ExxonMobil picked the wrong guy to try and intimidate. That much was clear as day during our interview with him on today's BradCast. [Audio link to full show is posted below this summary.]

As the most powerful storm in history, with record breaking rain and winds, slams the West Coast, a nor'easter threatens the East Coast and powerful storms, including late season tornadoes, threaten the middle of the country and the Gulf Coast this week. Tens of millions of Americans are currently under threat of severe weather. In total, according to NBC, "more than 90 million people will experience dangerous weather in the form of high winds, flooding rainfall or severe thunderstorms through Wednesday."

Welcome to our climate change-fueled future, where record rains and mudslides are the "welcome" relief to seemingly endless drought and wildfires on the West Coast. And as other regions of the country, still recovering from summer hurricanes, are now staring the barrel of still more climate-related threats. Its going to get much worse from here, according to a new study published on Monday by the World Meteorological Organization. The report finds that greenhouse gas emissions, responsible for our quickly worsening climate crisis, hit a new record high last year and increased at a faster rate than the last decade's average, even amid temporary decreases during pandemic lockdowns.

That report, and several others warning that things are getting worse, not better, come as the nations of the world plan to meet beginning next week in Glasgow, Scotland for a critical, U.N. sponsored climate conference to figure out how to decrease emissions and stave off the worst of what is coming --- and what is already here.

But while some are trying to save the world, others are simply trying to save their own town by pushing back against the fossil fuel industry that caused this mess by lying, for decades, about the dangers of burning their products, while spending millions to lie about the reality of global warming.

On today's program we're joined by Imperial Beach, California MAYOR SERGE DEDINA, who has sued [PDF] ExxonMobil, Chevron, BP and 30 other fossil fuel companies to demand they cover the costs of saving his small, poor Southern California coastal town from the ravages of rising sea levels. According to The Guardian, "Imperial Beach commissioned an analysis of its vulnerability to rising sea levels which concluded that nearly 700 homes and businesses were threatened at a cost of more than $100m. It said that flooding will hit about 40% of the city’s roads, including some that will be under water for long periods. Two elementary schools will have to be moved. The city’s beach, regarded as one of the best sites for surfing on the California coast, is being eroded by about a foot a year."

Dedina has since been attacked by Exxon's attorneys and accused of "collusion" with other towns, some of whom, like Santa Cruz, have also sued the oil giant for fraud. The attorneys even demanded documents from Dedina's cell phone and computers which, apparently, turned up little more than videos of his son surfing.

"I think they're throwing lots of things at the wall to see if they stick," Dedina tells me. "The only thing I have in common with Santa Cruz is that I like to surf, and they have good waves there."

His small majority minority town, bordering Tijuana, has an annual budget of $20 million. That's just $5 million more than the ExxonMobil CEO was personally paid by the company last year alone. Now Dedina wants Exxon and the others to pay up for their dangerous and fraudulent lies about the climate, which are now costing the small coastal town much more than they can possibly afford to save it.

"They're grasping at straws," says the Mayor, in response to the harassment from the oil companies. "They spent millions of dollars on lawyer fees to take on a city that has nothing. Literally nothing. We have nothing to give. We've given it all already. We're just trying to have a decent life for our residents, who have little as well. God, what a waste of money and time."

But Dedina, a lifelong resident, award-winning environmentalist as well as co-founder and Executive Director of WILDCOAST, a non-profit ocean conservation organization, says he has no interest in backing down.

"We're still going to hold them accountable," he explains today. "We're not going to be intimidated. They can't do anything to us that the ocean hasn't already done."

"You grow up in our city, you have nothing. You learn how to be a scrappy fighter and stand up for what you believe in. You fight for what our city needs.  That's why I'm mayor, and why I was elected mayor. We're going to keep fighting these companies. They took on the wrong guy," warns Dedina.

