Keep hope alive. We've got a bunch of mostly good news stories for you on today's BradCast! [Audio link to full program is posted at the end of this summary.]

Among those stories today...

  • EVERY VOTE MATTERS: The great state of California has finally wrapped up its month-long tabulation and canvassing following its March 5th Super Tuesday primaries. And, in one race, there's a bit of a first-of-its kind surprise. Ever since 2012, the state has run a top-two primary system, where candidates from all parties run in the same primary race and the top two vote-getters, regardless of party, go on to compete in the general election. This year, however, in a U.S. House race for an open seat in the state's 16th Congressional District, there was an exact tie among the 2nd and 3rd place candidates, who each received exactly 30,249 votes. So, three candidates --- in this case, all Democrats --- will go on to the November general election and its anybody's guess who may win.
  • BIDEN RISING: After months of polls showing Joe Biden trailing Donald Trump in national polling, now that the general election is in sight with Americans finally beginning to understand that --- like it or not --- it will almost certainly be a Biden v. Trump match-up, the polls are finally turning in favor of the President. It's a fairly small shift, but a meaningful one, with a bevy of high quality polls almost all finding Biden either ahead of or tied with Trump. There are lots of caveats for these numbers, as discussed today (for example, it's only April and these numbers could change, and they don't include third-party candidates, etc.), but the general news should come as an encouraging turn of events for those who have been freaked out for months about Biden's performance against Trump in early polling.
  • RIGHTWING DIRTY TRICKSTERS PAY THE PRICE: Bufoonish rightwing clowns Jacob Wohl and Jack Burkman, who sent misleading robocalls to thousands of Black voters, lying to them about being arrested and more if they voted in the 2020 election, continue to pay a price for their dumb, offensive, dirty tricks. The pair will now have to pay as much as $1.2 million for their violations of civil rights laws in New York, according to a consent decree struck with the state's Attorney General Letitia James. That follows previous penalties for the pair of a more than $5 million fine by the Federal Communications Commission last year, and two years of probation plus 500 hours of voter registration to which they were sentenced in Ohio, another of several states where their scam played out.
  • MORE RIGHTWING DIRTY TRICKSTERS PAYING A PRICE: A woman named Aimee Harris who pleaded guilty to stealing a diary belonging to President Biden's daughter Ashley Biden before the 2020 election, when she sold it for $40,000 to rightwing dirty trickster James O'Keefe and his nearly-defunct fake "news" outfit called Project Veritas, was sentenced to a month in prison, three in home confinement, two years of probation and to return the money she raised from her crimes. Her partner in the scam, who was smart enough to cooperate with federal authorities, will be sentenced later this year, suggesting that criminal charges may still be in the offing for the disgraced Republican operative O'Keefe. His home was searched by the FBI after the crime initially came to light. Keep hope alive.
  • NOPE: Yet another New York appeals court judge has rejected yet another last-ditch legal attempt by Donald Trump to delay his trial on 34 felony fraud counts related to his hush-money payments to porn star Stormy Daniels to help him cheat to win the 2016 election. That criminal trial is now still set to begin with jury selection this coming Monday. In this latest court denial, the NY appellate judge dismissed Trump's motion regarding the partial gag-order against him --- expanded after he identified and attacked the daughter of trial Judge Juan Merchan on social media --- charging the order was somehow "unconstitutional". The bad news for the disgraced former President comes just one day after his bid for a change of venue for the trial was similarly denied by a different appellate judge.
  • YOUR MONEY IS NO GOOD HERE: Last week it appeared that Trump successfully avoided, for now, the seizure of his property as he appeals his liability in New York's $454 million civil fraud judgment against him. He was allowed to file a reduced bond for just $175 million with the state. As it turns out, however, there are a lot of problems with that bond, as secured from a sleazy California outfit known as Knight Specialty Insurance Company. A LOT of problems. More and more of which have been coming to light ever since NY A.G. Tish James, last week, informed the judge in the case that Trump's bond appears to be deficient. Among those problems: the surety company is not licensed to issue bonds in New York; the company does not have enough "capital and surplus" to meet state standards (or even cover the amount of the bond!); and the bond itself appears to suggest Trump is responsible for the $175 million dollars, rather than Knight, which is not an actual bond at all. A hearing on the matter is scheduled in NY civil court for April 22.

On today's BradCast we mark the Presidents' Day holiday honoring the birthdays of both George Washington and Abraham Lincoln, with a quip from our friend Marcy Wheeler, independent national security journalist at Emptywheel, who tweeted: "Happy President's Day, America, a holiday celebrating the guy who said Presidents should not be kings and the guy who said insurrectionists should not be President." [Audio link to full show follows this summary.]

Among our stories covered in that spirit today...

FIRST: During a stunning, hastily called news conference over the weekend in Pakistan, a top official alleged that the nation's recent parliamentary election was littered with fraud. He claims to know because, he says, he was in charge of it in one of the country's largest provinces. The official now claims to be ashamed of what he did, "stabbing the country in its back", and announced that he was both resigning and turning himself in to law enforcement. "We converted losers into winners, reversing margins of 70,000 votes of independent candidates for 13 national Parliament seats," he said on Saturday, as fraud allegations stemmed from, among other things, Internet and cell service that was shut down on Election Day, as polling locations were moved at the last minute.

THEN: Contrast that potentially very real election fraud, announced by a real whistleblower who expects to be thrown in prison for his crime, with the endless phony allegations of "election fraud" by Donald Trump and his duped supporters following the 2020 election. Those claims, shamefully, continue all the way up through today. Just last year, when Trump was again asked for evidence of fraud in the 2020 election, he cited an oft-debunked documentary film released in 2022 called 2000 Mules. It was a film made by convicted (and Trump-pardoned) election fraudster Dinesh D'Souza in partnership with the long-ago discredited Rightwing Texas-based "election fraud" group called True the Vote, as headed up by a woman named Catherine Engelbrecht.

