It's February 8th, 2008, and it's now official: One member of the broadcast MSM has officially joined the ranks of those "crackpots" and "conspiracy theorists" over at The BRAD BLOG!

Congrats to Pittsburgh's WTAE's Team 4 for their excellent, responsible, and appropriate reportage on the serious concerns facing Pennsylvania's Allegheny County voters in the upcoming election. Their investigative report asks "Is Your Vote Safe With County Voting Machines?" and the clear, well-reported, fair and balanced answer comes back as an unambiguous, no punches-pulled: Absolutely not!

Golly, if only the Democrats had had any idea that AG Michael Mukasey would turn out to be such a stooge for the Bush Administration, maybe they wouldn't have confirmed him. Oh, wait. Yeah, we recall something about that coming up before the Dems decided to give this guy the job anyway.

At right is just one sample from Mukasey's testimony today, answering (or not) Robert Wexler's questions asking if he's been given White House instructions on whether or not he may enforce Contempt of Congress citations. He takes the time to apparently make up a few "facts" along the way while dodging Wexler's questions.

David Swanson reports...

Mukasey said that he would not investigate torture (video) or warrantless spying (video), he would not enforce contempt citations (video), and he would treat Justice Department opinions as providing immunity for crimes (report).

...before he goes on to offer some interesting information suggesting that John Conyers may be "on Edge of Starting Impeachment Hearings" after today's testimony. Whether that happens or not, Swanson offers contact information so that you can weigh in to the Chairman with your opinion on Impeachment (which is, after all, his Constitutional duty, for those of you keeping score at home.)

Besides the growing number of voting machine problems, none of which would have been helped by adding a vvpat printer to a DRE but most of which would have been helped by banning the DREs outright, we’ve also got the leaking of the GAO report on the Florida CD-13 race from 2006. It seems that the GAO found that the machines were not the cause just the voters. Of course they overlook the fact that the same voting machines in other Florida counties also had a high percentage of undervotes but in different races.

It appears that the good folks who inhabit the Mesa County, CO, Commission seats are about to defy the Secretary of State and, possibly, the courts. They have voted to use their uncertified ES&S voting machines no matter what the state tells them.

This afternoon the New Mexico Democratic Party announced that they were going to go back and recount every vote cast on Tuesday....

We believe we can now pull this issue up out of the weeds a bit, after more than 24 hours of trying to make sense of what the Los Angeles County Registrar's office has been describing to the media as "real clear."

What's clear is that the only thing that's clear is the fact that the county's new acting Registrar of Voters, Dean Logan, has seriously blown his first outing since coming South from his disastrous 2004 Washington state gubernatorial election debacle.

Unless swift action is taken by Logan and CA Sec. of State Debra Bowen, it's likely that hundreds of thousands of voters may have been disenfranchised in last Tuesday's Democratic Primary Election...

We momentarily interrupt our Election Meltdown '08 coverage to quickly point out that a total of five large undersea Internet cables, leading to various areas of the Middle East, have now reportedly been "cut." The Khaleej Times reports that "An estimated 1.7 million Internet users in the UAE have been affected by the recent undersea cable damage," which, folks who worry about such things note, is in addition to millions of users in Iran.

We noticed the story when three cables were cut last week, but didn't have time to look into it. We still don't. Nor do we pretend to know what it all means.

But as BonnieNet --- who's done some good digging, and has put together a map of the locations of the reported cuts --- says, "3 was quite a few. 4 is pushing it. 5 starts to make you wonder."

17,000 Voters Forced to Vote on Provisional Ballots After Being Dropped from Registration Rolls 'Maintained' by SoS and Voting Machine Company, ES&S

The good news: New Mexico now votes on paper ballots, since their touch-screen debacle in the 2004 Presidential Election left Gov. Bill Richardson with little legal choice but to move to paper.

The bad news: The huge turnout in yesterday's Democratic Primary led to long lines, voters who found they were no longer on the registration rolls for some still-unexplained reason, 17,000 votes had to be cast on provisional ballots which remain uncounted today, and now it's being reported --- incredibly --- that at least three ballot boxes were kept overnight last night, uncounted, at the home of a Democratic County Party Chairwoman.

What makes it all worse, as if all that is not troubling enough, is that the current razor-thin margin between Barack Obama and Hillary Clinton in the caucus stands at just 217 votes out of 136 thousand ballots cast.

The governor's apologizing, the party is prevaricating, the candidates' representatives are negotiating, and, as usual, it's the voters who are left hanging, wondering if their voices will actually be heard...

We are not even close to a settled “Tsunami Tuesday,” and we may not be for another week depending on whether the problems with the Los Angeles Co ballots (Double Bubble Trouble) go to court, but nothing happened to change my mind that DREs need to be banned from our election process. As proven in Arkansas and probably in other states, though news of machine problems was scarce, the addition of a vvpat to a DRE only adds to the possibility of machine malfunction. But we need them for accessible voting, you might say. Anecdotal reports from California are that the single DRE put in each state polling place may not have always actually been set up to be used. They were just there because federal law and state law say they had to be there. (More on disabilities access very soon)

The Los Angeles Times, which has been among the worst major newspapers in the country --- for years --- in reporting (or, actually not reporting) on issues of Election Integrity tells us today, in regards to yesterday's voting in California, that there were "Few election glitches, except for independents."

