Looks like Donald Trump was not "ARRESTED ON TUESDAY" as he lied (again) to his easily-duped followers over the weekend. But, just to put this up front on today's BradCast: We reject the notion that indicting the former President in relation to a hush-money payment made to help him win the 2016 Presidential election --- and the payments made while he was in the White House to cover it all up --- is a "minor crime" not worth indicting a former President for. [Audio link to full show follows this summary.]

That point is explained in much more detail on today's program, along with other related stories and important points, as the GOP begins to collapse in on itself...

  • Given that no U.S. President has ever been indicted, nobody knows how (or if) this will work out, and what will happen after Manhattan District Attorney Alvin Bragg in New York (or Fani Willis in Georgia, or Special Counsel Jack Smith at the federal level), actually brings an indictment against Trump. That is, presuming one or more of them actually do, as we also discussed with callers on yesterday's program.
  • A so-called "liberal" at Facebook was critical of our coverage yesterday, even if he doesn't appear to have either listened to it, or even read the item we posted along with it. His critique seems to be that, on this week's 20th Anniversary of George W. Bush's unlawful, accountability-free invasion of Iraq and the war crimes that followed it (as discussed yesterday as well), we shouldn't be wasting time discussing accountability for Donald Trump. He is wrong for a host of reasons...
  • ...Several of which also happen to be discussed in Will Bunch's newsletter at Philly Inquirer today, headlined "U.S. presidents and their crime spree since 1968." Bunch concludes his piece with this on-point observation:

    So let me get this straight: We look the other way when our leaders oversee war crimes or greenlight torture or commit quasi-treason with foreign adversaries because the American presidency is too big to fail, but we're also going to ignore a cut-and-dried lower-level crime because it's too small? I'd argue that charging Trump with violating a law that applies to 333 million other Americans is a first baby step toward undoing 55 years of gross injustice, and it's long overdue. We need to rediscover that it's still illegal even when a president does it.
  • Meanwhile, as GOP House Judiciary Committee Chair Jim Jordan (along with the Republican chairs of the Oversight and Administration Committees) is demanding NY D.A. Bragg come in to testify and turn over all documents from his criminal grand jury probe of Trump --- before any indictment has even been issued --- it seems worth noting that Congressional subpoenas are now optional. Jordan and House Speaker Kevin McCarthy and several other GOP members made that clear last year when they ignored similar requests from the House January 6 Committee and faced no accountability for their Contempt. Nonetheless, they are apparently hoping to weaponize the federal government at this point to prevent elected state law enforcement officials from doing their job of fighting crime.
  • All of that, while Bragg is reportedly considering whether Trump will be forced to carry out the same "perp walk" that all other white collar criminals facing felony crimes in NYC must face, or whether a former President should be given special consideration for some reason.
  • At the same time, in the wake of Trump exhorting supporters to "PROTEST, PROTEST, PROTEST!!!", very few seem to be answering his call so far. That may be because many of them reportedly believe it's all a trap by the Feds! (Marjorie Taylor Greene, however, believes there's no need to protest, because any indictment of Trump only assures he will be re-elected in 2024. Maybe. Though it begs the question as to how other Republicans, like Jordan and Trump himself, can claim that indictments are only being brought to hurt his chances in 2024.)
  • And while all of those rightwingers collapse in on themselves, Fox "News" appears to be doing the same thing. A producer named in Dominion Voting Systems' $1.6 billion defamation suit against the Republican propaganda outlet is now suing Fox, claiming misogyny by Tucker Carlson and his staff and that she and Maria Bartiromo are being sacrificed by the company for their false reporting on fraud in the 2020 Presidential election. She is also charging she was coerced by Fox attorneys into offering misleading testimony in the Dominion lawsuit. As Media Matters' Angelo Carusone told us on this show several weeks ago regarding the damage that Dominion's suit may due to Fox: "It's sort of like a Jenga puzzle. Pulling one block is not going topple it down, but its certainly gonna make it a lot more vulnerable to toppling. The tiniest little breeze will probably knock the rest of it over." --- Well, it's getting pretty windy at Fox "News" these days.
  • Finally, Desi Doyen joins us for our latest Green News Report, including news on the 12th(!) major winter storm now slamming California this season; unprecedented heat records smashed in Argentina; and the latest warning from the U.N. that the window for avoiding catastrophic, irreversible damage to the climate is almost closed, requiring an unprecedented worldwide effort to radically cut fossil fuel emissions before the end of this decade...

I have no idea what this week is going to bring. As noted on today's BradCast, nobody, save for (maybe) the Manhattan District Attorney does. And I suspect even he is largely flying blind about what happens once (and if) Trump is ultimately indicted in New York State. [Audio link to full show is posted below this summary.]

Before we get to discussion about that --- and callers on the same topic --- today is the 20th anniversary of the U.S. invasion of Iraq. As we said at the time, and have been saying for the 20 years since, we were lied into war under false premises by the George W. Bush/Dick Cheney regime. In the bargain, hundreds of thousands of Iraqis were killed and about 5,000 Americans. No weapons of mass destruction were ever found. More disturbingly, no one was ever held accountable for that pointless war and the lies that were told to get us there.