Next, we catch up with the weekend "sausage making", as President Biden and Congressional Democrats continue to try and find accommodation for corrupt, obstructionist Democratic Senators Joe Manchin (WV) and Kyrsten Sinema (AZ), in hopes of passing the critical healthcare, education, child care, family leave and climate change legislation known as the Build Back Better Act. The weekend's accommodations including more scaling back of the bill and its wildly popular provisions, which are otherwise favored by largely the entire Democratic Congressional caucus and the White House. That, after Manchin already forced the removal last week of the measure's key provision meant to fight the ravages of climate change.

Still, as Desi Doyen reports today, there are enough provisions left --- at least as of now --- that, along with cooperation from states, individuals and private companies, it may still be feasible for the U.S. to meet President Biden's pledge to cut U.S. emissions by 50% overall by 2030, and to reach net zero emissions by 2050. But it ain't gonna be easy. And, even if successful, it may not be nearly enough.

Finally, callers ring in on all of the above, calling out who they blame for all of the various fine messes the nation, and the world, now find itself in.

On today's BradCast: A new effort by grassroots progressive activists to make sure all 27 U.S. House races and all 141 state House and Senate races on the ballot are competitive this year in the state of Florida is already yielding encouraging results. [Audio link to full show is posted at bottom of summary.]

But, first up today, a few thoughts and a quick review of some highlights from the second night of the virtual 2020 Democratic National Convention, including some mainstream media abetted confusion about Rep. Alexandria Ocasio-Cortez' role in the very cool 50-state-plus-several-territories Roll Call vote on Tuesday and more. Bottom line: to the surprise of nobody, Joe Biden is now officially the Party's Presidential nominee this year. At the same time, voters in Wyoming, Alaska and Florida took to the polls on Tuesday for statewide primary elections, which received much less coverage than they might otherwise have.

The good news, for a start: there have been few, if any, problem reports for voters at the polls in all three states as of today. That's particularly surprising for Florida, where there always seems to be one disaster or another. But, whether it's because so many ballots were already cast by mail in the Sunshine State in advance of Election Day or some other reason, it's always good news when voters aren't (to my knowledge) being disenfranchised due to chaos and failures at the polling place. As to the results, we focus today on several interesting races in Florida, the mother of all swing-states, which will once again play an out-sized role in the critical November elections.

One race was the Democratic primary contest won by former Republican software designer turned whistleblower Clint Curtis. Longtime BRAD BLOG readers will remember him well, as we broke his story in 2004 when he filed a sworn affidavit alleging that he was asked by a man named Tom Feeney --- Florida's then powerful state House Speaker (later U.S. House Rep and always close friend of the Bush Family) --- to create prototype software to flip an election on touchscreen voting systems without detection. With much less funding than his Democratic opponent, Curtis reportedly won the Democratic nomination for the U.S. House in Florida's very Republican 6th Congressional District. He'll likely face an uphill climb this year to oust first-term incumbent Michael Waltz. But, if Curtis could defeat his Democratic opponent who outspent him by about 5 to 1, anything could happen this November.

To discuss some of the other races in the rest of the state, we're joined once again today by progressive "Down With Tyranny" blogger and co-founder of the progressive BlueAmericaPAC, HOWIE KLEIN who brought along a SPECIAL GUEST today!

Last week on this show, Klein discussed an effort by activists in Florida to make sure there would be no Republicans running for office at the state or federal level without Democratic competition on the ballot. As Klein emphasizes at his blog today, in response to ABC News which finally noticed the effort as of Election Day morning, it was not the state or national party which undertook this effort, but outside activists who watched some 21 state House and Senate races go uncontested all together by Democrats in 2016. That, Klein and his special guest argue today, means that in huge swaths of the state, Democrats (who, theoretically, outnumber Republicans in Florida) don't bother to turn out at all for elections at the state level. In a state which Donald Trump is said to have won in 2016 by just 130,000 votes out of millions of registered voters, the ill-considered strategy by the Florida State Democratic Party to sit out all together in many places, has arguably been a costly one. The GOP has dominated both the state legislature and Governor's mansion for years now.

