The news out of Ukraine continues to be grim, but there are a few bright spots here at home on today's BradCast, a way that you can help fight fascism without leaving home, and a renewed challenge to an alleged insurrectionist Congressman's eligibility to run for re-election. [Audio link to full show is posted at the end of this summary.]

FIRST UP, Vladimir Putin is now unleashing outright atrocities and unspeakable war crimes against the civilian population of Ukraine. On Wednesday, for example, Russian troops bombed a maternity hospital in Mariupol as nearly half a million residents in the southern Ukrainian city have been cut off from food, water, medicine and power for days. It could all still get much worse. In several ways. One of them is that the crippled Chernobyl nuclear plant in Ukraine, now in the control of the Russians, has now been cut off from the power grid. Diesel generators are hoped capable of keeping the cooling system for the plant's 20,000 spent fuel rods from melting down entirely...as long as generators can be refueled and kept running.

Yesterday, we discussed a bit how working at home --- as many of us did during the pandemic lockdowns --- can help the war effort against Russia in several ways, if only by tamping down surging oil prices. A new poll from Rupert Murdoch's Wall Street Journal finds a huge majority of Americans, 79%, favor cutting off Russian oil imports, even if it further increases the cost of gas at the pump.

Today, we double down on our call: HELP FIGHT FASCISM! WORK FROM HOME! (For now. If you can. It really could make a difference in several ways!) One of our listeners has some additional thoughts, via email, which we share today along similar lines.

NEXT UP, some good news for Democrats --- and those who support representative democracy --- from the U.S. Supreme Court this week. But that good news on U.S. House redistricting in two critical swing states also served to overshadow some potentially ominous news from the GOP's stolen and packed Court. The good news was that the Justices turned away two Republican challenges to new U.S. House maps selected by two state Supreme Courts in Pennsylvania and North Carolina. Each is likely to benefit Democrats this November. The disturbing, largely overshadowed news, is that the four rightwing Justices who would have preferred to have heard the challenges to the new House maps, made clear in their dissents that they are likely supportive of the bonkers "Independent State Legislature Theory".

In short, that's an old Constitutional argument that's been around for years, but has never received the support of a majority of Justices. It holds that two clauses in the U.S. Constitution delegating the "time, place and manner" of elections to state legislatures means that only state legislatures can set any election law, procedures or district map. That means that any other state officials --- Secretaries of State, state Boards of Elections, Governors through their veto pens, or even state courts --- have absolutely no authority to challenge or change any election-related provision adopted by a state legislature. Under this theory, even state Constitutional amendments adopted by a vote of the people would be deemed unconstitutional!

As noted, it's a bonkers theory. But it's one that now apparently has at least four votes in support on the Republican Party's far-right stolen majority. The dissenting Justices in the redistricting cases made quite clear: this issue will return to the Court soon, and it needs the support of just one more Justice. You have now been warned.

FINALLY, for the past two weeks or so, largely since Russia invaded Ukraine, we've been trying unsuccessfully to get back to a story we were covering closely prior to the war, as its both an important one, and there have been a number of twists and turns in it since over the past several weeks.

As we discussed early last month with John Bonifaz, Constitutional law expert and Free Speech for People (FSFP)'s co-founder and President, voters in North Carolina filed a challenge with the State Board of Elections to first-term MAGA Congressman Madison Cawthorn's eligibility to run for re-election. The challenge is based on their claim that Cawthorn violated Sec. 3 of the 14th Amendment which bars anyone from running for federal office who has taken an oath to defend the Constitution, but subsequently "engaged in insurrection or rebellion" against it. The Civil War-era amendment was initially meant to prevent Confederates from running for federal office. Now it is being used to challenge Cawthorn's eligibility to run and, if successful, others as well, including Donald Trump himself if he becomes a candidate in 2024.

Cawthorn spoke at Trump's rally on January 6th, 2021, just days after being sworn in. He is also said to have been among some of the elected officials who may have helped organize the deadly assault on the Capitol that day, meant to prevent the ratification of Joe Biden's Electoral College victory.

There have been a number of twists and turns in this story in recent weeks. Rather than defend himself before the State Board, Cawthorn filed a federal lawsuit to block the challenge entirely, absurdly claiming the Board had no right to determine anyone's eligibility to run for office. Both the State Board and the state's Attorney General filed motions rejecting that argument.

As the case worked it's way through federal district court, the State Board of Elections paused the challenge, as the state's U.S. House map was being contested in state court as well. Once the state Supreme Court selected the maps to be used in the 2022 mid-terms, Cawthorn's district had changed. The voters who initially filed the challenge to his eligibility, with the help of the non-partisan, government accountability group, FSFP, were no longer residents of Cawthorn's new district. But FSFP found new voters in Cawthorn's new district to refile the challenge.

And then, last Friday, in a gobsmacking ruling from the bench, the Trump-appointed federal judge overseeing Cawthorn's lawsuit to block the state challenge ruled in his favor. Judge Richard E. Meyers II declared that a law adopted by Congress in the years after the Civil War, the Amnesty Act of 1872, somehow forgave not only Confederate soldiers, but also any insurrectionists against the United States at any time in the future. The judge's ruling essentially holds that an act of Congress 150 years ago --- without ratification by any states --- nullifies an actual Constitutional Amendment for all time.

Yes, as FSFP's Legal Director RON FEIN, who joins us today explains, the ruling is largely as absurd as it sounds. Fein explains why, and what FSFP plans to do about it, including their emergency appeal to Judge Meyers ruling, filed in federal court today...

As the horrors of war continue in Ukraine today, we focus on the latest efforts to counter it by ending --- or trying to --- Russian oil and gas imports to the EU and US, and as we enjoy more accountability for GOP election fraudsters and insurrectionists, including one who funneled Russian money to Donald Trump's 2016 campaign and another who used to appear on The BradCast from time to time. [Audio link to full show is posted below this summary.]