Trump told CNN that the group had "found millions of votes on camera, on government cameras, where they were stuffing ballot boxes.” We already knew all of that was a lie. The much-debunked 2000 Mules film actually showed no such thing to anyone actually paying attention to it. But last week, it was reported that True the Vote was forced to admit in a court filing to the state of Georgia --- which is suing the group for information on their so-called "whistleblowers", who they had claimed were insiders to massive Democratic fraud in 2020 --- that they actually have no such information. They have no documentation, records of any conversations, or even contact details for the so-called "whistleblowers" and "informants" they said they had built their case on in their phony "documentary".

FINALLY: On Friday, Russia's democratic hero and Kremlin opponent Alexei Navalny died in an Arctic penal colony. He had been a prisoner of Vladimir Putin's on trumped-up charges since returning to Russia in 2021 after an assassination attempt (stunning details of which are revealed "live" in the extraordinary 2022 documentary Navalny). His death at 47-years of age stunned supporters, many of whom had assumed he would one day unseat Putin to become "Russia's first George Washington", it's first truly democratic leader. Instead, as one lamented, he will be their "Martin Luther King", as a moral example that will inspire generations of freedom seeking Russians.

On Monday, Navalny's widow Yulia Navalnaya again demanded the return of his body, which she charges Russia will keep long enough to hide allow any traces of the nerve agent she believes was used to kill him to dissipate. She also vowed to continue his fight against the Kremlin.

World leaders, including President Biden, upon word of Navalny's death, condemned Putin. Our own disgraced former President, however --- a huge Putin fan --- waited for three days before issuing an unhinged rant on his social media in which, after mentioning Navalny's name, quickly became a lengthy screed about his own legal problems.

In a chilling --- if inspiring --- portion of the documentary film Navalny, when asked by the filmmaker for a message to supporters if he is killed upon his then-planned return to Russia. He says, in English, "My message is very simple: don't give up." The filmmaker then asks him to respond directly to the camera in Russian.

"Listen, I've got something very obvious to tell you," Navalny quips. "You're not allowed to give up. If they decide to kill me, it means that we are incredibly strong. We need to utilize this power --- to not give up, to remember we are a huge power that is being oppressed by these bad dudes. We don't realize how strong we actually are."

Navalny then adds a familiar quote: "The only thing necessary for the triumph of evil is for good people to do nothing. So don't be inactive."

Putin is expected to win his fourth term as Russia's leader in Presidential "elections" next month. He faces no real opposition given that any such candidates have now been either jailed, killed or forced to live in exile.

I'd say Tuesday was a high (or low?) watermark for GOP failure, but on The BradCast, we think it wise to never under (or over?) estimate them. [Audio link to full show is posted below this summary.]

Among our many stories covered today...

  • Nikki Haley lost the one-person Republican Presidential Primary in Nevada by more than 30 points. (To be fair, it's not entirely her fault. Donald Trump rigged it. And he's setting up Republicans in the state for failure this November regarding the state's voting systems.) Joe Biden reportedly won his mostly one-person Democratic Primary in the state on Tuesday with nearly 90% of the vote.
  • With three different swing-state GOP state Chairs (in Florida, Arizona and Michigan) ousted in recent weeks in scandals related to allegations of rape, bribery, or financial impropriety (and Nevada's GOP Chair heading to criminal trial in a few weeks for forgery as a fake 2020 elector), Trump's once-favored Chair of the RNC, Ronna Romney McDaniel, is being pushed out in the middle of a Presidential election year. Why? Trump's MAGA faithful are trying to find someone, anyone ... anyone but him ... to blame for their repeated, post-2016 election humiliations. Why not Ronna?
  • But the humiliation continued on Tuesday, as newly tapped and freshly failed GOP House Speaker Mike Johnson engineered what Wall Street Journal described as "an embarrassment for the party", Punchbowl called "one of the most embarrassing days in recent House GOP history" (which is saying quite a lot!), and WaPo raved: "a stunning rebuke" for a months-long impeachment probe by Republicans hoping to identify "High Crimes and Misdemeanors" by Dept. of Homeland Security Alejandro Mayorkas. Turns out, they couldn't even convince their full caucus that he'd committed any, and one heroic Dem showed up from his hospital bed amidst chaos on the House Floor to deliver Johnson and Marjorie Taylor Green's phony impeachment scheme an embarrassing final blow. At least for Tuesday night, in the first impeachment vote ever against a sitting member of the Executive Branch.
  • Actually, it wasn't the final blow on Tuesday night for House Republicans. Johnson held a subsequent vote for aid to Israel. It also went down in humiliating flames.
  • All of that comes on the heels of Congressional GOP insistence that they would block any aid package for Ukraine --- now facing a very real existential crisis and invasion from a hostile neighbor --- unless the bill included a massive amount of money for the U.S. southern border, where Trump and Republicans pretend there is an ongoing "existential crisis" and "invasion". So, Dems gave in and agreed with Senate Republicans to add a very hard-right border deal to the aid package --- only to see Trump throw a fit at a possible real solution for the only real(ish) election year issue he seems to have left. So now House Republicans are vowing they will only consider an aid bill for Ukraine (and Israel and Taiwan) if it doesn't include money for the U.S. southern border. Seriously. It's as insane and stupid and dysfunctional and embarrassing as it sounds. And, it might even be hilarious, but for the fact that democracy remains on the brink in Europe, as the near-entirety of the Republican Party now cowers to the personal whims of their four-time indicted cult leader.
  • Popular Republican criminal, pretend fake "pimp", and definitely fake "journalist" James O'Keefe quietly issued a tweet on Monday night, admitting that his reporting on 2020 election fraud in Pennsylvania was "wrong" and that he is "aware of no evidence or other allegation that election fraud occurred in the Erie [Pennsylvania] Post Office during the 2020 Presidential Election.” It took him four years and a begrudging lawsuit settlement to "correct" his false story about supposed massive mail ballot fraud by the USPS. Trump continues to fraudulently pimp that nonsense to this day. All of this on the heels of O'Keefe being pushed out of his own fake news organization, called Project Veritas, last year amid allegations of financial malfeasance and abuse of employees. Or, as his partner in the 2010 fake ACORN "pimp" hoax videos described it when quitting the group herself in December: "an unsalvageable mess --- one wrought with strong evidence of past illegality and financial improprieties."
  • Finally today, some listener mail with an important coda to our mind-blowing interview on Tuesday with Susan Greenhalgh, election integrity advocate and consultant on the just-completed civil suit trial by Marilyn Marks and the Coalition of Good Governance against the State of Georgia and its Sec. of State Brad Raffensperger. The suit seeks to move the state from easily-hackable, unverifiable touchscreen voting systems to verifiable hand-marked paper ballots; And, some email on Taylor Swift and the Superbowl, which I thought we decided we wouldn't be discussing this week on The BradCast?!!...