On Tuesday, thanks to the activists, Democrats were on the Florida ballot from top to bottom, including 140 out of 141 state House and Senate contests. (One candidate, who his now suing, was disqualified due to a technicality in her filing paperwork.) Klein details just some of the several actually progressive candidates who will now be competitive on this November's ballot --- even in so-called "red" districts --- and perhaps provide additional reason for Democrats to show up and vote in some cases where they may not have.

One of those candidates who won an astonishingly tight three-way primary race for the Democratic U.S. House nomination in FL's 3rd Congressional District was Howie's special guest on today's program, 26-year old businessman and very impressive progressive candidate, ADAM CHRISTENSEN. The first time candidate, who'd be perhaps the youngest ever sworn in to the U.S. House if he's successful in November, is running to fill the seat being vacated by far-Right GOP Trumper, Rep. Ted Yoho (perhaps most famous for recently verbally assaulting Rep. Alexandria Ocasio-Cortez on the steps of the U.S. Capitol building.)

I must say I was exceedingly impressed with Christensen --- one of BlueAmericaPAC's endorsed progressive candidates in FL --- and his unflinching run for the seat in what has traditionally been a very "red" district. "If it was ever going to happen," he tells me today, "if this seat was ever going to flip, it was this year. So I jumped in, and a bunch of people realized we have a shot at this."

He has also taken a leadership role in the effort to run competitive candidates at the state level. "We were able to get House district candidates for every single district in the state of Florida to be able to run, so that we could actually go on a broad-based attack to be able to try to flip the Florida House. We partnered with four out of the five House candidates in our Congressional District to number one, try to turn out the vote, and number two, to try to make sure that we ran viable candidacies and we were able to cut the margins in some of the rural counties and actually win the rural counties." He cites that as one of the reasons he was "able to pull off an upset last night", with all three candidates in his race winning between 32.3 and 34.5% of the vote. Christensen came out on top by about 800 votes out of some 61,000 cast.

"There is a way that these districts can never be won, and that's if you don't run candidates in them," Klein argues. "If you don't run candidates, you don't win. And, also, if you don't run candidates the party starts to die. People don't even know what the Democratic Party means in some of these places. If you're running candidates, they're going to enthuse voters who will vote down ballot. These voters who come in are going to vote for Biden [and Biden voters will] vote for someone like Adam. That's why it pays, always, to have these candidates."

Christensen echoes Klein's thinking. "If you go on a full, broad-based attack and make them spend time, resources and energy in places that they don't want to, you are going to win. Politics is a game of attrition, and if you don't treat it that way, you will lose. If you do not run candidates everywhere, you will lose," he says.

I'd encourage you to click below to tune in for the full conversation with the candidate, as he explains how he is unflinchingly prepared to take his case --- for progressive platforms like the Green News Deal and Medicare for All --- to those who have, for years, called themselves Republicans because they (falsely) believe the party is "conservative". For example, as he explains, he supports "middle class tax cuts" because, as he details today and on his website's platform page, Americans are burdened with PRIVATE taxes such as insurance for health care and costs for universal childcare. Providing those services by public means would ultimately lower costs ("private taxes") on the middle class.

"What we do is speak in the language of Republicans, of independents. We use the terms 'middle class tax cuts', 'small business tax cuts'. What I mean by that is we are going to reduce the amount of taxes --- private taxes --- that everyone has to pay," says Christensen. "We are going to get rid of the insurance companies from the health industry --- which is a small business tax cut, because small businesses pay eight grand per employee, and 30% of that goes to an insurance company. That is a tax cut. Get rid of those, that is a tax cut. Use those terms."

Both Klein and Christensen argue that there are a lot of independent voters in the District who, along with Democrats, may go with Christensen and pull off an upset against Kat Cammack --- Yoho's Chief of Staff and the apparent winner of the 10-candidate free-for-all on Tuesday to win the GOP nomination for the 3rd District seat.