Among the many stories covered on today's program...

  • Fossil fuel profiteer Shell Oil apologizes after getting caught secretly buying cheap Russian oil, even after pretending last week that it was ending its business with the country after their invasion of Ukraine. Does it smell "like Ukrainian blood?," Ukraine's Foreign Minister wonders.
  • On Tuesday, after nearly two hellish weeks of unspeakable humanitarian suffering in Ukraine and pressure from the public to do the right thing, several more major American companies --- McDonald's, Starbucks, Coke and Pepsi --- finally decided to "pause" doing business in Russia.
  • The European Union, which has made the mistake of becoming reliant on Russia for about 45% of its gas imports, announced plans to try and wean themselves off two-thirds of it by year's end. Hopefully this will help hasten their move to clean, renewable energy.
  • President Biden announced today that the U.S. will halt all imports of Russian oil and gas. Hopefully this will help hasten our move to clean, renewable energy.
  • Also, both White House Press Secretary Jen Psaki and President Biden pushed back hard against the obnoxiously phony claims by Republicans, Fox "News" and the oil industry that opening up more public land to oil and drilling leases and permits would lower surging U.S. gas prices. As both Psaki and Biden point out, Big Oil is already sitting on some 9,000 currently unused permits on millions of acres of land, as is. The GOP/Fox "News"/Big Oil axis of evil is really hoping that Americans don't know that, so they can blame Biden for the surge in global oil and gas prices...even as new polling finds American majorities are willing to pay more at the pump to help Ukraine and they want to expand renewable energy development, not fossil fuels.
  • The International Energy Agency (IAE) has a list of 10 things the EU can do to decrease gas use by at least 10% before year's end. Many of those things the U.S. can do as well. One thing many of us could and should do to lower the cost of gas in a big way during Russia's war on Ukraine --- since many of us already did it for much of the past two and a half years anyway, cleaning the skies and drastically lowering gas prices in the bargain --- WORK AT HOME AGAIN if possible!
  • The first January 6th insurrectionist to stand trial before a jury, was found guilty on all five felony counts today. (He's a helluva guy, apparently. Threatened to kill his own teenage children if they told on him. Ya know, as "patriots" do.) The DoJ hopes the result may lead other Trump insurrectionists to plead guilty. We hope it leads the DoJ to keep working their way up to the top of the insurrectionist cabal.
  • The leader of the violent rightwing street gang calling itself Proud Boys, Enrique Tarrio --- who wasn't even at the U.S. Capitol on January 6th, 2021 (because he was in police custody on a separate crime) --- was indicted, with several others in his gang of white hoodlums, on conspiracy charges related to their violent, coordinated attack on the Capitol. Tarrio had reportedly met with Oath Keepers leader Stewart Rhodes in a parking garage in the hours before the Republican assault on American democracy. Rhodes and several other Oath Keepers were also recently indicted on seditious conspiracy charges. And Rhodes, like another rightwing hoodlum facing new felony indictments in a separate matter (discussed below), had been a guest on The BradCast several years ago.
  • This story is amazing. Jesse Benton, a longtime Republican operative and former campaign manager for Senators Rand Paul (in 2010) and Mitch McConnell (in 2014), has already been pardoned for felony election fraud once, by Donald Trump in the closing days of his Administration. Now Benton has been indicted again, for more election fraud, and along with another former guest on The BradCast! Tune in for the full story, but Benton was originally charged and convicted some years ago for buying away an endorsement for about $75,000 from a Michele Bachmann supporter during the GOP Iowa Caucus in the 2012 Presidential campaign. At the time, he worked for Rand's father Ron Paul's Presidential campaign. Benton was sentenced to two years probation and a $10,000 fine just days before the scheme he has now been indicted for which includes receiving $100,000 from an unnamed Russian national, keeping $75,000 for himself, and giving $25,000 of it to the campaign of "Political Candidate 1" in his own name, an unlawful straw donation to avoid laws barring foreign money in American elections. Benton promised a meeting with "Political Candidate 1" in Philadelphia on September 22, 2016, the day that Donald Trump happened to be holding a fundraiser there. They all took pictures together, according to the September indictment unsealed on Monday, along with Doug Wead, a GOP Presidential historian and, in recent years, far-right operative who appeared a number of times on this program some years ago. Wead, a Senior Advisor to Ron Paul's 2012 campaign was indicted as a co-conspirator with Benton. They both face the potential of a lot of time in prison. Each of the six counts charged against both of them carries sentencing of 5 to 20 years. But, yup, more Russian money in Donald Trump's 2016 election. Who could have guessed it?
  • Finally, Desi Doyen joins us for our latest Green News Report, in which we can barely keep up with Russia/Ukraine related events in the energy industry (including nuclear) and as the U.N. offers some good news for a change, in this case regarding global plastic pollution.

All of the above is much funnier, outraging, and/or more enlightening when heard in full on today's surprisingly lively BradCast (given what we have to work with at times like these)...

Third round of Russia-Ukraine talks end; We open the phones to listeners to discuss possibilities for a peaceful solution and end to the aggression...

The war porn continues on too much of the corporate media. Too many pundits. Too many self-declared experts without actual expertise or who have ideological axes to grind. Too much politics, not enough talk about how to get to peace. Once again on today's BradCast, we're trying our best to get there. [Audio link to full show is posted below this summary.]

On last Friday's show, we spoke with longtime Russia-Ukraine expert and author Anatol Lieven of the Quincy Institute for Responsible Statecraft about his proposed roadmap, of sorts --- and the tough choices for all sides that comes with it --- for peace in Ukraine.

In short (and please read Lieven for a more complete description) it entails....