Back in 2003, 66% of Americans supported the invasion, in no small part because opposition voices in the U.S. were largely shut out of the mainstream media conversation. Now, 61% of Americans, according to new polling, think that war was a mistake.

And, because there was never any accountability for the war criminals, guys like Florida Gov. Ron DeSantis are considered to be front-runners to become the next Republican nominee for President of the United States. That, despite the fact that, as Washington Post detailed over the weekend, DeSantis played a key role in torturing detainees with forced-feeding at Guantanamo Bay while he served as a 27-year old Navy lawyer there.

Meanwhile, now playing the part of imperialistic invader and war criminal is Russia and its leader Vladimir Putin, who the International Criminal Court on Friday issued an arrest warrant for, accusing him of abductions of thousands of Ukrainian children since his unlawful invasion just over one year ago.

If you're wondering just how terrible Putin actually is, please do yourself a favor soon and watch last week's Academy Award winning Best Documentary, Navalny (currently available via HBO Max and Amazon Prime). As discussed today, it is jaw-dropping. For a whole bunch of reasons. And, don't worry, it's also uplifting and hilarious at times...even as we see, live and as it happens, the attempted assassination of Russia's incredibly likable opposition leader, Alexei Novalny, and the remarkable moment when he actually tricks one of his own would be assassins into confessing to his attempted murder. All caught live on camera!

Then, we get to the story that I have a feeling we'll be covering for some time on this program: the first criminal indictment of a U.S. President in our nation's history. It may finally happen this week in New York (emphasis on "may"), thanks to Manhattan D.A. Alvin Bragg. He is believed likely to bring charges against Donald Trump related to the hush-money payments the disgraced former President made to porn star Stormy Daniels to cover up a sexual affair. That payoff, carried out at his direction by his then-attorney Michael Cohen, helped Trump win the 2016 Presidential election. Cohen went to jail for it. Trump never did. At least not yet.

Trump is almost certainly not going to be "BE ARRESTED ON TUESDAY", as he claimed in a panicked, weekend, ALL-CAPS statement on his social media site. Tuesday is seen as the earliest time he could possibly be indicted by a Grand Jury in New York. But, even if so, he will not be "ARRESTED" by New York law enforcement officials in Florida, where he now lives.

If Trump finally is indicted on criminal state charges, whether it's this week or next, will he actually go back to New York to turn himself in? Seems unlikely. But, if not, then what? Would NY ask Ron DeSantis' Florida law enforcement to arrest and extradite Fugitive Trump from Mar-a-Lago? Also seems unlikely, even with DeSantis believed almost certain to run for the GOP's 2024 Presidential nomination against Trump. Will Trump's supporters actually "PROTEST, PROTEST, PROTEST!!!" as the cowardly ex-President is begging them?

And why are House Republicans, led by House Judiciary Chair Jim Jordan --- who pretends to support law and order --- now actually weaponizing the federal government to try and undermine Bragg's case?

In fact, nobody knows what is coming next. There is no playbook for what is about to happen --- whether it happens this week, or next, or even in a different state, like Georgia. But it does seem to be a good day to open our phones to listeners on the topic, to talk about it all and get their best guess about what where things go from here.

As we've advised many times on The BradCast, accountability takes a while. Particularly when you're talking about criminal accountability for a President of the United States for the first time ever. [Audio link to full show is posted below this summary.]

We're joined today, for the first time in several months, by perhaps the one person who may know nearly as much (and, in some cases, even more) about the many criminal cases against Donald Trump than the many prosecutors currently considering indictments against him for those crimes.

Longtime, independent national security and accountability journalist MARCY WHEELER of Emptywheel.net joins us for the full hour today. There is now just too much going on all at once in the various federal investigations being overseen by Special Counsel Jack Smith (not to mention the several criminal and civil probes underway in Georgia and New York), to fit into a single segment.

We dive into details with Wheeler on both the probe of Trump's hundreds of stolen, classified documents recovered by the FBI last year at Mar-a-Lago, and the ongoing investigation of the broad conspiracy surrounding the Trump-incited January 6, 2021 insurrection at the U.S. Capitol (and his many other attempts to steal the 2020 election.)

Among the many points and questions discussed with Wheeler on today's show...

ON SPECIAL COUNSEL JACK SMITH:

  • Where is he? Literally. And why are there no known new photos or videos of him Special Counseling?
  • And what, if anything, does his incredibly low profile tell us about the work that he is doing?

ON THE TRUMP STOLEN DOCUMENTS PROBE:

  • What does this week's news that Smith is hoping to pierce the attorney-client privilege by invoking the crime-fraud exception to force federal grand jury testimony from Trump attorneys like Evan Corcoran actually mean? And, is it true, as the New York Times reported on Tuesday, that Smith's motion to do so is "an aggressive new dimension to the inquiry"?
  • What exactly is the crime being investigated that Smith contends took place between Corcoran and Trump that would nullify the attorney-client privilege?
  • What do we need to know about this past weekend's startling news that Team Trump has now turned over still more classified documents and that some of them were reportedly scanned onto a laptop computer (and thumb drive) said to belong to a Trump aide at his main fundraising PAC?
  • Why weren't those documents found at Mar-a-Lago during the FBI's very thorough search last August?
  • Should we be concerned that more classified documents are out in the wild after being digitized and shared with others?
  • Where are the dozens of documents that were previously in the now-empty classified document folders recovered by the FBI last August? And, is Trump's claim that he kept empty classified document folders as trophy keepsakes even plausible?
  • Does the discovery and quick return of a handful of classified and other Presidential records found by aides at the offices and residences of Joe Biden and Mike Pence make any difference in a potential decision to charge Trump for having stolen thousands of documents and then lying about them to federal officials?

