Following up on Saturday's NEWSWEEK scoop that Attorney General Holder "may be on the verge of" appointing a prosecutor to investigate Bush/Cheney-era torture, Digby notes how the chuckling dinosaurs of ABC News' This Week with George Stephanopoulos on Sunday snickered their way through a discussion of prosecution for torture by the Bush/Cheney regime (in our name!) as if they were wise-cracking about any old political brouhaha from inside the Beltway. (Video/transcript here, courtesy of C&L.)

Note to Stephanopoulos: How about featuring some actual journalists and bloggers who've actually been covering this issue for months (years?) before you eventually come to wonder why your show has gone the way of all the dead trees in the newspaper publishing business. Greenwald, Scahill, Wheeler, Horton all come to mind. It might bring your show up to date...or at least, up to 2006 or so.

The serious folks out there, several mentioned above, took a look at Saturday's NEWSWEEK report with the grim sobriety and analytical acumen that it deserves, while in largely shabby followups Washington Post, New York Times, and Rupert Murdoch's Wall Street Journal all seem to float anonymously sourced trial balloons, averring the notion that only low-level rogue interrogators who exceeded the boundaries of the DoJ's illegal torture justification memos would be targeted by such an investigation.

On that point, while Glenn Greenwald charges such an approach would be arguably "worse than doing nothing," as it would "actually further subvert the rule of law rather than strengthen it," he also notes:

It's worth emphasizing here that all of these reports are preliminary and from anonymous DOJ sources, so it's a bit premature to get too worked up over a prosecution approach which Holder hasn't even announced yet. Still, given how many DOJ sources went to multiple newspapers at the same time to disclose Holder's plans, it seems clear that this was a coordinated, approved effort to disseminate Holder's intentions as a "trial balloon" to gauge public reaction.

Scott Horton's reporting counters the indications from anonymous sources in the increasingly obsolete WaPo, Times, and WSJ coverage which suggests focus on only low-level agents and contractors, rather than policy makers, by reporting that his sources at DoJ indicate just the opposite [emphasis ours]...

Will Palin now have to threaten a lawsuit against Fox "News" too?! Oh, the tangled webs...


By way of reminder, Palin's private attorney, Thomas Van Flein, had issued a legal threat on the 4th of July to those in the media (seemingly only the perceived left-leaning media) who discussed questions about the Palin's contracting of their house in Wasilla, and the Wasilla Sports Complex, both built while the state's soon-to-be-former Governor was mayor of the small Alaskan town.

"This is to provide notice to [Alaska blogger and radio host Shannyn] Moore, and those who re-publish the defamation, such as Huffington Post, MSNBC, the New York Times and The Washington Post, that the Palins will not allow them to propagate defamatory material without answering to this in a court of law," Van Flein wrote for Palin over the weekend.

Of the outlets named above, only MSNBC had actually discussed the controversy (video here), during a telephone interview with Moore following her Huffington Post blog item referencing a potential "iceberg scandal," and the further details we followed up with on that here.

When asked why the other outlets, which hadn't reported on the matter, had been targetted as well in the statement,"Van Flein said he believed they were asking questions," according to the Anchorage Daily News. "What I've been informed is that they've been interviewing people in Wasilla about this, and have tried to interview the governor's parents about it," Palin's attorney told the paper.

For her part, Moore quickly shot back in her own defense, against the Van Flein/Palin legal threats, assailing the outgoing Governor as "a coward and a bully."

So does Fox "News" now need to lawyer up too?

Alaska Gov. Sarah Palin marked the Independence Day holiday by firing back at "false and defamatory allegations" made over the past twenty-four hours; noting limits on the "right of free speech"; declaring herself a victim; and issuing threats of potential litigation against a number of journalists and media outlets.

Through her private attorney, Thomas Van Flein, Palin issued a statement on Saturday in response to stories concerning suggestions of a federal investigation into the contracting and building of her house on Lake Lucille in Wasilla and the Wasilla Sports Complex, both constructed during her tenure as Mayor of the small town.

The four page response [posted in full at the end of this article] rebuts allegations as discussed on this blog and other news sites on Friday following the former Republican Vice Presidential nominee's surprise announcement that she would be resigning from office with a year and a half still remaining in her first term as Governor.

The defiant statement includes a warning "to provide notice" to journalists and media outlets that she "will be exploring legal options this week to address such defamation."