  • Ukraine declaring neutrality (not unlike Austria or Finland after WWII), and that they they will not join NATO or any other military bloc (including Russia's!), while "demilitarizing" offensively, but retaining defensive-only military capability.
  • Recognizing Crimea as part of the Russian Federation and allow some form of independence for the Russia-backed separatist regions in the Donbas in the eastern part of the nation. All three territories would then hold internationally observed referenda on who they would like to align with. (This would also likely include revisiting the Minsk II agreement that was brokered in 2015, leading to a a cease-fire in the Donbas region, even as Ukraine has been disinclined to move ahead with the negotiated terms of that agreement, thanks, in part, to opposition from ultra-nationalist factions in its country.)

Lieven's roadmap shares the broad contours --- if not every detail and critical nuance --- with the conditions for cease-fire the Kremlin reportedly putting forward before today's peace talks with Ukraine. That's good news. Or, at least we are choosing to see as such today.

The two parties had their third round of such talks on Monday, with hopes of first reaching an agreement on a temporary cease-fire to allow for humanitarian corridors so citizens can leave besieged cities and allow food and medicine to be brought in. Similiar hopes for cease-fires over the weekend were dashed after just a few hours. Both sides blame the other.

But, even as they struggle to create humanitarian corridors, Ukraine has reportedly agreed to Russia's condition of dropping hopes of joining NATO. But Russia, reportedly, is insisting that all conditions for a treaty be met before they end their lawless aggression. This could take a while --- even as both parties have good reason at this time to find their way to peace as quickly as possible.

We open the phones today to listeners to discuss peace, and whether Ukraine should take such a deal; whether Putin can be trusted to keep it (or whether his interests in reconstituting the Soviet Union or an even more expansive Greater Russian empire would see him continue his march of military aggression); and whether accepting such terms would be the equivalent of rewarding Putin's bad behavior (and war crimes.)

When Lieven opened his article last week on a potential path to peace in Ukraine, he used a quote from Robert Lovett, U.S. Defense Secretary for several years in the early 50s, declaring: "Forget the cheese --- let's get out of the trap." That argument has been cycling through my brain ever since. Today, we get to find out how listeners feel about it when we open the phones for an important conversation: one that was more about peace, for a happy change, than about war...

It was a very lively BradCast today, even amidst horrible times. So there's that. [Audio link to full show is posted below.]

First up, Desi Doyen joins us for a too-brief summary of the latest report, issued today, by the U.N.'s Intergovernmental Panel on Climate Change (IPCC), warning that the world is running out of time to prevent the worst effects of climate change and even our ability to adapt to it. The new report is almost 4,000 pages, but at least she gets several minutes to explain all of it!

Similarly, we briefly discuss oral argument at SCOTUS today in which the Republicans' stolen and packed Court majority has, virtually out of the blue, decided to hear a challenge to Barack Obama's Clean Power Plan, even though it was never even implemented. The point here, by the newly far-right Court, is clearly to gut the Environmental Protection Agency (EPA)'s regulatory power, despite meeting their mandate for decades to institute regulations that protect the environment and Americans within it. This latest gambit by the Court is akin to their recent move that blocked OSHA's ability to regulate safety in the workplace with a vaccine mandate. Make no mistake: The U.S. Supreme Court is gutting Executive Branch agencies ability to do their job. It is the final step of the GOP's long effort to "deconstruct the administrative state," as many, such as Steve Bannon, have long vowed.

Next, it's on to the latest news in Russian President Vladimir Putin's horrific, appalling, inexcusable war on 41 million innocent men, women and children in Ukraine, after he issued yet another veiled threat over the weekend to use nuclear weapons.

On the upside, peace talks between Ukraine and Russia took place over the past 24 hours, and are on pause as the representatives from both sides take early results of discussions back to their capitals.

In the meantime, the world, at least the western world, continues to unify in opposition to Russia's aggression. The U.S. and 27 EU nations continue to institute more and more crippling financial sanctions against Russia, its banks, companies and oligarchs, despite the considerable costs that will be borne in response by those nations. Many of them, including the U.S. are also sending more weapons to help Ukrainians defend themselves from a slower-than-expected, but still very deadly, assault by Russia, including with the use of cluster munitions deployed to densely populated urban neighborhoods. Germany is upping its commitment to NATO. Finland is considering joining. Even Switzerland(!) has reversed decades of neutrality to freeze Russian assets. Oil companies BP and Shell have announced they are dumping their considerable stakes in Russia's state-owned oil and gas companies (though we're still waiting on Big Oil companies in the U.S. to do the same.) The NYSE and Nasdaq announced they are halting trading of Russian-owned companies.

Russia's appalling aggression has, it seems, united much of the free world against them. So why are there actually some on the American left --- the theoretically anti-war left --- who seem unable to condemn Russia for their unprovoked atrocities? Even some folks who listen to this program?

We have covered in detail many of the legitimate complaints Russia has long had against NATO and the U.S. We have long been, in fact, sympathetic to many of those complaints and have been critical of overly-hawkish Democrats (and Republicans). But when one nation launches a massive, deadly assault on a sovereign neighbor that posed absolutely no threat to them, all bets are off. Any benefit of doubt goes out the window. At least until they call off the attacks and withdraw their troops.

As we noted last week after Russia began their assault (and again on Twitter over the weekend) we oppose naked aggression by nuclear-armed superpowers, whether its the U.S. attacking Iraq or Russia attacking Ukraine. This is an easy call.

Nonetheless, we share some email today in response to that position (which seemed fairly uncontroversial, especially for a largely progressive audience) and open up the phone lines today to a bunch of callers to try and find out why some on the supposed "anti-war left" are having trouble with that idea.

Among today's lively discussions with callers, the truth about Russia's misleading claims about "denazifying" Ukraine (there is an ultra-nationalist faction there, but they have no seats in Parliament, and by the way, Ukrainian President Volodymyr Zelenskyy is Jewish and lost several family members to Nazis during WWII) and one caller who simply can't even find it within himself to condemn Russia's horrific attack on 41 million innocent people in Ukraine. (Though, to be fair, I couldn't tell you if the caller is actually on "the left" or not)...

