provisional Ballots (some 240k in LA County alone) for a variety of reasons, some legit, some a bit more troubling.

Both voters and poll workers --- lots of them! --- call in today to report on polling problems from Tuesday, views on the primary in general, on AP reporting the Democratic contest as over on Monday before voters even voted on Tuesday, and much much more on today's show. In fact, the phone lines were so busy, with so many callers, that KPFK asked us to continue on for an unprecedented second hour of our special coverage! Both of which are now posted below...

Guest: Prof. Jonathan H. Adler on 'Baptists, Bootleggers and E-Cigs'...

I usually try to avoid talk about elections on election days themselves, but the AP, NBC, CNN and all the rest in the corporate media gave me little choice on today's BradCast, even as millions of voters go to the polls today in California, New Jersey, New Mexico, North Dakota, South Dakota and Montana. [Audio link to show is posted below.]

Last night, just after we got off air, Associated Press decided to declare that Hillary Clinton had "clinched" the Democratic nomination. Their reporting was based on conversations with unpledged Super Delegates who do not actually cast their vote in the nominating process until the end of July (July 25th, to be specific), at the Democratic National Convention. So, with their misleading, inaccurate pronouncements of the Democrats having 'selected a female nominee for the first time in history' (they haven't --- yet), I offer a word or two today --- okay, a rant or two --- on the amazing disservice those news organizations have done to voters (not to mention the Clinton and Bernie Sanders campaigns, their supporters, the DNC and American democracy itself) with their inaccurate and misleading misreporting.

Then, I'm joined by Jonathan H. Adler, Professor of Law and Director of the Center for Business Law & Regulation at Case Western Reserve University School of Law, to discuss the strange bedfellows who've joined forces in support of onerous new FDA regulations on life-saving vaping (e-cigarette) technology. We've discussed the topic on the show on a number of occasions in the past (most recently here), not only because half a million Americans still die each year, unnecessarily, from cigarette smoking, but because, bizarrely, it has largely been Democrats and other supposedly anti-tobacco crusaders who have been leading the deadly campaign against vaping, making it much harder for smokers to quit smoking in the bargain.

Why would Dems be fighting --- alongside Big Tobacco(!) --- to kill the vaping industry, despite scientific studies finding e-cigarettes to be at least 95% safer than smoking and the UK's Royal College of Physicians (the equivalent of the office of the Surgeon General in the U.S.) recent pronouncement: "in the interests of public health it is important to promote the use of e-cigarettes...as widely as possible as a substitute for smoking"?

In her recent article, "Democrats Work With Big Tobacco and Big Pharma to Choke the Vaping Industry," at the American Media Institute (and at the NY Observer), journalist Monica Showalter offers an answer. She details the "strange bedfellows against vaping," citing both Big Tobacco's support of the crippling new FDA regulations, along with massive donations given by Big Pharma to big name Democrats in the U.S. Senate, just as those politicians came out in favor of restrictions on vaping. The Big Pharma companies include those which control the multi-billion dollar smoking-cessation nicotine industry that produces products such as nicotine gums, patches and, yes, inhalers!

Adler, the co-author of a study titled "Baptists, Bootleggers and E-Cigarettes", joins us to explain the strange coalition, and the powerful history of the "Baptist and Bootleggers" political/economic theory, where seemingly opposing groups, such as bootleggers and religious opponents of alcohol, worked together to keep Prohibition going as long as possible in the U.S. in the early part of the 20th century.

A similarly fascinating and powerful (and bizarre) political and financial coalition seems to be at work here, as Adler explains, to blunt the nascent and life-saving e-cigarette industry, despite recent studies showing, for example, "that when restrictions are imposed upon electronic cigarettes that either make them harder to get or make them more expensive, teen smoking rates go up. The idea that we could adopt policies in the name of public health that increase teen smoking rates should really be frightening."

Also, what should be similarly frightening to Democrats and others who claim to be against smoking, according to Adler, is that the Big Tobacco companies have been very supportive of the onerous FDA regulations no being applied to vaping products. Those are costly new rules that Big Tobacco can afford to comply with, but Mom and Pop vaping shops, currently leading the industry in the U.S., simply cannot. "The major tobacco companies asked [for] and supported the FDA's proposals to regulate e-cigarettes," Adler tells me. "Indeed, Phillip Morris is largely credited with helping to write the statute under which these regulations were adopted."

