Diebold Elections Systems, Inc., is no more. At least in name.
After a year and a half of conversely trying to dump their failed voting unit and/or lying to customers about the reliability and security of their voting systems, corporate parent Diebold is giving up the ghost of its election business which, according to an analyst in a Reuters report, was “responsible for less than 10 percent of Diebold’s revenue, and 100 percent of its bad publicity.”
According to a company statement [PDF] just released, Diebold Elections Systems, Inc., will become Premier Election Solutions as of today. The company president, David Byrd, who has overseen the disastrous election unit for some time, will stay on as president to go down with the ship, apparently.
Applying full lipstick to the pig, the company statement declares, “The change to Premier signals a new beginning for the company.” And President Byrd picks up where he left off, furiously polishing his turd with the claim that “This is both a fresh identity for our company and a unique opportunity for us to concentrate our focus solely on providing best-in-class elections solutions for current and potential customers.”
No word on when they’d begin that “focus” after years of claiming same, but doing anything but. They have, however, radically lowered their expected revenue statement for the year by $120 million.
After a string of disastrous reports on the quality and security of their voting systems, along with plummeting stock prices since last week, it seems clear that Diebold, the once-great, more-than-100-year old company, is doing whatever it can at this point to save the corporate parent. While its stock price (DBD) plummeted at today’s opening bell and is currently down some 5.6% from yesterday, the price has begun to rise again in the last hour or so on news of the spin-off.
More than anything, however, the move may well be a harbinger of a coming declaration of bankruptcy for Diebold/Premier, as we see it. With the unit now spun off from the blue chip Diebold parent, declaring bankruptcy or dissolving the company altogether might be less trouble for investors and the main company as a whole, as their extraordinary legal and financial liabilities continue to mount…
The BRAD BLOG has speculated in the past that voting machine companies such as Diebold and Sequoia Voting Systems, whose corporate parent Smartmatic has also been unsuccessfully seeking a buyer for some time, will likely have trouble unloading their units given the extraordinary liabilities all of these companies now likely face after years of producing shoddy equipment and attempting to defraud both the public and election officials about the quality, security, service, and price of their hastily built voting systems.
A devasting exposé by “Dan Rather Reports” aired on Tuesday night (complete video here) will likely make Sequoia even more difficult to unload. The investigative report detailed seven Sequoia plant workers who testified on camera about a mysterious order to use inferior paper on the company’s punch card ballots to be used in Florida during the 2000 election. As well, they were told — despite the objections of the plant’s quality control manager — to change the alignment on the punch card chads being sent to Palm Beach County. Rather’s report tested the inferior, misaligned ballots that were sent to the county anyway, in 2000, and found that “hanging chads” resulted on ballots that had punched through cleanly for years before the bad paper and re-alignment was forced by still-unnamed company officials.
In the wake of Rather’s report, the election watchdog group Voter Action has called for a Congressional investigation into allegations of “commercial fraud” by all of the voting machine vendors.
In Diebold’s statement announcing the restructuring this morning, they admitted that “efforts to sell this company…have proven unsuccessful.” Instead of blaming the failure on their hackable, inaccurate, inaccessible voting systems, they claim the move was “due in part to the rapidly evolving political uncertainties and controversies surrounding state and jurisdiction purchases of electronic voting systems.”
Diebold’s voting systems have been found in study after study to have severe problems. But the final blow may well prove to have been the recent findings by California Secretary of State Debra Bowen’s independent “Top-to-Bottom Review” of all voting systems certified in the state. The devastating reports, by computer scientists at the University of California, found that Diebold’s voting systems were easily hacked in just minutes and even failed to meet disabled voter accessibility standards as mandated by federal law.
Bowen decertified Diebold’s touch-screen systems beyond the use of one unit per polling place in order to marginally meet those federal disabilities standards. All of the systems’ unreliable “voter verified paper audit trails” will have to be counted, 100%, by hand. Since the latest findings in the Golden State, other states and counties have begun to reexamine their own use of the flawed systems.
Angling, perhaps, for the “Understatement of the Year Award,” Diebold spokesman Michael Jacobson downplayed the importance of California’s actions, suggesting to PCWorld today that Bowen’s moves “played a small part in the decision to restructure the business unit and lower revenue expectations.”
The company announced today that they were “lowering [their] full-year revenue expectations for the election business by approximately $120 million” from their previous estimates for the year of “$185 million to $215 million.”
While we’re no financial analysts, the adjustment would seem to lower expected revenues from more than $200 million to a paltry $65 to $95 million, by our rudimentary math.
“This is a cumulative effect. There’s a lot of activity in a lot of states,” Jacobson understated to PCWorld.
Last year, Diebold admitted that it was under “formal” investigation by the SEC, reportedly due to allegations of misstatements to investors concerning projected revenue from voting machine sales and long-term service contracts.
As well, the company is currently defending itself in a Securities Fraud Class Action lawsuit filed in December of 2005 charging fraud, insider trading, manipluation of stock prices, and concealment of known flaws in their voting machines.
Those of us in the Reality Based World, however, paying close attention to Diebold’s various attempts to re-arrange the deck chairs on its Titanic, have been noting all of these glaciers in the water for some time. Diebold CEO Tom Swidarski might have been wise to take up our offer for advice on what was wrong with his company back when we offered it in March of 2006, just after former CEO Walden O’Dell had finally been pushed overboard.
O’Dell, a George W. Bush “pioneer,” having raised more than $100,000 for the Bush/Cheney ’04 campaign while he led the North Canton, Ohio, company, had infamously — and disastrously — brought Diebold to the center of attention for e-voting critics when he wrote that he was “committed to helping Ohio deliver its electoral votes to the president next year” in an ill-advised Republican fund raising letter back in 2003.
The company has been forced to defend itself against charges of corruption and vote rigging ever since. But while it hasn’t been shown that Diebold has actually thrown any elections, myriad findings, including California’s reports and a study last year at Princeton University, have shown that both the physical and software “security” on its systems are easily violated and could allow a single user with access to just one of its voting machines to implant an undetectable computer virus that could flip an election without detection. The University of California also found an undocumented user account that could allow company employees to access and take over the entire voting system remotely without use of even a password.
The newly named company, Premier (while it’s still in business), will remain headquartered in Allen, TX, where we visited it a week or so ago. Our recent late-night visit to the building, the day after Bowen’s decertification/recertification of their voting systems is documented, with photos, right here.

