Was to Attend State of the Union Address! Was Already Seated in Gallery When Arrested by Capitol Police!
EXCLUSIVE DETAILS...'T-Shirt' Story Confirmed by AP...Media Fighting over Sheehan for Morning Show Appearances...Protesters Rallying for Sheehan's Release...Police push protesters away from Capitol...Sheehan Finally Released, Says She was 'Roughed Up...PHOTO OF THE 'T-SHIRT' FINALLY...

CNN is now reporting...

Antiwar activist Cindy Sheehan --- who was invited to attend President Bush's State of the Union speech --- has been arrested, Capitol police say.

Invited by Rep. Lynn Woosley [sic] (D-CA) to attend the State of the Union, reports are that she was arrested inside the Capitol chamber.

MORE... 9:08p ET - CNN's "Breaking News" banner announcing the arrest at their website now removed, shortly after CNN reported arrest on air. No further news available currently at their site on the arrest...

9:14p ET - AP reports on CNN's report. Says, "Activist Cindy Sheehan Arrested at Capitol".

9:30p ET - The BRAD BLOG has confirmed the arrest moments ago with David Swanson of AfterDowningStreet.org.

According to Swanson, Sheehan was "arrested for wearing the shirt she was wearing all day, which had the number of U.S. troops killed in Iraq...She was lifted out of her seat [in the Capitol Chamber gallery] by the Capitol Police and taken away."

Swanson told The BRAD BLOG moment ago that Sheehan is "now under arrest and lockup by Capitol Police." He confirmed that moments ago with Gael Murphy, a co-founder of CodePink, an organization which has been working Sheehan. Murphy spoke by cell with Sheehan after the arrest, and they are currently arranging for an attorney for her.

"This not the Park Police," said Swanson. "We're used to getting arrested by them. This was the Capitol Police....She didn't even want to go to the speech, she said she couldn't stand to listen to Bush, but she went. She didn't even protest, she was just wearing the same shirt she'd be wearing all day, a black shirt with the number of troops killed. It was already 'out of date' and she had to add 3 more to the previous number."

9:40p ET - Reports we are receiving are in conflict with AP's updated report that Sheehan had a protest banner prepared to be unfurled. It was, according to our sources, her T-Shirt which seems to be the given reason for her arrest... According to AP:

A Capitol police official reportedly said Sheehan had unfurled a banner, which is a violation of House rules.

We cannot confirm the "banner" reports, and have been told by several sources the arrest was due to the T-Shirt she was wearing after already being allowed into the Capitol chamber where Bush was to deliver his State of the Union address just moments later...

Cindy Sheehan's son Casey was killed in Iraq in 2004.

9:50p ET - Reuters confirms arrest. Few details given.

9:55p ET - Photo of the arrest from Reuters...

10:02p ET - CNN files its story. Sticks to "banner" reporting:

WASHINGTON (CNN) --- Peace activist Cindy Sheehan was arrested Tuesday in the House chamber after she unfurled an anti-war banner before President Bush's State of the Union address.

Capitol police arrested Sheehan and questioned her for about an hour in a separate area of the House, a senior House official said.

Sheehan, who became a vocal war opponent after her son was killed in Iraq, was an invited guest of Rep. Lynn Woolsey, D-California, who has called for a withdrawal of troops in Iraq and supports legislation for the creation of a Department of Peace.

10:20p ET - AP updates their report. Confirms original exclusive BRAD BLOG report that it was a T-Shirt, not a banner that led to Sheehan's arrest:

[Capitol Police Sgt. Kimberly] Schneider said Sheehan had worn a T-shirt with an anti-war slogan to the speech and covered it up until she took her seat. Police warned her that such displays were not allowed, but she did not respond, the spokeswoman said.

Police handcuffed Sheehan and removed her from the gallery before Bush arrived.

10:39p ET - Sheehan still in jail, Morning Shows "fighting over her"...

David Swanson, in D.C. tells The BRAD BLOG that Sheehan is still in jail. Swanson had been previously arrested along with Sheehan at earlier protests.

He tells us, "Attorneys are trying to get her out. Media is fighting over here...Today Show, Good Morning America, they all want her...but she has to get out of jail first."

11:30p ET - Bob Fertik reports:

There are 200 protesters standing outside the Capitol Police HQ between 1st and 2nd on D St NE (between Hart SOB and Union Station). They are chanting and demanding Cindy's release. Tell the DC media to cover the protest!

He also suggests...

