After many weeks of speculation, and embarrasingly bad media coverage, Attorney General Eric Holder has finally named a Special Prosecutor to probe the use of torture by the Bush/Cheney Administration. The announcement comes on the same day that a redacted version of a 2004 Inspector General's report [PDF] on the CIA's use of torture was also released. RAW STORY has a good backgrounder on the announcement.

The prosecutor, John Durham, a career DoJ attorney from Connecticut, has already been investigating the CIA's destruction of torture video tapes, and has been described by AP as "one of the nation’s most relentless prosecutors."

The IG's 122-page report details the beating and death of detainees, threats of violence, death and sexual assault to their family members, and other techniques used by U.S. government interrogators that were "inconsistent with the public policy positions that the U.S. has taken regarding human rights."

Shortly after the announcement today, U.S. House Judiciary chair John Conyers (D-MI) and subcommittee chair Jerrold Nadler (D-NY) released a statement applauding the appointment of the Special Prosecutor and calling for a 'broad mandate' to prosecute not just 'frontline personnel,' but also the 'policymakers and lawyers' who created the "conditions where such absues were all but inevitable to occur."

"Seeking out only the low-level actors in a conspiracy to torture detainees will bring neither justice nor restored standing to our nation," says Nadler in the statement (posted in full below)...

On Aug. 20, 2009 The New York Times published a front-page article:

[Emphasis added]The Central Intelligence Agency in 2004 hired outside contractors from the private security contractor Blackwater USA as part of a secret program to locate and assassinate top operatives of Al Qaeda, according to current and former government officials.

A substantially similar article appeared in the Washington Post and in the Los Angeles Times.

The New York Times article provided limited background information on Blackwater aka Xe, referencing what amounted to a massacre of 17 unarmed Iraqi civilians gunned down by Blackwater mercenaries in Nisoor Square as simply an instance in which Blackwater had been "accused of using excessive force."

In "Blackwater = Murder, Inc." I covered the explosive allegations made in sworn statements by two former Blackwater employees --- murder, weapons smuggling, corruption, and the use of child prostitutes. I argued:

Now, that same corporate press learned from "official sources" that Blackwater is linked to former Vice President Richard B Cheney's "assassination wing." It repeats, without challenge, the official source contention that the only ones targeted by the "assassination wing" were senior al Qaeda officials --- this despite Jeremy Scahill's and Keith Olbermann's revelation that John Doe 2, reportedly a former member of Blackwater's management, alleged:

In Part I of this five-part series, I took care to distinguish the post-9/11 application of torture techniques by the U.S. military from the role played by the CIA and demonstrated how the Bush/Cheney decision to torture predated the quasi-legal Justice Department memos. Sibel Edmonds' recent on-air revelation that, prior to 9/11, Osama bin Laden was relied upon by the Bush administration as a Central Asian asset, added one more disturbing piece to an incomplete puzzle, which, as could be expected, lent itself to a number of comments asking whether 9/11 was "an inside job." These, in turn, were summarily dismissed in another comment as "conspiracy theory."

Where does this concept of dismissing inquiry into momentous events as "conspiracy theory" come from?...

During my recent interview with FBI translator-turned-whistleblower Sibel Edmonds on the Mike Malloy Show, a caller had asked her opinion on whether she believed 9/11 to have been "an inside job."

Edmonds replied by first specifying "As I have done for the past 7 or 8 years, I have basically stuck with what I know, first-hand, directly, my own knowledge, based on my own experience, based on what I obtained, which is not a lot, but it is extremely important."

After explaining the difference between what she does and doesn't know first hand, she went on to explain: "I have information about things that our government has lied to us about. I know. For example, to say that since the fall of the Soviet Union we ceased all of our intimate relationship with Bin Laden and the Taliban - those things can be proven as lies, very easily, based on the information they classified in my case, because we did carry very intimate relationship with these people, and it involves Central Asia, all the way up to September 11." ...

Earlier this week I wrote about the ABC "News" chuckleheads, and their laff riot over the floated idea of a torture probe, "on the verge of" being announced by AG Eric Holder. They laughed and pooh-poohed the high-larious suggestion on last Sunday's Stephanopoulous.

And now MSNBC offers another egregious example of corporate media failure --- in this case, again, "inside the beltway" corporate media failure --- in their "coverage" of such a possible investigation/prosecution. Glenn Greenwald is, as usual, a must read here beginning this way on Wednesday...

As I say, Greenwald's analysis of how far off the rails such insider "journalism" has now gone; how far from what the nation's Founders intended; how completely and utterly out of touch these guys actually seem to be from the public, is a must-read. So please do.