It seems impossible to believe that the U.S. mainstream media will be able to meet this moment. And yet, there are signs, suggests our guest today, longtime journalist and media critic DAN FROOMKIN of Press Watch, formerly of Washington Post, Huff Post, The Intercept and Harvard's journalism watchdog, the Neiman Foundation.

In a column late last year, Froomkin detailed the "intense internal pressure to defend democracy" that newsrooms will be facing in 2024. The greatest pressure, he reports, is likely to come not from outside those newsrooms, but from inside, where "traditional bosses are still in control," holding fast to "both sides" journalism, but where they are finally being challenged by what he describes as a "silent journalistic majority", an often younger and/or more diverse group of reporters "whose sense of self is defined by more than just not taking sides. It’s defined by informing the public of the truth."

With the stakes now higher than ever, he observes, there are signs, at least, that some in the traditional, unhelpful mainstream are begin to change in order to meet the moment. It's a tall order --- especially after so many decades of failure --- but there are some positive signs that even the traditionalists are beginning to understand the threat posed to American democracy itself by a Republican party which has now all but fallen to the fascistic, autocratic demands of its cult leader.

"The good news --- and it is unusual for me to focus on the good news in the media --- is that I think we're seeing two steps forward, one step back, in that I do see some braver, more honest, more upfront journalism happening on occasion at the major institutions," Froomkin tells me, before adding, "And then every so often, they'll backslide terribly."

He argues that many are "getting really impatient with this 'both-side'-ism, this 'a pox on both your houses' stuff."

"If you talk to any journalist who is not personally invested in the old way of doing things, you'll find that they actually agree with this critique. It is not a radical critique anymore. It is very much a 'How do we do journalism in this day and age?' question. And I think the answer is increasingly becoming that we need to call it out the way we see it. And that we need to stand up for democracy and for a free press, and for core journalistic values. It doesn't mean telling people to go vote Democratic, it doesn't mean being easy on the Democrats. But it does mean pointing out what this danger is right now."

"If Trump takes power, he's going to go after the media. And he will criminalize journalism in a lot of ways, and the free press will be under a lot of pressure. I don't think any journalist can sit there and say, 'I'll be fine if Trump wins.' They should all be terrified," Froomkin asserts, adding: "An increasing number are. You're seeing some of that, for instance, in this story on political violence. That was one of the big issues swept under the rug until recently."

As Froomkin explains, the jury is very much still out. But what he once saw as a "generational project" now needs to happen much quicker. "The stakes feel so high right at this moment --- for obvious reasons --- that I think there’s pretty good chance of change before November," he wrote last month. We'll see if he's right about that.

In the meantime, there has been some encouraging news elsewhere, at least from the court system in recent weeks, resulting in a rush of long-overdue accountability for people and organizations of the corrupted right.

  • Last week, New York Attorney General Tish James' office filed motions seeking $370 million from Donald Trump, his company, and its top executives for years of massive bank, tax and insurance fraud. She is also seeking a lifetime ban from the NY real estate market for Trump, and a five-year ban for his eldest sons. The whole crew has already been found liable by the state judge overseeing the case. The only question now is what the penalties will ultimately be. Closing arguments are this week and Trump will not be allowed to make part of them himself, after failing to agree he would do so without attacking prosecutors, the judge or his staff, or turn the remarks into a political statement.
  • Also last week, Wayne LaPierre, the wildly corrupt 30-year leader of the terrorist-supporting National Rifle Association, finally resigned on the eve of his corruption trial --- also thanks to Tish James in New York --- which began this week. LaPierre and other top NRA officials allegedly bilked millions of dollars from the non-profit organization to fund their own lavish lifestyles. James hopes to force LaPierre and the others to pay it all back and permanently bar them from serving on the board of any NY charity. Thoughts and prayers.
  • Longtime Republican grifter James O'Keefe's sleazy, fake "journalism" organization called Project Veritas, finally seems to be all but permanently dead. That, after O'Keefe was found to have overseen years of "financial malfeasance" according to its Board and newly seated CEO, Hannah Giles, who resigned last month citing "an unsalvageable mess" at the organization, "one wrought with strong evidence of past illegality and past financial improprieties." Giles originally played the "prostitute" in heavily edited videos published years ago by Andrew Breitbart targeting the community organizing and voter registration group ACORN. O'Keefe --- as we spent quite a bit of time some years ago detailing to mainstream media outlets who had also fallen for the hoax --- pretended to have dressed up as a "pimp" in those fraudulent videos. Though scams, they still resulted in rightwing millionaire, billionaire and just plain old dupes donating tens of millions of dollars to O'Keefe's organization over the years in support of their phony, frequently unlawful, partisan schemes targeting groups and individuals on the left. The organization and O'Keefe himself are reportedly under criminal and/or civil investigation for a number of those schemes.
  • Remember Kim Davis? The sleazy, far-right Kentucky county clerk who, in 2015, refused to issue marriage licenses to same sex couples after the U.S. Supreme Court's Obergefell ruling? Last week, a federal judge found her liable for $260,000 in legal fees and expenses incurred by one of the couples who she unlawfully refused to license. In 2022, a federal jury said she had to pay the couple $100,000 in damages. The rightwing legal organization representing Davis for free, Liberty Counsel, says they will appeal the original verdict, the order for attorneys fees, and Obergefell itself at the U.S. Supreme Court.