Call the White House Comment Line 202-456-1111,1,1 and express your outrage that the mother of a soldier killed in Iraq was arrested for wearing a t-shirt with the number of soldiers killed in Iraq!!!!!

11:49p ET - Village Voice has more on Sheehan's recent arrests, including this evening's.

11:54p ET - CNN's Ed Henry finally corrects their report and confirms it was a T-shirt that was the reason for Sheehan's arrest.

He just reported during Anderson Cooper:

"She entered the gallery wearing a shirt with some sort of anti-war slogan...they were afraid she was going to do something with it in front of the cameras".

What, like wear it? The only opinions allowed in the people's Capitol tonight are George W. Bush's, we guess.

Here's another opinion on the "State of the Union" from outside the capitol tonight.

12:05a ET - Police Surround HQ to fend off Protesters... More from Fertik...

David Swanson reports by phone on the scene: During the protest in front of the Capitol Police HQ, 2-3 dozen police locked arms and pushed the crowd across the street. A protester named James from World Can't Wait was arrested for chanting "Free Cindy Now" with a megaphone. As the police grabbed the megaphone, they hit a woman protester in the head, but she is ok. They also kicked Aliska from World Can't Wait in the head, and she required treatment in an ambulance before she was released. Cindy is now being taken to the Central Processing Center in Judiciary Square, and the crowd is following her.

World Can't Wait is an organization that held a protest near the Reflection Pond on the elipse today, calling for Bush to step down.

12:18a ET - MSNBC now has an online poll on whether the Capitol Police should have arrested Sheehan for wearing a T-shirt. Go register your opinion...

12:22a ET - SHEEHAN FINALLY RELEASED! SAYS SHE WAS "ROUGHED UP"...According to Fertik who is in touch with David Swanson...

David reports Cindy has just been released. She was filmed by 3 networks and answered a few quick questions and mentioned she was "roughed up" - David said she looked tired and frustrated. She went off to sleep and will appear on the Today show in the morning.

12:44a ET- NBC reports the shirt in violation of the "law" read: "2,245 Dead How Many More??"

Attytood points out:

Did you know that in 1971, the Supreme Court said it was unconstitutional to arrest a man who wore a "F--- the Draft" T-shirt into the courthouse? (Cohen v. California, you can look it up.) So now Alito's on the court for 45 minutes and your civil liberties are already going down the toilet. You were warned.

1:21a ET - MBare gets the money shot!

Note the hand-corrected number on the shirt, as we reported previously, since 3 U.S. troops had been killed in Iraq since Sheehan put the short on earlier today.

Mbare points out that moments later, in Bush's speech, just after Sheehan's arrest, he said (without a hint of irony):

"Every step toward freedom in the world makes our country safer --- so we will act boldly in freedom's cause. Far from being a hopeless dream, the advance of freedom is the great story of our time.

No one can deny the success of freedom, but some men rage and fight against it.
...
We love our freedom, and we will fight to keep it."

So will we, Mr. "President"...

2:41am ET - David Swanson, now safe and sound back home, has details and more photos of both Sheehan wearing the shirt earlier in the day, as well as VR's Impeachment Truck (NOTE: Who is that debonair gent behind Sheehan in this photo? ;-)

3:13am ET - One final thought for tonight. Also with a hat-tip to MBare...

U.S. Constitution: First Amendment:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Good night America.

NEXT DAY UPDATE: More on Sheehan's arrest, her own words, and the Republican Congressman's wife who was asked to leave for wearing her own T-shirt in support of the troops now posted here...

MORE UPDATE: Acceptable State of the Union protest...

FURTHER UPDATE: Capitol Cops admit they "Screwed up"! NBC reports they will be dropping all charges!

NOTE: We've now restored the Comment link that we had to temporarily turn off previously while this site was getting pounded with hits, making it impossible to update the item. Thanks for your understanding.

New Patriot Act Provision Creates Tighter Barrier to Officials at Public Events

Tuesday, January 31, 2006

By Kelley Beaucar Vlahos

WASHINGTON — A new provision tucked into the Patriot Act bill now before Congress would allow authorities to haul demonstrators at any "special event of national significance" away to jail on felony charges if they are caught breaching a security perimeter.

Sen. Arlen Specter , R-Pa., chairman of the Senate Judiciary Committee, sponsored the measure, which would extend the authority of the Secret Service to allow agents to arrest people who willingly or knowingly enter a restricted area at an event, even if the president or other official normally protected by the Secret Service isn't in attendance at the time.

The measure has civil libertarians protesting what they say is yet another power grab for the executive branch and one more loss for free speech.