ON THE JANUARY 6 CONSPIRACY PROBE:

  • Mike Pence has now been subpoenaed to testify before the grand jury investigating the January 6 attack. He says he will challenge the subpoena based on the Constitution's "speech or debate" clause that, he claims, prevents him --- as President of the Senate on January 6 --- from having to answer questions by the Executive Branch. That, after Pence previously refused to testify to the House J6 Committee on the basis of separation of powers and Executive privilege.
  • Many are describing Pence's defense "novel", but Wheeler (and I) recall when the previous Republican Vice President, Dick Cheney, hoping to also have it both ways, attempted to play the exact same hand to avoid testifying to both the Legislative and Executive branches during the George W. Bush era.
  • In any event, will Pence's ploy work? And, if so, will it prevent Smith from being able to bring indictments?
  • How do the recent guilty verdicts for Seditious Conspiracy, in the trials of a number of rightwing Oath Keepers militia members (and the ongoing trial of racist Proud Boys members), affect potential indictments of the former President?
  • Is it likely that the DoJ will simply take the "Al Capone tax evasion" route by charging Trump with a simpler crime, such as wire fraud, based on his fundraising scheme that raked in some $250 million after the 2020 election for an "official election defense fund" that didn't actually exist?
  • And, by the way, can a former President --- with a 24/7 Secret Service detail and all of that --- actually be sent to prison in the event he ever actually is indicted, convicted and sentenced?

As you can tell, just a few things to discuss with Wheeler today. And, as usual, she offers a ton of important, smart and keenly-informed insight!...

While voters were at the polls for primary elections in six states (Arizona, Kansas, Ohio, Michigan, Missouri and Washington) on Tuesday, we take the moment to turn to foreign affairs for a hot minute on today's BradCast.

Happily, few problems were reported for voters at the polls in those six states --- at least that we could find so far today --- beyond another predictable failure of electronic poll books, this time across Mohave County, AZ, for about six hours when polls opened. More issues may reveal themselves before tomorrow, or thereafter, of course. Meanwhile, there are a whole bunch of far-right, Trump-backed, 2020 election deniers on the ballot today, with several running for critical offices such as Governor, Sec. of State and the U.S. Senate. All of which, if those candidates win on Tuesday and again this November, could cause very serious problems for democracy itself in 2024. We'll pick all of that up on tomorrow's show, with whatever noteworthy reported results may be available by then.

But today, we had the opportunity circle back to Russia's ongoing war with it's sovereign neighbor Ukraine, now entering it's sixth horrific month following Russia's invasion on February 24. If you follow most Western media, Ukraine's military is making valiant if deadly headway in pushing back at over-extended and exhausted Russian troops in the South, while Russia presses its offensive in the East.

If you follow Kremlin-controlled media, this is a war special military operation that can never be won by Ukraine, and continues to threaten expansion into a global conflict, including the use of nuclear weapons, as Russia takes great pains to note --- on an alarmingly regular basis.

But, it's not only Russian-controlled media suggesting the war is ultimately unwinnable for Ukraine. A number of foreign policy-centered Western media outlets and think-tanks have long argued similarly in a push for peace talks and a ceasefire in the now war-torn nation of Ukraine.

There was some good news this week, in that an agreement brokered by Turkey and the U.N. between the two warring nations last month has resulted in ships carrying Ukrainian grain finally able to leave port to deliver food around the world. Russian ships will also be allowed to do so through safe corridors established amid mined waters in the Black Sea. If the agreement holds, millions of tons of grain and other agricultural products will finally be able to flow from "the breadbasket of Europe" to help ease rising global food prices and the threat of hunger and political instability in developing nations.

The first ship to leave port on Monday was "loaded with two commodities in short supply: corn and hope," as U.N. Secretary-General Antonio Guterres described it. Beyond that, there is not much to be hopeful about in the protracted conflict.

Writing at The National Interest over the weekend, veteran foreign policy experts and former U.S. National Security officials Steven Simon and Jonathon Stevenson made the case for diplomacy. They called on the U.S. to help encourage a negotiated settlement by making clear to Ukraine that "Neither side can fulfill its maximal war aims" and they must find opportunities for peace talks and, if possible, a cessation of hostilities, despite Vladimir Putin's apparent disinclination to negotiate.

"It is well and good for the United States and its NATO allies to keep arming Ukraine. But it is also time to encourage both sides to start exploring possibilities for a political solution before escalation puts diplomacy even farther from reach," the pair conclude. "And unless the United States and NATO condition military assistance on Ukraine’s constructive political engagement, they will lack the leverage to work effectively towards a stable objective."

But is such a demand appropriate or even possible under the current conditions in the war torn nation? Isn't it up to Ukraine --- which has lost so much in blood, treasure and sovereign territory --- not the U.S. or NATO, to decide when and if Ukraine is ready to negotiate an end to the war?

