Huffington Post Picks Up the Cause...
Please take action!

Last week we briefly discussed Stephen Heller who, out here in Los Angeles, is now facing three felony charges for exposing the illegal scheme by Diebold to use uncertified software on their voting machines in the state several years ago. The LA Times coverage is here.

Heller blew the whistle on the company's plan to defraud California voters when he exposed documents he saw while working as a temp worker at Diebold's California law firm, Jones Day. The courageous act, from which Heller stood to gain nothing (he, in fact, was fired for it) led to the decertification of Diebold in the state by former Sec. of State Kevin Shelley, and then to the eventual settlement between the company and the state of California for $2.6 million in 2004.

Today, several Huffington Post blogger take up on Heller's behalf, along with issuing some calls to action to contact the LA District Attorney's office to encourage tell them to drop this appalling case of punishing the patriot, Heller at the behest of the the bullies at Diebold.

Peter Soby Jr.'s coverage is the most complete. Here's a snippet:

Let's make this clear, folks. The docs Heller is accused of exposing were important evidence. First, they show that Diebold and their attorneys, Jones Day, conspired to mislead the California secretary of state, and that the lie they told was material, and resulted directly in the disenfranchisement of voters. Second, another document demonstrates that Diebold lied to the secretary of state when it represented that certain problems with its software were "fixed." This document, the release notes for the new software, showed that the problems were not fixed. Third, the documents showed that Diebold had been advised by Jones Day that what it had been doing with its uncertified software was illegal. Fourth, the documents show that Jones Day advised Diebold that it was subject to criminal prosecution. So in a nutshell, Diebold was defrauding the state government and taxpayers of California, and disenfranchising the voters of California. And the documents PROVE it.

And for allegedly exposing Diebold's felonious behavior (which led directly to Diebold being de-certified in California), for allegedly helping protect the taxpayers and voters of California, for allegedly helping to keep elections clean and fair, what happens? Diebold, the true criminal in this case, and their powerful international law firm Jones Day, press the L.A. District Attorney's office to hammer Heller, a whistleblower. Three felonies! Diebold was (and probably still is) screwing California voters, Heller is alleged to have seen the smoking gun evidence of Diebold's crimes, and, like a true patriot and whistleblower, allegedly exposed that smoking gun evidence, and now HE'S the one facing jail time. Only in Bush's America!

This won't stop till we put our collective foot down. The people that are helping to protect our constitution are the criminals?! Where is the justice in that? It's time for some dramatic action. We need a 10 million person march on Washington or something. Our country is going down the tubes fast.

We DID have a 200,000 strong demonstration in September of '05 in Washington around the White House, demanding we end the illegal Iraq war & also demanding Bush be impeached for his lies to Congress & the people that started the war.
(Of course, Bush&Cheney made all the documents classified so we can't prove it--unless we impeach.)
200,000 strong & some estimates were 300,000 people marching in the streets!
They had wonderful speakers, some of them current members of the legislative branch. They had songs & signs. They kept the peace.
I watched the entire thing on Freespeech TV (FSTV) which is on DISH at 9515 I think--that's where I get some of my independent news.

BUT DID THE CORPORATE FAKE NEWS MOST PEOPLE WATCH REPORT IT?

Barely. They said some people protested in Washington.
Then they reported other demonstrators were there to support the war. They didn't mention the impeach thing.

Yeaaah--like 200 Republicans on 3 buses showed up for a few hours! I wonder who paid for & sent them?
They reported it like the statement that 200,000 adamant people who paid there own way, marching together make, is any where near equal to the statement 200 quiet people made.
200 vrs. 200,000.

Hey Group! Did YOU contact the California DA?
Well, do it.

Pass the word for everyone to watch FSTV/DISH/9415 & LINK-TV/DISH/9410 (or vice-versa on the channels).

No commercials, not corporate-controlled, no federal money so the GOP can't put people on the board to hijack it (like PBS), and no money from DISH.

And guess what? This news looks like the independent news we see on the internet (like right here).

A side note, is that LINK-TV & FSTV must be KILLING rightwingers & Republicans, because they can't do a damn thing about it, to ruin it.

I saw that protest and it warmed my heart but as has been pointed out, MSM didn't report on it. My brother doesn't even think there is anything to this e-voting debacle. I keep telling him to read more but he "hasn't got the time" yet has no problems talking down about the information I search out to stay on top of things. Typical anti-liberal thought. Closed minds are very difficult to get through to but progress is being made. We have to keep the heat on the real traitors like Bill Frist.

This is bad.

On the brighter side, there's more and more whistleblowers, more and more independent media getting the true news out, exposing things like this. They simply cannot keep up with all the whistleblowers and people exposing them. It's impossible.

Everywhere I go, I see people on the internet mentioning LINK-TV & FSTV, and I see remarks about how everyone knows our votes are being stolen by electronic voting machines.

There simply isn't enough of "them" (the criminal Bush regime) to wiretap, prosecute, etc...etc...all the people against them.

It is absolutely impossible for them to combat this tidal wave, no matter how the MSM spins it.

So glad to see this action. Diebold is truly shooting itself in the foot now, and I'm glad they took this action.

It proves how the neocons really are....they are willing to fight to the last stand for their election theft, whether it benefits them & republicans or democrats or just some nobody.
Action Plan
The neocons have shown their desperation and their fear now by prosecuting Heller, its time to turn the tables and prosecute Diebold for doing it to start with.

We all now know that Bush has only passed legislation that helps the richest 1% of the populace since he's been in office.
He's trying his best to do even more for the richest 1%--He's going to try dropping the estate tax, once again, soon, for the benefit of the richest family around--the Waltons of Walmart fame.
WHY oh WHY are Republicans STILL loyal & talking Bush up--unless, of course, we are speaking of the upper 1% in income, or the ones that have a political job?
I carefully explain it to them---that Bush is screwing THEM too, so why do they continue to support him--but they give you the standard 'you're a liberal wing-nut' robot response.