Christensen, who was raised as a Republican, also understands --- as I have long discussed --- the need to take the fight straight to them on the Right, to not flinch from the Fox "News" phony attack squad, but meet them where they live and explain, as he does in very astute detail today in response to my questions, how progressive policies are, yes, even good for Republicans!

So, can a true progressive win in a very so-called "conservative" Congressional district on his first try, without moderating his views --- but expound on them clearly to explain how they would help even so-called "conservatives --- during a general election contest? We may found out in just over 70 days. Klein points out that Rep. Katie Porter, in what had long been deep "red" Orange County, California, already proved it can be done. But I think Christensen's story, and his run --- staffed by volunteers who are all 23-years old or younger! --- should be an inspiring one for a lot of folks around the country considering the possibility of doing the exact same thing in the future, even in what are seen as so-called "red" areas of the country...

After a few words on Canning's latest article at the blog on the "Political Revolution" embodied by the new freshman class of progressive U.S. House members and the many challenges they are now facing down in D.C., we discuss some of the lessons learned and important stories covered at our little, independent, reader- and listener-supported website over the past decade and a half.

Many of the stories we broke years ago --- too numerous to link here, on everything from electronic voting concerns and voting rights to climate change and much more --- have since become part of the national consensus as well as many popular calls for reform. That, even as much (but not all) of our independently verifiable, evidence-based news coverage was marginalized or dismissed by many in the corporate media years earlier. We discuss just a few of those stories today --- too numerous to detail here --- as we look both back and forward on this latest milestone. We also offer thanks to the many who have made all of it possible over the years, from our blogging contributors, to radio affiliate partners, to various whistleblowers (publicly known and unknown) over the years.

Secretary Wilbur Ross took to the airwaves to, essentially, call 800,000 federal workers whiners for needing to use food banks to feed their families, when they could just go out and get a bank loan instead to cover costs until the federal government reopens.
  • In the U.S. Senate, Mitch McConnell finally allowed votes on measures to reopen the government, one from Rs and one from Ds. Both failed to get the 60 votes needed to overcome filibuster, though the D version --- which did not include funding for Trump's border wall --- received more votes than the R version in the GOP-majority Senate.
  • And Trump's former attorney Michael Cohen learned that he may have to appear before both House and Senate Committees next month, despite threats to his family by the President of the United States.
  • Finally. Desi brings us the latest Green News Report, with more bad news about the shutdown and Greenland's melting ice shelf, but some encouraging news on a huge majority of Americans who now appreciate the threat of climate change and on the amazing teen climate activist taking on the corporate powers and millionaire/billionaires at Davos this week...

A federal court victory for Jill Stein in Wisconsin; a federal court hearing in Pennsylvania; the fight to restart counting in Michigan; and the case for a recount in Florida. Yes, in Florida. But that's just the tip of the iceberg on today's very busy BradCast! [Audio link to complete show follows below.]

First up, some encouraging news from the New York Attorney General concerning his intentions to hold Donald Trump's nominees to head up the Environmental Protection Agency and Dept. of Labor accountable to the rule of law. Then, a bit more good news out WI today, where a federal court dismissed a Team Trump attempt to stop the ongoing Presidential "recount" in the state.

Meanwhile, a federal court in PA heard Jill Stein's case calling for a statewide count and forensic analysis of voting systems today. And, following the the hearing, in a press conference outside the courthouse, University of MI Computer Science and voting systems expert Prof. J. Alex Halderman explained again why such a study is necessary.