FINALLY, as today's show ended, it looks like former New Jersey Gov. Chris Christie has decided to suspend his 2024 GOP Presidential campaign (much as we called for him to do --- if he was truly serious about keeping Trump out of the White House --- on yesterday's program.) The announcement comes just hours before a debate tonight between Nikki Haley and Ron DeSantis in advance of Monday's Iowa Caucuses. Presumptive frontrunner Donald Trump won't be at this debate either, but we will have Special Coverage, nonetheless, for some reason, on tomorrow's BradCast...

  • Trump troubles: Last week, a former U.S. Air Force intelligence officer was sentenced to three years in federal prison for unlawfully keeping classified documents related to national defense in his home. If he got three years for what he reportedly did, life should be getting very very difficult for what Donald Trump did when he stole thousands of pages of documents, many of them highly classified, upon leaving office, stored them at his home, and obstructed attempts by the federal government to retrieve them. A former federal prosecutor believes an indictment in Special Counsel Jack Smith's stolen document case against the former President could come as early as "this week". Given the Trump attorneys meeting at DoJ on Monday, and the apparent panic exhibited by Trump at his dumb social media site thereafter, that prosecutor could be correct.
  • More trouble for more GOP "voter fraud" fraudsters: Last week, longtime GOP fraudster and fake journalist James O'Keefe was sued by his own fake news organization for abusive behavior and allegedly ripping off the company, including, for example, for $150,000 in luxury car services. This week, Catherine Engelbrecht and Gregg Phillips, the "voter fraud" fraudsters behind the discredited 2,000 Mules film and who run the phony, rightwing True the Vote nonprofit, were called out in a complaint to the IRS for allegedly violating state and federal laws in using the nonprofit to enrich themselves with unlawful loans, unreported lucrative contracts and other apparent self-dealing.
  • Kurt Cut the Wires: Since 2020, we've been reporting on Republican election officials unlawfully breaching, copying, and distributing computerized voting system software in states such as Colorado, Michigan, Pennsylvania and, in most detail (where there is more coming soon, methinks), Coffee County, Georgia. Those incidents appear to have been part of a multi-state conspiracy overseen by disgraced Trump lawyer Sidney Powell and hatched in the Oval Office with Donald Trump and others on December 18, 2020, according to testimony given to the House January 6 Committee. But, in what appears to be a separate (if somewhat related) incident this week, a nonprofit group in Missouri is calling out the Director and Deputy Director of Elections in the very right-leaning town of St. Charles for breaking the seals on voting machines and cutting wires inside them to prevent what they believe is the ability for the systems to connect to the Internet. Tampering with voting systems is a violation of several state laws. And these yutzes, Director Kurt Bahr and Deputy Director Mark Parkinson, appear to admit to the whole thing. On video tape.   • Unequal justice: Last year, just before the primary elections in Florida, Gov. Ron DeSantis called a televised press conference in the Democratic stronghold of Broward County to announce the arrests of 20 former felons for voter fraud just days before the state's 2022 primary elections. The stunned and mostly people of color --- who were allowed to register and vote by the state --- were rounded up on video tape for what DeSantis declared to be unlawful voting as former felons convicted on charges related to murder or sex crimes. But, as the Orlando Sentinel reports this week, a State Attorney in a Republican stronghold, just months earlier, "declined to prosecute six voter fraud cases that involved circumstances strikingly similar to the cases later brought against 20 ex-felons by Gov. Ron DeSantis' election police unit and statewide prosecutors." Those cases were dismissed because, as the prosecutor determined, their fraud was "not willful"...just like the 20 who DeSantis had rounded up and arrested in Broward just days before last year's elections. Despite DeSantis' promise at his presser last year that there would be more arrests, there have only been four. The six from Republican Lake County are not among them.

We're back! And with good news on today's BradCast...whether the media have been reporting it that way over the past week, as we've been on a break, or not. [Audio link to full show follows below this summary.]

FIRST UP, some notable quick news headlines today --- and some from last week --- which we'll undoubtedly jump deeper into in the days and weeks ahead. Including...

  • Cartoonishly corrupt Republican Attorney General of Texas, Ken Paxton, is impeached by the hard-right Texas legislature.
  • Cartoonishly corrupt Republican activist and pretend journalist James O'Keefe is sued by Project Veritas --- his own ironically named nonprofit --- for waste, fraud and abuse.
  • A bunch of new Republicans entered the fray for the 2024 Presidential nod (the unhung Mike Pence, the disgraced Chris Christie and some guy named Doug Burgum).
  • One Republican, popular New Hampshire Gov. Chris Sununu, smartly announces he's not running.
  • And progressive activist and academic Cornel West announces he's running for President under a third-party banner.

THEN, its on to the one story that made me wish I wasn't on vacation last week (well, a little, anyway.) And that's the story of President Biden outfoxing the GOP to take three Republican-engineered fiscal cliffs off the table over the next two years, all for the price of less than one, in his ingenious debt ceiling deal with House Speaker Kevin McCarthy...who got hosed in the bargain.