Um, does the braintrust at the LA Times realize that out of 15.3 million registered voters in the state, some 20% of them, more than 3 million, are "independents"? (3,043,164 to be exact, with more than 700,000 in LA alone, if the latest numbers from the CA SoS are to be trusted). Plus more than 300,000 voters registered as "American Independent" who may or may not have wished to be included as members of that party? Or shall we just deliver the "Understatement of the Year Award" right now to the folks at the LA Times?

That's more than just a "few glitches," no?

And if the following disturbing video from a Los Angeles Ron Paul supporter who switched from Democratic to Republican specifically to vote for Paul is any indication, it's not just "independents" who experienced "few election glitches" yesterday...

Your Election Glitches, Hiccups, Snags and Snafus Failure Headquarters...

We're crawling through tons of election-related problem reports (thanks to VotersUnite's early report, and those of you emailers and commenters) this morning from all over the state, and all over the country. Trying to make sense of as many of them as possible. Confirm them, seek out more details, etc. It's really a matter of triage at this point.

Many of you, in other threads, have been sharing experiences and concerns from the polling place yesterday, or have come across troubling reports from the news media, etc.

Feel free to repost and/or add new comments here in this thread, as we continuing to sift through the rubble, so that we might be able to continuing collecting some of the reports, and allowing for others here to dig into them as well. There seems to be more than enough work to go around today. Again. And unfortunately...

In last evenings “Daily Voting News” I said that we seemed to have dodged a bullet. That statement may have been made a little early. Most of the big reports are election administration failures. Administration failures are those failures that cannot be blamed on voting machines or the voters or poll workers. They are those failures that fall directly in the laps of clerks or registrars or boards of elections. Not enough paper ballots at the precinct is an administrative failure. The “decline to state” issues in Los Angeles County and elsewhere in California, is an administrative failure that may cost hundreds of thousands of voters their voice. We are also picking out little pieces in media articles and some first hand reports that machines put in some California precincts for voters with disabilities were not operational and voters with disabilities ended-up losing the privacy of their vote just so they could cast a ballot.

Hundreds of Thousands of Non-Partisan Voter Ballots May Not be Counted in California's Open Democratic Primary Election
City Attorney Calls for Review by CA SoS, County Registrar of Voters...

Alright, we've got a bona fide mess here in Los Angeles County. We covered this a bit earlier tonight, but have been speaking with various precinct captains and trying to figure out exactly what's going on. As mentioned it's a confusing mess, and could indeed be shaping up as "California's Butterfly Ballot" as far as we can tell.

There are two main problems:

  1. Many voters who thought they were registering as non-partisan independents have been surprised to learn they registered instead as members of the "American Independent" party, and thus, were not allowed to vote in the open Democratic primary.
  2. More insidiously, those independent non-partisan voters who did successfully manage to get registered as "Decline to State" (or DTS, or Non-Partisan), were allowed to vote in the Democratic Presidential Primary if they requested to do so when voting. However, without filling in a certain bubble on the ballot, specifying they wanted it to be counted in the Dem Primary, their vote for President, according to LA County's Registrar of Voters, will not be counted.

After being up since dawn, we hope to get some rest tonight shortly, and will then get a clearer picture on all of this, and the myriad other problems reported elsewhere in California and around the nation tomorrow (and beyond).

For now then, our friend Jake Soboroff at Why Tuesday has a video interview, posted below, with LA City attorney, Rocky Delgadillo who is also expressing concerns about what is becoming known as the "Double Bubble Trouble" issue. As well, Delgadillo gives a full statement to CBS2 News, calling for review of the issue, which could well disenfranchise hundreds of thousands of voters, by CA SoS Debra Bowen and LA County's acting Registrar of Voters Dean Logan.

Logan arrives here fresh from from his reign over the disastrous 2004 gubernatorial election mess in Washington state. He replaces the recently-resigned LA County Registrar and Diebold cover girl, Conny "Cut and Run" McCormack, who seemingly left this ridiculous scheme in place as a parting gift to LA County voters.

Independent Voters Have Trouble Voting, and Having Their Vote Counted, in the Open Democratic Primary
A Legal Battle Could Be on the Horizon Over 'California's Butterfly Ballot' if Results are Close...

Have been talking to various folks at various mainstream media outlets all day, hoping to help improve their coverage beyond the usual "glitches, hiccups, snags and snafus" reporting, so they might better understand that those are not "glitches", but failures.

My report on Los Angeles County issues for now, promised earlier, will therefore be somewhat truncated for the moment. I'll try to offer more details late night and/or tomorrow when, as the Century Foundation's Election Integrity expert Tova Andrea Wang smartly points out in her article titled "Super Tuesday. And Wednesday, and Thursday": "[M]any of the biggest problems will not be revealed until well after the polls close tonight."

For now, allow me to point out that, or caution, that serious legal issues could come in to play if results of the Democratic primary in the state are close in any way...

I know that any voter who was affected by a machine malfunction or had to wait in a long line will disagree but we seem to have dodged a bullet so far in this primary. Voting machine malfunctions were wide-spread as were electronic poll book failures. This evening and tomorrow will bring us many more reports of problems as counties get polls closed and begin to tabulate the votes. Please note that our information comes from media reports and not anecdotal reports from voters.

Also in the news this evening is a report from Cuyahoga Co Ohio where a judge has denied an injunction filed by the ACLU in which the group hoped to stop the county from changing to centrally-counted paper ballots.