Those are just some of the difficult and nuanced questions we discuss with our guest today, GEORGE BEEBE, Director of Grand Strategy (yes, I know, an ominous sounding title!) at the Quincy Institute for Responsible Statecraft, one of our go-to think-tanks for smart, no-nonsense foreign policy solutions.

Beebe's is the author of 2019's The Russia Trap: How Our Shadow War with Russia Could Spiral into Nuclear Catastrophe. He served over two decades in the U.S. government as an intelligence analyst, diplomat, and policy advisor, including as director of the CIA’s Russia analysis and as an advisor on Russia to Vice President Dick Cheney. (Yes, we discuss both of those ominous matters --- his work with the CIA and for Cheney --- as well!)

Among the questions and issues Beebe speaks to today: His concern that there is no real exit plan for our current strategy, not unlike the lack of a U.S. plan when we launched the Iraq War in 2003; Is it true that there is no way for Ukraine to "win" this war? That the only way is via diplomacy?; Should it be up to the U.S. and NATO, who are supplying much-needed armaments to help Ukraine defend itself, to decide when Ukraine should negotiate towards a settlement? Or should that remain Ukraine's sole decision?; Does Russia even have an interest in negotiations?; What should we learn from their repeated reminders that a continuation of the war could lead to a potentially nuclear expansion?; And, since it's actually a somewhat related matter, what does Beebe make of House Speaker Nancy Pelosi's controversial visit on Tuesday to Taiwan, and what effect is that likely to have on the Russia/Ukraine conflict?

"This is a very complex issue," Beebe tells me on the matter of the United States' own culpability in the matter. "Most foreign policy issues don't have single factor origins. They're usually the result of a confluence of different forces. What's happened in Russia's invasion of Ukraine is that it is the culmination of a series of developments, missteps on the part of a lot of different players over time, that all contributed to the situation that we're facing today."

"That doesn't excuse the Russians and it doesn't excuse Putin from making the choice to invade Ukraine. I think he is fully responsible for that choice, regardless of what preceded it. It didn't have to happen," he argues. But "Russia certainly has what I regard as understandable security concerns...That doesn't mean that the invasion was justified [or] that the manner in which this operation was carried out was at all justifiable."

"But I also would not say that Putin simply woke up in February and said, 'Hey, I would like to invade Ukraine.' There was a lot that went into shaping that decision, and I think a lot of blame on both the Russian and the Western sides."

As you can tell, there is much to discuss and try to make sense of with the Director of Grand Strategy at the Quincy Institute today. I hope you'll tune in for it!

Acting Defense Secretary Christopher Miller --- and every civilian and sworn member of the U.S. military under Miller's chain-of-command --- has a legal duty, under the Uniform Code of Military Justice, to refuse to carry out an unlawful order to take part in a military coup that is designed to prevent the peaceful transfer of power to the duly elected 46th President of the United States on January 20, 2021. That duty holds even if the order to carry out that military coup is issued by the current Commander in Chief.

This is not an abstract concern.

Recall that the increasingly desperate Donald Trump previously discussed with the disgraced and recently pardoned, former National Security Advisor, Lt. General Michael Flynn, the possibility of utilizing the military to facilitate a re-do of what U.C. Irvine Law Professor Rick Hasen described as a "decisive" electoral victory for his opponent, Joseph R. Biden.

The prospect that Trump would dare to issue an unlawful coup order was driven home by the fact that all ten living former Secretaries of Defense found it necessary to publish an ominous Washington Post editorial on Sunday that they directed to Miller. With his subordinates, Miller has failed to fully cooperate with the transition, according to President Elect Biden.

The former Secretaries of Defense not only admonished Donald Trump's newly placed Acting Secretary of Defense that he had a duty to facilitate the transition, but also issued a stark warning: "Civilian or military officials who carry out [efforts to involve the U.S. military in the election] would be accountable, including facing criminal penalties, for the grave consequence of their actions on our republic."

The potential for such an unlawful order is underscored by the fact that the former Secretaries of Defense, who signed off on the op-ed, included Mark Esper. He was fired by Presidential Tweet on November 9 --- two days after the networks called the election for Biden. While we don't know precisely what Trump may have conveyed to Esper, there can be no doubt but that Esper, more than any other former Secretary of Defense, is acutely aware of Trump's post-election state of mind.

The word needs to go out, not only to Miller's subordinates and to high-ranking members of the military, serving at the Pentagon, but also to everyone who wears the uniform. You must not obey an unlawful order to carry out a military coup.

Desi and I are ducking out for a short breather over the Independence Day holiday. But, before we go, I appeared recently on Free Forum, hosted by longtime broadcaster and great interviewer TERRENCE MCNALLY.

So, with McNally's kind permission on today's BradCast, we bring you that recent interview, originally recorded in studio on June 24, 2018 at KPFK, our flagship Pacifica Radio Network station in Los Angeles, in which the tables are turned a bit on me.

I respond to his questions about my background, the bizarre circumstances --- and, yes, election chicanery --- which helped lead me deep into the world of investigative blogging, broadcasting and muckraking some 15 years ago.