The statement opens by charging that following her stunning, and often beguiling, hastily called press conference at the beginning of the holiday weekend, "several unscrupulous people have asserted false and defamatory allegations that the 'real' reasons for Governor Palin's resignation stem from an alleged criminal investigation pertaining to the construction of the Wasilla Sports Complex."

Also, late tonight, the Los Angeles Times has filed a short article featuring a response from an FBI spokesperson in Alaska who denies that the agency is investigating the Palins on those matters...

As of tomorrow, the increasingly useless Washington Post will become more so. Dan Froomkin, one of the few journalists at the once-credible newspaper who bothered to do his job by investigating and asking the questions that mattered during the Bush Administration's historic gutting of America and so much of what it stands for, filed his final "White House Watch" column today. He described, today, what he does as "accountability journalism." We could use dozens more like him in the MSM.

His piece today echoes FBI whistleblower Coleen Rowley's exposé on these pages yesterday, in his description of Bush as "the proverbial emperor with no clothes." He goes on to note how, after 9/11, "the nation, including the media, vested him with abilities he didn't have and credibility he didn't deserve."

Seemingly dead-set on hastening its obsolescence, Washington Post has fired "White House Watch" columnist Dan Froomkin, one of their only unflinching truth-tellers who never stopped telling those truths, even through every dark year of the former oppressive regime when McCarthyesque tactics prevailed, and 99% of the men and women who held jobs like Froomkin's failed the nation by pulling their punches and folding to the cynicism of fear and intimidation.

Says Froomkin in response: "I'm terribly disappointed. I was told that it had been determined that my White House Watch blog wasn't "working" anymore. But from what I could tell, it was still working very well. I also thought White House Watch was a great fit with The Washington Post brand, and what its readers reasonably expect from the Post online."

Ironically, folks like Howard Kurtz and Dana Milbank remain employed by WaPo in the meantime. So do unapologetic wingnut liars and tools such as Charles Krauthammer, William Kristol, George Will and a bevy of others. And in more irony, despite the paper's purge of just about anyone who might have been described as "liberal" or "progressive" (and yes, Froomkin held Obama feet to the same fire he held Bush's), the still-employed wingnuts will continue to label the hard-right charging WaPo as "the liberal media," even as the editors and publishers of the paper run out of money, wonder what happened to them, and blame "the Internet" for their own failures in falling for the bait.

"As I've written elsewhere," Froomkin said in his statement, "I think that the future success of our business depends on journalists enthusiastically pursuing accountability and calling it like they see it. That's what I tried to do every day. Now I guess I'll have to try to do it someplace else."

Where the U.S. MSM continue to fail

Andy Worthington, who largely broke the story of the reported 'suicide' of Ibn al-Shaykh al-Libi in a Libyan prison, into the English-language press on Sunday (as we helped that night), picked up last night on our followup to the original story, decrying the paucity of coverage of the disturbing report in the U.S. corporate mainstream media.

Al-Libi was, after all, the 'ghost detainee' who had offered a false link between Iraq and al-Qaeda, used loudly by the Bush Administration before the war as a key justification for it, after being tortured by the CIA and Egypt, where he'd been secretly renditioned from U.S. custody at Guantanamo. He would later recant his false 'confession,' explaining that it had come about only after 17 hours of 'mock burial,' and a session of brutal beatings by his captors which followed it.

Newsweek describes the al-Libi affair today as "one of the biggest intelligence fiascos of the run up to the Iraq War" and "a major embarrassment for the Bush administration."

Worthington asked why the initial "media silence," before noting that while U.S. outlets have finally begun to cover the story, one of the better initial reports, from Peter Finn at Washington Post fails to follow up on the paper's own previous coverage of 'ghost detainees,' which included al-Libi, who had disappeared, at some point, from the Bush Administration's long list of suspected 'terrorists' captured following 9/11.

Al-Libi was one of those captives previously reported on by WaPo. His re-emergence in Libya --- where he was spotted by Human Rights Watch at the Abu Salim prison in late April, in apparent good health, but refused to be interviewed, reportedly saying only "Where were you when I was being tortured in American prisons?" --- was punctuated, just two weeks later, by the surprising news of his reported 'suicide.'

But where WaPo covered some of the points mentioned in a press release on al-Libi's death from HRW, they failed to mention any of the other 'ghost detainees' mentioned in the very same press release, whose whereabouts had been a mystery up until now. That, even though WaPo had previously reported the 'missing' status of those same detainees!