The direct application of KUBARK techniques to a "floating population" of "ghost detainees" at CIA black sites will be covered in Part V. In both segments, I will demonstrate how torture was applied not to protect the American people but to help produce doctored intelligence that would provide cover for imperial conquest. I will end with the disturbing yet still unresolved questions as to how many victims of the Bush/Cheney torture regime remain amongst "the disappeared;" how many of those victims are now deceased...

Just in from Senator Feingold (D-WI), on the weekend news, that "The Central Intelligence Agency withheld information about a secret counterterrorism program from Congress for eight years on direct orders from former Vice President Dick Cheney," according to CIA Director Leon Panetta...

Imagine --- just imagine --- the outrage we'd be hearing from every side of the Rightwing blogo-mediasphere if the report [PDF], just out today from the Inspectors General of five different U.S. intelligence agencies, found that President Obama was carrying out a clandestine "Presidential Surveillance Program" that only he, a handful in the White House, and just two or three officials at the DoJ were aware of.

They would, of course, be appropriately outraged (for a change), and even justified in calling for Obama's impeachment over an apparently unprecedented, illegal intrusion into the private lives of American citizens, justified only by a single "legal finding" of one low-level attorney at the DoJ's Office of Legal Counsel.

But will the wingnuts say a word about the report out today showing that Bush/Cheney's criminal outfit did exactly that? Will those who have found our site of late, having come here to justify crazy Sarah Palin's decision to abort in her first term, condemn Bush for any of this, as they surely would had it been found that Obama had been doing the exact same thing? We'll see.

Finally, we're beginning to receive some details on what former Deputy AG James Comey's incredibly dramatic Congressional testimony (video here, transcript here)-- describing his late-night sprint to Ashcroft's hospital bedside to intercept White House officials (Gonzalez and Card) coming over to strongarm him into signing an extension for the still not-fully-disclosed spying program --- was all about.

Several weeks ago, VelvetRevolution.us, in coalition with a number of other accountability groups, filed bar disbarment complaints against 12 different Bush Administration attorneys in four states and the District of Columbia in regard to their approval of banned torture techniques used during detainee interrogations.

In a press conference today we (Disclosure: The BRAD BLOG is co-founder of VR) added two more to that list, both top CIA attorneys who continue to serve at the agency under the Obama Administration.

The faux Republican outrage over Nancy Pelosi's perceived slight, in charging that CIA briefers directly misled Congress, has been amusing to watch. Even as the Democrats' seeming inability to either defend her, or fear of sinking into the same phony political sandtrap, is disappointing. But Democrats seem to excel at disappointment these days, so that part of the ginned-up story is hardly surprising.

The GOP hypocrisy in charging that Pelosi has somehow hurt the morale of The Agency in the bargain (and, as bonus, that Obama's release of the Bush Torture Memos has endangered CIA operatives) has been all the more amusing to witness, in their complete and entire selective amnesia of their party's own 100%, unqualified support of a White House which, for the first time in the history of this nation, had publicly outed the identity of a covert CIA operative. In unapologetically exposing Valerie Plame-Wilson, and completely destroying her entire, crucial network monitoring the trafficking of WMD in the Middle East along with it, untold damage was brought not only to CIA operatives risking their lives in the defense of this nation, but also to the national security of the nation itself, which was significantly blinded in the Middle East --- and on the issue of WMDs, of all things --- at a time when we were theoretically going to war there, over that very issue. Yet, the Republicans chose to side with the criminals in treason, over the "morale" or "effectiveness" of The Agency in their shortsighted and inexcusable politicization of the matter.

It doesn't get much more absurd than all of that...unless you add to it the Democrats' near-complete incapacity to take on, and tear down, the opportunistic Republicans on their own, absurdist argument in phony defense of the CIA of late.

Ernie Canning, here at The BRAD BLOG, has been documenting the CIA's rich, and often ugly, 50-year history in the use of torture, and other illegalities, as a direct tactic to control foreign populations in the march towards the growth of U.S. Empire in the twentieth, and now twenty-first, century, well-prior to the Bush Administration's claims of the necessity for so-called "Enhanced Interrogation Techniques" in the post-9/11 era. But more germane, for the moment, to the continuing, cynical, and disingenuous Republican "outrage" over Pelosi's charges that the CIA misled Congress during classified briefings --- as happily amplified by the corporate broadcast media on all of the Sunday News Shows today --- is 42-year CIA veteran Melvin A. Goodman's brief summary of the CIA's rich history in bamboozling Congress published over at The Public Record. As with the use of torture by the CIA, no, The Agency's lies to Congress did not begin in the post-9/11 period, but they certainly reached a high-point (or low-point, depending on your perspective) during that period which the GOP has now chosen for their fully-politicized, hoped-for distraction, in targeting the current Democratic Speaker of the House.