As you may know, we were all in favor of Biden avoiding negotiations entirely, invoking the 14th Amendment to declare the dumb Debt Ceiling law unconstitutional, and ordering the Treasury Department to simply pay our bills without disruption to avoid a first-ever U.S. default. If anyone had a prob with that, they could sue him --- or try to --- in order to force the global economy meltdown that would have come with such a default.

But Biden, and his lead negotiator, Steve Richetti, came up with a much better idea. In the bargain, they took not one, not two, but three GOP fiscal cliffs off the table for the price of less than one budget negotiation this fall. And it all would have been much more difficult if Biden had taken the leverage of invoking the 14th off the table.

In short (much more detail on today's show), the President outfoxed Republicans. Bigly. And where they had demanded some 18% in cuts to government spending, they got a measly 0.2% over the next ten years. In the bargain, the Debt Ceiling is suspended until 2025 and spending will largely stay flat over the next two years on a few non-defense matters.

Make no mistake. There are some cuts in the deal that suck. But nothing more than Biden would have been forced to give away anyway in order to avoid a protracted Government shutdown with obstructionist Republicans when a new budget would be needed at the beginning of the next fiscal year this October.

As British columnist Will Hutton correctly opined on Sunday, while "It is easy to write off President Joe Biden as a senile, 80-year-old duffer," the deal was "massively weighted in his favour" and represented an "extraordinary victory".

It's a shame that so many in the U.S. media --- on the Right, Left and Other --- seem incapable of reporting it that way, in order to properly educate the American electorate about what actually just happened.

We try to balance the scales a bit on that score on today's program before opening the phones to callers in the second half of the show to hear why they believe we might be wrong about all of this. (SPOILER ALERT: We're not!)

"Industrial-scale defamation is not free speech," our guest on today's BradCast insists, as very real accountability for many liars and scoundrels and fake news con-artists on the Right gets closer with each passing day. [Audio link to full show follows this summary.]

FIRST: The forewoman of the Special Grand Jury in Georgia which recently completed its work in Fulton County, suggests multiple people have been recommended to District Attorney Fani Willis for indictment. "It is not a short list," teases Emily Kohrs about who her panel suggested to Willis should be charged in the investigation of the attempt to steal the 2020 Presidential election in the Peach State by Donald Trump and his top supporters. While Kohrs did not offer specific names, she did say, "you're not going to be shocked. It's not rocket science," before offering other somewhat cryptic --- if tantalizing --- hints.

NEXT: More accountability for right-wing liars. In this case, James O'Keefe, the Republican activist and scam-artist who initially made his name in 2010 by releasing deceptively edited videos which falsely suggested he dressed up as a 70s-era Blaxploitation pimp to walk into ACORN offices for advice on sex trafficking and how to avoid taxes. In fact, he never dressed as a pimp in those office, and never received any such advice. (See our full Special Coverage here.) Years --- and millions of dollars of dark-money later --- O'Keefe is now reportedly out at Project Veritas, his own ironically-named fake news and entrapment organization. Its Board of Directors detailed "financial malfeasance" by O'Keefe, and claims that he bullied staffers. Yes, the scammer who bilked Rightwingers out of millions, using hidden video "stings" to pretend to be a journalist uncovering "waste, fraud and corruption" on the Left, is seemingly undone by his own waste, fraud and corruption. Go figure.

THEN: We're joined by ANGELO CARUSONE, President and CEO of media watchdog Media Matters for America, to discuss Dominion Voting's $1.6 billion defamation suit against Fox "News", after the network's executives, hosts and guests repeatedly offered massive lies to their audience about election fraud following the 2020 Presidential election.

Of course, like us, Carusone has been watching Fox lie on air for years now. So, is there something different this time around? Carusone explains why he believes the revelations from hundreds of insider texts, emails and depositions in Dominion's redacted 192-page brief [PDF], released last week in its motion for summary judgement against Fox, is seemingly very different from the lies that Fox has been caught telling in the past.

We discuss how "for so long the commercial media enabled Fox," allowing it to be regarded as an actual news organization, when it is not. Non-Rightwing corporate media outfits "actually enabled Fox News in a way, by treating them as anything other than the partisan political operation that we all know they are." Carusone argues that what is revealed in the Dominion brief "is so incontrovertible that even the enablers can't engage in the type of enabling --- or even just silence --- that they previously had for too long."

We discuss the "hypocrisy" of Fox' First Amendment defense and their claims that Dominion has "cherry-picked quotes stripped of key context," given that cherry-picking out of context quotes is actually the Fox 'News' business model!

We discuss what the hell happened to formerly respectable --- before joining Fox --- financial news reporters like Maria Bartiromo and Lou Dobbs, who seemed to lead the coverage of phony 2020 fraud claims at the network by featuring Trump's loony attorneys like Sidney Powell and Rudy Giuliani as guests, despite the fact that they had offered less than zero evidence in support of outrageous claims that Dominion's voting systems flipped millions of votes to steal the election for Joe Biden from Trump.

And, perhaps most crucially, we discuss what may happen if Fox loses this one, and how a judgement of $1.6 billion may be the least of the company's problems. "It's not just going to end at the $1.6 billion," says Carusone, "because what ends up happening is that shareholders themselves then begin to sue for breach of fiduciary duty. Because it's very apparent that the Murdochs made misrepresentations about the nature of this litigation for quite some time." While losing the case means losing a lot of money, Carusone argues, "it will set them up for additional litigation that will compound the problem. They won't be able to sustain that from a financial perspective. It puts control of the company in jeopardy."