It's been a rough week. So before we get to America's rising 'demons of hell' on today's BradCast and how we might counter their re-emergence against what is left of American democracy, a few slightly more encouraging news items to kick things off. [Audio linnk to full show is posted at end of summary.]

In Georgia, the three white men who were caught on video tape murdering 25-year old black jogger Ahmaud Arbery in 2020 after hunting him down in their pick-up trucks, were each sentenced today to life in prison. Two of them, father and son, got life without the possibility of parole. The third, their neighbor, could be paroled after serving 30 years. But he's already 52, so...

In Arizona, or Florida, or wherever "they" preside, the buffoonish, rightwing conspiracy theorists, con-men and theoretical cybersecurity experts calling themselves Cyber Ninjas, declared they exist no more. That, just one day after an AZ state judge said they are to be fined $50,000 for each day that they continued to refuse to hand over public documents regarding the pretend "forensic audit" of Maricopa County (Phoenix), AZ's 2020 Presidential election they were hired by the GOP state Senate to carry out. More on that matter, hopefully, on a not-too-distant BradCast.

Next, as our week commemorating the grim, one-year anniversary of Donald Trump's attempt to steal the 2020 election by hurling thousands of supporters at the U.S. Capitol last year on January 6th, in hopes of halting the certification of the Electoral College vote with a deadly insurrection, comes to a close, a bit of mopping up and looking ahead to ways to prevent a more successful election coup from happening in the near future.

First, some reflections today from our 39th President, the 97-year old democracy champion Jimmy Carter. He wrote this week in the New York Times that he now "fears" for our democracy, citing last year's insurrection and the politicians in his home state of Georgia and elsewhere, such as Texas and Florida, who have "leveraged the distrust they have created to enact laws that empower partisan legislatures to intervene in election processes." Carter sees Americans "being persuaded to think and act likewise, threatening to collapse the foundations of our security and democracy with breathtaking speed." He says the he now fears that what he, his Carter Center and America itself "have fought so hard to achieve globally — the right to free, fair elections, unhindered by strongman politicians who seek nothing more than to grow their own power — has become dangerously fragile at home."

Carter is hardly the only one with a long and broad perspective on history who has become unnerved by what we are now seeing in America. Ronald Reagan's U.S. Solicitor General, Charles Fried, interviewed last month by CNN's Christiane Amanpour, noted his birth in Prague in 1935, when "Czechoslovakia was a real democracy" before "the demons of hell came out and spoiled that for 50 years." The 86-year old longtime Republican and Harvard Law professor now says he sees "those people re-emerging" and he "hears the same tune and it scares me."

So, for those of us paying attention, what can be done? We talk about exactly that today with our guest, DR. NILS GILMAN of the Berggruen Institute, following on his recent L.A. Times op-ed discussing similar nightmares as those cited by Carter and Fried which have continue to emerge throughout 2021 and what we can ALL now do to try and counter them.

Gilman was also the co-founder the Transition Integrity Project (TIP), a bipartisan group of security, military, political and media experts who met during the summer of 2020 to game out what might happen [PDF] in various worst-case scenarios if Trump decided to declare the election results invalid and/or refused to leave office that fall. We begin today with how his TIP group viewed the January 6 Electoral College certification event in advance, which he says they saw as a "moment of Constitutional stress that bad actors could potentially exploit," warning at the time that "there needed to be preparations on the part of law enforcement to be ready for that possibility." Perhaps we'll pay more attention to his group's warnings the next time, if they decide they need to reconvene before 2024 election.

He is now warning, in his piece at L.A. Times, that "the runaway train of illiberalism continues to bear down on American democracy, and the need to act could not be more urgent." Gilman explains today what he means by the term "illiberal democracy," a phrase he cites as being coined by Hungarian strongman President Viktor Orban, who was recently endorsed by Donald Trump. Under Orban, Hungary, in recent years, has seen its media essentially taken over by his rightwing government.

Citing strongman leaders "all over the world, in Brazil, Turkey, the Philippines, Poland, "you're seeing the rise of this illiberal democracy, where you still have elections, but the electoral process is so corrupted that it basically ensures that you will get right or far-right victories under any and all circumstances." Sound familiar? That, as nations like Hungary are literally being hailed of late by folks on the American right like Tucker Carlson and Fox "News". "It's being celebrated in rightwing media as a model that America might want to follow," Gilman charges.

He goes on to detail, both in his op-ed and on today's program, what "ordinary citizens" who oppose such fascist takeovers of our democracy can and must do at the state and local level --- as we wait and hope for voting rights and election protection legislation at the federal level --- to otherwise counter such forces. Election officials are now facing threats from Trump's MAGA Mob across the country, even as his supporters are working to take over key election administration positions by both hook and crook.

"People can go out and become pollworkers," urges Gilman. "We have an under-supply. Run as a local election administrator. There are thousands of positions all over the country. Our election system is currently totally decentralized and local administrators have a lot of power, and we need people committed to the democratic process to be in those position, not people who are committed to partisan victory at any and all costs."

As he explains, "there are things that an ordinary citizen can do. But the truth is that the real problem is we need to have elites who are going to be committed to democratic practice. What we have in this country now --- and we're seeing this very much in the current Congress --- you see a split between some elites who are basically complicit with the crimes of the previous administration and then others who are complacent about the likelihood that this could come back. We need elites to take this problem more seriously and really take on the challenge of illiberalism and the anti-democratic tendencies that are becoming more and more legion in this country, particularly on the right."

We also discuss my personal concerns --- my personal nightmares --- about the ability of committed, bad faith Republicans at this point to game the Electoral College in 2024 in a way they were not prepared to do in 2020. If they do so --- at the state legislative and/or Congressional level --- I believe there is nothing currently in federal law or the U.S. Constitution to prevent such a bad-faith exercise from succeeding next time. It's been a while since one of our favorite BradCast guests has joined us, and so we've got a lot to catch up with her on today, starting with the GOP's latest attempt to use "legal means to subvert democracy," as she describes it, out here in California. [Audio link to today's full show is posted below this summary.]