Goodman's summary is worth a quick review --- particularly by Democrats who seem to be caught flat-footed, yet again, in having a clue about how to dismantle, and defang this latest absurd strawman argument mustered by a party with no tools left in their toolbox, other than a fully-compliant corporate media, and a startlingly-inept opposition party.

Andy Worthington, who largely broke the story of the reported 'suicide' of Ibn al-Shaykh al-Libi in a Libyan prison, into the English-language press on Sunday (as we helped that night), picked up last night on our followup to the original story, decrying the paucity of coverage of the disturbing report in the U.S. corporate mainstream media.

Al-Libi was, after all, the 'ghost detainee' who had offered a false link between Iraq and al-Qaeda, used loudly by the Bush Administration before the war as a key justification for it, after being tortured by the CIA and Egypt, where he'd been secretly renditioned from U.S. custody at Guantanamo. He would later recant his false 'confession,' explaining that it had come about only after 17 hours of 'mock burial,' and a session of brutal beatings by his captors which followed it.

Newsweek describes the al-Libi affair today as "one of the biggest intelligence fiascos of the run up to the Iraq War" and "a major embarrassment for the Bush administration."

Worthington asked why the initial "media silence," before noting that while U.S. outlets have finally begun to cover the story, one of the better initial reports, from Peter Finn at Washington Post fails to follow up on the paper's own previous coverage of 'ghost detainees,' which included al-Libi, who had disappeared, at some point, from the Bush Administration's long list of suspected 'terrorists' captured following 9/11.

Al-Libi was one of those captives previously reported on by WaPo. His re-emergence in Libya --- where he was spotted by Human Rights Watch at the Abu Salim prison in late April, in apparent good health, but refused to be interviewed, reportedly saying only "Where were you when I was being tortured in American prisons?" --- was punctuated, just two weeks later, by the surprising news of his reported 'suicide.'

But where WaPo covered some of the points mentioned in a press release on al-Libi's death from HRW, they failed to mention any of the other 'ghost detainees' mentioned in the very same press release, whose whereabouts had been a mystery up until now. That, even though WaPo had previously reported the 'missing' status of those same detainees!

Given the disturbing fate of al-Libi --- who, HRW's Tom Malinowski charges, "was missing because he was such an embarrassment to the Bush administration. He was Exhibit A in the narrative that tortured confessions contributed to the massive intelligence failure that preceded the Iraq war" --- it's disappointing that the paper has so far failed to connect dots that could, in this case, help shine a spotlight on growing concerns about some of those other detainees: A spotlight which may help keep them alive, at this point.

There is certainly good reason to question both the timing, and reported means, of al-Libi's death, not the least of which is the point made in several media reports, including AP's, where some have "expressed doubts that al-Libi killed himself, saying al-Libi was a 'true Muslim and Islam prohibits committing suicides.'"

Yet, as Worthington notes, the Post failed to even mention the current status of the other detainees HRW discovered in the Libyan prison, even as they had similarly been sent there by the CIA following claims of abuse and torture at the hands of the U.S....

I don’t want to give the wrong impression. All nations possess a legitimate need to gather intelligence. There have been large numbers of extraordinarily dedicated CIA employees, like Ray McGovern and Valerie Plame Wilson, who have sought to protect this nation from harm. But there is the dark side of the agency, a covert branch which has engaged in deception, intrigue, torture and assassinations, all designed to destabilize democratic governments in order to advance and consolidate the power and influence of a US-based, multi-national corporate empire.

In Part I of this five-part series, I described how the George W. Bush administration did not wait for legal "permission" from its Department of Justice before embarking on its plan to use torture as means of forcing confessions and other information from detainees. In "Prosecute or Perish" I stressed that the current torture scandal is the product of a half-century of CIA torture; that by failing to prosecute those who tortured in our name in the same manner that we prosecuted the Japanese officers who waterboarded my father during World War II, we not only will expose our nation to the charge of hypocrisy but will endanger the very survival of our constitutional democracy and the rule of law.

As I noted in Part I, we cannot move forward unless we honestly examine our past --- which, in this instance, mandates a careful look at the origins of the CIA...

Dark Beginnings

In a sense, it may be said that the CIA was a stepchild of Nazi Germany. As noted by Joseph Trento in Prelude to Terror (2006), its founder, Allen Dulles, had done business with the Nazis before World War II. Dulles served in the O.S.S. in Bern, Switzerland. From 1945 to 1947, preceding the creation of the CIA, Dulles ran his own private and entirely illegal intelligence service in which he “began a massive ex-Nazi recruitment* campaign, using a State Department refugee office as a front.” The recruitment campaign, Prof. Alfred McCoy observed, in A Question of Torture (2006), entailed more than the use of war criminals as spies. It included German scientists “who had directed Nazi experiments into human physiology and psychology” and whose early research would lay the ground work for CIA torture techniques…
