If you still have any doubts about what this Supreme Court is up to, even after their disastrous Citizens United ruling, yesterday's "emergency order" should now make things crystal clear...

"Regained," New York Times? Did we miss something? Had the "millionaires and corporations" previously lost their "enormous voice in American Politics"???

Maddow covered some of the details in quickie coverage last night, observing: "It's great news for anyone psyched to get all the riff-raff out of politics so we can get over this whole democracy fantasy and just settle down to being ruled by our economic overlords, like the founding fathers intended."...

Just in tonight as tabulation continues in Ohio's primary election today. Via Josh Sweigart at Middletown Journal:

Long-time readers of The BRAD BLOG will remember that similar "glitches" affected the 2004 Presidential Election in the Buckeye State when the election night reporting website went down late in the evening, was moved to the "back up servers" of a far Rightwing firm in Chattanooga, TN, before coming back up to show that George W. Bush had taken the lead over John Kerry.

That system was created by Mike Connell, the GOP's IT guru who, in 2008, was subpeonaed for a deposition in a long-standing 2004 election fraud suit, only to die in a mysterious plane crane just weeks after the election, before he could testify in open court. Computer security experts have long charged that the results of Ohio's '04 Presidential election may have been compromised by a so-called "man in the middle" computer attack as the servers changed locations that night.

Similarly, in the hotly contested 2005 Special Election contest between Jean Schmidt (R) and Paul Hackett (D) for Ohio's 2nd Congressional District seat, central tabulator computers went down during late-night counting in Clermont County, only to come back up showing Schmidt with the lead over Hackett.

Whether something similar could be going on tonight in Butler County remains to be seen, but the attacks on the servers certainly seem worth noting here should further information become available over the next few hours, days, or weeks.

In another part of Ohio, Cuyahoga County (Cleveland) experienced its own predictable failures with its ES&S precinct-based optical-scan vote tabulators during pre-election testing over the weekend. 89 of the county's 1,200 machines (6%) froze up entirely during those tests...

The second in the series offers important info and a good reminder of the names you'll be seeing again soon, singing the same old phony, discredited "voter fraud" songs once again as November nears, as sure as the sun rises in the East.]

Brad Jacobson has filed the first in a series of exclusives at RAW STORY concerning GOP operative and Bush-appointed FEC commissioner Caroline Hunter. [Disclosure: Jacobson has blogged at The BRAD BLOG in the past.] Here's the lede for his first excellent investigative report yesterday:

The report goes on to detail how Hunter --- who, as The BRAD BLOG has highlighted over the years, had previously been allowed to serve as a commissioner on the U.S. Election Assistance Commission (EAC) --- deceptively misrepresented the facts, on behalf of the RNC, in a 2004 voter caging hearing in federal court.

Jacobson quotes election law experts, including two long-time former DoJ Voting Section attorneys, who argue that while the way she couched her sworn testimony may "shield her from perjury charges," the statements she gave may "still pose ethical problems that potentially could result in her disbarment."...

All eight defendants in Clay County, Kentucky's election fraud trial have been found guilty today by a federal jury. Six of those eight were high-ranking election officials, including the county clerk, a circuit judge and the school superintendent. The conspirators were charged with having manipulated federal elections in 2002, 2004 and 2006 by buying and selling votes and manipulating electronic voting machines.

According to AP, each of the now-convicted felons could face up to 20 years in prison for what prosecutors had described as a conspiracy to manipulate elections for decades in the rural, heavily Republican county.

In additional to federal racketeering, several of the defendants were also convicted of charges that included mail fraud, extortion and laundering money used to buy votes.

The BRAD BLOG has been following this story since the conspirators were originally arrested in March of last year, and as details of the election officials' manipulation of ES&S iVotronic touch-screen voting machines has emerged...

Meanwhile, back in Clay County, Kentucky, where election officials (including the county clerk, a district court judge, and the school superintendent) were arrested last year, and are now on trial, accused of having "fix[ed] elections for decades," a "precinct worker testified...that top election officers in the county taught her how to change people's choices on voting machines to steal votes in the May 2006 primary." The vote stealing was accomplished on ES&S touch-screen electronic voting machines, without the knowledge of legitimate voters, after they'd left the booth thinking they had cast their votes.

The scheme also included Republicans changing their party registration to Democratic in order to serve as Democratic poll judges and officers on Election Day, as has been alleged elsewhere (for example, in Ohio in 2004)...

Is it possible that Thor Hearne, the rightwing operative attorney The BRAD BLOG has been following for years after we discovered him at the heart of a phony "non-partisan" GOP astroturf operation set up just after the 2004 election, calling itself the American Center for Voting Rights (ACVR), has finally seen the light?

Seems highly unlikely for the national general counsel of Bush/Cheney '04 Inc., who knowingly misled Congress on that point and many others. But perhaps after our years dogging him and detailing his lies and phony agenda working to keep legal (Democratic-leaning) citizens from being able to exercise their legal right to vote, he's gotten tired of being the poster boy for the Republican's anti-democracy campaign.