"Over the past ten years, we've found every one of the [voting and tabulation systems in the U.S.] susceptible to hacking. Doesn't matter whether they're plugged into the Internet directly or not," he said. "The evidence on the paper ballots, the evidence on the software in the machines --- that's what we're asking to examine. And that's the only way we're ever going to know for sure whether our votes were counted correctly or not in the 2016 Presidential election. We think that by looking at that evidence, which seems to me like just a common-sense security precaution, we can increase voter confidence, and help everyone know their that their votes really counted." Those comments come on the same day that the Obama Administration announced plans to release a report on charges that Russian hackers attempted to interfere in the 2016 U.S. election.

Then, we're joined by long time election integrity champion, Susan Pynchon, founder of Florida Fair Elections Coalition and a central character in HBO's Emmy-nominated 2006 documentary Hacking Democracy, joins us to discuss a lawsuit [PDF] filed late last week calling for a statewide hand-count of paper ballots in FL(!)

Pynchon explains the reasons why it was filed, which include not just the surprising result in the state's Presidential race, but also reports that a Florida-based corporate vendor by the name of VR Systems --- a company contracted by about a dozen states --- was reportedly hacked earlier this year. She says they provided "voter registration and other services in 64 of Florida's 67 counties. Voter databases, management and tracking of mail-in ballots, and election reporting services on election night." (And here is that Exhibit T [PDF] from the complaint that I referenced during the show, concerning troubling voter registration problems reported on Election Day in several Sunshine State counties, including Broward and Lee.)

Also, Pynchon details the high "invalid vote rate" ("votes that weren't actually counted --- undervotes, overvotes, and invalid write-in votes"), which she says is "more than double in this election than it was in 2008 and 2012. We need to take a close look at that because it's not normal. It's not typical of past elections." She goes on to describe how one county was also found to have "ordered duplicate sets of [security] seals," asking: "So how secure is that when you're sealing a ballot box with a seal that could then just be replaced with your duplicate set of seals?"

Coincidentally, part of Halderman's remarks from outside of the federal courthouse in Philadelphia this afternoon, which we play in full on the show today, referred to how easy it is to break into those voting machine security seals. He says they are "easy to remove in just a few seconds with a hairdryer or a screwdriver."

"You know, if you'd asked me this ten years ago, I would have said, well, maybe it sounds like science fiction, someone hacking into a country's national election by tampering with the voting machines," warns Halderman. "I think it's only a matter of time before this happens, if it hasn't happened already."

Finally today, an incredibly chilling missive was confirmed to have been sent to the U.S. Dept. of Energy from the Trump transition team, seeking the names and details of scientists and other employees there and at national laboratories involved in climate change and other related studies...

Incredibly enough, it's been ten years this month since we broke the story about vote-rigging software whistleblower Clint Curtis. It was certainly the biggest story we'd broken up until that time, in December of 2004, and, for some, it is still the story we may be best known for.

That's not surprising as it involves election fraud, touch-screen voting systems, Florida, a powerful Congressman, the Bush family, Chinese spies and several disturbing deaths.

For those not familiar with it, you can find a quick summary here. The index of most of the key articles in our years-long series, beginning with our 12/6/2004 exclusive on Curtis' sworn affidavit can be found at BradBlog.com/ClintCurtis. (And, yes, if you're looking for the horrifying NSFW "crime scene photos" of the main death involved in this case, those are here.)

In short, Curtis was a software programmer from Oviedo, FL who claimed in a sworn 2004 affidavit and then sworn testimony before members of the U.S. House Judiciary Committee, that he was asked to create a vote-rigging software prototype for touch-screen voting systems back in 2000 by then Rep. Tom Feeney (R-FL), a very powerful Republican in the Sunshine State and a close friend of the Bush family. At the time, Curtis worked for a company named Yang Enterprises, Inc., which had many contracts with NASA and the state of Florida. In 2000, when he says Feeney asked him to create the vote-rigging software, Feeney was both the Speaker of the FL House, as well as a registered lobbyist for Yang. Feeney would also go on to great ignominy due to his dealings with Republican uber-lobbyist Jack Abramoff.