To defeat corporate control of our country, maybe we need to concentrate on getting the word out to people about media consolidation & why it's been so bad for Democracy.
The FCC knew what would happen when they began allowing one person to own more & more media outlets, because they had to change the FCC rules that had been in place for years to allow it.
Plus, when Reagan was in office they threw out the "Fairness Doctrine" which said they must always allow equal time for opposing views.
There used to be many media owners & many outlets which kept competition thriving & no one could control it.
But now, a handful, I believe it's 5 , huge conglomerates own & control almost ALL the information we get--on radio, TV & print. These companies won't allow any information to get out that could hurt them, so they don't report a lot of what really is happening & what they do report is slanted THEIR way.
For instance, one of the conglomerates owns a weapon's production company & likes to encourage the war because they're making a lot of money selling their weapons. (In fact, did you know that WEAPONS are the #1 industrial export in this country?) (You've heard the old joke that Bush knew Saddam had WMD because we had the receipts.)
Another owns a pharmaceutical company, so they won't report on the children's immunization scandal in which it's been found that the high mercury level used as a preservative in children's immunizations has been linked to the huge rise in autism. The pharmaceutical companies deny it--of course.
They also won't tell you that a "rider" was slipped into the Patriot Act that protects these same pharmaceutical companies from paying any damages if they prove it in court.
The government will not admit the mercury connection to autism, but still is "phasing" the mercury out of the immunizations, "as a precaution".
That sounds good, but the real reason they are "phasing" it out is because if they just stopped putting mercury in the immunizations all at once--the drop in autism cases would be all too obvious & would only serve to prove mercury WAS the cause of the high rise in autism, & the pharmaceutical companies could be sued.
The bottom line of these corporations is to make money--so to cut costs, they have fewer reporters & hardly ANY investigative reporters like we used to have. We used to have a few reporters in every branch in government--snooping & sniffing around for foul play--they knew their "beat" well & could tell when something wasen't right & knew how to get answers.
Now, there aren't any reporters in these government offices & everything has gone corrupt without these reporters shining a light on what's happening.
The government also has a glut of public relations people that pre-package & produce "fake news" reports about their own agencies etc, & send them for free to news stations--then the news stations have their own employees read the narration which is already written for them, while the station plays the fake news reports--so it seems like the station did this report themselves. But, in reality, it is essentially an ad written by the government about the government for the citizens to see.
The rest of the world gets way more real news than we do, & they KNOW we don't. They think we're idiots.
We're like some little banana republic we used to feel sorry for, where the government took it over & now owns the media & blasts it's phony propaganda at them 24/7.
The only difference is that the banana republic KNOWS their news is government propaganda & we don't.
The reason I feel this media consolidation problem is the one to work on first, is because if the real truth were known, everyone would be up in arms over all of it.
Also because Democracy CANNOT function without an informed citizenry. We have to know what is going on to make an informed decision.

Not to mention all the other fantastic documentaries you get to see and the only place you get to hear the greatest minds in the world: Noam Chomsky, Bill Moyer, Howard Zinn, Gore Vidal etc.

Their documentary about the daily life of the Palestinian people got by blood boiling in outrage and Chomsky’s Manufacturing Consent is a thing of beauty.

People can also catch Democracy Now on the net.

Contribute and keep Independent Media alive. They do a great job.

So "neocons" are just thiefs that steal votes to benefit anybody or nobody? Are you confused?

The fact is that the republicans control the chair and the majority member count in each and every oversight committee in congress.

As to whistleblower oversight, I watched the committee that oversees the whistleblower protection laws do its thing last week.

This was the first whistleblower hearing in twelve years in this republican congress.

All the famous whistleblowers were there ... Sibel Edmonds, Tice, etc. etc.

The whistleblowers have all been screwed, blued, and tattooed by this republican government.

I hope Steve Heller stays the course and keeps his chin up. No plea bargains, hopefully. This is really a blessing in disguise, provided only that he not give gound and that the mainstream media pay attention to his case.

It's similar to the class-action suits against Diebold, and Clint Curtis' campaign for Congress, in that it will focus public attention on crooked companies and crooked people in cahoots with them. Be brave, Steve! And don't be surprised if the D.A. gets a phone call from Karl Rove. "It might be better if we don't pursue this..." etc etc.

The Help America Vote Act of 2002 (HAVA) was signed into law in Oct. 2002. Amongst other things HAVA required the formation of the Election Assistance Commission (EAC) and provided some mandates, in Title III of the law, for federal elections including some standards for voting systems. Those standards include, but are not limited to, accessibility for voters with disabilities and accuracy in the vote count. Testing by experts in accessibility has shown that none of the Direct Recording Electronic (DRE, usually touch-screen) voting systems presently in use meet the requirements for accessibility for disabled voters. Failures in testing and vote counting in real elections have also proven that, at times, the voting systems presently being used across the country do not meet the federally mandated requirements for accuracy.

So what guidance has been provided by the EAC to the states with regards to Title III? Well, actually none. In fact even though voting systems presently in use do not meet federal law the EAC is just now getting around to issuing guidance to state and local election officials and, according to the draft of the plan ‘featured’ below, it is going to take another two years before the EAC can complete the guidance.

Why can’t they just tell the vendors and the states that the law is clear and, if they fail to follow that law, violations will be referred to the DoJ? The fact that the vendors misrepresent their products as being accessible is a clear violation of the law. It is time they are held responsible and it doesn’t take two years of studying Title III of HAVA to make that clear....