Given the disturbing fate of al-Libi --- who, HRW's Tom Malinowski charges, "was missing because he was such an embarrassment to the Bush administration. He was Exhibit A in the narrative that tortured confessions contributed to the massive intelligence failure that preceded the Iraq war" --- it's disappointing that the paper has so far failed to connect dots that could, in this case, help shine a spotlight on growing concerns about some of those other detainees: A spotlight which may help keep them alive, at this point.

There is certainly good reason to question both the timing, and reported means, of al-Libi's death, not the least of which is the point made in several media reports, including AP's, where some have "expressed doubts that al-Libi killed himself, saying al-Libi was a 'true Muslim and Islam prohibits committing suicides.'"

Yet, as Worthington notes, the Post failed to even mention the current status of the other detainees HRW discovered in the Libyan prison, even as they had similarly been sent there by the CIA following claims of abuse and torture at the hands of the U.S....

Salon's Glenn Greenwald Joins Us in Being Tarred as 'Conspiracy Theorists' While WaPo and AP Continue to Uncritically Advance the Government's Often Wholly-Imaginery Anthrax Case...

Glenn Greenwald returns from his vacation rested and ready to keep up his devastating work on the anthrax beat over at Salon. On Monday, he noted how the FBI's timeline for the supposed Anthrax Killer, Bruce Ivans' trip to mail deadly letters in Princeton, NJ, was literally impossible. So the FBI just leaked a different theory to the Washington Post, who had uncritically reported their first one. Again, the new theory was dutifully passed on uncritically, without the reporters even bothering to note that their first reported theory was wholly debunked.

Writes Greenwald (in reference to the Post here, but feel free to replace its name with virtually any other MSM outlet of your choice):

That's because The Post's role here has been and continues to be what the establishment media's role generally is --- to serve government sources and amplify their claims, not to investigate their veracity. That's how it was Saddam Hussein who was the original anthrax culprit, followed by Steven Hatfill, and now Bruce Ivins. It's how Jessica Lynch heroically fought off Iraqi goons in a firefight, how Pat Tillman stood down Al Qaeda monsters until they murdered him, how Iraq possessed mountains of WMDs, and now, how Russia has assaulted the consensus values of the Western World by invading a sovereign country and occupying parts of it for a whole week, etc. etc. All of those narratives came from the Government directly into the pages of The Washington Post, which then uncritically conveyed them, often (as in the case of the Jessica Lynch lies and WMD claims) playing a leading role in doing so.

He then follows up with this eerily all-too familiar refrain, at least for me and likely most long time BRAD BLOG readers:

Similarly, here is an Associated Press article from last week, by AP's Matt Apuzzo, purporting to report on what it admits are many "meticulously researched" questions that have been raised (including by me) about the FBI's case, yet repeatedly demonizes such skepticism with these phrases, laced throughout the article: "the ingredients for a good conspiracy theory"; "skeptics and conspiracy theorists"; "armchair investigators, bloggers and scientists"; "one of the great conspiracy theories, like whether we landed on the moon or whether Lee Harvey Oswald acted alone"; "anti-Jewish writers blame the attack on a Zionist plot"; "You can't prove aliens didn't mail the letters."

Welcome to my world, Glenn.

As always, in Establishment Media World, nothing is more insane or radical than refusing to believe every word the Government says. Even after Iraqi mushroom clouds and the whole litany of Government falsehoods, the establishment hallmark of Seriousness and Sanity is accepting the Government's word. When it says Iraq was behind the attacks, then it was. When they said Hatfill was the culprit, he was. Now that they say that Ivins is, he is, and only "conspiracy theorists" --- comparable to those who disbelieve we landed on the moon --- would question that or demand to see the actual evidence. The FBI is relying, understandably so, on their mindless allies in the media to depict its case against Ivins as so airtight that no real investigation is necessary.

Glad to hear it's not just us. Apparently, we're now in very good company, even as our Outlaw Nation continues to crumble around us. To the corporate MSM, however, everything is just fine.

UPDATE: Pelosi Admits She's Not Read the Articles of Impeachment Against Bush!

A mother of a late Friday disclosure. From the Times tonight, in an unbylined story, for tomorrow's papers...

WASHINGTON — The Federal Bureau of Investigation said Friday that it had improperly obtained the phone records of reporters for The New York Times and The Washington Post in the newspapers’ Indonesia bureaus in 2004.

Robert S. Mueller III, director of the F.B.I., disclosed the episode in a phone call to Bill Keller, the executive editor of The Times, and apologized for it. He also spoke with Leonard Downie Jr., the executive editor of The Washington Post, to apologize.

The records were apparently sought as part of a terrorism investigation, but the F.B.I. did not explain what was being investigated or why the reporters’ phone records were considered relevant.