There is much much more to this story, much of which was also eventually told in Murder, Spies and Voting Lies: The Clint Curtis Story, an award-winning documentary film by Patty Sharaf. It includes spying for China and at least two deaths in addition to the vote-rigging allegations, but I'll let you explore it all via the links above and/or in my all-new interview with Curtis from this week's KPFK/Pacifica Radio BradCast

As it's been 10 years since we broke the initial story, it seemed a good time to get caught up with Curtis, reminisce a bit about the original story (and his eventual, gutsy, and at times hilarious campaign to run against Feeney for the U.S. House), as well as find out what he (and Feeney) have been up to since then --- even as we've been almost-continuously reporting on new developments in the case over the years since we originally broke the story in late 2004.

I gotta say I enjoyed this interview with Clint --- it was great to catch up with him --- and I hope you will too.

Deposition recalls FL Republican whistleblower Clint Curtis' 2004 affidavit on 'reducing black vote' before 2000 election...

Well, this sounds familiar, and for good reason...

In a 630-page deposition, released to the press yesterday, former Republican Party Chairman Jim Greer described a systemic effort by Republicans to suppress the black vote. Referring to a 2009 meeting with party officials, Greer said "I was upset because the political consultants and staff were talking about voter suppression and keeping blacks from voting." He also said party officials discussed how "minority outreach programs were not fit for the Republican Party." Florida is currently embroiled in a controversy surrounding Gov. Rick Scott's (R) voter purge program, which disproportionately affects voters of color. Fifty-eight percent of Scott's original list of voters who were supposedly ineligible to voter were Hispanic while Hispanics make up only 13 percent of Florida's eligible voters. Greer and the GOP cut ties in 2010, and he is currently facing felony corruption charges.

The summary above comes from ThinkProgress' Alex Brown who offer a hat-tip to Salon's Alex Seitz-Wald who opens his report this way:

In the debate over new laws meant to curb voter fraud in places like Florida, Democrats always charge that Republicans are trying to suppress the vote of liberal voting blocs like blacks and young people, while Republicans just laugh at such ludicrous and offensive accusations.

The entire matter echoes back to our initial 2004 exclusive on then Republican software programmer turned whistleblower Clint Curtis who had filed a sworn affidavit charging Florida Republican Tom Feeney had asked his company, Yang Enterprises, Inc. (YEI), to create a vote-rigging software prototype in 2000.

At the time of his alleged meetings with Feeney, Curtis says the Congressman --- who had been Jeb Bush's Lt. Governor running mate in 1998 before becoming Speaker of the FL House and one of the most powerful elected officials in the state by 2000 --- discussed methods that he said the Republican Party had in place to "reduce the black vote" in the 2000 Presidential election.

It's been a while since we've checked in with election fraud whistleblower turned would-be politician Clint Curtis, so let's bring everyone up to speed. Clint Curtis is the computer programmer who was allegedly asked to write election-flipping software by former Florida Speaker of the House-turned-U.S. Congressman Tom Feeney (R) back in 2000. Curtis blew the whistle and testified, under oath and on video tape, before a U.S. House Judiciary Committee panel shortly after The BRAD BLOG broke the extraordinary story in late 2004. (Quick recap of the Curtis story and links to our years-long, in-depth coverage right here.)

Curtis fought back, taking on Feeney twice for his congressional seat, only to lose both times - the first to a fishy vote count in 2006 (which Curtis challenged with evidence in hand, only to be shot down by a Democrat-led Congressional committee) and the second time to a pro-Bush Blue Dog millionaire put up by the Dems in the 2008 primary. Feeney, dogged by Curtis' allegations, and an FBI investigation into his dealings with disgraced Republican lobbyist Jack Abramoff, would finally lose his seat in '08. (Curtis' story is covered in depth in the award-winning 2008 documentary film Murder, Spies & Voting Lies.)

You'd think that'd be enough politics for anyone, but not Curtis. He loaded up the truck and moved several hundred miles north of Beverly… Hills, that is. Now armed with a brand-spankin' new law degree, he is mounting one more assault on a Congressional seat --- this time in Northern California's 4th Congressional district.