"It's definitely problematic and chilling," said Lisa Graves, senior counsel for legislative strategy at the American Civil Liberties Union , which has written letters to the chairmen and ranking members of the House and Senate Judiciary Committees, pointing out that the provision wasn't subject to hearings or open debate.

Some conservatives say they too are troubled by the measure.

"It concerns me greatly," said Bob Barr, former U.S. prosecutor and Republican representative from Georgia. "It clearly raises serious concerns about First Amendment rights."

But not everyone agrees that rights are being trampled on by the additional provision. In fact, some say the ACLU is the problem when it comes to protecting national security.

Rocco DiPippo, a freelance writer for the conservative FrontPageMagazine.com and editor of The Autonomist Web log , said the ACLU has fought the government every step of the way over security measures following the Sept. 11, 2001, terror attacks.

"Its opposition to Specter's reasonable proposal is simply more of the same," he said. "I can understand the concern that we should be suspicious of government, but we shouldn't adopt this mindset: 'government is evil.' This is just more hatred of (President) Bush."

Under current law, the Secret Service can arrest anyone for breaching restricted areas where the president or a protected official is or will be visiting, but the new provision would allow such arrests even after those VIPs have left the premises of any designated "special event of national significance." The provision would increase the maximum penalty for such an infraction from six months to one year in jail.

In a post-Sept. 11 world many non-political events have been designated National Special Security Events and would rise to the higher status. Examples of possible NSSEs are the Olympics or the Super Bowl. In 2004, the presidential inaugural balls and President Ronald Reagan's June funeral procession in Washington, D.C., were designated NSSEs.

According to government sources with knowledge of the legislation, Secret Service protection and law enforcement authority would extend beyond protecting a specific person, rather the event itself would become the "protectee."

Currently, non-violent demonstrators who enter restricted areas at such events previously would be arrested and charged by local law enforcement with simple trespassing, said Graves. Under the provision included in the new law, they will be charged with felonies by the Secret Service.

"It's a different consequence to people," she said.

"You are talking about giving the executive branch broader authority to create these exclusion zones which could cover broad areas and last for days [during an event ]," David Kopel, a constitutional expert with the Cato Institute, told FOXNews.com.

A spokesman at Specter's office said the senator was surprised by the clamor over the provision, which merely makes a technical change to clear up legal confusion over who has arresting authority at NSSEs. His office had no further comment on the provision. Committee Ranking Member Sen. Patrick Leahy, D-Vt., also declined comment. Republican and Democratic House Judiciary Committee leaders did not return calls for comment.

White House sources say the measure was not instigated by the administration and pointed out that it was a stand-alone bill that was rolled into the Patriot Act by Specter's office during House-Senate conference negotiations. White House spokeswoman Dana Perino told FOXNews.com that the White House would not comment on the intent of the measure, but that the president is concerned with preserving individual rights.

"President Bush is committed to protecting the American people's national security as well as their civil liberties," she said.

Secret Service representatives said the agency does not comment on pending legislation.

The Bush administration has been criticized in the past for what many say are tactics that keep protesters far away from official events and by employing stringent policies to ensure favorable audiences for the president.

Last year, three ticket-holding audience members at one of the president's Social Security events in Denver, Colo., were apprehended by a man who they said identified himself as Secret Service. The three were forced away from the event because of an anti-war sticker on the driver's car.

"[The administration] has certainly demonstrated a desire to have carefully-controlled events," said Graves.

John Pike, director of GlobalSecurity.org, an Alexandria, Va.-based clearinghouse for domestic and international security information, said he "could certainly understand why the Secret Service would want that legal authority," given the enormous burden of making venues safe for VIPs today.

"However, I think many people have concluded that the way it is being used has nothing to do with protecting the president from Usama bin Laden and everything to do with suppressing dissent and making sure the protesters don't get on TV," Pike said.

Bush is not the first president to flex his authority in this area, said Kopel, who pointed out that beginning with Reagan, presidents have created a larger security bubble and greater distance between themselves and dissenters at public events. The 2001 terrorist attacks on the United States just intensified the situation, he said.

"I think the concerns about free speech in areas where the president is speaking long pre-date Bush. They were an issue in the Clinton administration, the first Bush administration and began as an issue during Reagan," Kopel said. "I do think the ACLU has legitimate concerns about the breadth of the new language and how it could be applied."

Graves points out that conservative "pro-life" groups will be the target of the new provisions, too, a scenario that could raise the concerns for those who are typically critical of the ACLU, which she said is necessarily concerned about other provisions in the bill that impinge on civil liberties.