2. Never before, for a folksy little straw poll event, has Diebold machines or any other type of machine been brought in to control the counting of votes. These fairs had always been counted by simple hand counts. But with 5 months to go before the formal primaries & caucuses, they did not want to have anti-establishment candidate Ron Paul be seen or perceived as “a winner” and getting the Media coverage and momentum that would have followed had he been announced as the winner. What we saw is that at least one (or more) Diebold machines failed and, instead of reverting to a simple hand count for that station(s), they held up the Election for around an hour, while they re-programmed the Diebold machines to ensure that all the counting was done by machine and none by hand (where the true voting trends would have been detected).
I smell a rat here!

Regarding the recent straw poll in which Ron Paul wuz robbed of a win…why in the hell did he accept the poll results and declare that he was “happy” with it?
WTF?
Surely Dr. Paul KNOWS that the damn Diebold, er, now Premier, machines were NOT reliable and that there would be behind-the-scenes shenanigans to twist the vote in the favor of the establishment candidates, rather than the one who’d most likely would have won it if there was an honest vote—Ron Paul?
If I were Dr Paul at the Iowa straw poll, I would have rounded up volunteers–along with the candidate himself–and vowed to stay RIGHT THERE next to EVERY SINGLE DIEBOLD machine all day long with a vow to not let the machine to ever be out of sight, no matter what. If anyone gets arrested, then all of the Paul supporters would have needed to get arrested, including Paul himself, for the “crime” of insisting on honest hand-count of the votes. Why didn’t Paul think of that?
If Paul had made a stand right then for an honest vote, the incident/arrests/stand would have gotten a hell of a lot of press, along with a possible forced honest outcome with a BIG Paul victory. A mass arrest of the stand-by-the-machine Paul supporters would have resulted with a vote result like it is now, but it would have been seriously clouded over with the big arrests of all those Paul supporters, including Paul himself.
Dr Paul BLEW IT! Dammit. There are times when a candidate need to make bold moves and Dr. Paul need to grow some cojones, otherwise, he’s not going to escape from the damn establishment shadow of vote fraud.
During the next poll contest, Dr. Paul had better make a stand if there’s going to be any damn DREs or hackable scanning devices being used in the contest.