We also discuss detailed concerns about the reported (and still unverified) results of the earth-shaking 2016 Presidential election, how jurisdictions around the country are now moving to new computerized voting and tabulation systems in its wake (even as those systems, with computer-marked, barcoded ballots will only sever to make public oversight of results worse, not better) and what Americans can do right now to fight like hell to assure they are able to vote and have their votes counted as per intent in the crucial 2018 midterms.

On today's BradCast, guest hosted by me, Angie Coiro – a passel of news and analysis as we wrap up the week.

First, the latest updates on Michael Cohen's close personal buddies/clients, all of whom are running from him as fast as they can. AT&T’s internal memo (well, hardly internal now) cleaves every connection with him so surgically you can all but catch a whiff of smoke from the cauterization. But how much of what we’ve learned adds up to a breach of law?

Another division – except this one is ongoing, long, and ragged: the gulf between Candidate Trump and his doppelganger occupying the White House. Said doppelganger detailed his new plan to get the price of medications under control. He took the usual opportunities to bash other countries (many of whom don’t have this problem), and President Barack Obama. What he didn’t do is consult Candidate Trump on what he’d promised on this same issue – which is missing from the new plan.

Republicans inside and outside the White House have taken disturbing aim at a sadly vulnerable target: John McCain, of all people. McCain is inching toward the close of his life with terminal cancer. That’s joke fodder for a White House aide, responding to McCain’s opinion on Gina Haspel with “he’s dying anyway” (ha ha ha! No, not funny). His war record was fodder for appalling lies on Fox News. And his intentions for his own funeral – good lord, how do you criticize anyone for their own funeral plans? – met with snide disapproval from Orrin Hatch.

Of course all three have apologized. For whatever that’s worth.

After that, a quick look at the repeating pattern of the now-iconic Disillusioned Middle-American Trump Voter.

And finally, a long conversation with political commentator and author Sally Kohn. Her book The Opposite of Hate explores breakdowns in society as massive as the Israeli/Palestinian divide and the Rwandan genocide. She met people who’ve slowly, tentatively built or rebuilt relationships severed by those political explosions. Maybe the most striking example: the woman who cheerfully sits down for tea with the man who murdered her family.

On today's BradCast: The Fox "News"-ification of Donald Trump's U.S. Government ramps way up with the terrifying late Thursday appointment of far-right neo-con, controversial former George W. Bush Administration official, and longtime Fox "News" contributor John Bolton as the President's third National Security Advisor. [Audio link to show follows below.]

Last week, national security journalist MARCY WHEELER of Emptywheel joined us to discuss the sudden firing of Sec. of State Rex Tillerson, and the move of wingnut CIA Director Mike Pompeo into Tillerson's role, with Pompeo's Deputy Director, Gina Haspel's nomination to become the next CIA Director. Haspel oversaw torture and the destruction of evidence of it while in charge of a secret overseas U.S. prison in 2002. But, unlike those positions, which require U.S. Senate confirmation, the President's National Security Advisor is a direct appointment, as Wheeler noted at the very end of the show last week, explaining that there would be nothing to prevent Bolton's appointment. If Trump wants Bolton as NSA, she chillingly warned, "he's in charge of nuking North Korea."

Well, sure enough, on Thursday, H.R. McMaster was pushed out as NSA and Bolton was named to replace him. So, Wheeler returns today discuss the many concerns --- from right, left and center --- about the dangerous new appointment of a man who strongly supported the 2003 U.S. invasion of Iraq, arguing at the time that the role of the U.S. there, after removing Saddam's (non-existent) weapons of mass destruction, would be "fairly minimal". He is also long and loudly on record calling for similar first-strike U.S. aggression against both Iran and nuclear-armed North Korea.

As Iraq War veteran and chair of VoteVets Jon Solz warned in a statement upon the news: "Let there be no mistake – there is no war for regime change, anywhere, that John Bolton wasn’t for. He sees troops not as human beings, with families, but as expendable resources, in his real-life game of Risk." He added: "To the Trump voters out there we say: You were suckered. John Bolton and Mike Pompeo represent the neocon foreign policy that Donald Trump falsely said he was against."

Bolton, according to one former senior Bush Administration official "was by far the most dangerous man we had," adding that his hiring is "an invitation to war, perhaps nuclear war." Senior Bush Administration diplomat Richard Haass cautions: "This is the most perilous moment in modern American history." They aren't the only ones very panicked about the appointment, charging Bolton's appointment puts us "on the path to war."

Wheeler offers her own additional concerns about Bolton, citing the very curious, potentially "casus belli" timing on Friday morning of Justice Department indictments of nine Iranians said to have been sponsored by their government to hack and steal academic papers (not U.S. Government secrets!) from thousands of university professors around the world.

She also cites the observation of former Bush Administration attorney Matthew Waxman at Lawfare, as "the most frightening thing I've read" about Bolton's appointment.

Waxman, she explains, "worked with Bolton, and he basically says, unlike everybody else who has worked with Trump, Bolton is very, very, very bureaucratically competent, like Dick Cheney. We've been blessed so far --- if we can use that term --- in the Trump Administration, in that he keeps hiring incompetents. Or, even if they're competent, people who don't understand how government bureaucracy works. John Bolton was trained by the master, Dick Cheney. He knows how government bureaucracy works. He's a vindictive man, and he knows how to get the bureaucracy to do what he wants it to do. And that is, I think, the most terrifying part of John Bolton being named National Security Advisor."