Additionally, he explains, it will weaken their position with cable companies, from whom Fox currently receive the bulk of its revenue, particularly as advertisers have fled their toxic air to the point where MyPillow guy, Mike Lindell, is now their single largest client. "It's sort of like a Jenga puzzle," Carusone tells me. "Pulling one block is not going to topple it down, but it's certainly going to make it a lot more vulnerable to toppling. And this one is a pretty key part of that piece --- just the tiniest little breeze will probably knock the rest of it over."

The BRAD BLOG, 'BradCast' and nation have lost a friend and champion...

Very shortly before airtime today, we learned that our friend, longtime progressive media critic and frequent guest on The BradCast, ERIC BOEHLERT, was killed earlier this week at the age of 57, in a tragic bicycling accident when he was hit by a commuter train in Montclair, New Jersey. [Audio link to full show is posted below this summary.]

We were, and are, a bit shook up today. We had a very different program planned, but decided, at the very last minute, with the wind knocked out of us by the news, to change today's show into a tribute to Eric. He last appeared on this show on January 19th of this year, to discuss the one-year anniversary of President Biden's inauguration and the disturbing difference in the way the corporate media covers his Presidency, versus the guy in office before him. We decided to share that interview again on today's program.

Eric's influence, fighting spirit and sense of fair play has long echoed on both this program and at The BRAD BLOG over many years. He was an indefatigable champion for the truth and frequently supportive of our work, particularly during as we revealed the truth about Breitbart/O'Keefe "ACORN Pimp" hoax and called on the duped mainstream media to issue corrections to dozens of inaccurate stories. In the nearly two decades we've known, worked with, and admired him, he has never stopped holding feet to the fire, particularly those of liars on the right and the supposedly non-right corporate media which, as he long documented, have consistently failed in their critical mission over those critical decades.

His legacy will largely speak for itself --- at Salon, Media Matters, Daily Kos and his latest venture, the Press Run newsletter, "an unfiltered, passionate, and proudly progressive critique of the political press in the age of Trump," and, of course, in his many media appearances, including the dozens of times he's joined us on air over the years. His Twitter feed, I'd be remiss without mentioning, was always a must-follow, particularly as he took on the horrible Andrew Breitbart back in the day.

Eric began as a music critic at Billboard and Rolling Stone before turning to media analysis. He also published two books, Lapdogs: How the Press Rolled Over for Bush and Bloggers On the Bus: How The Internet Changed Politics and the Press.

We discuss what happened --- and the outpouring of warm thoughts shared in his memory this afternoon by many in the media, and even folks like Hillary Clinton and Jon Stewart --- on today's show, along with his most recent and, sadly, final appearance on this program.

We also cover a few other things, including some accountability for a very Trumpy attorney who is (or was) representing a whole bunch of January 6th conspirators until he was disbarred late last week, and the 8-hour appearance on Tuesday by Ivanka Trump before the House Select Committee investigating Donald Trump's attempt to steal the 2020 election. But really, today's show is mostly in tribute and in memory of Eric, who, in addition to a much better informed public, leaves behind his wife Tracy Breslin and two children, Jane and Ben.

As Eric always noted at the top of his Press Run newsletters: "Stay Healthy. Be Kind."

Today on The BradCast: The last vote of the '2020' election has now been cast with Georgia's two U.S. Senate runoffs now over. The voting part anyway. Now the counting, fighting and complaining begin. [Audio link to full show follows below summary.]

We received mixed reports from on the ground in Georgia today. The state's voting systems manager, Gabriel Sterling, told the Atlanta Journal-Constitution that Election Day in the contests that will determine partisan control of the U.S. Senate went very smoothly on the state's 100% unverifiable touchscreen voting systems made by Dominion and forced on in-person voters in the state for the first time in 2020 by their Republican Sec. of State, Brad Raffensperger. Lines to vote, according to Sterling were short in most places, though as long as 30 minutes at some Atlanta metro area voting stations. Other sources on the ground in the Peach State told us that lines in some places that were longer than for the Presidential general election back in November. Given there were just three races on the ballot (two for U.S. Senator, one for a Public Service Commissioner), there shouldn't have been any lines at all to speak of. Nonetheless, the 'Rube Goldberg' touchscreen computer ballot marking devices and the computerized pollbooks and computerized scanners that are used with them --- instead of a much simpler, verifiable, reliable hand-marked paper ballot system --- always take longer to cast a vote. They also, as usual, created problems for voters in several counties, with misprogrammed access cards and other reported failures. Emergency hand-marked paper ballots were said to have been deployed in some cases, as needed.

We try to read some of the tea leaves from today's reports, as to what it all may mean, while we wait for results that could come tonight....or over the next several days.

We're joined today from on the ground in Georgia by LAUREN WINDSOR, journalist, Executive Director of American Family Voices, producer of the grassroots political web-show, The Undercurrent, and, apparently, "operative", according to a report by the Atlanta Journal-Constitution. Windsor has been in the state for the past month with her producer, bird-dogging incumbent Republican millionaires and Senators Kelly Loeffler and David Perdue, regarding their respective stock market windfalls amid the COVID epidemic. They are running against Rev. Raphael Warnock and Jon Ossoff, respectively.

She's been there as Trump has made a mess out of the runoffs, which he described over the weekend as "illegal", before showing up at a rally in the state, supposedly for Loeffler and Perdue on Monday night, not long after he confused matters further by calling for $2,000 COVID checks for Americans after Republicans (including the two GA incumbents) had insisted on $600 checks.

Windsor has broken a number of stories over that time, including last month when, as AJC documented, Perdue lied to her by claiming he planned to challenge Joe Biden's electoral vote count in the Senate tomorrow --- even though his term ended on January 3 and won't begin again until this year's election is decided and certified. Trump retweeted her tweet reporting Perdue's lie and his campaign then retweeted the President's tweet. There is apparently nobody left in the Republican Party who cares about telling the truth.