Today on The BradCast: is reform of our criminal justice system really possible given, the vast divide between Republicans and Democrats in Congress? One conservative joins me today to say "Yes!" and explain why. Also, the corporate media prepares to call the race for Hillary Clinton on Tuesday and Bill Maher argues that socialism is needed to keep capitalism from eating us alive. [Link to audio of show is posted below.]

First up, voters in California, New Jersey, New Mexico, North Dakota, South Dakota and Montana are getting ready to vote on Tuesday in the final, multi-state Primary Day of the Democratic nomination cycle, after both Puerto Rico and the Virgin Islands gave the bulk of their delegates to Hillary Clinton over the weekend. (Washington D.C. will, officially, hold the final primary of the season on June 14th.)

While we prepare to vote tomorrow here in California, and for whatever messes will almost certainly come along with it, folks in Florida (and Georgia and South Carolina) are battening down hatches for Tropical Storm Colin, marking the third-named storm of the season in the Atlantic, a record for this early in the year.

At the same time, the corporate media is preparing to declare Clinton the Democratic nominee on Tuesday, most likely after the close of polls in NJ, despite the fact, as Bernie Sanders continues to note, she is unlikely to have won enough pledged delegates to officially win the nomination until unpledged Super Delegates actually cast their votes at the Democratic convention in late July. As Cenk Uygur argued over the weekend with CNN's Brian Stelter, a lot could happen to change the minds of those party insiders before then, so why does the MSM insist on continuing to tip the scales in her favor with misleading reporting? (As I write this item, and before any state has voted Tuesday, when nearly 700 delegates will be up for grabs, including 475 alone here in CA, Associate Press just sent my iPhone a "breaking news" alert to inform me that, based on their tabulation of unpledged Super Delegates, Clinton "will be first woman to top major party ticket." So, take that, voters!)

Then, Tom Giovanetti, President of the right-leaning Institute for Policy Innovation, explains what he sees as a very real opportunity for Republicans and Democrats to come together to reform the U.S. criminal justice system, now that this nation leads the world in incarceration rates. Giovanetti even goes so far, as he did in a recent op-ed at Dallas Morning News, to commend President Barack Obama for his recent commutations of non-violent drug offenders and to call on fellow conservatives to join with progressives to reform what he describes as a bloated, legacy "tough on crime" system that makes little sense and even violates basic social and economic conservative tenets.

"It's fairly rare that we find ourselves agreeing with progressives and liberals on solutions to problems. This is probably one of the rare exceptions," Giovanetti tells me. "Progressives and Liberals have been at the forefront of talking about some of the abuses in the criminal justice system, the problem with mandatory minimum sentences, and things like that. I think conservatives are really only beginning to realize that there's a problem here. So I think for my colleagues on the center-right of the political spectrum, this is sort of an emerging issue."

He goes on to explain why reform is so overdue, how Democrats and Republicans are working together for reform in a number of state legislatures, and the path that he sees to move forward on the federal level. I remain dubious, particularly on that final score, but Giovanetti offers his reasons for optimism here in an encouraging conversation in which he even calls out some of his own for hypocrisy on this issue.

Finally, as Republicans continue to pretend they hate socialism, Bill Maher explains how capitalism is now out of control and eating our nation alive. "It's eaten our democracy, it's eating our middle class, it's eaten our health care system, our prison system, our news media, and even our food system." All of that and more on today's BradCast. GUEST: Constitutional law expert Ian Millhiser
ALSO: Federal court finds NC racially gerrymandered Congressional districts...

On today's BradCast, we look at the huge (yooge?) victories for both Bernie Sanders and Donald Trump in Tuesday's New Hampshire primary elections, not to mention a victory for the devil in Arizona and for justice in North Carolina.

First, in New Hampshire, both Sanders and Trump each destroyed their competition by record margins. But also both Sanders and Trump absolutely dominated virtually every demographic in their respective parties. The victories served to reveal how the political party establishment and corporate U.S. media pundits continue to be radically out of touch with the American electorate and how the "electability" arguments that have been put forward concerning both candidates are finally being questioned.

Moreover, on the Republican side, the contest resulted in both Fiorina and Christie heading back to Palookaville, while Rubio sunk like a stone and the GOP establishment may have found their next new "savior" in Kasich.

Then, we're joined by Constitutional law expert Ian Millhiser to discuss how a "Satanic Temple" trolled its way into killing the opening religious invocation long used by the City Council in Phoenix, AZ. Also, Millhiser explains a new federal court ruling finding that NC GOPers racially gerrymandered two Congressional districts in the key swing state.