We discuss why Defense Secretary James Mattis may now suddenly be the most important man in the world. And, in related Trump Foxification news, Wheeler also offers reason to be dubious about the reports that Fox "News" wingnut contributor Joe diGenova and his Fox "News" wingnut contributor wife, Victoria Toensing, will actually be joining Trump's personal legal team dealing with Special Counsel Robert Mueller's investigation.

Other related stuff covered today: Trump signs the massive $1.3 trillion omnibus spending bill passed by Congress to keep the government open as of midnight Friday, after pretending to threaten to veto the 2,200-page bill just hours before signing it as is --- and then lying about it. (He also seems unaware that a Presidential line-item veto he called for today was long ago found unconstitutional by the U.S. Supreme Court.); A former Fox "News" anchor with no government or foreign policy experience has been quietly promoted to become the 4th highest ranking diplomat at the U.S. State Department; One longtime Fox "News" military analyst finally quits after ten years, charging that Trump's favorite "news" outlet is now "a mere propaganda machine for a destructive and ethically ruinous administration."; And, in case you needed more proof for that charge, we've got an hilarious disturbing compilation of video clips comparing the way the outlet's anchors and contributors (including Bolton!)blasted the nation of Barack Obama meeting Kim Jong Un face-to-face some years ago, versus Trump's plans to actually do so in May...

CIA nominee oversaw unlawful waterboarding, destruction of evidence at U.S. secret prison; Also: Trump brags about lying to allies; More good 2018 news for Dems; Rep. Louise Slaughter RIP...

On today's BradCast: Don't be confused. Donald Trump has vowed "to bring back waterboarding and a hell of a lot worse", and he has now nominated someone to become CIA Director who has actually overseen such torture. [Audio link to show follows below.]

A noteworthy correction published by ProPublica on Thursday night, to an article they published last year, does not change the fact that Deputy CIA Director Gina Haspel, Trump's new nominee to become the next Director of the Central Intelligence Agency, personally oversaw the torture of U.S. held prisoners at a secret prison ("black site") in Thailand in 2002, and then directed the destruction of evidence documenting the torture.

To be clear, ProPublica (and others) are standing by their reporting that Haspel ran the prison in question during the torture of terror suspect Abd al-Rahim al-Nashiri, who the U.S. has admitted to torturing by waterboarding him three times at the secret prison. She also reportedly suggested the method used, an industrial shredder, to permanently destroy the video-taped evidence of both his torture and the waterboarding of Abu Zubaydah.

Those acts are impermissible under several different torture conventions to which the U.S. --- under the negotiation and urging of no less than President Ronald Reagan --- is a party, and European prosecutors are now reportedly investigating whether Haspel must be arrested for war crimes if she arrives anywhere on European soil.

All of that, as her nomination has returned U.S. torture to an issue of "debate" under this President, who promised, during his 2016 campaign, to "bring back" torture. Of course, leading the way is Rep. Liz Cheney (R-WY), daughter of the Vice President who set the standard for blatantly lying about modern day U.S. torture following the 9/11 attacks. Sen. Dianne Feinstein (D-CA), after taking some heat for suggesting she might vote for Haspel's promotion, is now calling for the declassification of documents detailing Haspel's role in these matters, in advance of U.S. Senate confirmation hearings.

Also today, news of Special Counsel Robert Mueller nearing what Trump has described as a 'red line' in his investigation, and growing concerns about what Trump's response to that may soon be. And, a few thoughts on the remarkable matter of the President of the United States bragging to donors this week of how he simply made stuff up while speaking to the Prime Minister of Canada, one of our closest allies and trading partners, about the U.S. trade surplus we have them (which Trump says he described as a "deficit", even though he proudly admits he had no idea.)

Then, very sad news today on the sudden loss of 88-year old progressive Democratic U.S. House "giant" Rep. Louise Slaughter of New York; Some brighter 2018 midterm news for Democrats from the Cook Political Report; and, finally, Republicans are having such a difficult time finding candidates to run for office in Nevada that they are now offering to pay them --- anyone --- to do so...

On today's BradCast, it was a day many have been anticipating for some time. Fired FBI Director James Comey testified in open session before the U.S. Senate Intelligence Committee on Thursday about his one-on-one meetings with President Trump, during which, he claims, Trump asked for "loyalty" during one meeting and asked Comey to help end the FBI's investigation into former National Security Adviser Michael Flynn in the other. Comey was fired by Trump shortly thereafter. [Audio link to show is posted below.]

During his written and opening statements, and subsequent Q&A with members of the Committee, Comey charged the Trump Administration with having "defamed" both him and the FBI, and lying about the reason for his firing, which he characterizes as an attempt to scuttle the Bureau's counter-intelligence probe into alleged Team Trump coordination with Russia both before and after last year's election.

Following today's testimony, Trump's personal attorney Marc Kasowitz claimed, once again, that Comey's testimony "completely vindicated" his client, and he otherwise vehemently rejected the assertion that Trump either demanded Comey's "loyalty" or sought to shut down the Flynn investigation.

Joining us for full analysis today is journalist and author Marcy Wheeler of Emptywheel.net. She offers a comparison to the breadth of this widening scandal and others she's covered in the past, such as the deliberate outing of covert CIA operative Valerie Plame during the George W. Bush Administration. "Dick Cheney was just so much more effective at coverup and abuse of power than Trump is," Wheeler quips.