But, first some very quick news items today, including good news in Florida, where a state judge has struck down Republican Gov. Ron DeSantis' deadly ban on local and school district mask mandates as "illegal and unsupported"; Bad news in Texas, where three weak-kneed Democrats who returned to the state legislature after blocking a quorum for the last month, just allowed Republicans to adopt a sweeping new voter suppression law; Disturbing news in Russia, where massive wildfires are now said to be threatening a top-secret facility where nuclear war heads are made; Very disturbing news for New Orleans, where evacuations are underway with potentially killer Hurricane Ida quickly approaching; And some puzzling news out of Southern California, where a man was found by police with 300 stolen Vote-by-Mail ballots from California's Gubernatorial Recall election, which is now under way.

That's where we kick things off with award-winning Salon columnist, Hullabaloo blogger and fellow Californian HEATHER DIGBY PARTON today. For those who don't know, state Republicans received three extra months, due to the pandemic, to gather signatures for their attempted recall of the Golden State's popular Democratic Gov. Gavin Newsom, in a state where it is virtually impossible for the unpopular GOP to win normal statewide elections anymore. Vote-by-Mail ballots have been sent to all registered voters with two questions: 1) Should Newsom be removed from office? And 2) If so, who should replace him? There are 46 candidates listed under the second question.

As Parton recently wrote at Salon and details today, Newsom could lose on question 1 with 49.9% of the vote, while current GOP front-runner and far-right, Trump-loving radio talk show host Larry Elder, could then "win" on the second question to become the Governor of the nation's most populous state with just 15 percent of the vote.

Why Democrats didn't reform the state's "archaic" recall system after a similar scam was carried out by the GOP in 2003 to oust then Democratic Gov. Gray Davis and replace him with Arnold Schwarzenegger is a mystery. Though it speaks to the fact that Democrats, in general, as Parton argues, "have failed to understand the political culture that we're dealing with now, and fail to grasp just how important it is that they look ahead and take steps to protect democracy."

"I would say wake up, because this is happening nationally. It's happening in blue states,  red states, and everywhere else --- which is an absolute assault on democracy that's coming from the right," she explains, citing the national consequences as well for the outcome of the Recall on September 14th. "We have an 88-year-old Senator" who may need to be replaced by the Governor at some point. If that Governor is Republican Larry Elder, he'd flip the majority in the U.S. Senate with his appointment and "Mitch McConnell would be laughing and laughing and laughing at the idea that Biden's agenda was completely derailed by the lazy people in California who didn't come out to vote."

In addition to the Recall, we also catch up with Parton on the U.S. pullout from Afghanistan, and the ridiculous way the media has been covering the largest and, so far, most successful U.S. airlift in history, even as they otherwise haven't paid attention to what has been going on for most of the last 20 years of America's longest war.

We discuss how the GOP's long con of claiming to be "small government conservatives" has been exposed by the big government authoritarian edicts of Governors like DeSantis in Florida and Greg Abbott in Texas.

And, as if that's not enough, she also offers thoughts on the growing attempts to bring accountability for Donald Trump's attempt to steal the 2020 election, particularly by the U.S. House Select Committee examining the Trump-incited January 6th attack on the U.S. Capitol. "What they seem to be putting together is the case that Trump was planning to steal the election, and he was using the power of the Presidency to do it."

So, yeah, there's a lot to catch up on today, in yet another very lively conversation with our friend "Digby"!...

Guest: David Roberts of Volts; Also: Update on stolen Dominion software released at Pillow Guy's failed 'Cyber Symposium' as CA Recall begins...

Our guest on The BradCast today is virtually begging those on the environmental center and left to come together, to put aside their various (if important) pet projects, in hopes of coming together for two key elements in the blueprint for the Democrats' $3.5 trillion budget reconciliation package. It is, he details, our last, best chance for likely more than a decade to soften the blow of our climate emergency. Do that, he says, then "we can resume fighting like a bag full of cats in a couple of months." [Audio link to full show is posted below this summary.]

But, first up, a quick follow-up from yesterday's BradCast, during which we broke the news that someone at MyPillow CEO Mike Lindell's bat-crap insane three-day "Cyber Symposium" in South Dakota this week to "Stop the Steal," released digital image copies of three hard drives containing Dominion Voting Systems actual Election Management System software, as used in real elections across the country. These copies seem to have come out of the County Clerk's office in Mesa County, Colorado. The elected County Clerk there, Tina Peters, is a hard-right official who appeared at Lindell's "symposium" that promised to reveal (then spectacularly didn't) how China supposedly flipped millions of votes over the Internet in 2020 to steal the election from Donald Trump.

With our confirmation yesterday that the Dominion software is now confirmed to be in the wild, even as the Gubernatorial Recall election is now under way in California (where Dominion's software is used in about 60% of the state), there are very serious concerns about what effect the security breach could have on the Recall election --- not to mention others coming up across the country this November. Marilyn Marks, a regular guest on the show, whose non-partisan election watchdog group, the Coalition for Good Governance, is suing the state of Georgia in federal court to stop them from forcing voters to use Dominion's unverifiable and vulnerable touchscreen voting systems in every polling place, tweeted yesterday about the "looming dark cloud over the Nov. elections," following the exposure of the EMS software. She wonders when and if election officials in the Peach State might pay attention to this breach, not to mention when national media, which seems to be all but asleep at the wheel on this, might cover the story as well.