"Finally! Satan gets a break in the United States!," Millhiser tells me in regard to the Phoenix story. He says that while the "satirical church" doesn't "actually worship the devil, they do believe that there shouldn't be these public displays of Christianity at City Council meetings." He describes their victory in Phoenix, as well as in other cities where the group has successfully "trolled" elected officials in the wake of a Supreme Court ruling that has begun to collapse the nation's long-standing separation between church and state.

"The Roberts Court has started to tear down those walls that have existed for a really long time," Millhiser, author of the new book Injustices: The Supreme Court's History of Comforting the Comfortable and Afflicting the Afflicted, tells me, before offering his best guess as to why the five conservative Justices on the Court are so "hostile to the notion of separating church and state."

Finally, Millhiser details the federal district court's redistricting ruling in NC --- what it will mean, how it may or may not affect the state's upcoming elections, how those hostile to minorities figured out long ago that they can use the slow pace of the U.S. Court system to game elections, and how doing so has suddenly become even easier following the Supreme Court's 2013 gutting of the key Voting Rights Act meant to prevent such schemes.

On today's BradCast, we try to make sense of the amazing GOP debate in New Hampshire on Saturday, the final one before tomorrow's First-in-the-Nation primary in the Granite State.

First, I offer a very few quick reminders and action items for those interested in fighting for Election Integrity during tomorrow's primary in NH. This, in a state which uses hand-marked paper ballots, but refuses to actually verify that results are accurately tallied by the state's oft-failed, easily-manipulated Diebold optical-scan computers before announcing results to the public. (For a reminder of the nightmare that occurred on that system back in 2008, you can peruse our Special Coverage here.)

Then, I'm joined for today's post-debate coverage and analysis by two progressive bloggers who have been consistently right for years --- Heather Digby Parton of Salon and Digby's Hullabaloo and Martin Longman of Washington Monthly and Booman Tribune --- to discuss where Rubio, Cruz, Trump and the others, including the corporate media, went wrong on Saturday night...and, unfortunately, for so many years prior.

From Rubio's remarkable on-stage meltdown to Cruz' ability to lie with amazing impunity (even when he is actually called out as a "flat-out liar" by CNN!) to the danger that Trump's ability to "win" may hold for both Republicans and Democrats alike.

And, as if that doesn't give us all enough to cover today, we take the time to call out the corporate U.S. media (and the Obama Administration) for allowing this mind-bogglingly precarious moment in U.S. history to even have come about in the first place...

• America's dumbest Governor, Paul LePage (R-ME), is apparently also America's most racist;
• President Obama's exceedingly modest and popular executive actions on gun safety freak out the NRA and the stooges who follow them;
• Native Americans in Oregon speak out against the out-of-state militiamen who've taken over a federal facility on their tribal lands;
• The Chief Justice of Alabama's Supreme Court, Roy S. Moore, reignites confusion over same-sex marriage in the state;
• And, Wheaton College shames itself still further by attempting to terminate a tenured professor because she believes Muslims and Christians "worship the same god".

As I said: A week of wingnuttery. (And some well-deserved righteous rants in response.) Enjoy!

Once again, it's the smartest post-debate analysis you'll find anywhere on today's BradCast, following last night's fear- and war-mongering "national security" GOP debate in Las Vegas (in which neither climate change, nor guns, two of the actual greatest threats to national security, were even discussed.)

Yes, it's now Trump and Cruz' GOP world. All of the other candidates --- and the entire Republican Party (and maybe even you and me) --- just live in it.

I'm joined for today's coverage by our returning champion, the great Heather Digby Parton of Salon and Digby's Hullabaloo blog. And, for the first time, I'm also joined by actor, comedian and radio broadcaster Hal Sparks, formerly of E's Talk Soup, Showtime's Queer as Folk and currently of Disney XD's Lab Rats and the Hal Sparks Radio Program Mega-Worldwide on WCPT in Chicago!

As our theme song says, we're "tryin' to make some sense of it all," once again on today's program. No easy feat. But we go well beyond the "horse race" in our analysis, as usual, and as the 2016 Republican Presidential candidates (that's the year they're hoping to win the nomination, not the number running...it just seems that way) worked hard on the stage last night at Sheldon Adelson's Venetian Hotel and Casino to be the manliest-man and bombiest-bomber of them all!

Parton and Sparks offer incisive and lively commentary and fact-checking on what has seemingly now become a two-man race for the nomination. And I try to explain why Democrats ought to be very very careful what they wish for. Enjoy!