Will this be another quixotic attempt? Or will the progressive Democratic candidate who ran unchallenged in the recent CA primary, finally break through, giving Congress a much-needed voice of reason and election integrity advocates a serious ally in the House of Representatives?

BTW, for those who had been paying attention, I predicted all of this Rand Paul fun earlier in the week, when I wrote in my "Super-ish Tuesday Backgrounder" on Monday:

The "Tea Party," however, may be in for a surprise should Paul win tomorrow and then in November, as he is an actual conservative candidate --- now otherwise known as a libertarian --- meaning he, like his father, calls for removing government entirely from all but those functions called for directly in the Constitution. For example, he supports an immediate pull out of U.S. troops from both Iraq and Afghanistan, an idea that, in truth, is largely anathema to the bulk of the grossly disinformed "Tea Baggers"/GOP base (versus the true "Tea Partiers" who first emerged in 2006 in support of Ron Paul, against George W. Bush, and who were consequently marginalized as wackos back then by the bulk of the GOP and its Bush-lovin' base.)

I just didn't think it was gonna happen on the Wednesday after his Tuesday election! :-)

By the way, this is just one of the upcoming films on GOP uber-lobbyist Jack Abramoff. Another one, a theatrical re-telling of his story, is currently in production with Kevin Spacey starring as "Casino Jack," and me not starring, despite my best efforts, as the diminutive yet dangerous Tom Feeney.

DoJ said to have dropped two-year investigation into corrupt former Florida Rep's lobbyist-funded trip to Scotland...

[Updated: Former Congressman Bob Ney (R-OH) responds to this article. Ney, convicted for his dealings with Abramoff, including a trip to Scotland, suggests Feeney may have been helped off the hook by friends in high places. See details and Ney's comments in UPDATE at bottom of story.]

Late last week, alleged vote-rigging conspirator and former three-term Congressman Tom Feeney (R-FL) was informed that the Department of Justice was dropping their two year probe into his 2003 lobbyist-paid junket with Jack Abramoff to play golf in Scotland, according to his attorney Robert Luskin (who also happens to be Karl Rove's criminal attorney).

The DoJ's investigation was stymied earlier this year by an appellate court decision disallowing their subpoena of Feeney's statements to the U.S. House Ethics Commission on the basis of Constitutional separation of powers. As we noted last month, the friendly Feeney finding was likely to foul the fed's felony fact-finding against the failed former Florida Congressman.

The Ethics Commission had, themselves, let Feeney off the hook on the last day in which Republicans controlled the panel before Democrats took over in 2007. He would agree to pay just $5,643 for the private plane trip and swanky vacation with rightwing lobbyists, despite court papers declaring the trip to have been worth approximately $20,000...

Unsealed appellate court decision explains delay in corruption probe of Tom Feeney, but will indictments ever come?...

So whatever happened to that expected indictment of former Congressman Tom Feeney (R-FL) and alleged vote-rigging conspirator for, among other things, his 2003 Abramoff-funded junket to play golf in St. Andrews, Scotland?

The other two Congressman who took the trips with the disgraced, imprisoned Republican uber-lobbyist have been held, at least, partially to account (Rep. Bob Ney (R-OH) spent time in jail, Rep. Tom DeLay (R-TX) is still facing related indictments in Texas). Feeney ran a sad "apology" commercial --- five years later --- during his unsuccessful re-election bid in 2008, but since then has so-far escaped real accountability for that, and the many other allegations of corruption that helped see him listed as among Congress' "Most Corrupt" for four years running.

So what happened to Feeney's indictment? A D.C. Court of Appeals decision from February (as we reported at the time, when we also noted Feeney is now being repped by Karl Rove's criminal attorney) was finally unsealed last week likely explaining the answer --- at least for the delay of such an indictment...
