SimmonsCooper Files Lawsuit on Behalf of AVANTE International Technology Corporation
EAST ALTON, Ill., July 12 /PRNewswire/ — SimmonsCooper LLC has filed a lawsuit against the three largest voting machine manufacturers for infringing AVANTE International Technology Corporation’s Voter Verifiable Paper Audit Trail (VVPAT) and optical scan patents.
Named in the suit are Diebold Election Systems, Election Systems & Software, Inc. (ES&S), and Sequoia Voting Systems. The suit was filed on behalf of Kevin Chung, CEO of Avante International Technology Corporation, Inc., who invented VVPAT.
AVANTE’s VVPAT and optical scanning (which includes automatic ballot marking) patents allow voters to verify that their electronically-cast ballots are being accurately counted while also allowing for auditability between the paper record and the electronic record.
The AVANTE technology directly addresses widespread skepticism about the integrity of electronic voting, solving a problem that has threatened to undermine public faith in a process tainted in recent elections by allegations of computer manipulation.
“AVANTE isn’t the only victim here,” said Paul Lesko, the SimmonsCooper lawyer representing AVANTE. “Local governments, acting in good faith in determining which electronic voting system would serve the needs of their districts, also have every reason to be upset at these companies.
“We believe the evidence will show that these companies sold infringing equipment to public officials, and that they did so consciously, with knowledge of AVANTE’s intellectual property,” added Mr. Lesko.
SimmonsCooper is seeking damages and an injunction on behalf of AVANTE.

And – come on Mexico! Hang in there. That’s where the Bushies are trying to steal one like they have been doing here. They’ve started working on some new tricks for the Nov. election.
And why Mexico? According to Greg Palaste – and it makes sense – it’s all about the oil. Mexico is where we get most of ours; and right now it’s owned by the government. Bush wants our oil guys to be able to buy up some of their state-run oil biz.
So what do we do about November?
What about paralel elections? Are any of y’all working on that?
Having somebody outside every polling place in a contested Congressional race asking folks to do a paper vote and comparing the box with the real vote…

It is very sad when our media reports on elections in foreign countries, but nary a word on ours. You are probably right about the oil. Until our own citizens wake up, this is the way it will be. I truly don’t think enough people care or can’t be bothered.

AVANTE has a huge point. If several unscrupulous voting machine companies with no respect for anything but their bottom lines create the impression that NO electronic systems can be devised and manufactured without gaping vulnerabilities, then honest companies with the integrity to care about producing a quality product will sink with them. But I think any machines must be required to prove their reliability AND to subject their software to expert outside scrutiny – something none of the three baddies being sued have done/allowed.
And just to think – those guys couldn’t even do a good job of copying!!