Among many other points in our discussion today, Wheeler responds to Kasowitz' charge that Comey made "unauthorized disclosures of privileged communications" (he didn't, she explains); details the new revelations from Comey's testimony regarding his various meetings with the President and his contemporaneous documentation of those meetings; potential legal exposure for Attorney General Jeff Sessions and Vice President Mike Pence in this matter; whether we should have confidence in Special Counsel Robert Mueller's oversight of the still-widening probe; whether Trump himself is now being investigated for obstruction of justice (she says it's "clear" that he now is); whether any of it amounts to impeachable offenses; and the possibility --- raised several times during today's hearing --- that White House audio tapes of the Trump/Comey meetings may exist. "Lordy, I hope there are tapes," Comey declared today.

She also breaks down the bizarre testimony before the same U.S. Intelligence Committee on Wednesday, when the heads of the NSA and DNI, without any apparent legal basis or precedent, refused to answer questions about whether Trump had asked them to intercede into the FBI probe. "Just because Donald Trump is President," Wheeler tells me, "it has not changed the rule that you have Congressional overseers and you answer their questions."

Finally, near the end of today's show, news breaks out of the UK regarding Exit Poll results from Britain's parliamentary election, suggesting a stunning surprise loss of majority power for Conservative Prime Minister Theresa May and what is likely to be regarded as a huge victory for the Labour Party's Jeremy Corbyn, sometimes regarded as "Britain's Bernie Sanders"...

On today's BradCast, the savior of the working class and "Great Negotiator" refuses to even sit down with union workers at his own property in Las Vegas, even as his party comes apart at the seams and the South-Eastern U.S. buckles up for another deadly storm. [Audio link posted at bottom of article.]

In advance of tonight's Vice Presidential debate, we speak with Bethany Khan of the UNITE HERE Culinary Workers Union Local 226 in Nevada, where workers at the Trump Hotel Las Vegas voted to unionize last December. Nonetheless, the Trump Organizations has refused, to date, to even begin negotiations with some 500 now-unionized workers at his 1,200-room, 64-story five-star luxury tower in Sin City. The union is therefore calling for a North American boycott of all Trump properties (hotels, casinos, golf courses, etc.), using the hashtag #BoycottTrump.

Khan explains the action and how the GOP nominee for President has been using every available tool to challenge the lawful union vote, despite claims to represent the working class in the course of his campaign.

"Mr. Trump and his company is legally required to bargain with the Culinary Union and with the workers. The workers are fighting for fair wages, job security, good health benefits," she tells me. "They filed a series of objections --- the way the vote was counted, or who voted --- a host of things to try and tie this up in court. This practice of expansive litigation is one the union workers have beat --- soundly --- and we won. So there are no more objections they can file on the election. The hotel is certified as a union hotel. It's a union property. The only thing that's missing is a union contract."

While the Culinary Workers have endorsed Hillary Clinton, Khan says their organizing campaign started "before Donald Trump announced he was running for President," but adds that "The path to the White House goes through the Las Vegas Strip."

"There are 550 workers in his hotel here in Nevada. They're working people, living paycheck to paycheck. Culinary Union members comprise a majority of the middle class in Nevada. Mr. Trump, who says he wants to make America great again, has a great opportunity to start here in Las Vegas with his workers and give them a contract."

On today's BradCast, we decode and debunk Thursday's night final GOP debate before next Tuesday's crucial primary elections in OH, IL, MO, NC and FL and, maybe, if we're really really lucky, the last GOP Presidential Debate this election cycle! (But, we'll see.)

While Trump and Cruz and Rubio and Kasich all played nice last night at the 12th(!) Republican Debate of the 2016 primary season, they also got away with some pretty remarkable nonsense on trade, education, Social Security, war, torture and much more.

Joining me today to rebut not only the candidates, but also some of the CNN moderators passing off inaccurate and disproven bullshit as legitimate Presidential debate questions, are journalist David Dayen of The Fiscal Times and Salon (and more!) and John Amato, creator and publisher of the infamous Crooks and Liars blog (who joined us on his birthday, nonetheless! Thanks, John!)

If you couldn't stomach watching one more GOP Debate last night, we make it tolerable for you with today's program. Today on The BradCast: It's not just Donald Trump, stupid, it's the entire Republican Party. Also, another report from the U.N. climate conference in Paris, this time from the perspective of small island nations.

First up, Senate Republicans, once again, do the bidding of the NRA and terrorists by blocking a Democratic bill to keep those on the Terror Watch List from being able to easily buy guns and explosives.

Then, some weapons grade trolling from Donald Trump, as he calls for a ban on all Muslims entering the U.S. That call has delighted the far right fringes of the party, but they're not the only Republicans who love it. Even Republican U.S. House Speaker Paul Ryan, while claiming to condemn Trump's dangerous, terror-enabling position, vows to support him should he become the GOP nominee for President of the United States.

It's a sad day when we must turn to Dick Cheney and George W. Bush --- yes, seriously --- for reason among Republicans. That day, however, thanks to years of race baiting by Fox "News" and friends --- and the GOP approving of it all --- is today.