The founder of Georgia Tech's new School of Cybersecurity, Prof. Richard DeMillo, who joined us on the show earlier this week before the stolen hard drives were leaked, to discuss vulnerabilities recently uncovered by an expert witness [PDF] in Dominion's system in the Georgia case, told me via email today that he is "still processing" the breach. But, he told me, the "news points to the urgency" of unsealing the report by the Coalition's expert witness in the case, at least to other cybsersecurity experts and election officials. "The fact that the Dominion EMS images are now public increases the likelihood that [Dominion] ImageCast voting software [as used on their touchscreen voting machines] was also leaked. The only antidote is to conform to standard industry practice and publish their vulnerabilities so that Dominion and their customers can take public steps to mitigate the risks to election infrastructure."

For the record, a number of large jurisdictions in California use the exact same Dominion touchscreens as are used across Georgia, including San Diego, San Francisco and Riverside. Are state officials here in CA even aware of this latest, serious leak? We will continue to follow the story in the days ahead, and hope that national media --- or even just CA media! --- jump in and try to get some answers from election officials about what this serious concern may mean for ongoing voting in the Recall.

Then, along with the news today from the National Oceanic and Atmospheric Administration (NOAA) that July was declared the hottest month on the planet in recorded history, we're joined by a longtime progressive climate and energy journalist who is trying to help Democrats and climate activists understand the necessity of supporting two key provisions in the Democrats landmark, $3.5 trillion budget reconciliation bill. He described this matter recently as America's "last big shot at climate change policy for a decade or more."

The great DAVID ROBERTS, publisher of the must-read Volts newsletter, joins us today to explain the importance of those two initiatives, the development of a Clean Energy Standard (CES) and clean energy tax credits in the reconciliation bill. The huge measure can be passed with simple majorities in both chambers, as long as all 50 Senators who caucus with Democrats and almost all of the Democrats in the House play along. Those two provisions together, he wrote and explains today, "would revolutionize the US electricity system" and finally give us the chance to reach net-zero emissions from the electric grid in the very few years climate scientists now tell us we must, in order to avoid the worst impacts of climate change.

Never mind other ideas that climate hawks may have for now, such as a carbon tax or cap-and-dividend. They are not part of President Biden's menu of options. It's this "or we will get nothing that will tackle fossil fuels this decade," he warns.

It may sound a bit wonky, but it really isn't. Roberts spells out, in simple terms, what both a clean energy standard and clean energy tax credits mean in the context of the critical goal of decarbonizing our electricity system, even as he has preached that the answer to ending the dangerous burning of fossil fuels is to "electrify everything", from transportation to buildings.

"Right now, roughly a third of our emissions come from electricity. But the whole plan for decarbonization is to move transportation --- which right now runs on gasoline and diesel --- to move that over to electricity. And to move buildings --- right now buildings are heated and cooled largely with fossil fuels, mainly with natural gas --- to move that over to electricity," he says. "So if you move the other two big chunks of emissions onto the electricity grid, then you see that, oh, having a clean electricity grid is the core strategy for decarbonization.  It's not just one sector. This is the sector that is going to clean up all the other sectors. So there's nothing more important for short-term, immediate decarbonization than cleaning up the electrical grid."

Both the Clean Energy Standard and tax credits will serve to move the entire grid to renewables. "Renewables are the cheapest form of clean energy. And the overwhelming effect, as any analyst will tell you, if we pass this policy, is going to be giant surge of renewable energy projects."

There is, of course, much more to this conversation, but the bottom line is that, as Roberts warns, "the stakes are enormous," and with Democratic majorities so narrow right now in both Congressional chambers, virtual any Senator or faction can sink both this bill and the smaller but still critical $1.2 trillion bipartisan infrastructure bill that's paired with it.

"If Democrats fail, they all fail, and they're going to get crushed in 2022," Roberts tells me, as he explains how it may be that a fossil fuel-loving Senator like Joe Manchin from coal state West Virginia, may still find a way to support these efforts which will, necessarily, hasten the demise of fossil fuels.

"So Manchin and [Bernie] Sanders are going to have to find a bill that they can both sign," Roberts argues. "[Kyrsten] Sinema is going to have to find a bill she can sign. I don't think even she wants to be responsible for the whole Democratic agenda going down, including her precious, beloved bipartisan infrastructure bill, because that would go down too. So it all sinks or swims together. It's a unique situation in my lifetime."

If these two bills actually make their way to the President's desk, especially with the two key provisions Roberts is citing as critical to curbing global warming, he says he will "eat crow" from every rooftop in the land, when it comes to his earlier doubts about Joe Biden's centrist, go-along to get-along roots. These measures, if they actually happen, he notes, would easily place Biden into the Democratic pantheon along with folks like FDR and quickly eclipse even Barack Obama's own accomplishments in office.

"Calling your lawmaker matters," Roberts emphasizes, even if you believe they are already on the correct side of this fight. "This is something I hear from Senate offices, from House offices, all the time. The email campaigns? Eh. The letters?  Eh.  But when people take the time to call, it gets collated and marked down, and the Senator hears about it. It matters. They need to hear that there is a public appetite specifically for the climate provisions to get through." Tell them you support a CLEAN ENERGY STANDARD.

"This is crunch time," he warns. "Everybody needs to be talking about it and getting their fellow Democrats fired up. This is the time to fall into formation, to quote Beyoncé, it's time to fall into formation and make this happen. We can resume fighting like a bag full of cats in a couple of months. But, just for a few months, we need to be coordinated and speaking in a single voice. Specifically the Clean Energy Standard. That's the core of it."

Today's BradCast, by and large, serves as another fine example of why we fight, and what we fight for. [Audio link to today's full show is posted at the end of this summary.]

Among our stories today...