Remember two weeks ago when Nancy Pelosi said, on ABC's The View: "I thought that Impeachment would be divisive...If someone had a crime that the President had committed, that would be a different story"?

What a disgrace. And once again, it's a citizen who tries to do the media's job for them, by asking her about those Articles, as filed by Kucinich, against Bush.

"I didn't read it yet!," the Democratic House Speaker tells the citizen when he hands her a copy of the Articles, as submitted into the Congressional record, and voted by the full House to be deferred to the Judiciary Committee.

She didn't even read them?! And yet she has the temerity to go on national television, on ABC, to say that she's unaware of any crimes he's committed and that Impeachment shouldn't be done "unless you have the goods that this President committed a crime"?! Amazing. Here's the video...

Then Returns to Similar Questions About Ivins' Lack of Access to 'Dry, Powdered Anthrax' in Sunday Article
New WaPo Story Begs Additional New Questions in Feds' Purported Case...

We're glad it's the Washington Post, and not just us "bloggers," asking questions about this anthrax case. Had we been the ones pointing to the questions that WaPo is now pointing to, we'd have been accused of forwarding "just another conspiracy theory" and the notable questions raised might have been relegated to the trash-bin of history.

Since it's WaPo raising the questions, on the other hand, the trash-bin will take an extra day or two to fill up, but we suspect the results may eventually be the same: Legend will have it that the lone "Anthrax Killer," Bruce E. Ivins, killed himself just before he was to be indicted on capital murder charges. Case closed on the previously-unsolved deadly series of terrorist attacks that occurred on American soil since 9/11.

That said, it's certainly odd the way that WaPo has been covering this story. While their top story on page A1 today is headlined "Scientists Question FBI's Probe of Anthrax Attacks" and sub-titled "Ivins Could Not Have Been Attacker, Some Say," the paper nonetheless managed to scrub from their website --- or at least completely replace --- a story they ran originally on Friday afternoon questioning the same points (whether Ivins had the means, ability, or access to the dry, weaponized anthrax used in the attack letters against senior Democratic Senators and other perceived "liberals") with another that greatly softened concerns about those questions.

No retraction or correction notice --- unethically, in our opinion --- was given for WaPo's odd swaperoo. The Friday WaPo story we linked to that day --- which was dated "Friday, August 1, 2008; 5:46 PM" and reported that that the purported "Anthrax Killer," Bruce E. Ivins, "had no access to dry, powdered anthrax" at his U.S. Army bioweapons lab in Fort Detrick, MD --- was simply swapped out with a completely different story in its place on the matter, dated Saturday, August 2, 2008. The same URL was used for both stories, but the Saturday story didn't have the bulk of the reporting which quoted named experts and colleagues questioning Ivins' ability to even carry out such an attack.

After noticing the swap/excising of the original Friday story (hat-tip BRAD BLOG commenter Bruce Sims), we were set to run a story focusing on the spiked report, when we then checked today's paper to see that they were leading the Sunday edition with a story that raised many of those same questions from the Friday story again.

Fortunately, we cached the original Friday story here, before it was disappeared and replaced, and have done the same for today's story, should that one go missing as well. Comparisons between WaPo's (disappeared) Friday, Saturday, and Sunday coverage is curious enough, however, --- and offers some fresh, additional unanswered questions --- that it seems worth noting all of it, and the differences in each days' coverage, for the record...

Earlier today we singled out the media's failure to note the purported "liberal" leanings of those targeted by the "Anthrax Killer" (such as two leading Senate Democrats) in their coverage of the reported suicide of suspect Bruce E. Ivins.

Those reports noted that Ivins was soon to be indicted in the case. But was he the one who really dunnit?

A BRAD BLOG reader points us to this curious note, near the end of a late-afternoon story from today's Washington Post coverage, noting that Ivins had "no access to dry, powdered anthrax" at the Fort Detrick lab where he worked [emphasis ours]:

'Huh?' Says The BRAD BLOG...And So Does the Campaign Legal Center...

We admit to being perplexed enough by Matthew Mosk's Sunday article in WaPo, claiming that GOP "voter fraud" zealot Hans von Spakovsky, formerly of the DoJ Civil Rights voting unit, was "cleared" by a U.S. Election Assistance Commission (EAC) inspector general's report, to poke around for a few minutes trying to figure out who this Mosk was, and how the hell he figured the report "cleared" von Spakovsy of anything.

vS was one of the notorious villians at the DoJ who politicized the hell out of the Civil Rights division by turning it into a blunt instrument to keep minority voters from being able to cast their lawful vote in any way he could figure out how to do.