House and Senate leaders, who return to Capitol Hill this week, are trying to renew the Patriot Act by Friday. Democrats and four Republicans in the Senate who filibustered a final vote in December after raising concerns about preserving civil liberties instituted a short-term extension of the previous bill, which was set to expire on Dec. 31.

What she did had nothing to do with the patriot act or the republicans. She deliberatly broke a rule of the House of Congress, when she attempted to hang a banner from the gallery. The House Chamber deserves respect, and not to have someone hang a banner from the gallery. I'm a veteran myself, but I still have respect for the buildings and monuments, our fellow soldiers have died for in the past 229 years. There is a limit as to what she thinks is right.

I , for one, think Mrs. Sheehan did a brave and serious thing. I would not have attempted to hang a protest sign in a session of the Congress, but I do not fault her for it. I believe she is conducting a peaceful demonstration (if she unfurled a banner at all) and as far as her attire goes, that is none of my business nor the President's. The gallery isn't just for suits and gowns. She was invited. (Sounds like "E.T." doesn't it?). I reject sniping at her over etiquette or failure of reverence for buildings. If the Neocons had the slightest things for what Americans respect and revere, we wouldn't be where we are today: engaged in an invasion. The only thing we are on the offense about is offense against our own civil liberties.

OK, so we all knew the 3rd Reich is running our country. We all knew they could do anything they want, when Bush goes on TV and says, "I'm illegally wiretapping, and whaddya think about that?" Not even hiding breaking the law anymore. Does it surprise anyone, that they will arrest the mother of a fallen solder for wearing something they didn't like? Will everyone wake up, please, from this nightmare? This is absolutely unheard of in the United States of America! They will go as far as we let them, and we're letting them go!

Freedom of speech is now against the law in the United States of America. Does everyone hear what I'm saying???

Cindy Sheehan, a mother who sacrificed a son to Bush's illegal war --- is arrested for just sitting there with the truth, while Ann Coulter advocates the assassination of a Supreme Court Justice and is cheered on. Not a single conservative even admonished her! Yet a mother who dares to do confront the president in her grief - is made to feel like a criminal. It is Cindy Sheehan's constitutional right to protest, to question authority, and to speak her mind. Why does someone who uses "extermination speak" and death for Democrats get to roam free?

Unfortunately, the Reuters link above has the picture of Cindy being led out of the chamber and she is not wearing the t-shirt. So she was likely ready to display the shirt or in the act of holding it up when she was arrested.

The WORKING CLASS PARTY needs to be created today.

All you need is some old school AMERICAN values and a few charismatic candidates who speak the truth.

We can do no worse than produce something better than the corrupt Fascist Republidems (1 party not 2)running this country into the ground.

These fckers have to feel the fear and anger they imposed on us with their Rhiestag fire known as 9/11. Every human right stripped away must be returned and the cancer that has been imposed on our constitution must be burned off. You bastards think you own and control the American spirit however it still breathes free at Bradblog. We can put our minds together to take back our country PEOPLE. Our Founding Fathers have enabled us to remove a government of corruption simply through active involvement. We will coral these corrupt lying murdererous bastards and put them into jail. Nothing worth doing was ever won without a fight. For example, I believe if we got the Green Party to change their name to the Working Class Party it would have instant recongnition, a broader appeal, and we wouldn't have to start from scratch.
COME ON PEOPLE WE CAN DO IT!!! Free thinking American people cannot allow these greedy losers to successfully HIJACK our government of checks and balances that was created for US and future generations.

I just put on the Democratic response --- there's a small, annoying delay and poor, overdriven sound quality on Fox News Channel yet it looks and sounds just fine on MSNBC, CNN, and all local broadcasts. In fact, my local Fox broadcast is showing a Fox News Channel feed where the audio is also fine.

Had to turn off COMMENTS during the period we were one of the only places reporting on the arrest, since I couldn't update the item as the site was getting pounded.

Now turning them back on. Thanks for your understanding.

"So sorry for being such a uniformed nutjob before. The Kool-aid is starting to wear off."

Hey Jason/Ricky, its a LITTLE LATE for that compadre.

You're talking about people having to fight for their freedom of speech, getting the picture yet?

"I wonder why it takes so long for SO MANY WING NUTS to wake up to these facts???"

What about the facts these crooks in power are neoliberal fascists? You say you hate all liberals but its the neocons doing the talking, and aren't ALL of them liberals??