Next, something not quite as regrettably stupid: Another dispatch from the U.N. climate conference in Paris (COP21), this time from Dr. Hugh Sealy, Energy Policy Advisor to the Government of Grenada, appointed by the United Nations Development Programme as a consultant to climate change negotiators for the small island developing states. Many of those nations are on the front of the front lines in the battle against climate change, some facing the possibility of disappearing completely underneath the sea.

That group is hoping for an agreement that will limit global temperature rise to just 1.5 degrees Celsius, even as the consensus of the parties to the treaty is to institute greenhouse gas emissions cuts to prevent temperatures from rising more than 2 degrees above pre-industrial times. That goal, set to ensure the Earth stays inhabitable, is already a long shot, according to most experts.

"Two degrees is too much," Sealy tells me during today's interview. "We need 1.5 to stay alive. We're already at 1C of warming and are already starting to see the effects of 1 degree where I live, which is in Grenada in the Caribbean. We are already experiencing sea level rise of around 3mm per year and that sea level rise is accelerating. We are already locked in to 1 meter [approximately 3 feet] of sea level rise by the end of this century. We are already starting to see warming. We are already starting to see extreme weather events. And our scientists are telling us we will not survive at 2 degrees."

Sealy, who is also an environmental scientist and Associate Professor at St. George's University, explains: "This is not something that is an economic issue for us, it's an existential issue for us. Our backs are literally against the wall on this one. And therefore we will fight for our existence. We will fight for 1.5 to be anchored in the agreement. 2 degrees is just too much for us. The richer countries are saying 'Well, it's going to be too difficult, too economically difficult for us to reach 1.5 degrees, so we can keep it below 2'. My response to them is the small islands are the canaries in the coal mine. If we go down, you're going to go down as well."

"If you think the Syrian refugee crisis is bad now," he adds, "imagine if all the low-lying areas in the world have to migrate. And it's not only the small islands. The majority of the world's population lives on a coastline, and all those areas will be displaced."

He goes on to explain exactly what it is that the Small Islands are hoping to walk away with from the Paris conference, how the world now needs "a Global Marshal Plan" to fight climate change, and how there is no "denier community" in Grenada and other small island nations. "The most important thing, in my mind," he says, "grow a global mitigation effort that will guarantee us survival."

Finally on today's program, a bit of good news (because we could really use some!): Renewable energy is now set to overtake coal as the world's largest power source. So, there's that. And maybe, with it, some hope after all...

GUEST: Kit Kennedy of Natural Resources Defense Council...

On today's BradCast, the winning streak for environmentalists continues...as does the losing streak for the CIA.

First, new revelations from former CIA Directors about the many months of attempted warnings from the CIA and other national security officials about "significant" and "spectacular" al Qaeda attacks prior to 9/11 and even long prior to the "Bin Laden Determined to Strike in the U.S." Presidential Daily Briefing memo in early August of 2001. Also, new admissions about the agency giving the go ahead to killing women and children during drone attacks on suspected terrorist targets.

Then, another big victory for the climate, this time in New York state where Gov. Andrew Cuomo on Thursday rejected [PDF] a proposed pipeline that would have brought imported liquefied natural gas from Africa and elsewhere in to Long Island. One of Cuomo's stated reasons for vetoing the project in federal waters was due to climate change and the fact that the pipeline would have threatened not only commercial traffic and fisheries in the area, but also the construction of several proposed windfarms for the same location that would have brought clean, renewable energy to the Empire State.

National Resources Defense Council attorney, and former Special Deputy AG for Environmental Protection in New York, Kit Kennedy was at Cuomo's veto ceremony on Thursday and joins us to explain his reasons and the larger implications of rejecting the controversial Port Ambrose Terminal project.

"This was a classic David vs. Goliath fight between dirty fossil fuels and renewable energy," Kennedy explains. "And in this case, Goliath went down and renewable energy has prevailed over fossil fuel and it is a huge victory."

She credits a large local coalition for that "huge victory", another in a recent series that came about due to the dedicated commitment of organizers and activists. "Local residents, elected officials, fishermen, environmentalists of all stripes, came together not only to oppose the project but to support an offshore wind project that was proposed for the same site."

"In vetoing the project yesterday, Governor Cuomo said the risks exceeded the reward of the project," she tells me today, arguing that this victory and other recent ones represent "a turning point" for energy production in this country.

"This is an incredibly exciting time to be working on climate and clean energy issues in the United States. We have all sorts of decisions going the way of clean energy. I think it is a tipping point, and we're going to see our country take strong action to fight climate pollution and to build up the clean energy economy," Kennedy says.

Attorney Timothy O'Connor, Director of the Environmental Defense Fund's California Climate Initiative joins us to explain the absurd Big Oil-funded DontTakeMyGas.org campaign. You'll be shocked to learn that it's sponsored, to the tune of millions of dollars, by the scam artists of the Western States Petroleum Association (WSPA) in hopes of blocking the state's proposed landmark effort (SB-350) to cut petroleum use by 50% by 2030.

"If other states see California --- the nation's leader in gasoline use --- cutting its consumption and its spending," O'Connor tells me, "I think they're going to want some of that for themselves. And that's where I think WSPA really wants to stop this snowball from growing and taking hold, and really rolling into something pretty big nationally."