He is also the failed nominee for the FEC who still has yet to show enough grace to remove his name from consideration, as he has singlehandedly succeeded in ensuring that the commission is entirely crippled, unable to vote on anything without a quorum, during an election year.

As the IG's report on whether the EAC was inappropriately influenced, by von Spakovsky and others, to withhold and the re-write a bi-partisan study on voter fraud, the then-chair of the EAC, Paul DiGregorio --- a Republican himself --- said that “too many of [von Spakovsky’s] decisions are clouded by his partisan thinking”...vS “certainly tried to influence...There’s no question about that," and that, the EAC chair felt that "von Spakovsky thought he should use his position (on the EAC commission) to advance the Republican Party position.”

Mosk used his WaPo article then, to quote vS alleging that the "conclusions (of the EAC IG report) represented a personal vindication" for him. Huh?

We got distracted by other business, and were unable to finish our poking around to figure out what Mosk might have been after, and why this article, on a report published three weeks ago suddenly became "news" to the Washington Post, with "clearance" of von Spakovsky as the central meme.

J. Gerald Hebert, over at the Campaign Legal Center Blog seems to have come away with the same perplexed reaction, opening his article yesterday with...

In discussing WaPo's failure to properly describe Karl Rove's most recent indisputable lie (claiming it was Congress, not Bush, who rushed the resolution to authorize the use of military force in Iraq), Greg Sargent hits upon one of the most maddening --- and demonstrably destructive --- failings of the corporate mainstream media agenda-setters...

As Glenn Greenwald notes, the unwillingness of news orgs to challenge GOP lies by taking that extra step and using the F-word --- "false" --- is "one of the most significant problems in how our establishment media functions." And as Times proved yesterday, when this extra step is taken, the world doesn't get knocked off its axis. Yet WaPo's editors --- perhaps out of fear, perhaps for other not particularly admirable reasons --- simply refuse to label GOP falsehoods what they are.

It's time the Washington Post, and scores of other such news outlets like it, start using actual words, like "lie", to report on what is actually going on in this country. No doubt they'll get around to it soon enough. Just in time for Hillary.

That, even as WaPo apparently has no problem reporting out and out rumors lies (long ago disproven ones at that) on their front page --- at least when they involve Democrats --- to the point that even a WaPo cartoonist had to take them to task for it.

And about this "balance" bullshit...oh, don't even get me started...

Apparently, one of the requirements for working as a reporter at the Washington Post is that you must remain as out of touch as possible with anything that matters.

According to ThinkProgress today, Watergate's investigative genius, Bob Woodward, smartly meets the requirements...

Earlier this week, Washington Post investigative reporters Bob Woodward and Jeff Leen hosted an online chat at washingtonpost.com. One of the participants asked Woodward and Leen how pervasive the voter suppression tactic known as "caging" is. The investigative reporters had no idea what it was:

Washington, D.C.: Don't you have a duty to report criminal activity to the appropriate authorities?

How pervasive is "caging"?

Bob Woodward and Jeff Leen: We publish what we can find and document. Many times over the years government authorities have pursued the information we have dug up and launched their own investigations. But we're trying to serve the readers, and we do not act as police or prosecutors. And please send us an e-mail explaing [sic] what "caging" is.

Woodward and Leen aren't the only Washington Post reporters who are clueless about caging. In a washingtonpost.com online chat with congressional reporter Jonathan Weisman in May, a questioner asked "why Congress didn't jump on Monica Goodling's testimony about caging." Weisman's response: "So what is this caging thing?"

So for all those Washington Post reporters out there, let's go over the facts again...

Wow. Snap. Washington Post covered yesterday's House Judiciary subcommittee hearings in two separate articles today and via one hell of an online video to boot.

Dana Milbank covered on page 2, opening with "John Tanner is one sorry man." Dan Eggen covered the "political uproar" that we kicked off here at The BRAD BLOG several weeks ago, on page 4.

But it's Milbank's online "video sketch" that cuts to the bone, offering the best first-hand encapsulated coverage of the hearings we've seen to date (far better, even, than the PBS News Hour's version last night).

Consider the following montage a "Must See!" And one that almost makes one begin to feel sorry for John "Minorities Die First" Tanner...

...We said "almost." But not by much. A reply to Tanner's testimony yesterday --- from an insider still forced to work under him at the DoJ's Civil Rights Division Voting Section --- to come shortly.