Why yes, they are. Neo-fascist liberals with big dreams of totally opening their own McDonalds empires all over the middle east. They dream of owning EVERY SINGLE plot of land...

We have foreign spies running the major pentagon/DIA and other areas, and you're just awakening to this fact?!?!???!

What the hell is wrong with people, that they have to go through alice in the looking glass land.....HELLO, YES we need to shut down the fucking voting machines. And the lobby groups, plus forge our THIRD PARTY!!!!!

Vote is a trust

Get mad and get out there!!!!!!! Get really mad, because these bastards have done it ALL to you. 6 or 7 squad? I think this site gets thousands (if not hundred thousand) of hits..

I think another Kent State incident is just around the corner. Is it going to take that for the US public to wake up and see what is happening to their rights? If it does happen, will the media and the WH put the spin on, make it appear legal? Necessary? Part of the war on terrorism? I am so glad to not live there anymore.

Bad choice, really. God Bless Cindy, but as anyone can tell you who has visited the Capitol, they have strict rules on conduct and behavior while in the gallery. You can't even fart in the gallery without being yanked out. And during a large event like this they're going to be even more strict, like wardrobe.

Would have been a more powerful statement to sit there and let chimpy not recognize her when he talks about other fallen sons and daughters.

There's another boring SOTU address and who gets the attention? CINDY! :)

Meanwhile, I just love how those stupid people here who start calling Cindy names. Just goes to proof that she's rattling you! Good! Goes to prove that she's doing something right to piss you off! :P :P :P

You can say name call all you want. Knock yourself out! But Cindy does not care! I don't care! We don't care!

When we get our country back and we get rid of bush and his criminal thugs, that's when the SOTU will get respect. For now, no. And on Wednesday morning, Cindy once again will be on the air. YEAH! :) :hehe: :)

It is acceptable to wear designer clothing, watches and accessories with cleverly infused branding, and we allow and expect our executive leaders, congressional leaders, Supreme Court justices, invited family and friends to wear patriotic flags on their lapels to such events as the State of the Union address, but somehow criminal to wear clothing which honor our citizens' greatest sacrifice.

What is inappropriate about someone quietly honoring and remembering our loved ones, killed in the US/Iraq War, during the President's State of the Union address. How more poignant, appropriate, and timely could this message be upon Ms. Sheehan's upper torso? Isn't this, in fact, the best arena and time to honor those whose lives were lost through their patriotic duty?

What is criminal about honoring the dead who gave their lives in the name of this country - who gave their lives for a noble cause, according to our president, so that others will know and share in this same cherished state of democracy and freedom as we, in these United States, are so fortunate to know. Are we ashamed of our commitment to spread democracy throughout the world - a commitment which unfortunately calls for the ultimate sacrifice?

How, may I asked, is Ms Sheehan's action disrespectful and criminal? I would think if one does not have the noblest cause for engaging our men and women in war, then one would feel desperately threatened by such emotional "branding", so to speak, and would perhaps, "legally" restrain one from such display. And you did just that, Mr. Bush and Co., with your overt contempt and disdain for the citizens of this country by the removal of Ms Sheehan from your State of the Union address.

Who would have thought that one mother could instill so much fear, in so many, with her truthful expressions of sorrow for those who have sacrificed their lives for your "noble" war?

Its wrong because Cindy's T-shirt is a liberal/conservative symbol of truth.

Communists hate the truth. And so they would sooner try to destroy her, which only makes her cause stronger!

Great going, keep it coming!! :)

It's hard to comprehend the mitigated gall of some people. Ignorant tyrants raging sanctimoniously about nothing but LIES! BLACK IS WHITE. HOT IS COLD. Unreal. I wish all of the blackened hatred they harbor in their souls right back at them, tenfold. Unfit for humanity.

Willfull ignorance. It's disgusting.

Peace.

take note of what Ed Henry said on Anderson Cooper:

"She entered the gallery wearing a shirt with some sort of anti-war slogan...they were afraid she was going to do something with it in front of the cameras".

Add this to the stories about spying on quaker peace groups, and anti-war protesters are one step away from being classified as enemy combatants.

GOD BLESS CINDY SHEEHAN! As in the Vietnam War era - which I am now apparently reliving - getting ARRESTED in protest is making a bigger statement, and getting more publicity for the cause, and encouragement to others; she's going on the Today Show for God's sake! As Mike Malloy just said, a lot of dead folks in Nazi Germany (and Stalin's Russia) PRAYED for someone to speak up for them. GOD BLESS THIS COURAGEOUS WOMAN! END THIS WAR!