Both Perdue and Loeffer, she tells me, are "trying to have it both ways with regards to supporting the Electoral College challenge. Now they're trying to have it both ways with supporting the $2000 relief checks. They're saying, 'We'll tell you that's what we want, but we're actually going to work with McConnell to make sure it won't happen.'"

She shares of number of stories from her adventures over the past month covering both millionaires Perdue ("this guy owns a home within a gated community that's within a gated community.") and Loeffler ("It wasn't exactly a 'rag to riches story' for Kelly Loeffler. It was more of a 'riches to riches' story.) And Windsor also has some thoughts on the failure of Republican hoaxster James O'Keefe --- who she has also been bird-dogging for years now --- to deliver his promised "bombshells" on Democratic "voter fraud" in the 2020 cycle. Windsor also offers her careful prediction for how today's critical contests will ultimately shake out.

Also today, we enjoy a rare bit of speculation on Donald Trump's future, following a curious story out of Scotland Monday reporting that the tiny airport near Trump's failing Turnberry Golf Resort is set to "expect the arrival of a US military Boeing 757 aircraft" on January 19th, the day before Biden is to be inaugurated. Hmmm....

And, speaking of speculation, Politico has a few scoops on what House and Senate Republicans are planning for their challenges at Wednesday's joint session of Congress to the affirmation of Biden's Electoral College votes in at least three states (perhaps as many as six) during their desperate, last-ditch --- most likely futile, definitely sore-loser --- effort to overturn the 2020 Presidential election and/or make a name for themselves as 2024 Presidential contenders and/or ruin their chances all together in the bargain. We shall see. Suffice to say, Wednesday is likely to be a very long day, as we have long been warning.

Finally, Desi Doyen joins us for our first Green News Report of 2021! With a whole bunch of stories we were unable to cover while off last week, including several new parting gifts from the Trump Administration, such as "bomb" trains and more asthma attacks for children, as well as some much better news for humanity and the planet out of Japan...

On today's BradCast, it's the 15th Anniversary of The BRAD BLOG! So --- in addition to the news of the day --- we take a precious few minutes on today's program to reminisce a bit with longtime BradBlog.com legal contributor ERNEST A. CANNING and Green News Report co-host and BradCast producer DESI DOYEN! [Audio link to full show is posted below.]

After a few words on Canning's latest article at the blog on the "Political Revolution" embodied by the new freshman class of progressive U.S. House members and the many challenges they are now facing down in D.C., we discuss some of the lessons learned and important stories covered at our little, independent, reader- and listener-supported website over the past decade and a half.

Many of the stories we broke years ago --- too numerous to link here, on everything from electronic voting concerns and voting rights to climate change and much more --- have since become part of the national consensus as well as many popular calls for reform. That, even as much (but not all) of our independently verifiable, evidence-based news coverage was marginalized or dismissed by many in the corporate media years earlier. We discuss just a few of those stories today --- too numerous to detail here --- as we look both back and forward on this latest milestone. We also offer thanks to the many who have made all of it possible over the years, from our blogging contributors, to radio affiliate partners, to various whistleblowers (publicly known and unknown) over the years.

And, yes, there was also a bit of news today for a change in Washington D.C., so we also cover that on today's program. Among those stories...

  • Donald Trump's federal government shutdown nears the end of it's fifth record week, as he folded like one of his own cheap and poorly tailored suits on Wednesday night in his standoff with U.S. House Speaker Nancy Pelosi on delivering his State of the Union next week.
  • At the same time, federal aviation unions issued a dire warning about the ongoing effects and potential critical dangers of the shutdown.
  • We share a heartbreaking story about a 10-year old girl who suffered a broken wrist in stoic silence for a week, because she was frightened to tell her father, a Dept. of Homeland Security employee forced to work without pay.
  • Billionaire crypt-keeper and Commerce Dept. Secretary Wilbur Ross took to the airwaves to, essentially, call 800,000 federal workers whiners for needing to use food banks to feed their families, when they could just go out and get a bank loan instead to cover costs until the federal government reopens.
  • In the U.S. Senate, Mitch McConnell finally allowed votes on measures to reopen the government, one from Rs and one from Ds. Both failed to get the 60 votes needed to overcome filibuster, though the D version --- which did not include funding for Trump's border wall --- received more votes than the R version in the GOP-majority Senate.
  • And Trump's former attorney Michael Cohen learned that he may have to appear before both House and Senate Committees next month, despite threats to his family by the President of the United States.
  • Finally. Desi brings us the latest Green News Report, with more bad news about the shutdown and Greenland's melting ice shelf, but some encouraging news on a huge majority of Americans who now appreciate the threat of climate change and on the amazing teen climate activist taking on the corporate powers and millionaire/billionaires at Davos this week...

On today's BradCast: Are Democrats falling for all of these rightwing traps? Or are they willingly walking right into them...because they want to? [Audio link to show follows below.]

After a few news headlines today --- Australia's parliament finally adopts marriage equality; the white Charleston, SC cop who killed unarmed black man Walter Scott receives a 20 year sentence; another school shooting, this time in NM --- we move on to Sen. Al Franken (D-MN)'s announcement today on the floor of the U.S. Senate that he plans to resign "in the coming weeks".

The stunning announcement by the popular and dogged comedian-turned-Senator comes after fellow Democrats this week called for him to step down in the wake of several allegations of sexual misconduct said to have occurred before he became a U.S. Senator. Franken, who has been a champion for women's rights during his time in the Senate, maintains he either doesn't recall the incidents at all or remembers them quite differently than reported. He has described the most recent charge leveled against him this week by an unnamed victim, said to have been a Congressional staffer in 2006, as "preposterous". Nonetheless, while expressing confidence he would have been cleared by the Senate Ethics Committee of any wrongdoing, he says he will now step aside before that probe was even able to begin in earnest.