  • We've got an update following yesterday's lively interview with John Brakey, the longtime, progressive Election Integrity and audit expert who has been serving as an observer and advisor at the Maricopa County, Arizona 2020 election "audit", alongside the state's Republican former Sec. of State Ken Bennett. Bennett was tapped by the GOP state Senate in April to serve as its liaison to the ill-considered clown show "audit" they hired the inexperienced, partisan, conspiracy theorist company named Cyber Ninjas to carry out. Last week, Bennet was shamefully locked out of the building after he'd shared information from the third count of the County's ballots with experienced outside experts who seem to confirm that the Ninjas' original ballot tally was wrong. In fact, they suggest that the original County count was accurate (as expected, by all by the Trump MAGA mob). As of yesterday's show, Brakey had confirmed that Bennett was resigning his post after the dust up. But shortly after we got off air, Brakey reports, Bennett met with Senate President Karen Fann and, essentially, unresigned. We explain what happened and what may happen next, as even Republican members of the state Senate are now describing the effort as "botched" and turning hard against both the Ninjas for their incompetency and Fann for her folly in having hired them.
  • Despite the obvious failure of the Ninja's disastrous pretend "audit" in Arizona, Republicans across the country are noticing the millions of dollars raised by the grifters running that spectacle, and have decided they'd like some of that sweet sweet "audit" theater in their own home states. But on Wednesday, the U.S. Dept. of Justice issued new guidance documents, warning that they intend to enforce federal laws that may be violated by such exercises.
  • In separate, but related guidance on Wednesday, the DoJ also also made clear they intend to enforce federal voting rights laws against states enacting new voter suppression measures, as GOP-controlled legislatures are now doing all over the country. That, even as recent rulings by the GOP's stolen and packed SCOTUS has made such enforcement much more difficult, in lieu of new federal laws needed to protect the franchise.

    To that end, the House Oversight and Reform Committee on Thursday held a hearing on, among other things, the Texas state legislature's attempt to adopt such a bill. Texas Democrats left the state two weeks ago to prevent the quorum needed to pass such a bill during the ongoing special session called by Gov. Greg Abbott to do just that. And today, 82-year old state Rep. Senfronia Thompson --- the longest serving woman and African-American woman in Texas history, now in her 25th term --- offered moving testimony about her and her family's personal experiences with Jim Crow voter suppression laws in the Lone Star State. We share some of her must-listen remarks in response to GOP Congressmembers at the hearing who downplayed the difficulty of minority voters to exercise their right to vote.

  • With COVID surging again, thanks to the Delta variant and those who have refused to get life-saving vaccinations, President Biden announced new initiatives at the White House today, following impassioned remarks to encourage Americans to get their shots. "This is an American tragedy," he said. "People are dying --- and will die --- who don't have to die. If you're out there unvaccinated, you don't have to die," the President pleaded before detailing the new incentives. Among them: Paying the unvaxxed $100 to get their shots; Expanding federal reimbursement for employers and employees to take time off to get both themselves and their families inoculated; and a new requirement for federal workers and contractors to either get vaccinated or face regular testing and other restrictions.

Guest: Const'l Attorney John Bonifaz on reversing 'the road to tyranny' (and also on how to get foreign corporate money out of U.S. elections)...

Writing at Washington Monthly today, asking "Why Is Merrick Garland Defending Bill Barr's Policies?," law professor and Free Speech for People (FSFP) Board Member Jennifer Taub quips: "This is Merrick Garland's Tylenol moment, and by which I mean he has more than a headache but a poisoning on his hands." Yup. Today's BradCast won't cure his headache, but it may offer an antidote for the poisoning...if he pays attention. [Audio link to full show follows below.]

The new Attorney General spoke at the Dept. of Justice on Tuesday about his national strategy to focus on the rise of domestic terrorism, particularly carried out by white supremacists in the wake of the Trump-incited January 6th attack on the U.S. Capitol. Garland described such incidents as "attacks on all of us collectively, aimed at rending the fabric of our democratic society and driving us apart," adding: "We have an enormous task ahead, to move forward as a country, to punish the perpetrators, to do everything possible to prevent similar attacks and to do so in a manner that affirms the values on which our justice system is founded and upon which democracy depends."

Garland's remarks follow on his announcement Friday that he is doubling the number of DoJ attorneys focused on enforcing voting rights at the federal level in light of new vote suppression laws being adopted by Republicans in states around the country.

So, he seems to understand at least two major threats to the values "on which our justice system is founded and upon which democracy depends." But is he really prepared to punish all of the perpetrators?

Every day now it seems that stunning new information is revealed as to just how poisoned our Dept. of Justice had become under the Trump Administration, as the former President used the nation's once widely respected law enforcement agency for his own personal purposes, to protect himself from legal accountability (as in former AG Bill Barr's use of the department to block Trump from criminal accountability for obstruction following Special Counsel Robert Mueller's findings and from civil accountability in the defamation case filed by Trump's alleged rape victim, E. Jean Carroll, both of which Taub writes about today); to wield power against his perceived political enemies (as we learned last week, when it was revealed that the DoJ secretly obtained phone, email and text message records from Democratic lawmakers and several media outlets in 2018); and, in futile efforts to keep himself in power (as we learned today, based on emails obtained by the House Oversight Committee revealing Trump tried to order the DoJ to file briefs in the U.S. Supreme Court in support of his evidence-free big lie that the 2020 election was stolen from him).

As more and more emerges, it's difficult to keep up with it all. But, sadly, what we know so far is likely only the tip of the iceberg. That's why, back in February, a group of non-partisan government watchdog groups penned a letter [PDF] to then Judge Merrick Garland, prior to his confirmation as AG, calling on him to form a task force at the DoJ immediately after being confirmed, "to investigate any potential federal criminal or civil violations that may have been committed by former President Trump, members of his administration, or his campaign, business, or other associates."

The letter, which has now been signed onto by more than 200,000 Americans, according to FSFP, asks Garland to convene the task force to probe Trump's "flurry of unethical, unconstitutional, and often criminal activity, culminating on January 6, 2021, with the seditious insurrection on the United States Capitol incited and encouraged by former President Trump and his allies."