Simon Worrall's piece from February's Maxim on the mysterious death of Bush/Rove/GOP IT guru Mike Connell is now available online.

As we noted in our detailed exclusive preview of the piece last month, the 3,500-word exposè by the British author and journalist is the closest thing to mainstream corporate media coverage that this story has received since Connell's death. Worrall offers a number of tantalizing facts and fresh interviews about the man whose companies and computers and websites were said to have been near the center of (among other under-investigated crimes) the alleged gaming of the 2004 Presidential Election in Ohio. He has also been posting a series of short "Back Story" pieces on this feature article over on his own blog that you may find interesting as well.

Connell died when the single-engine aircraft he was piloting just prior to Christmas 2008 crashed in flames near Akron. The tragedy came just weeks after he was compelled by a federal judge to give a deposition in a long-standing 2004 federal election fraud lawsuit, on the heels of reports that Connell had been threatened by Rove to "take the fall" for whatever happened in '04. After Worrall's year-long investigation, he believes it's highly likely that Connell was, in fact, murdered.

Hundreds of thousands died in Haiti. Detainees were revealed to have been murdered in American custody at Gitmo. Democracy died again in Diebold's Massachusetts. A faint hope for reviving the death of the public's airwaves dies yet again as Air America dies. And the U.S. Supreme Court commits mass murder of everbody and everything else that had still been left teetering.

Worse. Week. Ever.

As it happened, I was previously scheduled to be a guest on Peter B. Collins' podcast yesterday to discuss MA. Suffice to say, the conversation ended up a bit broader, and a great deal darker.

Several supporters of Democrat Martha Coakley were injured during her rush to get to the phone as quickly as possible in order to concede the race for the U.S. Senate in MA to Scott Brown even before AP called the race in favor of the Republican.

That, while some 25% of the precincts had yet to report even how Diebold's easily-hacked, oft-failed optical-scan machines (which are in violation of federal voting system standards and programmed by a company with a disturbing and criminal background), had even reported their tabulation and, more disturbingly, while 0% of the voters' cast ballots in Massachusetts had been counted or examined by any human being on the face of the earth.

"After months of campaigning, the Attorney General thought it was important to make sure neither her, nor her supporters voters were actually counted, so best to ensure that the Democracy Menace wouldn't rear it's ugly head right here in the Bay State," said Coakley's campaign manager Kevin Conroy.

Sen. John Kerry (D-MA) released a statement upon hearing the news, proclaiming he was "proud of the speed at which Martha was able to concede the race with even fewer of the votes counted by anyone --- zero in Martha's case --- than when I conceded the race for President of the United States in 2004." Kerry added that he had prepared his statement on Monday, so as to save valuable time on Election Night, since American Idol was also scheduled to be on.

While criticism of Obama and Democrats is as easy as it is appropriate (as well as frequently engaged in here), their failures on the marquee items --- Afghanistan, health care, torture accountability, etc., ya know, the items Fox "News" and the other wingnuts like to talk about --- tend to obscure the very real differences between the current administration and the former one across a broader, and much less sexy (by cable news standards), level. That's just one of the reasons I reject the far too lazy "Democrats are just the same as Republicans" knee-jerkisms.

While on the big ticket items, as noted above, there is far less difference in real world results than all of us would like, but below the radar, in executive departments and policies, the difference has been, at times, and in some areas, like night and day.

Desi Doyen and I have made this point on a number of occasions in our Green News Reports --- most recently in last Thursday's edition, highlighting new, important and aggressive policy changes and initiatives at the EPA, federal Bureau of Land Management (BLM) and the Dept. of Interior.

Now, some important changes at the DoJ's Civil Rights Division, and of particular note to long time readers of The BRAD BLOG, its Voting Rights Division, are beginning to show real change and significantly for the better, whether you hear about it on Fox and CNN and MSNBC or not.

Adam Serwer of The American Prospect highlighted some of that positive change late last week on the heels of an upheaval at the DoJ's Voting Rights Division over which The BRAD BLOG played a very direct and significant role in 2007....

There have been a few occasions during my 62 years when I heard something profound that stuck with me.

The year was 1969. I was attending a freshman college history class, shortly after returning from Vietnam, when my professor said:

His words came back to me as Brad Friedman and I simultaneously made guest appearances on Live from the Left Coast with Angie Coiro.

While the topic was Afghanistan, a concern emerged over the splintering of the Left as a product of what Coiro described as strident "rhetoric," such as the suggestion that President Obama was a "sell-out" or the announcement by Rep. Dennis Kucinich (D-OH) that he intended to introduce a privileged resolution to stop the "criminal enterprise" in Afghanistan. The concern was the potential for that "rhetoric" to adversely impact the Democratic Party in the 2010 and 2012 elections.

Unfortunately, in part due to technical difficulties they had on the show that night, I failed to adequately articulate my concerns, which go to the core of the Progressive dilemma in U.S. electoral politics....