We share excerpts of Franken's remarks on the floor today, which include, as he notes, "some irony in the fact that I am leaving while a man who has bragged on tape about his history of sexual assault sits in the Oval Office and a man who has repeatedly preyed on young girls campaigns for the Senate [in Alabama] with the full support of his [Republican] party."

So, did Democrats fall for another right-wing trap in pushing Franken out? It wouldn't be the first time. We discuss several such traps --- including one that MSNBC seems to have fallen for this week regarding progressive radio host Sam Seder, before wisely changing course two days later --- with longtime progressive writer and blogger GAIUS PUBLIUS, who wrote earlier this week about Democrats falling, yet again, into the Republicans' "deficit trap" regarding federal spending on military and social programs. We debate why and whether Democrats fall into these rightwing traps or if they willingly choose to walk into them, for some reason.

"Why is it that Democrats seem to be one foot in the Republican camp and afraid to be too much in opposition, and one foot in the Democratic camp and not so fully pro-democratic values as we'd like them to be?," Publius observes as we discuss Franken, the 'deficit trap' and more. "I would argue that it's not fear. We're not dealing with cowards here. We're dealing with people who are, in some sense, compromised by their own values. Their own values are putting them in this position where they can't please anybody."

There's lots to chew on in today's conversation on these topics!

Guest: Michael Slater of Project Vote | Also: Reason for (some) optimism regarding Trump and the UN Paris climate accord...

On today's BradCast, the Trump-toxified GOP appears to have abandoned all pretense of "values" and "personal responsibility" to elect someone to federal office even after he violently assaulted a journalist on the Eve of the Election. And a longtime voting rights group announces they are forced to shutter their doors for lack of funding. What's wrong with this picture? [Audio link to show is posted below.]

On Thursday, after being cited on assault charges for "body slamming" a reporter from The Guardian the night before, Republican Greg Gianforte was nonetheless elected as Montana's next U.S. Congressman in the Special Election to fill the seat vacated by Donald Trump's Secretary of the Interior, Ryan Zinke. The At-Large seat for the state's only member of the House of Representatives has long been held by Republicans. And, though Trump won the state by more than 20 points last November (Zinke won his seat by 16 points), first time Democratic candidate Rob Quist was polling within single digits of Gianforte and thought to have a shot especially after the GOPer melted down on Election Eve.

Alas, it wasn't to be. We discuss what the Dem loss means going forward (they did swing the vote from GOP to Dem by some 10 points since November), why it likely happened (more than 72% of voters had already cast votes by mail before the meltdown, and many Republicans liked it anyway), Gianforte's apology (only after the election was over), how Trump's own threatening rhetoric has poisoned his party, and how House Speaker Paul Ryan could, Consitutionally, prevent the criminally-charged Gianforte from being seated in the House of Representatives, if he wanted to (and how you can help encourage that).

Next up, while partisan eyes remain on political candidates, and GOP-controlled states like New Hampshire and many others use phony "voter fraud" claims to try and make it harder for left-leaning voters to vote, non-partisan, non-profit voting rights groups are forced to fight for resources just to stay in operation. One such group, the decades-old ProjectVote.org, which has helped register millions of voters, trained voter registration groups around the country, helped to expose how a GOP scheme to promote fraudulent "voter fraud" claims led to the U.S. Attorney Purge during the George W. Bush Administration, and has otherwise filed lawsuits in more than a dozen states to ensure compliance with 1993's National Voter Registration (or "Motor Voter") Act, announced this week they are being forced to shut their doors at the end of the month due to a lack of funding.

Project Vote's President and Executive Director Michael Slater joins us today to discuss the sad and maddening news at a time that groups like his are needed more than ever.

We discuss some of Project Vote's many accomplishments, going back to their founding in the 80s, how the Right has created a "machine to develop propaganda to justify policy outcomes that are in no way in the interests of democracy", improvements (if not enough) in the media in shining a light on the GOP's "voter fraud" lies; and how "folks in the funder community" need to step up to make sure others can fill the void that will be left behind in Project Vote's absence.

"I would encourage people that make contributions to set a portion of those contributions aside for democracy work," Slater says. "There are a number of very good organizations that do democracy work that include Lawyers' Committee for Civil Rights Under Law, the Brennan Center, League of Women Voters, Common Cause --- there's a range of good organizations. The challenge, I often think, is that as an emergency comes up like what we've seen with the attacks on immigrant rights, people immediately put all of their available money into those programs or those emergencies, and they they forget about the ongoing work that we need to do on the democracy sector."

Yup. I would also argue, as I have for years, that many partisans seem to have no problem giving money to candidates and political parties, but only look to support "the democracy sector" after their candidate has lost an election and it is otherwise too late to do anything about it. Or, as in this case, after the folks doing the difficult democracy work are forced outta business.

Finally, to help get all of that our of my system, some encouraging news, believe it or not, concerning the Trump Administration's deliberations on whether to drop out of the landmark UN Paris Climate Agreement, and a musical moment guaranteed to leave you feeling groovy over the upcoming holiday weekend...sort of...

Rightwing grifter and convicted federal criminal James O'Keefe --- the guy who we exposed as having faked the infamous ACORN "pimp" hoax --- lost again in court this week.

O'Keefe, of course, is no stranger to being a loser. You'll recall the Republican scam-artist was also forced to pay $100,000 to a San Diego ACORN worker after illegally videotaping him as part of the phony "sting" scheme back in 2009.

This week's latest loss for the pretend "journalist" was in regard to his attempted 2010 wiretap conspiracy in the New Orleans office of then Democratic U.S. Sen. Mary Landrieu...