"If we are to begin the process of restoring the integrity of the Department of Justice and the rule of law to our nation," the groups write --- before detailing at least five different categories of "potential offenses" by the previous administration --- "it is essential that the Department thoroughly investigate these actions and, where warranted and appropriate, hold accountable those who have violated the nation's laws."

That DoJ task force, however, has yet to be formed. And Garland, according to our guest today, Constitutional attorney and longtime voting rights champion JOHN BONIFAZ, co-founder and President of FSFP, has yet to reply to the February letter.

On today's show, Bonifaz explains why "it's critical" that this task force be stood up, and why such a group of prosecutors need to be convened in this matter, rather than an independent commission formed by Congress, a blue ribbon panel formed by the White House or even another Special Counsel investigation launched by DoJ.

While he supports Congressional oversight in general, he explains: "The reason why we believe a task force is the best way to go over a Special Counsel is we do think this should not be assigned outside of the Department to someone who then is seen, as Robert Mueller was, as the sole arbiter of this." While disagreeing, as many scholars do, with the notion that a sitting President cannot be criminally indicted, Bonifaz explains that Mueller's report "was very clear that once the President was out of office, he would be free to be prosecuted for those crimes."

"That's just one example of many as to why this task force needs to be created," he tells me. "There are multiple investigations that need to proceed, and potentially multiple prosecutions. It would be an outrage for this Administration to claim that it's going to turn the page, it's not going to conduct that kind of accountability for those that have engaged in such lawless behavior in the last Administration. That's what happens on the road to tyranny. If we're to protect our democracy and our Constitution, it's critical that we hold Donald Trump and his associates accountable for the violations of federal criminal law they may have committed."

We discuss a number of the already known issues currently crying out for real probes by federal prosecutors if the DoJ is ever to be restored; concerns about Trump associates still burrowed in at Justice; the many investigations known to have been shut down by Barr which should quickly be re-opened; and the question of "why is the Biden Justice Department continuing the work of the Barr Justice Department" when it comes to attacks on press freedoms via only-recently lifted gag orders on secret subpoenas of reporters' private records and "the intervention that the Barr Justice Department started in the E. Jean Carroll case --- both of these decisions were clearly made with Garland's knowledge."

I also ask Bonifaz for his opinion on whether he believes Garland is actually up to the gargantuan task of dealing with the ongoing and increasing problems that DoJ must now handle regarding all sorts of criminal and civil matters, even while bringing both accountability for the unprecedented corruption of the previous Administration and the necessary reforms at DoJ to avoid the same or worse abuse of the nation's top law enforcement agency in the future.

"I think this is a moment for the Department of Justice, but also for democracy and our Constitution. And they need to get it right," he explains.

In a separate matter, FSFP --- which was founded in the wake of the Supreme Court's 2010 'Citizens United' ruling that opened the floodgates to corporate money in American elections --- is now working at the state level to enact model legislation that would bar corporations with foreign investors (which is a whole lot of them!) from being allowed to spend money in state and municipal elections.

We try to hit a lot of news on today's BradCast after yet another very busy news weekend both at home and abroad. We don't get through our entire stack, but that's only thanks to some good calls from listeners along the way. [Audio link to full show is posted below summary.]

Among the stories we cover on today's program...

  • 600,000 are now dead from COVID-19 in the U.S. as states --- including California on Tuesday --- begin opening up again for business at full capacity (and as infection rates start to tick up again nationally...we're hoping it's just some noise in the data for now...)
  • Israel's longtime, hard-right leader Benjamin Netanyu, recently indicted on corruption charges, is finally out as Prime Minister of Israel. On Sunday, the Israeli Knesset officially approved a new governing coalition with a former top Netanyahu aide, Naftali Bennett, as the Jewish state's new Prime Minister. He will lead a broad coalition of some eight left, right and center parties, including the first Arab party to sit in a governing coalition. The fragile new partnership aims to move beyond the exceedingly polarizing years of the former PM, even as Netanyahu --- in one of his Trumpiest tantrums to date --- demonized many of his former rightwing colleagues in the new coalition as an "evil and dangerous leftist government" and decried his personal legal troubles as the result of a witch hunt. (Sound familiar?)
  • A disturbing story broke over night by CNN, suggesting there may be an ongoing or "imminent radiological threat" at a new nuclear power plant in China. Details come largely via a French company that has partnered with the Chinese on the Taishan Nuclear Power Plant in Guangdong province. Independent experts are watching the situation closely to determine how dangerous --- or, not-that-unusual --- the situation now is, as cracks seem to have formed in the main encasement of fuel rods at the plant. We'll continue to watch this one as well.
  • U.S. allies appeared just shy of giddy over the weekend and into today, as Joe Biden made his first appearance as President at the G7 summit in Cornwall, England and the NATO meetings that followed it. Biden and longtime allies in Europe hope the new President will restore a sense of normalcy to the proceedings and the post-WWII order, even as old disputes continue and many in Europe remain concerned (for good reason!) about the continuing fragile and divisive political situation in the U.S. that allowed the rise of Donald Trump's autocratic regimes in the first place.
  • Former National Security Agency whistleblower Reality Winner was released early from prison on Monday for good behavior. Winner had sent documents to media revealing Russia's attempted hacks of a voter registration software company in the U.S. during the 2016 election. The extent of those hacks is still publicly unknown but, arguably, wouldn't be known at all had it not been for Winner revealing the information to the media and public. As thanks, she was slapped with one of the longest prison sentences ever for such a leak to the media.
  • Then, callers ring in on a number of the various stories covered above, as well as some additional ones, including the news that Trump's DoJ secretly subpoenaed phone, email and text message records from Democratic lawmakers; Republicans continue to undermine American democracy in states across the nation; Democratic Sen. Joe Manchin continues to obstruct democratic reforms; and concerns persist about whether Biden's Attorney General Merrick Garland is up to the task of bringing accountability for so much of the unprecedented damage wrought by the Department during the Trump years...