I for one plan to continue my legal efforts at mother diebold so that not only they feel the sting, but that they stop feeding the new premier beast which is not acapble of raising private funds to extend it’s ugly reach into my voting pocket.

Attached to it, according to whistle blowers, is a request for a sex change to “cowgirl”.

Saw this coming two years ago. What do you do if you’re a public company and you have a division that represents maybe 5 percent of your business and:
– you can’t sell it
– it has service contracts 3-5 years out so you can’t just shut the thing down
– you know you are likely to be hit with claims in litigation that can take out the other 95 percent of your operation?
You do the only thing you CAN do: Spin it off, quarantine it under another board of directors, leave yourself an opening so IF they clean it up you can duck back in and profit, and if/when you get hit with the big damages in legal claims, declare bankruptcy.
Then you say to the empty-handed plaintiffs who are left holding nothing but damaged goods and an unenforceable judgment, “Let them eat cake!”
And you move on to the next corporate executive position.

Electronic voting is completely owned by the Bush administration and by default the republicans led by Karl Rove. If democrats really wanted to take care of the electoral problems, someone like George Soros, with the financial means to buy a company, would buy the company, fix it and GIVE AWAY THE MACHINES to every state. Some of the old timers I list in #28 were talking about this stuff years ago on this blog. Years before spying on Americans was in the regular news, it was said on this blog that “every phone call you make is watched“. Echelon was talked about years ago here.

Yes, deceit of the people is an institution in the US, and it is part and parcel of the functionality of the US Military as well. Many specialized universities train experts in the field. They are trained professionals who have a mission to deceive.
We call it “PR” and “advertising” and “news”. It is actually propaganda being used to deceive the people.
One recent case where they got caught was at Wikipedia. The CIA and FBI were caught changing the text of various Wiki articles.
Yes it is quite brazen for them to do it so out in the open. They usually use corporations with people like Dunne to do it for them. With taxpayer money.

I posted before you did and it has #34 at this time, could change, and a message was attached to it:
I personally know that my posts are inanimate objects that can’t await or moderate themselves.
And I can’t go back and “moderate” them because they are not going to be moderate to everyone, plus I am not an admin.
John Gideon did that to me a month or so ago, and later my post disappeared. I guess it was not moderate enough for him.
If the numbers change you know what happened to my post #34.
Just an FYI Dredd Man, comments here are NOT moderated before posting, unless a particular posted is put on a ban or moderate list if they are a spammer, or otherwise have broken the posting rules here repeatedly (after several warnings, etc.)
However, there are some posts that get triggered into the moderate queue based on certain criteria built into WordPress when they are thought to be possible spam. Certain words and/or too many URLs in the note, etc. could trigger the system to believe it may be spam, and thus the comment waits for one of the admin folks to approve it.
You are certainly not on a moderate list, though occassionally one of your comments, for whatever reason, might end up in the mod queue errantly. Just so’s ya know.

Rather than Premier Election Systems I am surprised they did not call it Monarch Election Systems,.. or His Royal Highness The King – Election Systems.
What is the status of the Kennedy/Papantonio qui tam litigation against election fraudsters and cheats like Diebold ? If Premier Election Systems is spun off from any connection to Diebold and then suffers eventual bankruptcy – does that prevent the recovery of damages cause by Diebold Election Systems if the qui tam suit is successful ? Is this the Diebold parent company’s strategy to release/absolve them of negligence, fraud, malicious misrepresentation of product – and having to pay any court/jury imposed damages down the road ?
Combined these electronic voting machine vendors took billions of dollars in US taxpayer money, they provided a shoddy product at top dollar prices. Is the US taxpayer not entitled to some reimbursement and punitive damages to dissuade these corporate charlatans and shysters from doing these bogus and fraudulent transactions again ?
A slap or the wrist will not stop these corporate bandits and snake oil salesmen – a hefty court ordered award for recovery of damages to the US taxpayer is long overdue. These EVM purveyors had a major hand in formulating the HAVA Law to their best advantage, thanks to Bob Ney, who is now in jail. The sad state of affairs in the election vote counting process that is now privatized beyond any oversight by the citizenry is a direct result of allowing lobbyists into the halls of congress to write legislation to their direct benefit and profit – the needs of the American taxpayer and populous be damned.
Let’s start a thread devoted to renaming this collection of rogues. I’ve suggested Black Hole in an article. I’ll check back to read your suggestions. We could compile them.
